1. Equality Before Law :
All person are equal in dignity so
They must be treated equally irrespective of their status
Law should be blind
- Poor
- Rich
- Commonpeople
- Government Servants even the King / President
- (Equitable Equality) or
- (Mathematical Equality)
- Ordinary law
- Ordinary court
- No Discrimination
- No Immunities
In England all personwere subjectto one and the same law.
Criticism:
Mathematical equality is not possible
There must be classificationof the individuals
For every classificationthere will be particular law
State cannot be run
without immunities
Judges are immune
Presidentis immune
King can do no wrong
Strict application of this principle is not possible
Predominanceof LegalSpirit:
That court has to see that peoplesare trial
under the law or not
Fundamental rights must be protected by the court
as England having no written constitution
Here in Pakistan our fundamental rights are protected by the
Constitution like :
Freedom pf speech
Freedom of movement
Freedom of association
Freedom of life etc
