The Battle Of War Of 1916
arch 11, 1778 – Lieutenant Gotthold Frederick Enslin becomes the first documented service member
to be dismissed from the U.S. military for homosexuality. Under an order from General George
Washington which states "abhorrence and detestation of such infamous crimes," Lt. Enslin is
drummed out of the Continental Army after being found guilty of sodomy.
March 1, 1917 – The Articles of War of 1916 are implemented. A revision of the Articles of War of
1806, the new regulations detail statutes governing U.S. military discipline and justice. Under the
category Miscellaneous Crimes and Offences, Article 93 states that any person subject to military
law who commits "assault with intent to commit sodomy" shall be punished as a court–martial may

1941 – The U. S. Selective Service System includes "homosexual proclivities" as a disqualifying
condition for inclusion in the military draft.
1942 – Military psychiatrists warn that "psychopathic personality disorders" make homosexual
individuals unfit to fight. The military issues the first formal regulations to list homosexuality as an
excludable characteristic. Those in the military identified as homosexuals can be discharged and
denied veterans benefits.
January 20, 1950 – Army Regulation 600–443 is published, identifying three categories of
homosexuals. Those deemed to be aggressive are placed in Class I and are subjected to general
court–martial. Homosexuals considered active but non–aggressive are placed in Class II and can
avoid a court–martial by accepting a dishonorable discharge – or resigning, if they are officers.
Personnel professing or exhibiting homosexual tendencies without committing a violation of the
sodomy statute are designated "Class III," and can be removed from service under general or
honorable discharge.
May 31, 1951 – The Uniform Code of Military Conduct is adopted. Article 125 forbids sodomy
among all military personnel, defining it as "any person subject to this chapter who engages in
unnatural carnal copulation with another person of the same or opposite sex or with an animal is
guilty of sodomy. Penetration, however slight, is sufficient to complete the offence." The 1951
Manual for Courts–Martial provides an even more explicit

Ethical Dilemmas In The Military
The size of the military reaches astonishing numbers and due to this many ethical dilemmas take
place. Moral and legal issues occur throughout whether it be on the field or on base and addressing
those cases calls for just and fair trial. Numerous factors must be accounted for such as where it
occurred, historical basis to back judgments, the authority of the individual as well as the individual
themselves in the sense of their beliefs and the decisions they made. Including all these factors lead
to an answer for this ethical dilemma: To what extent does the military punish a soldier for
disobeying morally wrong orders given to them?
Blending morality with legality often ends with confusion and misjudgment for both parties ... Show

The military determines such punishments given out yet should change when going away from the
country such as when units deploy overseas whereas views and ethics change. Do ethics and moral
views stay consistent throughout deployment and can soldiers integrate within the areas culture? The
Uniform Code of Military Justice or UCMJ defines the rules and regulations of soldiers enlisted in
the United states yet does not state the acknowledgment of moral integration in deployment as stated
in article 5 "This chapter applies in all places"(UCMJ). This article fails to acknowledge integration
of culture and ethical views of those that have experienced change such as those on deployment or

A war crime is an unjust act of violence in which a military personnel violates the laws and
acceptable behaviors of a war. Despite all the violence in a war, a soldier shooting another is not
considered a war crime because it is not a violation to the laws and practices of a war, and it is
considered just. A war crime is defined as a "violations [violation] of the laws and customs of war"
("War Crimes"), and are attacks "against civilian populations, prisoners of war, or in some cases
enemy soldiers in the field" (Friedman). War crimes are typically committed with weapons or by
uncommon, cruel, devastating military methods and are "...Committed primarily by military

Specific war crimes such as murder can be "individually and collectively...Some trials involved the

prisoners who "...were murdered before reaching a prisoner–of–war camp, allegedly while trying to

prisoners of war and on civilians...to determine remedies for diseases...others, such as those
involving castration, sterilization, and excessive use of X–rays, do not appear to have had any

of deportation and forced labor, where thousands of people were deported from "the occupied
countries of Europe in order to fill the manpower shortages created by a burgeoning war

Military And Government In Ancient Greece
What was the military and government like in Ancient Greece? The Greek government was harsh, it
could be cruel or just unfair. Until later, that's just what it was and nobody could change it. The
military was similar, and it was strict. Nobody could say no to enlistment in the military if they were
of age. The soldiers held the highest of honors within just their armor. The Ancient Greek military
and government was severe because of the unjust laws, the strict rules, and the harsh conditions of
living.
The Ancient Greek conversion to a democratic government started in Athens but took quite a bit of
time. The acropolis, in Ancient Greece, was a religious and military center of a city state and a place
of refuge for people during emergencies. ... Show more content on Helpwriting.net ...
Athens was the starting point of the new age in government and took some time for the full effect to
take place. In the military, if one were of age, they had to fight, whether for themselves and/or to
protect their land. The Greeks also left behind a legacy. Democracy itself was the Greeks' big
achievement, one that still exists today. Their military strictness also exists in today's armies and
military forces, in the form of training and discipline. After all this, the Greeks may have been one
of the hardest civilizations in terms of their people, but they will always have a huge influence in the
history and formation of the world to what it is

The Art of War Analysis
The Art of War Analysis The Art of War was one of our world's first written documents that dealt
with militaristic strategies and advancements. The book was written by a Chinese military leader
named Sun Tzu, who commanded and analyzed his military over the Warring States Period of
China. Sun Tzu produced this text in an attempt to provide future military advantages for the
Chinese, but The Art of War's ideas eventually spread to neighboring civilizations and empires. The
ideas and facts expressed in Sun Tzu's writings proved effective as military groups became more
powerful through the writings. Throughout The Art of War, Sun Tzu expressed his views and tactics
primarily in moral ethics, intelligence, environmental tactics, and ... Show more content on

Fighting in one's "homeland" will lead to better conditions for the army that originated in that area
because they know of the environment and what it takes to survive there. Sun Tzu explains his
opinions of military tactics on six types of terrain and all of them easily gave the best advantages to
the military that used them. The last topic that Sun Tzu took great pride in was military leadership.
Since Sun Tzu was a general, he knew how to run an army to its best conditions with a minimal
amount of casualties. During the text, Sun Tzu states, "Now the general is the pillar of the state; if
the pillar has mastered all points of war, the state will be strong; if the pillar is defective, the state
will be week." (p. #1) Tzu is using the general's leadership as a supporting structure to the whole
empire or civilization. If the military leader is dysfunctional, then the whole state or empire will be
dysfunctional as well. The Art of War also states, "The masterful leader cultivates the moral law, and
strictly adheres to proper methods and discipline; thus it is his power to control success." (p. #1) The
leader must also have great morals in order to run a great military and these morals by which the
leader lives by will serve as models for the civilization. A great military starts with a great leader,

The Military Force of Thailand
As far as we are concerned, unlike other Asian countries such as Indonesia, Malaysia and others,
Thailand military forces portrayed a significant concern pertaining to internal turbulence within
Thailand. (Simon, 2000, p. 13) This is because, for several decades, since communist aggression and
until todays, internal security has become the main core focus of Thailand military forces in the
aspects of defence and security of Thailand (Taylor, 2013, p. 12); compared to other aspects such as
external defence. Before discussing or deliberating the roles of Thailand military forces in internal
security, it is better for us to understand the definition of internal security because it might raise
confusion as it both aspects are associated closely with the national interest of a country. As coined
by the Democratic Republic of Timor–Leste National Parliament (2003), internal security is defined
as an activity or program advanced by the State (Government) with the aims to guarantee order,
security and public peacefulness, to safeguards people and goods, to prevent law–breaking and
contribute to guarantee the normal functioning of the democratic institutions. Through this clear
definition, it is clear that external security and internal security are different with each other. In
Thailand, the military undertook a crucial role of internal security pertaining to the Burmese
refugees and insurgency in the southernmost of Thailand insurgency by the Malay–Muslim
insurgent. (Taylor,

Teaching Children to Kill in Africa
Children learn countless new things as they grow up, but would anyone want a child to learn to kill?
Teaching children to kill may seem like a savage thing from the past, but is still present today. In this
modern age, children are still being recruited and forced to become child soldiers. Many military
groups in Africa train their youth to kill anyone who is seen as an opponent. Forcing children to
commit such atrocities violates their human rights. Military groups only give their child soldiers the
bare necessities to survive. The events child soldiers go through would traumatize an adult. Nobody
should be exposed to such horrific experiences, much less children.
Many African countries that use child soldiers do not have the resources to stop this practice. Also,
many people are afraid to have these children reintegrated into society. People view these children
as murderers, but they are simply kids that were brainwashed by their commanders. For these
children, it is either kill or be killed. Reintegrating child soldiers into society is necessary to start the
healing process of war–affected countries. The international community has tried to pass laws to
help stop the use of child soldiers. However, this does not mean military groups automatically
release and stop recruiting children. Should the international community take a more proactive role
in stopping the use of child soldiers?
There are many ways a child can become a child soldier and many reasons why a child is

The Importance Of Conscription In The Military Service
Should a government have the power to compel its citizens into military service? Support your view.
For a government to be sustainable it must have the power to compel its citizens into military
service. The most important resource in the military is men because much of military weaponry isn't
autonomous. People are always in short supply, and especially in the modern age where the horrors
of war are clear visible and easy to access volunteers normally cannot supply enough manpower.
Conscription in various forms was necessary during the Civil War, WWI, WWII, the Vietnam War,
and Korean War to support the military in what sometimes became deeply unpopular conflicts.
While conscription laws definitely should have certain exemptions, these laws are necessary in
times of war, and thus the government must have the power to create and enforce them.
Why do you think that the United States government allowed substitutes to be hired, or
commutation paid? The U.S. government almost certainly permitted substitutions and commutation
payments in an effort to prevent the socially and economically powerful upper class from getting
cold feet. Business magnates and industry leaders naturally might be angered or fear a war that
could result in their conscription (and an inevitable decrease in their standard of living as draftees),
and the war effort would quickly fall apart without their support. In addition, there likely was a
purely selfish motive as what distinguished Senator would want

Military Vs Law Enforcement
I have been struggling with the choice of choosing between military and law enforcement. As the
both of them are very similar yet different among what one has to do. Some of the similarities could
that both are protecting and serving. The difference is the main purpose of the military is to protect
our nation. While law enforcement protects our civilians and uphold the law. The fact that both are
so similar is what makes it hard to make a choice. It only depends on personal reference and what
one wants to do.
The military has branches which includes, Air Force, Navy, and Army, as with law enforcement, the
options are FBI, DEA, USMS and Federal police. The difference is that the military is overseas and

Compare And Differences Of Military Law And Criminal Justice
Compare and Contrast Military personnel have a more restricted life because they have to abide by
two sets of laws. The Uniform Code of Military Justice (UCMJ) and the laws that everyday United
States citizens have to follow. The military law and the criminal justice program has a lot of
similarities and differences. The military has a different court systems and they sentences are
harsher than our justice system. Even prison life is different. In this paper, I will take a look at
military law and civilian law and examine how they are similar and how they are different. To begin,
military personnel has to follow the laws under the UCMJ which are laws that everyday civilians do
not have to follow. There are some laws under the UCMJ that are similar to civilian laws and yet
there are laws completely different than what civilians are used to. People in the military have to
follow the normal civilian laws and the UCMJ. Articles 77 through 134 of the UCMJ are known as
the punitive articles. If any of these laws are violated, it can result in punishment by court–martial.
For example, some laws that fall under the punitive articles are aiding the enemies, spies, espionage,
AWOL ( absent without leave), missing movement, burglary, and many more. Many will also likely
have civilian court cases as well if other local laws were broken too such as drunk driving to murder.
To continue, a court–martial is a military court. The

Military Drones Research Paper
The Use of Military Drones is Unjustified Are military drones really necessary to fight terrorism? Is
it the only way to resolve this issue? Drone technology appears to be increasingly popular as the
need of "self–protection" against terrorists becomes more urgent. It is fair to conclude that drones
are somewhat efficient. However, plentiful of instances and studies have proved otherwise. The
usage of military drones promotes terrorism, violates international laws, and invades privacy. They
are harmful rather than useful to our society. Drone strikes promote terrorism. The attacks on
selected targets may cause collateral damage, resulting in killing civilians. Thus, it is possible that
the strike could turn potential allies into enemies.(Mothana) ... Show more content on

The IHL, also known as the international humanitarian laws state that "the targeted individual must
be directly participating in hostilities with the attacker". Additionally, the human rights law states
that "the targeted individual must pose an imminent threat that only lethal force can prevent"
(drones.procon.org). Suspecting connections to militant organizations or under the CIA's policy of
"signature" drone strikes does not make it an excuse of profiling individuals as terrorists. Such
assumption is not legally sufficient to target someone as the sufferer of a drone strike.
(drones.procon.org) A military drone is mostly used when war is not openly declared, but is
authorized by the government. Attacks by the CIA, which is responsible for eighty percent of the
strikes, are classified as covert operations.(http://drones.procon.org/) The government cannot
provide any legal information about how the CIA appoints the targets of the strikes. Apparently, the
government continues to use military drones to accomplish unlawful killings of "expected
members", with the realization that it has contravened the international law as well as human

Should Civilian Law Enforcement Be Permitted? Military...
ISSUE: Should civilian law enforcement be permitted to utilize military tactics and equipment?
FACTS: In the early to mid–1900's, there was an obvious difference between civilian law
enforcement and our military. We all recall watching our soldiers in combat and all the special
equipment they used. This included backpacks full of tools, ammunition and supplies. They also had
heavy duty vehicles to include armored and track vehicles. We also saw them wearing clothing
designed to assist in concealing them, making it harder for the enemy to see them and therefore
adding an additional layer of safety that will hopefully prevent them from being shot or killed. Our
law enforcement officers at that time typically wore what could be described as dress clothes. It
consisted of dress pants, a dress shirt, a tie, sometimes a coat and usually a hat. The shoes were
shined and the clothing was clean and pressed. Many officers walked a beat and had close contact
with the people they policed. Many times they policed the same neighborhood they resided in. In the
1960's many of our soldiers were sent to fight in the Vietnam War. Again, we saw our military make
great advancements in equipment and safety gear. This included improved flak jackets, better
helmets, bullet proof vehicles and bullet resistant glass. We also improved on our weaponry and saw
the military move to M–16's from the heavier M–1's and M–14's, which also carried less
ammunition in its magazines. This time period also

Argumentative Essay On Women In Combat
In 2017, there was 214,098 women enlisted in the military (Women in the Military personnel).
Those who support women in combat believe that it may reduce the amount of sexual assaults and
that women in combat could improve and strengthen the military. Furthermore, advocates of Erin
Solaro strongly feel that none of the bad predictions about women in combat came true and are
doing perfectly fine. On the other hand, those who oppose women in combat are convinced that
female soldiers have a higher chance of being sexually assaulted and that men and women have
different physical standards. In addition, the critics of women in combat firmly believe that allowing
women in combat weaken the military, therefore harming the unit. Every reason was valid and
convincing, but I stand undecided on which side to support. Women in combat involve many
different varieties of combat positions and people who are in the military must follow laws that can
be different from laws in which a citizen follows. These laws are placed to prevent chaos."(Military

In other words, women would be safer if they joined the military. According to Gen. Martin
Dempsey, chairman of the Joint Chiefs of Staff, people would have a greater respect for women

harass female. Research proves that the rape in our military does not mean less women should serve,
but women should so they can be represented in more equal numbers (How the Military Can Lead).
In addition, when Panetta lifted the ban, she may have affected the growing number of sexual
assaults. Research proves that if males regonizes females as equals the amount of sexual assault may
decrease (Ending Ban, U.S. Hopes). With females being recognized as equals, the sum of sexuals

Essay On America After Ww2
America has changed immensely since WWI. Our policies of isolationism and distance from other
countries have evolved into open involvement, large trade agreements, and a booming economy.
However, as we have become more involved as a nation, we have used our military less sparingly.
The American military is used to garrison other countries, allied and warzone. Our military is being
used to oversee diplomatic meetings that we have no national or economic ties too. This leads to the
question of when American military involvement or force is justified when America is not at war.
The logical answer is that American military force is only justified through self–defense as well as
humanitarian intervention. Traditionally, the military is used for defense, whether it is to defend the
country or the country's interests. However, sometimes the threat which to defend against is harder
to discern than when in open warfare. In the modern age, a large threat to America and countries
everywhere is terrorism. From September 11, 2001 to the Florida shootings, terrorism, domestic and
abroad, has been a true threat ... Show more content on Helpwriting.net ...

Don’t Ask, Don’t Tell Policy Essay
Today's military is a unique force in my opinion. What makes the US Military so unique is that we
have an all volunteer force. With that volunteer force there are rules and regulations that need to be
followed because serving our country is a privilege. The 'Don't Ask, Don't Tell' policy is claiming
that even though it may be considered an infringement on human rights and freedom of expression,
it protects the rights of the rest of the military and opens a loophole for gay men and women to serve
in the armed forces. Other countries have successfully integrated gay men and women into their
militaries and compared the treatment of other "minority" groups in the military. Is the "Don't Ask,

There are claims that allowing gays and lesbians into the service openly about their sexual
orientation is violation to all service members' privacy. Officially, military commanders and
investigators are required to respect service members' privacy and are not allowed to investigate
personnel for homosexuality. This action is described as a witch hunt. Witch hunts distract the
service members from their work and the "Don't Ask, Don't Tell" made this distraction easier. This
causes interference with the ability for them to do their job performance effectively. The United
States is not the only ones who use the DADT ban. There are several militaries all over the country
that has experienced this ban at one point. For example, they are Australia, Britain; Canada, and
Israel just to name a few. They have all changed or lifted their ban without any problems and most
often maintained excellent careers and good morale. Belkin, McNichol reports, that "In November

Central America Case Study
Central America is a region where security threats are related to domestic issues rather than to state
actors. Its condition of bridge between the United States and the rest of Latin America makes it
particularly exposed to trafficking networks of drugs, weapons and human beings. In the last
century, a violent period of instability emerged due to the repression of communist insurgencies and
social unrest by military regimes associated with economic elites. After the end of this period, the
influence of the Armed Forces in the political life declined and the defense budgets were reduced,
under the perception that conventional wars were an unlikely scenario. Additionally, Costa Rica and
Panama had their military banned by law, to focus its resources in development and social needs.

Military Rules of Engagement and the Laws of War
Military Rules of Engagement (ROE) and the Laws of War A civilized society cannot function
without rules, laws, and codes of proper conduct. This statement may seem out of place in the
context of warfighting; however, this is one place where it is most necessary. The fighters, who
often act at the behest of their home nation, must have a code of conduct which allows them to make
the correct decision in a given situation in a combat zone. Rules of Engagement fill this gap for the
national militaries of the civilized world and serve as a soldier's code of conduct in the field. Similar
to Rules of Engagement (ROE) are the Laws of War . The Laws of War were established as an
international agreement. This agreement attempted to curtail the destruction caused by global
conflicts such as the two world wars fought during the twentieth century. The laws of war fall under
the Geneva conventions as well. Each of set of rules can be used as a foundation to create rules of
engagement for a particular mission. It is also important to align rules of engagement with the
uniform code of military justice. This code, referred to as the UCMJ, is used as legal framework for
the United States Military.

The American Military And International Law Of War Essay
"The law of war is that part of international law that regulates the resort to armed forces; the conduct
of hostilities and the protection of war victims in both international and non–international armed
conflict; belligerent occupation; and the relationships between belligerent, neutral, and non–
belligerent States." (DoD, Law of War Manual, pg. 7). Futurists Alvin and Heidi Toffler, authors of
The Third Wave and War and Anti–War, claim we have entered a new era of warfare – information
warfare. In the Third Wave, information ascends to become the most important resource and, as
such, becomes a significant means of both preventing and limiting future wars as well as winning
wars. Many scoff at the ideas as so much hype, but perhaps so, but is important to realize that the
American armed forces are the most information–driven force in the world. The American military
uses computers and technology for almost all aspects of protecting our freedoms, from designing
weapons, guiding missile attacks, paying the men and women who serve, write memorandums,
control radio networks, manage medical supplies, etc. All facets of our operations and mission
success evolve around technology. Many of the identities within the information warfare (IW)
community has come to agree that IW is not a single, simple thing, that it has many complex
dimensions. "Coming to grips with information warfare...is like the effort of the blind men to

Pros And Cons Of Transgender Military Service In The...
Transgender military service is a controversial topic in the United States. Many are in support of
transgender service members while many others dispute it. There is a clear division in this country
regarding this issue. There are also many strong points to a transgender–integrated military and
numerous drawbacks. Supporters of transgender service members contend it establishes equal
opportunities and a larger fighting force, while opponents dispute it detracts from standards and
resources.
To begin, the United States military became an all–volunteer force following the Vietnam War. Like
any other profession, service in the military is subject to compliance with equal opportunities laws
ensuring the most eligible get the job. Transgender individuals are a protected class under the equal

longer need to be secretive but can serve openly in their preferred gender. With this change, the

Supplying Law Enforcement With Military Style Gear
Supplying law enforcement with military–style gear can lead to citizens losing their trust in the
police force. While President Obama visited Camden, New Jersey he said in a speech that "we have
seen how militarized gear can sometimes give people the feeling like there 's an occupying force– as
opposed to a force that 's part of the community that 's protecting them and serving them" (Obama
quoted in Johnson). By seeing law enforcement with equipment that is used against an enemy, it
creates the image that the public is the enemy. People become defensive in run–ins with the police
because of the equipment being used. Not knowing whether or not the officer will see you as a
citizen or an enemy causes the public to be hesitant to trust the police. The equipment is an addition
to the officer, but sometimes the officer themselves are not the best to begin with. There is a lack of
diversity in the police force not just regarding race but also intelligence. When hiring many police
departments cap "acceptable" general intelligence test scores. The average points scored on the test
is 21 to 22, the equivalent of an IQ of 104, which is a little above average ("Courts Ok Barring High
IQs for Cops"). They do this in order to "reduce turnover rates, fearing smarter candidates would
quickly get bored with day–to–day policing" (Rizer). This also limits the emotional intelligence,

Banning Women In The Military Essay
Banning Women in the Military Gender equality in the military is a problem we just cannot seem to
solve. As the wise Mary Angelou once said, "How important it is for us to recognize and celebrate
our heroes and she–roes!" In this quote she is saying that we should not only praise our male heroes,
but we should also praise our female heroes because they are just as important in society. Banning
women from combat is many things, but among those many things, it is definitely not moral. The
combat ban on women in the military also limits career options because of the high number of
military jobs involving combat. Along with limiting careers, it is unconstitutional. The combat
limitation should be demolished because it is immoral, it goes ... Show more content on

It is burdensome for women to advance in their careers because there are a restrained amount of
positions available. "Women officers who want to advance their careers in the field artillery are
thwarted because they must serve at least two years as a battalion operations officer or executive
officers and there are very few of these positions available" (Fulton 1 of 7). The limited amount of
battalion and executive officer positions, which are mostly given to men, are just another one of the
many challenges military women face career–wise on a daily basis. "The Army, therefore
commissions women officers, but does not offer them competitive career paths, a practice that is
prejudicial and limiting to women in the Army" (Fulton 1 of 7). "Female officers commissioned into
field artillery have a future limited in both scope and responsibility" (Fulton 1 of 7). Women who are
looking for competitive careers in the military, especially in field artillery, have a hard time doing so
because of the limited amount of positions they can occupy in that field. If this law were to be
abolished, women would have not only a fairer opportunity to get a job in the military, but they
would also be able to find work more

Based on the "Worldwide Threat Assessment of the U.S. Intelligence Community", the U.S. Military
should prioritize and train for the conduct of counterterrorism, unconventional warfare, foreign

enforcement activities. Consequently, our nation must take a whole of government approach in
resolving these irregular threats working with the international community and the host nation. To
enable these partnerships in this whole of government approach requires military proficiency in civil

We must cease hostilities and provide a secure environment for our civilian partners to enable their

support of economic and infrastructure development. The military must be prepared to provide civil

Furthermore, these types of operations are conducted in a series, concurrently or blended within an

Essay about Article 92
Article 92 Good order and Military discipline: The Disciplinary Regulations of the United States
Army define military discipline as "a strict and honorable compliance by all servicemen with the
order and rules prescribed by laws, military regulations and orders of commanders (superiors)."
Military discipline is a special form of military relations. Its specifics lie in coordinating the conduct
and actions of military personnel and in serving to establish such relations as are required for
successful joint activity. The conduct of servicemen is regulated by special rules and standards of
behavior set forth in laws, military regulations and orders of commanders (superiors) and reflecting

All enlistees, both as personalities and members of definite service and public structures (including
those with a negative impact on discipline), their relations and degree of activity form in the
aggregate the disciplinary system of an element (unit). Psychological support for troops has emerged
as a necessity because this kind of work can deal, to a considerable extent, with a set of specific
psychological problems arising within disciplinary systems at all levels, not the lower echelons
alone, as is often believed. Occasionally it is just the matter of an enlistee being unprepared for
discipline–abiding lifestyle (ignorance of army regulations, orders and regulatory documents).
Sometimes, however, psychological problems stem from clearly expressed anti–disciplinary
attitudes in some or other serviceman, which attitudes tend to disorganize military activities, mixing,
and off–duty routine. Two groups of disciplinary psychological problems are identified. First,
inadequacy (weakness, instability, incompleteness, and unfinished nature) of individual, group or
organizational mechanisms for normative behavior and control thereof as is revealed by practice;
certain enlistees lack the required disciplinary motivation and/or they cannot behave in an organized
way in conformity with the regulations, rules, laws, and military traditions. Military command and

Sleep Deprivation In Law Enforcement And Military
Absolutely, sleep deprivation is a hazard that affects personnel in law enforcement and military.
Other factors, contribute to the hazard, which cause a person to be less productive (J.S, 2001). Sleep
deprivation is a leading cause of stress. Although many people react and process stress differently, it
affects the overall health of many. Change in scenery, for example a deployment to an unfamiliar
place can cause uncertainties, which cause stress. Stress built from being in an uncertain place, such
as in a combat zone will cause sleep deprivation.
I find it ironic that many studies have been conducted, but no resolution in combating the issue has
been addressed. Studies have determined that in order to feel restful, a person must get at

Literature And Law : The Military Draft
Anthony Appiah
Mr. Skardal
Literature and Law
The military draft would require compulsory military service instead of voluntary service. It started
in 1940 when volunteering personnel were not enough for the USA army. Thus, men were
compulsorily drafted to join the army. Now, the USA no longer compulsorily drafts men to join the
army. However, countries such as Switzerland do still draft its men. Conscription in US, also known
as the draft, starts after Congress passed a legislation, which has been signed by the president. The
Selective Service System does the drafting. Eligible Men and Male aliens are required to sign up
with the Selective Service before they turn 26. If an individual fails to do so, the person loses all his
privileges ... Show more content on Helpwriting.net ...
However, in other countries, one cannot legally be exempted from mandatory military service.
Switzerland has two hundred and sixty armed men. It does not have a mandatory military service.
The government spends 4.82 billion US dollars. South Korea has a mandatory military service. Any
individual that decides to object to service would be imprisoned. Disabled persons and people with
unstable mental status are accepted from rendering their services to the army. Some celebrities have
tried to be exempted from service. And by so doing faced serious sanctions such as not being
allowed into South Korea. At age 18, it is mandatory for a South Korean man to be in the South
Korean army. This individual would serve 12 months for the army, 23 months for the navy, 24
months for the air force, 36 months for special social service. As compared to South Korea, the
Switzerland army is more lenient and flexible in terms of drafting of its male citizens.
Ron Paul, Ex U.S. Congressman once said, "Justifying conscription to promote the cause of liberty
is one of the most bizarre notions ever conceived by man! Forced servitude, with the risk of death
and serious injury as a price to live free, makes no sense" Essentially his assertion makes sense. As
an individual, one is of his will and hence may not be forced to give his life to fight for a cause that
he does not personally identify with. But if the practice of forcefully drafting people to fight is

Morag Military Aid: A Case Study
In the UK the number one priority of the military forces is to defend the people of United Kingdom
against all types of terrorism. However, domestic use of military is to maintain law and order. The
British military is also used for other homeland security missions for example hostage rescue,
marine counterterrorism operations, contraband interdiction operations, explosive ordinance
disposal, and search and rescue (Nadav, 2003). Nadav states that the civil authorities breaks down
the aid provided by the military into three categories, which include military aid to government
departments (MAGD), military aid to the civil power (MACP), and military aid to the civil
community (MACC). Accrding to Morag military aid should always be used as a last resort if the

Law Enforcement, US Military, and Terrorism
Section 4: Law Enforcement, U.S. Military, and Terrorism
Law enforcement agencies at the federal level and the U.S. military play a significant role in
preventing terrorism on a state, national, and global scale. Former Vice–President Dick Cheney
comments, "On the ground, the first responders and local police [are] the first line of defense and
intelligence, followed by federal law enforcement, with our foreign intelligence and military forces
on call" (Melber). Through a collaboration of various agencies, counterterrorism efforts continue to
fight terrorist threats on a domestic and international scale.
On a national scale, law enforcement agencies, such as the Federal Bureau of Investigation (FBI),
are charged with detecting, disrupting, and dismantling terrorist cells within the U.S.; identifying
and preventing acts of terrorism by individuals; enhancing the capability to quickly determine
reliability, implications of terrorist threats, and improving the dissemination of information; and
enhancing the contribution to intelligence community ("Counterterrorism Division"). In the military,
Special Forces are deployed to "preclude, preempt and resolve terror incidents abroad. They prevent,
deter and respond to terrorist activities and train other nations' military in the basics of fighting
terrorism" ("Counterterrorism").

The Violation Of Federal Law And U.s. Military
Personal Statement Jake Orlando, JD Applicant University of Toronto Faculty of Law October 30,
2015 Early in 2008 I committed a major infraction while serving in the United States Army in Iraq,
a violation of federal law and of U.S. Department of Defense policy, a violation so inexcusable that
the only correction available would be a discharge. The violation was loving another man. I knew
little about the policy at that age, just barely 19, and barely anything about the law or politics. "Don't
Ask, Don't Tell" had always been in the back of my mind, but it never really mattered until the end. I
learned a very important lesson about life in the modern world when this happened, which is the law
is everywhere and the law can always affect you whether or not you know it's there. Never had I
wanted to be political, never had I wanted to stand out for the wrong reasons. But, my love was not
something I could hide, and moreover I couldn't hide myself any longer. To continue to hide, I
would be complicit with the enforcement of an unconstitutional law that destroyed lives. Coming
out was my first and most important act of protest. I refused to let a law keep me from being who I
am. As my military career ground to halt, I made a vow to myself and to the world that I would do
what I could to prevent the law from victimizing the vulnerable, the hated, and the unwanted. I'm
sick of being told: "I wish you were a lawyer." What makes me sick is not what's being said to me,
but rather the

Sign Up For Women In The Military Essay
Until 2016, women had limited opportunities in the U.S. Military. Women have been held back from
fighting in many combat roles and all positions recently opened up for women. This great
advancement pushed by the Obama administration has opened up thousands of military roles for
women. Over the years, people have slowly accepted that men and women are equals but there are
still many situations in which men are seen as above woman. Women should be required to sign up
for the U.S. MIlitary draft along with men. First, as of 2016, combat roles in the U.S. Military have
opened up for women. United States Military defense secretary, Ashton Carter, announced that the
Pentagon would allow women to serve in combat roles that they were once limited from. This
opened up approximately 220,000 military jobs to women. Over the years, the United States have
worked to integrate women so they would have more opportunities. Requiring women to sign up for
the draft would be a big step for gender equality in the U.S. Second, although originally directed at
African Americans, the equal protection clause of the 14th Amendment of the Constitution states
that everyone must be treated equal under law. This clause proves that every man, and woman has
equal protection of the laws. By law, women should be required to sign up for the draft. ... Show

aren't included in the draft, that means that one half of the U.S. population has nothing to contribute

women as equals. There are still many situations in which women are seen as lesser than men but
this could be prevented if both genders had the same requirements and

Women in the Military: The Combat Exclusion Law Essay
The question originally posed in the Combat Exclusion Law, regarding placement of females in
combat, continues to be debated as women are placed in combat roles without adequate training
(Sanchez, 2011). What distinguishes some positions as being acceptable while others are not? Who
has the authority to approve exceptions, and what exceptions have been made? On May 13, 2011, a
bill placed before the House of Representatives addressed the issue to "repeal the ground combat
exclusion policy for female members" (Sanchez, 2011, p. 1).
Political Issues or Influences
In 1973, women began to grow in numbers in the 'All–Volunteer Force' implemented under
President Nixon. "In February 1988, Department of Defense (DoD) codified the Combat ... Show

Exceptions of "assignments to units below the brigade level whose primary mission is direct ground
combat" (Keenan, 2008, p. 22) were put in place.
H.R. 1928 sought to title the bill "Women's Fair and Equal right to Military Service Act" (Sanchez,
2011, p. 1) as more than 250,000 females had already been deployed to combat zones in the Middle
East. As of May 2011,137 females had lost their lives while in combat (Sanchez, 2011). As women
continue to work side by side with men, the case of equal placement continues. Contrary to that
argument is the power to care for family members, specifically the children and how they are
affected when their mother goes into battle.
Additional Policies that were a Result or Outcome of Combat Exclusion Law
Upon the acceptance of the Combat Exclusion Law, each military service was to define their
policies to determine where females could and could not serve. What this means to the Army in
particular is that "all jobs except those having the highest probability of engaging in direct combat"
(Ferber, 1987, p. 4) will be opened to women in the Army. The Navy, Marines and Air Force have
all had to evaluate the exclusion laws as well and establish criteria as appropriate.

Don T Tell Policy Analysis
The Don't Ask Don't Tell policy was a United States Armed Forces policy pertaining to allowing
homosexuals to serve in the military. The policy allowed the "closet" homosexuals from serving in
the military (Embser–Herbert, 2007). The policy however barred the openly homosexuals members
from serving in the military. According to Embser–Herbert (2007), the law was enacted by President
Bill Clinton in 1993, before the enactment of the law there had been an outright ban on homosexuals
in the military. At the time the law was enacted it was considered a major step in embracing the

The military leadership believed gay and lesbian service members were not fit for military service,
were a security risk, threatened cohesion in the unit, and they violated the privacy of members of
their units who were not gay. This outlook has however been refuted by policy makers, who
according to Huffman et al., (2012) argued that sexual orientation was not a sufficient ground to
reduce the performance of an individual during combat. General Powell alluded to this when putting
a case for the group to a senate committee. According to Huffman et al., (2012) the rationale
banning gays from military service also went against the just war theory since according to General
Colin Powell the gays and lesbians were proud, brave and loyal citizens who deserved a chance to

The United States Military Bases
For roughly 1% of the United States population, the past 10 years have been an ever changing
experience serving across the world. On September 11, 2001, the United States was attacked by a
terrorist organization residing in Afghanistan. The United States Armed forces were called upon to
fight a war against terrorism. In May 2003, this conflict extended to Iraq, which was acting as a safe
zone for many of the world's terrorists. Since that time, more than 70,000 contractors and sub–
contractors have been hired by the Department of the Defense, in order to assist the United States
military in their mission against terrorism. These individuals known as the TCN's or 'third country
nationals,' take part in everything from base security to cooking and laundry. However, since these
individuals are not United States citizens and the government has turned its back to them. Personal
knowledge, department of defense reports, and official law reviews contain a wide variety of
information that give a look inside what has been happening on the United States military bases.
Allegations of human trafficking, sexual assault, and indentured servitude are all common issues
these TCN's have endured.

The Battle Of War Of 1916

  • 1. The Battle Of War Of 1916 arch 11, 1778 – Lieutenant Gotthold Frederick Enslin becomes the first documented service member to be dismissed from the U.S. military for homosexuality. Under an order from General George Washington which states "abhorrence and detestation of such infamous crimes," Lt. Enslin is drummed out of the Continental Army after being found guilty of sodomy. March 1, 1917 – The Articles of War of 1916 are implemented. A revision of the Articles of War of 1806, the new regulations detail statutes governing U.S. military discipline and justice. Under the category Miscellaneous Crimes and Offences, Article 93 states that any person subject to military law who commits "assault with intent to commit sodomy" shall be punished as a court–martial may ... Selective Service System includes "homosexual proclivities" as a disqualifying condition for inclusion in the military draft. 1942 – Military psychiatrists warn that "psychopathic personality disorders" make homosexual individuals unfit to fight. The military issues the first formal regulations to list homosexuality as an excludable characteristic. Those in the military identified as homosexuals can be discharged and denied veterans benefits. January 20, 1950 – Army Regulation 600–443 is published, identifying three categories of homosexuals. Those deemed to be aggressive are placed in Class I and are subjected to general court–martial. Homosexuals considered active but non–aggressive are placed in Class II and can avoid a court–martial by accepting a dishonorable discharge – or resigning, if they are officers. Personnel professing or exhibiting homosexual tendencies without committing a violation of the sodomy statute are designated "Class III," and can be removed from service under general or honorable discharge. May 31, 1951 – The Uniform Code of Military Conduct is adopted. Article 125 forbids sodomy among all military personnel, defining it as "any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient to complete the offence." The 1951 Manual for Courts–Martial provides an even more explicit ... Get more on HelpWriting.net ...

  • 3. Ethical Dilemmas In The Military The size of the military reaches astonishing numbers and due to this many ethical dilemmas take place. Moral and legal issues occur throughout whether it be on the field or on base and addressing those cases calls for just and fair trial. Numerous factors must be accounted for such as where it occurred, historical basis to back judgments, the authority of the individual as well as the individual themselves in the sense of their beliefs and the decisions they made. Including all these factors lead to an answer for this ethical dilemma: To what extent does the military punish a soldier for disobeying morally wrong orders given to them? Blending morality with legality often ends with confusion and misjudgment for both parties ... Show more content on Helpwriting.net ... Do ethics and moral views stay consistent throughout deployment and can soldiers integrate within the areas culture? Despite all the violence in a war, a soldier shooting another is not considered a war crime because it is not a violation to the laws and practices of a war, and it is considered just. A war crime is defined as a "violations [violation] of the laws and customs of war" ("War Crimes"), and are attacks "against civilian populations, prisoners of war, or in some cases enemy soldiers in the field" (Friedman). • 7. Military And Government In Ancient Greece What was the military and government like in Ancient Greece? The Greek government was harsh, it could be cruel or just unfair. Until later, that's just what it was and nobody could change it. The military was similar, and it was strict. Nobody could say no to enlistment in the military if they were of age. The soldiers held the highest of honors within just their armor. The Ancient Greek military and government was severe because of the unjust laws, the strict rules, and the harsh conditions of living. The book was written by a Chinese military leader named Sun Tzu, who commanded and analyzed his military over the Warring States Period of China. Sun Tzu produced this text in an attempt to provide future military advantages for the Chinese, but The Art of War's ideas eventually spread to neighboring civilizations and empires. The ideas and facts expressed in Sun Tzu's writings proved effective as military groups became more powerful through the writings. Fighting in one's "homeland" will lead to better conditions for the army that originated in that area because they know of the environment and what it takes to survive there. Sun Tzu explains his opinions of military tactics on six types of terrain and all of them easily gave the best advantages to the military that used them. The last topic that Sun Tzu took great pride in was military leadership. Since Sun Tzu was a general, he knew how to run an army to its best conditions with a minimal amount of casualties. During the text, Sun Tzu states, "Now the general is the pillar of the state; if the pillar has mastered all points of war, the state will be strong; if the pillar is defective, the state will be week." (p. #1) Tzu is using the general's leadership as a supporting structure to the whole empire or civilization. If the military leader is dysfunctional, then the whole state or empire will be dysfunctional as well. The Art of War also states, "The masterful leader cultivates the moral law, and strictly adheres to proper methods and discipline; thus it is his power to control success." (p. #1) The leader must also have great morals in order to run a great military and these morals by which the leader lives by will serve as models for the civilization. • 11. The Military Force of Thailand As far as we are concerned, unlike other Asian countries such as Indonesia, Malaysia and others, Thailand military forces portrayed a significant concern pertaining to internal turbulence within Thailand. (Simon, 2000, p. 13) This is because, for several decades, since communist aggression and until todays, internal security has become the main core focus of Thailand military forces in the aspects of defence and security of Thailand (Taylor, 2013, p. 12); compared to other aspects such as external defence. Before discussing or deliberating the roles of Thailand military forces in internal security, it is better for us to understand the definition of internal security because it might raise confusion as it both aspects are associated closely with the national interest of a country. As coined by the Democratic Republic of Timor–Leste National Parliament (2003), internal security is defined as an activity or program advanced by the State (Government) with the aims to guarantee order, security and public peacefulness, to safeguards people and goods, to prevent law–breaking and contribute to guarantee the normal functioning of the democratic institutions. Through this clear definition, it is clear that external security and internal security are different with each other. In Thailand, the military undertook a crucial role of internal security pertaining to the Burmese refugees and insurgency in the southernmost of Thailand insurgency by the Malay–Muslim insurgent. • 13. Teaching Children to Kill in Africa Children learn countless new things as they grow up, but would anyone want a child to learn to kill? Teaching children to kill may seem like a savage thing from the past, but is still present today. In this modern age, children are still being recruited and forced to become child soldiers. Many military groups in Africa train their youth to kill anyone who is seen as an opponent. Forcing children to commit such atrocities violates their human rights. Military groups only give their child soldiers the bare necessities to survive. The events child soldiers go through would traumatize an adult. Nobody should be exposed to such horrific experiences, much less children. Many African countries that use child soldiers do not have the resources to stop this practice. Also, many people are afraid to have these children reintegrated into society. People view these children as murderers, but they are simply kids that were brainwashed by their commanders. For these children, it is either kill or be killed. Reintegrating child soldiers into society is necessary to start the healing process of war–affected countries. The international community has tried to pass laws to help stop the use of child soldiers. However, this does not mean military groups automatically release and stop recruiting children. Should the international community take a more proactive role in stopping the use of child soldiers? There are many ways a child can become a child soldier and many reasons why a child is ... • 15. The Importance Of Conscription In The Military Service Should a government have the power to compel its citizens into military service? Support your view. For a government to be sustainable it must have the power to compel its citizens into military service. The most important resource in the military is men because much of military weaponry isn't autonomous. People are always in short supply, and especially in the modern age where the horrors of war are clear visible and easy to access volunteers normally cannot supply enough manpower. Conscription in various forms was necessary during the Civil War, WWI, WWII, the Vietnam War, and Korean War to support the military in what sometimes became deeply unpopular conflicts. While conscription laws definitely should have certain exemptions, these laws are necessary in times of war, and thus the government must have the power to create and enforce them. Why do you think that the United States government allowed substitutes to be hired, or commutation paid? The U.S. government almost certainly permitted substitutions and commutation payments in an effort to prevent the socially and economically powerful upper class from getting cold feet. Business magnates and industry leaders naturally might be angered or fear a war that could result in their conscription (and an inevitable decrease in their standard of living as draftees), and the war effort would quickly fall apart without their support. In addition, there likely was a purely selfish motive as what distinguished Senator would want ... Get more on HelpWriting.net ...

  • 21. Compare And Differences Of Military Law And Criminal Justice Compare and Contrast Military personnel have a more restricted life because they have to abide by two sets of laws. The Uniform Code of Military Justice (UCMJ) and the laws that everyday United States citizens have to follow. The military law and the criminal justice program has a lot of similarities and differences. The military has a different court systems and they sentences are harsher than our justice system. Even prison life is different. In this paper, I will take a look at military law and civilian law and examine how they are similar and how they are different. To begin, military personnel has to follow the laws under the UCMJ which are laws that everyday civilians do not have to follow. There are some laws under the UCMJ that are similar to civilian laws and yet there are laws completely different than what civilians are used to. People in the military have to follow the normal civilian laws and the UCMJ. Articles 77 through 134 of the UCMJ are known as the punitive articles. If any of these laws are violated, it can result in punishment by court–martial. For example, some laws that fall under the punitive articles are aiding the enemies, spies, espionage, AWOL ( absent without leave), missing movement, burglary, and many more. Many will also likely have civilian court cases as well if other local laws were broken too such as drunk driving to murder. To continue, a court–martial is a military court. The ... • 23. Military Drones Research Paper The Use of Military Drones is Unjustified Are military drones really necessary to fight terrorism? Is it the only way to resolve this issue? Drone technology appears to be increasingly popular as the need of "self–protection" against terrorists becomes more urgent. It is fair to conclude that drones are somewhat efficient. However, plentiful of instances and studies have proved otherwise. The usage of military drones promotes terrorism, violates international laws, and invades privacy. They are harmful rather than useful to our society. Drone strikes promote terrorism. The attacks on selected targets may cause collateral damage, resulting in killing civilians. Thus, it is possible that the strike could turn potential allies into enemies.(Mothana) ... Show more content on Helpwriting.net ... The IHL, also known as the international humanitarian laws state that "the targeted individual must be directly participating in hostilities with the attacker". Additionally, the human rights law states that "the targeted individual must pose an imminent threat that only lethal force can prevent" (drones.procon.org). Suspecting connections to militant organizations or under the CIA's policy of "signature" drone strikes does not make it an excuse of profiling individuals as terrorists. Such assumption is not legally sufficient to target someone as the sufferer of a drone strike. (drones.procon.org) A military drone is mostly used when war is not openly declared, but is authorized by the government. Attacks by the CIA, which is responsible for eighty percent of the strikes, are classified as covert operations.(http://drones.procon.org/) The government cannot provide any legal information about how the CIA appoints the targets of the strikes. • 25. Should Civilian Law Enforcement Be Permitted? Military... ISSUE: Should civilian law enforcement be permitted to utilize military tactics and equipment? FACTS: In the early to mid–1900's, there was an obvious difference between civilian law enforcement and our military. We all recall watching our soldiers in combat and all the special equipment they used. This included backpacks full of tools, ammunition and supplies. They also had heavy duty vehicles to include armored and track vehicles. We also saw them wearing clothing designed to assist in concealing them, making it harder for the enemy to see them and therefore adding an additional layer of safety that will hopefully prevent them from being shot or killed. Our law enforcement officers at that time typically wore what could be described as dress clothes. It consisted of dress pants, a dress shirt, a tie, sometimes a coat and usually a hat. The shoes were shined and the clothing was clean and pressed. Many officers walked a beat and had close contact with the people they policed. Many times they policed the same neighborhood they resided in. In the 1960's many of our soldiers were sent to fight in the Vietnam War. Again, we saw our military make great advancements in equipment and safety gear. This included improved flak jackets, better helmets, bullet proof vehicles and bullet resistant glass. We also improved on our weaponry and saw the military move to M–16's from the heavier M–1's and M–14's, which also carried less ammunition in its magazines. This time period also ... Those who support women in combat believe that it may reduce the amount of sexual assaults and that women in combat could improve and strengthen the military. Furthermore, advocates of Erin Solaro strongly feel that none of the bad predictions about women in combat came true and are doing perfectly fine. On the other hand, those who oppose women in combat are convinced that female soldiers have a higher chance of being sexually assaulted and that men and women have different physical standards. In addition, the critics of women in combat firmly believe that allowing women in combat weaken the military, therefore harming the unit. Every reason was valid and convincing, but I stand undecided on which side to support. Research proves that the rape in our military does not mean less women should serve, but women should so they can be represented in more equal numbers (How the Military Can Lead). • 31. Essay On America After Ww2 America has changed immensely since WWI. Our policies of isolationism and distance from other countries have evolved into open involvement, large trade agreements, and a booming economy. However, as we have become more involved as a nation, we have used our military less sparingly. The American military is used to garrison other countries, allied and warzone. Our military is being used to oversee diplomatic meetings that we have no national or economic ties too. This leads to the question of when American military involvement or force is justified when America is not at war. The logical answer is that American military force is only justified through self–defense as well as humanitarian intervention. Traditionally, the military is used for defense, whether it is to defend the country or the country's interests. However, sometimes the threat which to defend against is harder to discern than when in open warfare. In the modern age, a large threat to America and countries everywhere is terrorism. • 33. Don’t Ask, Don’t Tell Policy Essay Today's military is a unique force in my opinion. What makes the US Military so unique is that we have an all volunteer force. With that volunteer force there are rules and regulations that need to be followed because serving our country is a privilege. The 'Don't Ask, Don't Tell' policy is claiming that even though it may be considered an infringement on human rights and freedom of expression, it protects the rights of the rest of the military and opens a loophole for gay men and women to serve in the armed forces. Other countries have successfully integrated gay men and women into their militaries and compared the treatment of other "minority" groups in the military. There are claims that allowing gays and lesbians into the service openly about their sexual orientation is violation to all service members' privacy. Officially, military commanders and investigators are required to respect service members' privacy and are not allowed to investigate personnel for homosexuality. This action is described as a witch hunt. Witch hunts distract the service members from their work and the "Don't Ask, Don't Tell" made this distraction easier. This causes interference with the ability for them to do their job performance effectively. The United States is not the only ones who use the DADT ban. There are several militaries all over the country that has experienced this ban at one point. For example, they are Australia, Britain; Canada, and Israel just to name a few. They have all changed or lifted their ban without any problems and most often maintained excellent careers and good morale. Belkin, McNichol reports, that "In November 1992, the Australian Defense Forces lifted its ban on open gay and lesbian soldiers. Using all available data from military, academic, non–governmental, and other sources, this report assesses the extent to which the lifting of the gay ban has affected the well–being and performance of the Australian military." Its condition of bridge between the United States and the rest of Latin America makes it particularly exposed to trafficking networks of drugs, weapons and human beings. In the last century, a violent period of instability emerged due to the repression of communist insurgencies and social unrest by military regimes associated with economic elites. After the end of this period, the influence of the Armed Forces in the political life declined and the defense budgets were reduced, under the perception that conventional wars were an unlikely scenario. • 39. Military Rules of Engagement and the Laws of War Military Rules of Engagement (ROE) and the Laws of War A civilized society cannot function without rules, laws, and codes of proper conduct. This statement may seem out of place in the context of warfighting; however, this is one place where it is most necessary. The fighters, who often act at the behest of their home nation, must have a code of conduct which allows them to make the correct decision in a given situation in a combat zone. Rules of Engagement fill this gap for the national militaries of the civilized world and serve as a soldier's code of conduct in the field. Similar to Rules of Engagement (ROE) are the Laws of War . The Laws of War were established as an international agreement. This agreement attempted to curtail the destruction caused by global conflicts such as the two world wars fought during the twentieth century. The laws of war fall under the Geneva conventions as well. Each of set of rules can be used as a foundation to create rules of engagement for a particular mission. It is also important to align rules of engagement with the uniform code of military justice. This code, referred to as the UCMJ, is used as legal framework for the United States Military. The American Military And International Law Of War Essay "The law of war is that part of international law that regulates the resort to armed forces; the conduct of hostilities and the protection of war victims in both international and non–international armed conflict; belligerent occupation; and the relationships between belligerent, neutral, and non– belligerent States." (DoD, Law of War Manual, pg. 7). Futurists Alvin and Heidi Toffler, authors of The Third Wave and War and Anti–War, claim we have entered a new era of warfare – information warfare. In the Third Wave, information ascends to become the most important resource and, as such, becomes a significant means of both preventing and limiting future wars as well as winning wars. Many scoff at the ideas as so much hype, but perhaps so, but is important to realize that the American armed forces are the most information–driven force in the world. The American military uses computers and technology for almost all aspects of protecting our freedoms, from designing weapons, guiding missile attacks, paying the men and women who serve, write memorandums, control radio networks, manage medical supplies, etc. All facets of our operations and mission success evolve around technology. Many of the identities within the information warfare (IW) community has come to agree that IW is not a single, simple thing, that it has many complex dimensions. Many are in support of transgender service members while many others dispute it. There is a clear division in this country regarding this issue. There are also many strong points to a transgender–integrated military and numerous drawbacks. • 45. Supplying Law Enforcement With Military Style Gear Supplying law enforcement with military–style gear can lead to citizens losing their trust in the police force. While President Obama visited Camden, New Jersey he said in a speech that "we have seen how militarized gear can sometimes give people the feeling like there 's an occupying force– as opposed to a force that 's part of the community that 's protecting them and serving them" (Obama quoted in Johnson). By seeing law enforcement with equipment that is used against an enemy, it creates the image that the public is the enemy. People become defensive in run–ins with the police because of the equipment being used. Not knowing whether or not the officer will see you as a citizen or an enemy causes the public to be hesitant to trust the police. The equipment is an addition to the officer, but sometimes the officer themselves are not the best to begin with. There is a lack of diversity in the police force not just regarding race but also intelligence. When hiring many police departments cap "acceptable" general intelligence test scores. The average points scored on the test is 21 to 22, the equivalent of an IQ of 104, which is a little above average ("Courts Ok Barring High IQs for Cops"). Psychological support for troops has emerged as a necessity because this kind of work can deal, to a considerable extent, with a set of specific psychological problems arising within disciplinary systems at all levels, not the lower echelons alone, as is often believed. Occasionally it is just the matter of an enlistee being unprepared for discipline–abiding lifestyle (ignorance of army regulations, orders and regulatory documents). Sometimes, however, psychological problems stem from clearly expressed anti–disciplinary attitudes in some or other serviceman, which attitudes tend to disorganize military activities, mixing, and off–duty routine. Two groups of disciplinary psychological problems are identified. First, inadequacy (weakness, instability, incompleteness, and unfinished nature) of individual, group or organizational mechanisms for normative behavior and control thereof as is revealed by practice; certain enlistees lack the required disciplinary motivation and/or they cannot behave in an organized way in conformity with the regulations, rules, laws, and military traditions. Military Personal Statement Jake Orlando, JD Applicant University of Toronto Faculty of Law October 30, 2015 Early in 2008 I committed a major infraction while serving in the United States Army in Iraq, a violation of federal law and of U.S. Department of Defense policy, a violation so inexcusable that the only correction available would be a discharge. The violation was loving another man. I knew little about the policy at that age, just barely 19, and barely anything about the law or politics. "Don't Ask, Don't Tell" had always been in the back of my mind, but it never really mattered until the end. Women have been held back from fighting in many combat roles and all positions recently opened up for women. This great advancement pushed by the Obama administration has opened up thousands of military roles for women. Over the years, people have slowly accepted that men and women are equals but there are still many situations in which men are seen as above woman. Women should be required to sign up for the U.S. MIlitary draft along with men. First, as of 2016, combat roles in the U.S. Military have opened up for women. United States Military defense secretary, Ashton Carter, announced that the Pentagon would allow women to serve in combat roles that they were once limited from. This opened up approximately 220,000 military jobs to women. Over the years, the United States have worked to integrate women so they would have more opportunities.
