A lot has changed since the R v Butler case that was decided back in 1992, when Donald Victor
Butler was charged with various counts of selling obscene material, possessing obscene material for
the purpose of distribution or sale, and exposing obscene material to public view, contrary to
Section 163 of the Criminal Code, which states that "any publication a dominant characteristic of
which is the undue exploitation of sex, or of sex and any one or more of . . . crime, horror, cruelty
and violence, shall be deemed to be obscene" (R v Butler Edited 2). With the introduction and
growth of the internet, society has drastically shifted, as it has revolutionized the way humans live.
One issue that has come along with it is, with the internet being so vast in size and so endless in
content, it is difficult to regulate all the content on the internet with its borderless nature. Because of
this, is it much easier to gain access to pornography, which is what Butler was initially charged for
back in 1987. With such a shift in time from 1992 to now, I believe that the internet and other
developments have changed community standards and expectations, but not necessarily enough so
that the criminal restrictions on obscenity are no longer justified in our free and democratic society.

located in San José public libraries.
Background
Pornography is a multi–billion dollar industry and approximately 40 million people visit
pornography websites yearly (Logue, 2015; DeAngelis, 2007). Public computers allow
pornographic websites to be easily accessed unless there is a filter to block the content (The
Economist, 2015). Approximately half of public libraries nationwide use filters on their public
computers (Light, 2008). The ability to access pornographic content through the use of public
library computers has been a concern to many San José residents.
On October 24, 2007, Councilmember Pete Constant asked for a policy that would install filters on
library public access computers in order to reduce or eliminate children from viewing lewd material
(Light, 2008). On April 21, 2009, City Council rejected spending the money for the technology
required to implement the use of filters. The Council voted 7–3 to approve a reminder system for
users, which would state exposing children to pornography is illegal (Woolfolk, 2009). Despite the
rejection to use filters, in 2014 Jill Bourne revisited the idea by discussing how the filtering
programs have evolved. Bourne planned to test two new programs, Websense and SquidGuard,
which cost a fraction of what they would five years prior (Rodriguez, 2014).

It today's society, pornography is a fast–growing epidemic that is evident in families, marriages, and
teenage lifestyles. Supporters of pornography claim that it can be used as a tool to teach students
about sex education. However, critics claim that pornography is unjust, influential, and
dehumanizing. Pornography is unjust because it has the potential to break down intimate
relationships and marriages. It can also have negative effects on children in particular young boys.
More and more young boy's minds are being influenced by pornography which is leading to
misinterpretations about how to have a healthy sexual relationship. Most importantly, pornography
dehumanizes women and it exploits children. Women and children are being victimized for the
sheer pleasure of someone viewing pornography.
To begin, pornography has addictive characteristics and because of those characteristics intimate
relationships often suffer. Today, men and women tend to become addicted to watching pornography
and use it to masturbate. It has been proven that "problematic pornography is characterized by a
predominant urge for behavioral engagement, referred to as a craving" (Allen 67). If both parties of
a relationship have this urge or craving for pornography, this could cause their relationship to suffer.

amount of people who regularly watch baseball. Revenue from Internet porn exceeds by nearly a 2
to 1 ratio, the combined revenues of ABC, CBS, and NBC. The current estimate is there are over 4
million pornographic websites representing almost 400 million pages of pornographic material.
Pornography is not just for men to view in the wee hours of the morning but also for women. More
than 70% of porn is downloaded during normal business hours of 9 am to 5 pm.

The Cons of Pornography on the internet is that it is very easy to get to especially if you have

After watching this video its really weird to see someone as mentally ill as Ted Bundy talk to society and warn people about the effects that pornography can have. I interviewed one of my friends. She attends college in Moorhead. She told me that although she didn't have an addiction to viewing pornography, she has heard and known people who have and could possibly have had an addiction to it. She also stated "I don't think it becomes an unhealthy thing until you go too far and let it consume you. That's when it can become an addiction". Bundy stressed that nowadays and even 20– 30 years ago that it was everywhere and that even children aren't safe in their homes because it is so accessible. One thing that should concern society is that back when Ted was a child he didn't have technology, and with today's technology it is so accessible to anyone and it can be so private that no one would be able to tell if a kid or anyone was addicted to it. For my second question I wanted to know how pornography is distributed to people and more importantly how easy it is to access/view it. It started with the late Hugh Hefner, the creator of playboy introduced America to a new men's lifestyle magazine. Over the years, many women have posed for the cover and it's quite an honor for some.
