2. Essentials
• Transfer must be living persons (Section 5)
• Transfer must be of existing property
• Property must be transferable (Section 6)
• Transferor must be competent to contact(Section 7)
• Transferee must not be legally disqualified by law
• Object & consideration of transfer must be lawful
• Transfer must be in a mode and manner prescribed by law, if any.
3. Section 8: Operation of Transfer
• Section 8-“ Unless a different intention is expressed or necessarily implied,
a transfer of property passes forthwith to the transferee all the interest
which the transferor is then capable of passing in the property, and in the
legal incidents thereof.”
• Section 8 implies that with transfer of property, all the interest that the
transferor has in the property passes on to the transferee.
• “Unless a different intention is expressed or necessarily implied”- this
section will operate only incase of absence of express or implied contract
between parties.
4. • Section 8 provides legal incidents of each particular class of
property are passed along with the property when it is
transferred-
A. For land, the incidents are easements, rents, profits and all the
things attached to earth;
B. For house, the easements, rent after transfer, locks, keys, bars,
doors etc., which are provided with the house permanent use;
C. For machinery, its movable parts; etc.
5. Section 9
• Oral transfer- A transfer of property may be made
without writing in every case in which a writing is not
expressly required by law.
• Wherever the law requires a transfer to be made in
writing, an oral transfer will not convey any right from the
transferor to the transferee.
