6. What’s the legislation and how does it effect you?
False self-employment
Who carry’s the Risk? Unfortunately the agency does for all Tax and NIC’s
should it be proven that the workers are under Supervision, Direction & Control.
As with any legislation the devil is in the detail –therefore contractual and status
compliance is key.
HMRC reporting requirements
Are you ready? Is your umbrella provider ready?
Another government initiative to help crack down on false self employment tax
avoidance with a target to recoup an estimated £1.9 billion per annum –allows
transparency of parties in the supply chain. HMRC can see which Umbrella
trades with which agency for which contractor.

What effect could this have on agencies and what other options have you
considered? Restrictions on expenses allowable is expected and the use of
overarching contracts reviewed. –Should this force contractors away from the
umbrella product we have a self employment product that is insurance backed
and exempts the Agency of employers NI liability.

the agency could be responsible for employers NIC and tax.
