• If you examined all the accident records in any organization, you will find that the root-cause of 98%

13. OSH Act 514 was amended and gazette on 16 March 2022 as Act A1648: Occupational Safety and Health
(Amendment) Act 2022.
The amended bill consists of 2 sections being removed, amendments to 35 existing sections, an addition of 27
new sections.
Its is expected the amendments will create higher standard of safety and accountability from employers
and employee. It will ensure the reduction of job hazards in the workplace and allows for a heightened sense of
wellbeing contributing towards higher productivity and performance.
The act covers all places of work through out Malaysia however it excludes domestic servants, armed forces and
work on board ships. Does not exclusively mention “work from home” either.
The highlights of the amendments are that it increases the protection accorded to an employee and places
additional responsibilities on employers/principals towards their employee. Further, there has been an
increase in penalties as a financial deterrent effort.

14. Increasing protection to employees
Section 2: Act 514 is applicable to all places of work throughout Malaysia. The proposed amendments now seek to extend the
applicability of OSHA to all places of work throughout Malaysia including those in the public services and statutory authorities.
“Place of work” is defined under the OSHA as premises where persons work or premises used for the storage of plant or
substance.
Section 26A (new) : Right of employee to “remove” themselves from “imminent danger” which employee has reasonable
justification to believe exists at the workplace and employer fails to remove such danger despite being informed by employee
Additional responsibilities on employers/principals towards employees
• Section 15(2)(f): Development and implementation of procedures for dealing with emergencies at work.
• Section 16: Formulation of occupational safety and health policies at respective workplaces.
• Section 18A (new): Mandatory requirement for principal employers to ensure the safety of contractors and sub-contractors
including those employed by them as far as reasonably practicable.
• Section 18B (new): Obligation to conduct risk assessment in relation to the safety and health risk posed to any employee at the
workplace
• Section 52: Company Directors/Officers may be charged severally or jointly for offences under Act 514. Burden of proof is
upon the Company Directors/Officers to prove they are not liable.
Key highlights of the amendment
15. Financial Deterrent: Increase in penalties
• Section 19: Increment of penalty from RM50,000 to RM500,000 for offences including failure of employers to formulate safety
and health policies, procedures and plans.
• Section 23: Penalty of RM200,000 (previously RM20,000) for violations under Section 21 and Section 22 (Manufacturer’s duty on
plant and materials at the workplace).
The amendments have also provided an avenue for director or officer of a company to avoid liability by proving that: (i) the offence
under the OSHA was committed without his knowledge and; (ii) that the offence was committed without his consent and reasonable
precautions and due diligence had been exercised to prevent the commission of the offence.
The onus would therefore be on the director or the officer of the company to prove that they have taken reasonable steps to prevent
the commission of offence from occurring. Employers should therefore ensure they have the right policies, procedures and systems
in place so that they can rely on the “reasonable precautions and due diligence” defence.

Act A1648: Occupational Safety and Health (Amendment) Act 2022.
The “Occupational Safety and Health Act 1994” has made it mandatory for workplaces with forty or more
employees to have a Safety and Health Committee. Following that and in order to ensure a clear understanding of
the section 30 and 31 , Occupational Safety and Health (Safety and Health Committee) Regulations 1996 was
promulgated and these had been enforced effective January 1, 1997.
17. Section 30. Establishment of safety and health committee at place of work.
(1) Every employer shall establish a safety and health committee at the place of work in accordance with this
section if-
(a) there are forty or more persons employed at the place of work; or
(b) the Director General directs the establishment of such a committee at the place of work.
(2) The composition of a safety and health committee established under subsection (1), the election or
appointment of persons to the committee, the powers of the members of the committee and any other matter
relating to the establishment or procedure of the committee shall be as prescribed.
(3) Every employer shall consult the safety and health committee with a view to the making and maintenance
of arrangements which will enable him and his employees to co-operate effectively in promoting and
developing measures to ensure the safety and health at the place of work of the employees, and in checking
the effectiveness of such measures.
(4) A person who contravenes the provisions of this section shall be guilty of an offence and shall, on
conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not
exceeding six months or to both.
OSHA 1994 – with regards to Safety and Health Committee
18. Section 31. Functions of safety and health committee. The safety and health committee established at a place of
work pursuant to section 30-
(a) shall keep under review the measures taken to ensure the safety and health of persons at the place of work;
(b) shall investigate any matter at the place of work-
(i) which a member of the committee or a person employed there at considers is not safe or is a risk to
health; and
(ii) which has been brought to the attention of the employer;
(c) shall attempt to resolve any matter referred to in paragraph (b) and, if it is unable to do so, shall request the
Director General to undertake an inspection of the place of work for that purpose; and
(d) shall have such other functions as may be prescribed.
OSHA 1994 – with regards to Safety and Health Committee
