WHAT IS CANVASSING?

CANVASSING PRINCIPLES
Canvassing procedure is
administrative and summary in
nature.
ERs are accepted as valid and
shall automatically be included
in the canvass unless there is
convincing proof of tampering,
alteration or falsification.

CANVASSING PRINCIPLES
BBOCs are legally created
bodies, which canvass all
votes on ERs submitted to it
by the respective BETs.
BBOCs power is limited to
adding the vote tallies from
the ERs and declaring the
winners of the election.

BOARD OF CANVASSERS
One (1) BBOC in each barangay to canvass
the ERs for the Barangay Election and
thereafter proclaim the winning candidates.
EO shall constitute BBOC to be composed of a
Chairman, Vice-Chairman and Member-secretary, who
shall be chosen among the different Chairmen of the BETs
In a barangay with only 1 BET, said BET shall convert itself
as the BBOC.

SUPERVISION AND CONTROL
COMELEC has direct supervision
and control over the BBOC.
BBOC member may, at any time,
be relieved for cause and
substituted motu proprio by
COMELEC.

RELATIONSHIP WITH CANDIDATES AND
OTHER MEMBERS
BBOC members shall not be
related within the fourth civil
degree of consanguinity or
affinity to any:
barangay candidates or
any member of the same
BBOC.

PROHIBITION AGAINST LEAVING
OFFICIAL STATION
Beginning October 28, 2013 until
proclamation, BBOC member shall not be:
transferred;
assigned or
detailed outside of his official station,
allowed to leave his official station
without prior authority from COMELEC.

FEIGNED ILLNESS
BBOC member feigning illness in order to
be substituted shall be guilty of an
election offense punishable with 1 to 6
years imprisonment and perpetual
disqualification to hold public office and
to exercise the right to vote.

NOTICE OF MEETING OF THE BARANGAY
BOARD OF CANVASSERS
At least five (5) days
before the meeting of the
BBOC, Chairman shall:
give Notice of Meeting
to all members stating
the date, time and place
of the meeting.

BBOC VOTE REQUIRED
A majority vote of all the
members of the BBOC shall
be necessary to render a
decision.

PRELIMINARIES TO CANVASSING
BBOC for barangays with more than 1 BET shall meet
at 6:00 pm on October 28, 2013 in the voting center
of the barangay and shall forthwith canvass the ERs of
the precincts within the barangay.
Canvassing shall be held in the voting center most
accessible as determined by EO.
EO shall make corresponding report which voting
center was used as canvassing venue to his PES, who
shall likewise report the same to the RED.

CANVASSING PROCEDURE
STEP 1: The Secretary shall:
receive the envelope containing
the ERs
record in the Minutes of Canvass
Condition and Serial Number of the envelope
Condition and Serial Number of the paper
seal
Corresponding precinct number/s
comprising the cluster.

STEP 2: The Chairman shall:
exhibit the envelope to those present
open the envelope and retrieve the ERs
canvass all the ERs in accordance with
the following procedures

Chairman shall:
examine the condition of the inner paper seal of ERs,
while Secretary records in the Minutes the condition
and SN of paper seal
break inner seal, unfold ERs and exhibit it ,while
secretary records in the Minutes the condition and SN
of ERs
proceed to canvass by reading votes of the candidate
and entering the same in the Statement of Votes
(SOVs), if there is no objection

ACCOMPLISHING SOV
BBOC shall:
divide the 3 copies between the Vice-
chairman (2 copies) and secretary (1) copy
fill up the statistical data portion
accomplish SOVs simultaneously as
Chairman reads the votes.

STEP 3: If there is objection
to the ERs, Secretary shall
note the objection in the
Minutes, and the Chairman
shall proceed to canvass the
ERs

STEP 4: After the ER has been
canvassed, Chairman shall:
write on the upper right hand
corner the word “CANVASSED”.
affix below it his signature and date
of canvassed
return canvassed ER to its
envelope.

STEP 5: When all ERs have been canvassed, Vice-
Chairman and Secretary shall:
compare the entries in their respective copies of SOV
refer to ERs in case of discrepancy
initial all corrections together with all members of the
BBOC.
If there are no discrepancies, the members of the BBOC
shall affix their signatures above their printed names and
imprint their thumbmarks on the certification portion of the
SOVs.

BBOC shall prepare the Certification of Canvass
and Proclamation and proclaim the winning
candidates, after all SOVs have been completed
In barangays with only one (1) clustered precinct, the
BBOC shall immediately accomplish in triplicate the SOVs
and COCP and proclaim the winning candidates.

MATERIAL DEFECTS IN THE ELECTION
RETURNS
There are material defects in the ERs when:
Requisites in form or data have been omitted such as name of
candidate and/or his corresponding votes
BBOCs shall:
call all members of the BET by most expeditious means
direct BETs to affect the correction
require BET to complete necessary data regarding name of
candidate and or his corresponding votes and affix their initials on
the corrections
COMELEC shall order the BET to open the ballot box and count the
votes for candidates whose votes have been omitted, with notice to
other candidates, if votes in the ERs cannot be ascertained

DELAYED, LOST OR DESTROYED ERs
BBOC by messenger or other means,
obtain such missing ERs from:
BET, or
Upon prior authority, if copy has
been lost or destroyed, the BBOC
may use any authentic copies of
ERs and then direct its
representative to investigate the
case and immediately report the
matter to the Commission.

DELAYED, LOST OR DESTROYED ERs
Even if the BBOC has not
received all ERs , it may on the
basis of available ERs:
1. Terminate the canvass
2. Proclaim the candidates
election
Provided that the missing
election returns will no longer
affect the results of the elections.

FALSIFIED OR TAMPERED ERs

When the Election Returns appear to be :
tampered
altered
falsified
not authentic
prepared by persons other than BET
prepared by BET under duress, force, intimidation
BBOC shall
seek prior authority from COMELEC and
use another copy of ERs and, if necessary, the copy
inside the ballot box.

DISCREPANCIES IN ERs
If discrepancies in the votes of any candidate affect
the results of the elections, the COMELEC, upon motion
of the BBOC or any candidate affected and after due
notice to candidates shall:
proceed summarily to determine whether the integrity of the
ballot box had been preserved
order opening of the ballot box to recount the votes cast to
determine the true results.
disallow the recount of the ballots, seal the ballot box and order
its safe keeping if there are signs of replacement. tampering, or
violation of the integrity of the ballots.

WHAT IS MANIFEST ERROR

HOW TO CORRECT MANIFEST ERROR
If discovered before proclamation, BBOC shall:
promulgate an order in writing for the
correction
effect the necessary correction in the
SOVs/COCP by crossing out the erroneous
figures/entries with their initials
enter the correct figures/ entries
record in the Minutes the matter or fact of
correction

APPEAL ON MANIFEST ERROR
CORRECTION
Candidate aggrieved by the BBOC order may appeal to the
COMELEC within 24 hours from promulgation.
Once an appeal is made, the BBOC shall not proclaim the
winning candidate(s) unless the votes are not affected by
the appeal.
If discovered after proclamation, BBOC or any
aggrieved party shall file with the COMELEC an appeal
seeking correction when manifest errors are discovered.

QUESTIONS AFFECTING ERs
All questions affecting ERs shall be:
raised during the canvass
decided immediately by the majority vote of all BBOC
members
BBOC decision shall be in writing and form part of
the Minutes of the proceedings, and shall be final
and immediately executory.
After all questions on ERs have been resolved, BBOC shall
proclaim the winning candidates, without prejudice to the
right of an aggrieved party to file an election protest.

ELECTIONS RESULTING IN A TIE
In case of a tie for Punong Barangay or first or last
place for Sangguniang Barangay Kagawad, BBOC
shall:
record this fact/information in the Minutes.
by resolution, and upon 5 days notice to
candidates concerned, hold a special public
meeting for the purpose of drawing of lots
between the candidates with tie votes
proclaim as elected the candidate(s) who
win in the drawing of the lots

Other candidates who lost in the draw for
the first place, shall automatically be the
second placer.
If more than 2 candidates tied for first
place, rolled pieces of paper duly marked by
the numbers “1”, “2”, “3”, and so on shall
be made and candidates draws any one
thereof, one after the other, and thereafter
publicly open the same.
Number of the rolled paper drawn by each
shall decide their ranking.

If the tie is for the position of Punong Barangay
or for the 7th place for Kagawad, the one
favored by luck shall be proclaimed the winner.
BBOC issues a certificate stating the name of
the candidate who had been favored by luck
and his proclamation is based thereon.
The losing candidate in the drawing of lot is not
deprived of his right to contest the election.

CERTIFICATE OF CANVASS AND
PROCLAMATION (COCP)
BBOC shall PREPARE the following:
Certificate of Canvass and Proclamation (COCP) duly
signed and thumbmarked by each member (4
copies).
Statement of Votes is (SOVs) received by each
candidate.
On the basis of the above documents, PROCLAIM the
elected Punong Barangay and 7 Kagawads who obtain the
highest number of votes.
Subject to reasonable exceptions, the BBOC shall complete the
canvass within twenty-four (24) hours from the time first ER is
canvassed.

DISTRIBUTION OF COCP
Original copy – EO
Second Copy – Winning candidate
for Chairman of the barangay
Third Copy – Secretary of the
Sangguniang Bayan or Panlungsod,
as the case may be; and
Fourth Copy – Secretary of
Sangguniang Barangay.

Winning candidate for Punong
Barangay shall reproduce the copies of
the COCP and distribute the same to
each of the winning Kagawads.

EO submits on or before November
13, 2013, to the ERSD, COMELEC,
Manila, a certified list of the votes
obtained by each candidate ranked
from highest to lowest for the
Barangay Election in each barangay.

PROCLAMATION OF RESULTS
BBOC proclaims as elected the candidates for
Punong Barangay and 7 Kagawads who obtained
the highest number of votes.
Attach a copy of SOVs to each copy of the COCP
except for copy of the winning candidates.

SAFEKEEPING OF CANVASSED ERS
After canvass, BBOC shall:
Return ERs in their envelopes
Close and seal the same with paper seal
Record paper seal number in the Minutes
of Canvass
Affix their signatures on the paper seal
Deliver the ERs to the Treasurer

DUTY OF TREASURER
City or Municipal Treasurer shall:
Place the ERs in the ballot box in
the presence of EO
Padlock the ballot box but EO keeps
the key thereto.
Lock with self-locking seal
Report the number of the self-
locking seal to EO and ERSD.
Place the ballot box in a safe and
secure room.

DETAINEE VOTING

DETAINEE VOTING
Who may be avail?
Registered as voters prior to their detention
Registered while in detention through
detainee satellite registration, by virtue of
COMELEC Resolution NO. 9371 and No.
8811 as amended by NO. 8859

SPECIAL POLLING PLACES INSIDE JAILS
DSPPs shall be established in detention
center/jail facility with registered detainee voters
in the following manner:

Detainee voters shall be grouped/listed by district in cities
with several districts
Only those who are in the custody of detention centers/jail
facilities as of August 16, 2013 shall be included in the EDCVL-
DV and PCVL-DV. The BJMP shall submit to the Committee on
Detainee Voting the list of released detainees.
Detainee voters included in the EDCVL-DV but released
before the elections shall be allowed to vote in the regular
polling place where is registered. For this purpose, the SBET
shall manually cross-out name of the released detainee in the
EDCVL-DV.
PREPARATION OF EDCVL-DV and PCVL-DV

The DSPP should be established in an area
inside the jail spacious enough to accommodate
more than ten (10) voters at a given time.
LOCATION OF THE DETAINEE SPECIAL POLLING
PLACE

The EDCVL-DV and PCVL-DV shall be
prepared by the ITD containing the names
of all registered detainee voters who are
voting through the DSPPs.
PREPARATION OF THE EDCVL-DV and PCVL-DV

Only detainee voters whose names
appear in the EDCVL-DV and/ or PCVL-DV
may vote in the DSPPs.
WHO MAY BE ALLOWED TO VOTE IN THE
DETAINEE SPECIAL POLLING PLACES

members of the SBET
watchers who shall stay only in the space reserved for them;
monitoring groups (maximum of 2 per DSPP) who shall stay in
the space for watchers;
representative of the Commission on Human Rights;
representative of the Comelec
detainee voters accomplishing their ballots;
detainee voters waiting for their turn to accomplished their
ballots;
at least three BJMP personnel who shall stay also in the space
for watchers; and
other persons who may maybe specifically authorized by the
Commission.

AFP or PNP officer or member
any peace officer or any armed person belonging to any extra-
legal police agency, special forces, reaction forces, strikes forces,
Civilian Armed Forces Geographical Units, barangay tanod or
other similar forces or paramilitary forces, except the BJMP
personnel escorting the detainee voters

and Third Member who shall have the same

Conduct only the voting in the DSPPs
Seal and sign (per precinct) the envelopes
containing the used/accomplished ballots,
unused ballots and Minutes intended for
the ballot box and submit the same to the
respective BETs for counting before the
close of voting hours on election day
POWERS AND FUNCTION OF THE SBET

Members of the SBET may on election day
vote in the polling places where they are
registered, provided that their absence in the
DSPP shall not be more than twenty (20) minutes
and that they schedule their voting so that only
one member of the SBET shall leave at any one
time.

the BET watchers .
QUALIFICATIONS OF WATCHERS/RIGHTS AND
DUTIES OF WATCHERS

The following shall be allowed
access to DSPPs, and must follow
all the security measures enforced
and guidelines established:
monitoring groups accredited by
the Commission
accredited media
representatives
foreign observers
MONITORING GROUPS, OBSERVERS AND
MEDIA REPRESENTATIVES

Watchers, members of the SBET, Commission
on Human Rights (CHR) representatives,
accredited monitoring groups, accredited
citizens’ arms and COMELEC representatives
shall be allowed to bring:
cameras, cellular phones and laptops in the
DSPPs provided that these devices are to be used
exclusively for official documentation and
communication purposes and that secrecy of the
ballots shall be respected.
DOCUMENTATION AND COMMUNICATION DEVICES
ALLOWED IN SPECIAL POLLING PLACES

SBET shall get the necessary forms
documents and supply early in the morning on
election day from the City/ Municipal Treasurer
Early delivery of forms maybe allowed
upon approval of the Regional Election Director
in case NCR, and the PES in case of the
provinces.

FORMS TO BE REPRODUCED WHEN
NEEDED

Voting for all qualified detainee voters shall
take place on October 28,2013 (Monday)
Voting time - seven o’clock in the morning
until twelve o’clock in the afternoon
If the casting of votes is finished earlier than
twelve o’ clock in the afternoon, the SBETs
shall accordingly close the voting.
DATE AND TIME OF DETAINEE VOTING

SBET shall:
ensure that the DSPP is ready for voting in accordance
with the Lay-out of the polling place; and
post the EDCVL-DV near or at the door of the DSPP.
Chairman shall:
open the sealed envelope and count the number of
ballots in the presence of the other members and
watchers, if any
Poll Clerk shall:
enter in the Minutes their time of arrival, name of voting
center/s, the number of ballots and SNs of the paper
seal of the envelope received.
PRELIMINARIES TO THE VOTING

The spoiled ballots shall be placed
inside the envelope for spoiled ballots
seal and submit to the proper BET.
SPOILED BALLOTS IN DETAINEE VOTING

In the absence of any authentic identification
documents, Any member of the SBET or any
registered voter of the precinct/clustered
precinct may identify under oath the detainee
voter, and such fact shall be recorded in the
Minutes.
Only the Chairman of the SBET shall issue,
and not more than 1 ballot shall be issued at
one time.
MANNER OF OBTAINING BALLOTS

Any detainee voter or watcher may
challenge any person offering to vote in
accordance with the General
Instructions.
CHALLENGE AGAINST ILLEGAL VOTERS/CHALLENGE
BASED ON CERTAIN ILLEGAL ACTS.

PREPARATION OF BALLOTS FOR DETAINEE
VOTERS WHO ARE ILLITERATE OR PWD

After all the detainee voters in a particular clustered
precinct have already voted -
The Chairman shall:
count the unused ballots and record through the poll clerks
in the Minutes the quantity of unused ballot
tear the unused ballots
place them in their proper envelopes (A15)
seal and affix his signature together with other members of
the SBET
count the total number of used/ accomplished ballots
seal and affix his signature with other members of the SBET
SEALING OF THE ENVELOPES PER CLUSTERED
PRECINCT

The Poll Clerk shall:
Record in the minute, the SN of the paper seal of
the envelope containing accomplished/used ballots,
unused ballot and Minutes intended for the ballot
box and such other necessary information
The Chairman, Poll Clerk, Third member and escort shall
proceed immediately to the voting center where the
clustered precinct of the detainee is located and turn-
over the sealed envelopes to the proper BET.
SEALING OF THE ENVELOPES PER CLUSTERED
PRECINCT

After the submission/delivery of the
envelopes to the BET, SBET shall
deliver to the EO, the following:
EDCVL-DV
PCVL-DV
Sealed envelope (A15)
containing half torn/unused
ballots
Minutes intended for the
Commission
Other election paraphernalia
DISPOSITION OF ELECTION DOCUMENTS

The following shall avail of escorted
voting:
detainee voters who are
residents/registered voters of
municipalities/cities other than the
town/cities of detention.
detainee voters in detention
centers/jail where no DSPPs are
established.
Provided that said detainee voters obtain
court orders allowing them to vote in the
clustered precinct where they are registered
with the corresponding security escorts
ESCORTED DETAINEE VOTER

Detainee voters voting in their
respective clustered precincts shall be
given priority to vote. The escort shall
inform the BET that the voter is a detainee,
and shall be given priority to vote in the
express lane.
EXPRESS LANE FOR ESCORTED MAY BEAR
ARMS

To secure the detainee voters, the
escorts may bring firearms inside the
polling places. Said escorts and
detainee voters shall immediately
leave the polling place once latter
have finished voting.
JAIL/PRISON ESCORTS MAY BEAR ARMS

CONTINGENCY

Late arrival of official ballots, accountable
election forms and other election material
Shortage, non-availability or missing pages of
accountable and non-accountable election
forms and supplies
PROBLEMS THAT MAY BE ENCOUNTERED

Discrepancies in the serial number of ballots;
ballots bearing the same SN
the upper and lower SNs are different
either the upper or lower SN or both are missing
the SN is unreadable or hard to ascertain
the SN does not belong to the series
PROBLEMS THAT MAY BE ENCOUNTERED
In case the foregoing problems are encountered,
the REDs, AREDs, PESs, EOs, City/Municipal
Treasurers, BETs/SBETs, and BBOC shall institute the
appropriate contingency measure.

LATE ARRIVAL OF OFFICIAL BALLOTS, ACCOUNTABLE ELECTION
FORMS AND OTHER ELECTION PARAPHERNALIA
EO Treasurer and BET/SBET, shall jointly asses based on
the information from the Administrative Services Department
(ASD)/ Packing and Shipping Committee (PSC), the time of
arrival of ballots, accountable forms and other supplies at the
polling place
If ballots will arrive before twelve o’ clock in the afternoon of
October 28, 2013, voting shall immediately start and continue
up to five o’ clock in the afternoon.
CONTINGENCY MEASURES

If after five o’ clock in the afternoon, there are still
voters present who have not yet cast their votes, Sec.
23 of the GI shall apply;
If ballots, accountable forms and other supplies will
arrived after twelve o’ clock in the afternoon of
October 28, 2013, elections shall be reset to the
following day, October 29, 2013, or if it is not feasible,
on the next day, October 30, 2013.
EO shall announce and post notice on the date of the
resetting of elections in the clustered precinct/s
affected. Not later than six o’ clock in the evening of
election day.

EO shall report to the PES which clustered precinct/s
under his jurisdiction have extended/reschedules its
elections due to late arrival of ballots, accountable
election forms and other election material.
PES shall likewise report the same to the RED, who
shall consolidate and submit (by fax or e-mail) to the
Project Management Office (PMO) through the
ODEDO, the soonest possible time.
RED of NCR shall report directly to the PMO through
ODEDO.

Official Ballots
Shortage or non- availability of ballots - EO shall
report, by fastest means available, shortage or non-
availability of ballots to the Allocation Committee.
Before election day – Allocation Committee shall
determine the necessity of printing ballots. If
necessary, the Allocation Committee is
authorized to determine the quantity
requirements for printing. If printing is not
necessary, it is authorized to instruct the
Treasurer and the EO on the matter of re -
allocating the ballots.
SHORTAGE, NON-AVAILABILITY OR MISSING PAGES OF
ACCOUNTABLE AND NON-ACCOUNTABLE
ELECTION FORMS AND SUPPLIES

Official Ballots
On election day – the provision of Section 182 (Emergency
Ballots) of the BP Blg. 881 shall apply on the shortage or non-
availability of ballots on election day.
ELECTION RETURNS/TALLY BOARDS
Shortage or non-availability of ERs/Tally Boards – if either the
ERs/Tally Board are not received or not available:
EO shall report such fact to the COMELEC through the
Allocation Committee.

ELECTION RETURNS/TALLY BOARDS
BET/SBET shall:
improvise ERs/Tally Boards and proceed with the counting
of votes
after the counting, sign the improvised ERs/Tally Boards
and imprint their thumbmarks
distribute copies of the improvised ERs/Tally Boards in
accordance with Section 50 of the GI
enter in the Minutes that the ERs/ Tally Boards are not
available and that the BET together with the watchers

EO shall report it to COMELEC through the Allocation

sign the improvised SOVP and imprint their thumbmarks

enter in Minutes that SOVP is not available and that BBOC
together with watchers decided to use improvised SOVP
place all forms used inside the corresponding envelopes
and deposit inside ballot box
ACCOUNTABLE AND NON-ACCOUNTABLE ELECTION FORMS
AND SUPPLIES

Missing pages/copies of the Statement of Votes by
Precinct
BBOC shall take measures to reproduce/photocopy the
SOVPs. All such photocopies shall be certified by the BBOC.
Metro Manila Area – lacking or missing pages of all accountable
forms shall be replaced whenever possible
Outside Metro Manila – non – accountable forms and supplies may
be reproduced/photocopied upon prior approval of EO.

AUTHORITY OF ELECTION COMMITTEES

cause printing of required ballots/ERs
Packing and Shipping Committee
immediately pack and ship lacking ballots/ ERs through
the fastest means possible and ensure that they arrive at
and receive by the intended recipients on or before election
day

Official ballots bearing the same serial numbers
City/Municipal Treasurer:
issue the subject ballots to the BET/SBET
take note of its condition in the inventory report
Chairman of the BET/SBET:
prior to issuance of subject ballots to the registered
voter, shall add one Arabic numeral after the last digit of the
SN, starting with number 1, then 2, and so on, and affix his
initial. In so doing, the ballots will now have different SNs.
record opposite the name of the voters in the
EDCVL/EDCVL – DV, the new SNs
OFFICIAL BALLOTS WITH PROBLEMS ON SERIAL NUMBERS

Upper and lower serial numbers of the official ballot are
different
Poll Clerk:
enter in the Minutes the different SNs appearing in the
ballot, indicating therein whether it is located in the upper or
lower portion
record opposite the name of the voter in the
EDCVL/EDCVL-DV, the two (2) different SNs.
Chairman of BET/SBET:
issue the ballot to the voter

Either the upper or lower serial number of the official ballot
is missing
Poll Clerk:
take note in the Minutes the missing SN in the ballot
either in the upper or lower portion, indicating whether it is
located in the upper or lower portion
EDCVL/EDCVL-DV the available SNs.
Chairman of the BET/SBET :
copy the available SN in the portion of the ballot where it
does not appear and affix his/her signature

Both the upper and lower serial numbers of the official
ballot are missing
Poll Clerk:
record the fact in the Minutes
mark the ballots as “defective ballot”
place the same inside the envelope intended for spoiled
ballots

Serial number of the official ballot is unreadable or hard to
ascertain
Poll Clerk:
check the SN of the ballot preceding the ballot with
blurred SN and follow the sequence of the SNs
enter in the Minutes the ascertained SN
EDCVL/EDCVL-DV
issue the ballot to the voter.

series
Poll Clerk:
note in the Minutes the SN of the ballot that does not
belong to the series
record the same opposite the name of the voter in the
EDCVL/EDCVL-DV
