What if you were told that a law was made to remove discrimination of sexes in sports and education, or that man and woman are both given equal
opportunities as far as an athletic or educational career? Would you then agree or disagree with the ideology that both sexes are still treated different
even though this law was created and the opportunities that were promised aren't precisely indistinguishable? Title IX does not accurately protect sexual
discrimination; it doesn't give equal opportunities, and is unjust as far as benefits between male and female sports. Although this law allows men and

In order to comply with Title IX the schools had to effectuate with what's called proportionality. (CBS news) Proportionality states that the portion
of the school that is female must also be the portion of athletes that is female. Therefore setting a balance between the schools ratio and the athletic
ratios and also enforcing Title IX. The problem that balancing caused was that the school had to add more women sports which cost more money to
the school, or choose to cancel some of the schools male sports. Subsequently, the schools had to do what was best for the school and to avoid going
into debt for sports the male sports had to be put on the burner. Many schools cut male wrestling, track and field, tennis, and gymnastics teams instead
of adding women sports. Jason Lewis a gymnasts whose team was eliminated said that the number of men's teams are dwindling because colleges are
dropping what are called the minor men's sports, the ones that don't draw crowds or make money, and investing more and more in just one sport –

The Native Title Act 1993 was legislated following the decision in Mabo (No2). The Act itself extinguished the colonial doctrine ofTerra Nullius and
instead established native title rights. Terra Nullius as the name suggests is a Roman law concept, which literally means 'Land belonging to no one'.
Brennan J in Mabo decision rejected the doctrine and its early derivative concepts of native title and essentially replaced it with aboriginal customs,
traditions and laws which are recognised legally under Australian common law. The 1993Act provides a process through which the indigenous people
can lodge an application to seek a determination of native title to their land. There were significant amendments to the Act, including the introduction of

If say you have a division 3 school, with 5500 students, 3000 men and 2500 women. The idea that the school is going to be able to have at least
75% of those students show or give interest towards a certain sport or a certain inter mural game, is very hard to actually accomplish. The idea that
also, the underrepresented gender must have the ability to play the game is also very difficult to judge. I guess if a team can not win a game all
season but has double the amount of interest than spots available on the team, maybe that would or would not require equal funding. I think this prong
test of compliance needs to be re–evaluated. Another issue that I think needs to be taken into effect is football. There is no sport or club, male or
female, that can equal the same amount of funding needed for a football team and even created by a football team. Some smaller division 2 and 3
schools will even have a JV and Freshman football team along with their traveling varsity program. The amount of money that division 1 football
programs bring in for the school is amazing. Just the amount of men that it takes to fill up a football roster will keep prong 2 alive. As long as there
is a big football program, women will need to have continual expansion of sports, or the teams already in place, which will in turn, have the loss of

I consider myself quite the feminist. Likewise, if you believe that women should receive equal rights to men, then you should consider yourself a
feminist, too, and possibly look into the Title IX law, because it is the epitome of feminist success. Since the passing of Title IX, the number of
women participating in intercollegiate sports from 1971 has more than quadrupled, going from about 30,000 to more than 150,000 (Garber). Yet,
astonishingly, it is far from my favorite amendment to be passed by the federal government. This is because this law has morphed from a
well–intentioned piece of legislation that helped to increase female athletic opportunities into an obtrusive quota system that has begun to do more
harm than good. Although Title IX has helped in the past to increase gender equality within collegiate sports, in recent years, enforcing its policies has
resulted in a decrease of support for male athletes.
The problem is not with the general law of Title IX itself, which simply states that any education program receiving federal funding cannot
discriminate based on gender ("Gender Equity" 339): it is the way that this law has been enforced. Although the entirety of the Title IX law pertains to

The creation of Title IX in 1972 banned gender discrimination in schools nationwide, particularly in sports (Huffman 4). They also would not have the media exposure they get in sports without Title IX.
