WORLD ENVIRONMENT DAY
June 5, 2016
From Chairman’s desk
Esteemed Members,
As I mentioned in my previous
editorial, we are planning to
celebrate for the first time our
Foundation day on 1st
September with several
programs. Details regarding
competitions are appearing in
this newsletter. Besides the
inaugural program, prize
distribution to the winners of
the competitions, felicitation
of all past Chairman & Hon
Secretaries of the Centre,
unveiling of Souvenir,
Inauguration of Centre for
Continuing Education and
Skills development and two
Memorial Lectures; we shall
have a full day program with
interesting topics and of
course a grand get-together.
Details of program shall be
ready very shortly. Once
done, we shall be mailing the
same to you. President, IEI
Shri HCS Berry has consented
to be present on that day. I
am sure you would have
marked the date in your
calendar.
I take this opportunity to
thank all those who suggested
topics for memorial lectures
on our WhatsApp Groups.
We are getting good response
to the courses conducted so
far. Some members have
requested to take up such
courses outside Ahmedabad
too, however, this would
depend upon members’
response. If we get a
participation of minimum 30
persons at a place, we can
certainly conduct that course
at that place. Your
suggestions about taking
further short term courses
would go a long way in
shaping the future of our
engineers. S.J.Desai

CONTRACT MANAGEMENT & DISPUTES RESOLUTION Certification Course
October 08, 2016 11.00 am –5.00 pm Trainer: Shri B. J. Vasavada
Introduction: Contract management is a very important subject as it not only involves engineering skills but also needs
techno-legal aspects to be understood properly and implemented. Legal provisions of contract management are
governed by the Indian Contracts Act. Improper management of contracts costs heavily as the aggrieved party resorts
to arbitration or litigation or conciliation. Therefore the contract managers have to be thorough in knowledge as well
as execution of the contract. An employer has several obligations which if unfulfilled give rise to the disputes and huge
financial claims. The contract managers have to be aware of their obligations under the contract and try to ensure that
these are reasonably fulfilled under normal circumstances. Though best way is to avoid or even minimize the disputes
during the execution of an engineering contract.
However, disputes are bound to occur in any contract and hence their timely resolution is the need of the hour. Delay
in resolution of disputes is not the solution. On the contrary it adds up heavy burden of interest cost and therefore
timely resolution of the disputes is a necessity. In case the disputes could not be resolved amicably, the parties are free
to resort to arbitration and/or conciliation under the provisions of Arbitration and Conciliation Act. A contract manager
should therefore have thorough knowledge of provisions of both the above Acts as these are quasi-judicial processes
and any negligence on the part of the contract manager would cost the employer dearly. Disputes can also be resolved
by Alternative Dispute Resolution Methods effectively.
All these aspects shall be deliberated and discussed along with several interesting case studies in this workshop.
Who should attend: The workshop shall be attended by practicing and in service engineers from all engineering
branches whose live interaction would enlighten them about many facets of contract management and arbitration and
also about the settlement of disputes.
Program structure: The program shall include:
1. Indian Contract Act, Invitation to Bid & Award of Work
2. Arbitration / Conciliation in Construction Industry

Extension of Time & Termination of the Contract

Construction Contracts
6. Can Proper Contract Management Lead to Avoidance of Arbitration? Perception of Outsiders About Dispute
Settlement Mechanism in India

STRESS AND TIME MANAGEMENT
Introduction:
To serve is beautiful, but only if it is done with joy and a whole heart and a free mind.– Pearl S Buck
Stress is probably the biggest problem that managers have to face at work. Stress is intangible, it cannot be
seen, only experienced. Stress does not exist, yet many people each year have to take time off from work to
resolve the conflicts and tensions in their life. Stress is the twentieth century disease and the biggest and most
significant time waster of all. Management of stress is therefore very much necessary in modern times.
Peter Drucker’s famous dictum: “Time is the scarcest resource, and unless it is managed nothing else can be
managed.”
Time scarcity is getting worse: always-on communications, organizational complexity, and unrelenting
economic pressures are compounding an age-old challenge. With almost 50 percent of executives saying that
they’re not spending enough time on strategic priorities, time challenges are a concern. Time is money, time
is life. The specific feature of time is that once gone, it cannot be reclaimed. Therefore management of time is
a very crucial art which everyone ought to learn.
This program shall enable you to understand the basics of time and stress management related issues and
how to overcome them.
Who should attend: Those who aspire to progress and succeed by improving their effectiveness in their
professional lives should attend this program.
Program Includes:
1. Managing Stress (12 November; 19—20 hours)
2. Stress Management through hobbies (19 November; 19—20 hours)
3. Time management (26 November; 19—20 hours)
Faculty: Prof Suresh Mashruvala
Fees: Fee includes program fee and course material. A token fee of Rs 80/- is to be paid for Lectures on 12th
& 26th November. Participants attending all the three lectures shall pay a total fee of Rs.100/- A certificate
of participation shall be given at the end of the last lecture to the participants attending all the three
lectures.
