Because of our current system, individuals with a questionable criminal record, the mentally unstable, and members of society simply unfit to
purchase a gun are able to take advantage of the second amendment. For example, the Virginia Tech mass shooting that took place in 2007, as well
as the mass shooting at a church in Charleston South Carolina in 2016 both occurred on the basis of the purchase of a firearm without a formal

Background Check System Analysis
There are many limitations and loopholes to the current system.
The majority of US states don't have background check requirements for private gun sales or transfer of ownership. In 31 states, people can purchase
firearms from unlicensed sellers without undergoing a background check. According to a 2012 study by Injury Prevention of prison inmates convicted of
gun crimes in 13 states, 96% of offenders who were legally prohibited from owning a firearm acquired their gun from a supplier who didn't conduct
background checks. According to Philip Cook and Jens Ludwig, the databases utilized in the National Instant Criminal Background Check System,
or NICS, have an incomplete coverage. Far too many states fall short on submitting prohibiting mental health and other records. Five states had
made fewer than 10 records available and eight states had made fewer than 100 records available as of November 2014, according to FBI data. The
failure of states to submit records severely limits the effectiveness of NICS. In a national online survey of 1,613 gun owners, 22% who reported
obtaining their most recent firearm within the past two years said they did so without a background check. Additionally, the current background
checks do not prohibit stalkers or people with Domestic Violence Restraining Orders (DVROs) from being able to get a gun. The private sales or gun

A poll by the Quinnipiac University in June 2017 shows that 94% of Americans support requiring background checks for all gun buyers.
Additionally, a 2014 poll shows that 92% of gun owners, 92% of voters, and 86% of Republicans support background checks prior to all gun sales.

Although the Second Amendment to the United States Constitution includes, "the right to bear arms," there must be stronger regulations regarding
firearm sales in this country. IV. Policy Description
S. 436 (2011), otherwise known as the Fix Gun Checks Act of 2011 is a bill that was proposed by New York Senator Charles Schumer. The purpose of
the bill is:
"To ensure that all individuals who should be prohibited from buying a firearms are listed in the national criminal background check system and
require a background check for every firearm sale" (p. 1).
According to the bill, it is the duty of the United States Attorney General to withhold funds from those states that do not provide sufficient information
to the Department of Justice regarding those individuals who are prohibited from purchasing firearms. The funds withheld are those that would
allocated to a state in regards to the Omnibus Crime Control and Safe Streets Act of 1968. Under this Act, state and local governments are given
federal funding in order to "reduce the incidence of crime and to increase the effectiveness, fairness, and coordination of law enforcement and criminal
justice systems" (42 U.S.C.
