What is the rule of law?
3. ● The law itself is our ruler.
● No one is above the law.
● Everyone is equal under the law.
● Everyone is treated the same way by the law.
● The legal process is public and transparent.
● The law is reasonable and testable.
● A clear and transparent process exists for
changing the law.
4. In Canada, the rule of law is closely related to
the principles of democracy:
○ Government has power by the consent of
citizens
○ Citizens have rights that cannot be
arbitrarily taken away by the government
○ An accused is innocent until proven guilty
beyond a reasonable doubt in an impartial,
speedy and public trial
5. In a democracy, the law is made and enforced
by people, but power is separated:
○ Laws can be changed over time, as
decided by elected representatives
○ The head of government can propose laws,
but cannot impose laws
○ The courts enforce the laws in accordance
with the constitution
6. The rule of law provides us
with a peaceful, orderly
and sustainable way to
resolve disputes.
