HISTORY OF BARANGAY ELECTIONS
Barangay is derived from the Malay
“balangay,” a boat which transported
them (the Malays) to Philippine shores.
As a unit of government, the barangay
antedated the Spanish conquest of the
Philippines.
The Dato headed the barangays and
exercised absolute powers of
government.
Pre-Spanish Era

Spaniards kept the barangay as the basic
structure of government
Stripped the dato or rajah of his powers
Power was centralized nationally in the
governor- general
 Locally in the encomiendero and
later, in the alcalde mayor and the
gobernadorcillo.
Spanish Era

The dato or rajah was renamed cabeza
de barangay, who was elected by the
local citizens possessing property.
The position degenerated from a title of
honor to that of a “mere government
employee”.
Only the poor who needed a salary, no
matter how low, accepted the post.
Spanish Era

Barangays became known as “barrio.”
For some time, the laws governing barrio
governments were found in the Revised
Administrative Code of 1916 and later in the Revised
Administrative Code of 1917.
Barrios were granted autonomy by the original
Barrio Charter, RA 2370, and formally recognized as
quasi-municipal corporations by the Revised Barrio
Charter, RA 3590.
American Era

Barrios were “declared” or renamed “barangays”
-- a reversion to their pre-Spanish names -- by
PD. No. 86 and PD No. 557.
Their basic organization and functions under RA
3590, was expressly “adopted as the Barangay
Charter,” were retained.
Titles of the officials were changed to “barangay
captain,” “barangay councilman,” “barangay
secretary” and “barangay treasurer.

Before assuming office, BET shall
take and sign an oath in the form
(CEF No. 5A) prescribed by
COMELEC before:
1. Officer authorized to administer
oath
2. Other member of BET
Copies of the oath shall be
submitted to the Election Officer.

ENFORCING OBEDIENCE TO LAWFUL ORDERS
BET may issue an order in writing
directing a peace officer to take
into custody a person, until the
adjournment of the meeting,
who:
 disobeys lawful orders;
 Conducts himself in a disorderly
manner in the presence or within
its hearing & thereby interrupts or
disturbs its proceedings

ENFORCING OBEDIENCE TO LAWFUL ORDERS
In the absence of any peace
officer, such order may be
executed by any other competent
and able person deputized by the
BET, in writing.
A copy of such written order shall
be attached to the Minutes of
Voting and Counting of Votes
(Minutes)

RELIEF AND SUBSTITUTION OF BET
BET shall not be relieved unless disqualified
by law and inhibit himself by submitting an
affidavit to EO.
Within 3 days after constitution and
appointment, EO shall
1. Post a list of BET members in his
office and at the city or municipal hall
2. Verify whether BET members are
related to the candidates where they
are assigned
3. Inform the disqualified BET member

FILING OPPOSITION
Interested party may file an opposition
before the EO not later than September
28, 2010 on the appointment of BET
member on the ground of relationship.
Within 48 hours upon receipt,
opposition must be resolved by EO.
If resolved for disqualification, EO
appoints a qualified substitute

VACANCY IN BET
Member or members present shall
appoint a non-partisan registered voter
of the precinct to fill the vacancy until
the absent member appears.

ARREST OF ABSENT MEMBER
BET may order the arrest of a
member who has absented
himself with the intention of
obstructing the performance
of duties.

NO PARTISAN POLITICAL ACTIVITY
Member of BET shall
not engage in partisan
political activity or take
part in the election,
except to:
1. discharge his duties
2. vote

PROCEEDING OF BET
Meeting must be in:
1. Public
2. Assigned Polling place
BET shall decide by majority
vote and act thru the
Chairman.

VOTING PRIVILEGE OF BET
BET members may vote in the polling
place where they are assigned provided
that:
1. They are registered voters of the
barangay where their polling
place is located.
2. Their voting must be duly
recorded in the minutes.
3. Their names and precinct number
duly indicated in Part C of EDCVL.

VOTING PRIVILEGE OF BET
BET who is not registered voter in the
barangay where he is assigned may
vote in his precinct provided that:
1. Voting in his place of assignment
is light
2. His absence is not more than 20
minutes

WHO ARE ENTITLED TO WATCHERS
Candidates may appoint 2
watchers to serve alternately in
every polling place or canvassing
center.
Accredited citizens arms of

BET shall perform the following:
1. Accomplish the Minutes in 2 copies

2. Enter in the Minutes all data and
acts required.
3. Sign and Seal in separate envelopes
(CEF Nos. 18 and 18A) for distribution to:
EO -> RSD, ERSD
Copy for ballot box deposited inside
the ballot box

WHO ARE ALLOWED TO VOTE
Registered voters of the precinct
whose:
1. Registration records are
contained in the book of
voters (for SK voters)
2. Names appear in EDCVL unless
marked as double/multiple
registrants
3. BET members entitled to avail
of voting privilege

VOTING HOURS
7:00 am until 3:00 pm
If at 3:00 pm there are still
voters within 30 meters in front
of the polling place who have
not voted, voting shall continue
to allow said voters to cast their
votes

DUTY OF POLL CLERK
Poll clerk shall:
1. List the names of voters
consecutively numbered
2. Call the voters by announcing
each name 3 times in the order
in which they are listed
3. Disallow a listed voter to cast
vote if not around when called
4. Submit the list to the EO

PLACE OF VOTING
Voters shall cast their votes
in the polling place
designated by the COMELEC.

PRELIMINARIES TO VOTING
BET shall meet at the polling place at
6:00 am on October 28, 2013 and do
the following:
1. See to it that it has all election
forms and supplies needed.
2. Post one (1) copy of PCVL for
barangay voters and SK voters,
for BETs handling both barangay
and SK precincts;

PRELIMINARIES TO VOTING
3. Post the poster indicating the precinct number
and location of the polling place (CE Form No.
3) near or at the door of the polling place.
4. Set-up or arrange the polling place in
accordance with, whenever practicable, the
Lay-out of Polling Place provided in ANNEX
“E” hereof;
5. Staple or paste the Certified List of Candidates
for the Barangay & SK positions in the ballot
secrecy folders or desks/chairs; and
6. Place the ballot secrecy folders on top of the
desks/chairs/tables.

DUTY OF CHAIRMAN
Before the start of voting, the
Chairman shall:
1. Open the ballot box
2. Empty both of its compartments
3. Exhibit them to all those present
4. Lock its interior cover with 1
padlock
5. Retain 1 key to a padlock during
the voting

DUTY OF CHAIRMAN
6. Show to the public and watchers,
the package of official ballots and
the SK book of voters, duly
sealed
7. Break the seals
8. Enter in the minutes, the number of
pads and the serial numbers of ballots
in its pad, and the fact that the package
of ballots and SK book of voters were
shown to the public with seals intact

CONDITION OF THE BALLOT BOX
Interior cover of ballot box shall
remain locked until the voting is
finished and counting begins.
To make room for more ballots, the
Chairman, in the presence of
members and watchers, open the
box, press down with his hands the
ballots contained therein without
removing them, after which BET
shall close the same and lock it.

RULES TO BE OBSERVED
DURING THE VOTING
1. Voters shall vote in the order of
their arrival in the polling place.
2. No watcher shall enter the places
reserved for voters and the BET,
nor mingle and talk with them.
3. No person shall enter the polling
place carrying any firearm or any
other deadly weapon, except
those authorized by Comelec.

RULES TO BE OBSERVED
DURING THE VOTING
5. No crowding of voter of voters
and disorderly behavior inside
the polling place.
6. The interior cover of the ballot
box remains locked until the
voting is finished and the
counting begins.

PROHIBITION ON VOTING
It shall be unlawful to:
1. Bring the ballot or secrecy folder
outside the polling place
2. Speak with anyone while inside the
polling place
3. Prepare his ballot not using the secrecy
folder or exhibit its contents, except in
case of assistor to the assisted voter
4. Erase any printing from the ballot or
place any distinguishing mark

PROHIBITION ON VOTING
It shall be unlawful to:
5. Use carbon paper, paraffin paper or
other means of making a copy of the
contents of the ballot, or otherwise
make use of any other scheme to
identify his vote, including the use of
digital cameras, cellular phones with
camera or similar gadgets.
6. Intentionally tear or deface the ballot.
7. Disrupt or attempt to disrupt the
proceedings of the BET.

AUTHENTICATION OF BALLOT
Chairman must authenticate
the ballot by affixing his
signature at the back thereof
before giving the ballot to the
voter.
Failure to authenticate a
ballot is an election offense.
In no case the Chairman pre-
sign at the back of the ballot.

ORDER OF VOTING
Voters shall cast their votes
in the order of their arrival.
They shall not crowd around
the table of the BET and
shall depart immediately
after voting.

MANNER OF OBTAINING BALLOTS
STEP 1:
Voter approaches the
Chairman and inform the
latter whether he is voting for
barangay or SK elections.
Voter gives his name and
address and other data
concerning his person.

Chairman shall ensure that the
voter before him is the same
person he professes to be.
If BET doubts voter identity, he
is required to present proofs of
identifications.

STEP 2:
If BET is satisfied with voter’s
identity, Chairman announces
his name in a tone loud
enough to be heard in the
polling place.

STEP 3:
Voter shall be given the ballot provided
that:
1. He has not been challenged; or
2. Having been challenged, the
question has been decided in
his favor.
Not more than 1 ballot shall be given at
any one time.

STEP 4:
Before giving the ballot to the voter,
the Chairman shall:
1. Check if the fingernails are
stained with indelible ink
2. If stained, no ballot shall be
issued to him
3. Record such fact in the
Minutes

STEP 5:
If not stained, the Chairman shall:
1. Announce the serial number of ballot
2. Enter the same in the space
provided for
3. Authenticate the ballot
4. Fold the ballot
5. Give it to the voter
6. Voter affixes signature and
thumbmark in EDCVL

MANNER OF VOTING
Voter shall fill up his ballot by
writing in the corresponding spaces
the names of the individual
candidates he is voting for, using the
ballot secrecy folder.

BALLOTS FOR ILLITERATE AND DISABLED
PERSONS
A voter may be allowed to vote as
illiterate or disable provided such fact is
indicated in his registration record.
Illiterate or disabled voter may be
assisted by the following:
1. Relative within 4th degree of
consanguinity or affinity
2. Person of confidence belonging
to the same household
3. Member of BET

PERSONS
No person may assist an illiterate or
disabled voter more than 3 times
except BET members.
Third member shall enter in the
Minutes the name of the persons
assisted by BET and after voting
indicate therein the total number of
times each BET members assisted an
illiterate or disabled voter.

PERSONS
Poll clerk shall verify whether the
illiterate or disabled voter has authorize
the assistor to prepare his ballot.
Assistor shall prepare the ballot in the
presence of the illiterate or disabled
voter.
Assistor binds himself to fill out the
ballot in accordance with the
instructions of illiterate or disabled
voter by affixing his signature in the
space in the Minutes.

ACCESSIBILITY OF POLLING PLACE TO
DISABLED VOTERS
EO shall coordinate with proper
school or building officials
regarding the establishment of
precincts for illiterate or disabled
voters, which must be located in
the ground floor.

SPOILED BALLOTS
If a voter accidentally spoils or defaces
a ballot that it cannot be used, he shall
surrender it to the Chairman.
Chairman shall write the word
“SPOILED” in the space above the ballot
serial number recorded in the EDCVL.
Chairman shall give the voter a 2nd
ballot after announcing its serial
number and recording the same in the
EDCVL above the word “SPOILED.”

SPOILED BALLOTS
If 2nd ballot is spoiled and defaced, the
same shall be surrendered to the
Chairman.
No voter, shall change his ballot more
than once.
Spoiled ballot, without being unfolded
and removing the detachable coupon,
be marked with the word “SPOILED”
signed by the Chairman and placed in
the compartment for spoiled ballots.

PROCEDURE AFTER VOTING
1. After filling the ballot, the voter shall fold it
in the same manner as he received it.
2. Voter shall affix his thumb mark in the space
in the ballot and return the ballot to the
Chairman.
3. Chairman, without unfolding the ballot or
seeing its contents, verify its serial number
against the number previously entered in the
EDCVL.
If the serial number does not tally, the
ballot shall be considered “SPOILED” and
indicated in Part C of the Minutes.

4. If the serial number is the same, voter shall
affix his thumb mark in the space in EDCVL.
5. Chairman shall apply indelible ink at the base
of the right forefinger. If voter refuses, his
ballot shall be rendered spoiled.
If voter refuses after being informed, the
Chairman shall mark the ballot as spoiled,
sign and place it in the compartment for
spoiled ballots. Such fact must be recorded
in Part C of the Minutes.
6. Chairman shall sign in the proper space in
the EDCVL.

7. Chairman shall detach the ballot coupon and
deposit the folded ballot in the compartment
for valid ballots and the detached coupon in
the compartment for spoiled ballots.
Ballot returned to the Chairman, the
detachable coupon has been removed not in
the presence of BET members and votershall
be “spoiled”.
8. Voter shall then depart.

CHALLENGE AGAINST ILLEGAL VOTERS
A voter or watcher may challenge a
person offering to vote for:
1. Not being registered
2. Using the name of another
3. Suffering from existing
disqualifications
4. Being a double/multiple registrant

CHALLENGE AGAINST ILLEGAL VOTERS
In such case, BET shall check whether
the ground for challenge is true by
requiring proof of registration, identity
or qualification.
Voter is not required to present his ID
unless his identity is challenged.
Inability to present ID is not a ground
for not voting.

HOW TO IDENTIFY VOTERS
1. Established thru photograph or
specimen signature
2. Identified under oath by BET
member
3. Identified under oath by a
registered voter
NOTE: The one who will identify the voter
must also be a voter for barangay elections
or SK elections and recorded in the
Minutes.

CHALLENGE BASED ON ILLEGAL ACTS
1.Received or expect to receive or
promised to contribute money or
anything of value in consideration for
his vote or vote of another.
2.Made or received promise to
influence the giving or withholding of
vote.
3. Made bet or interested in bet which
depends upon the results of election.

REMEDY OF CHALLENGED VOTER
Challenged person shall take an
oath before BET that he has not
committed the acts alleged in the
challenge.
Upon taking oath, the challenge is
dismissed and voter is allowed to
vote.
If voter refuses, challenge is
sustained and voter not allowed
to vote.

RECORD OF CHALLENGES AND OATHS
Poll clerk shall record in Part E of
the Minutes all challenges, oaths
and decisions of BET.
Copies of challenges/oaths shall be

BET discovers after locking that some

CANVASSING
GUIDELINES for the
BARANGAY BOARDS
of CANVASSERS

WHAT IS CANVASSING?
Canvassing is the act of manually
counting and tabulating the election
results from ERs submitted by BET to
their respective Barangay Boards of
Canvassers (BBOC).

CANVASSING PRINCIPLES
Canvassing proceedure is
administrative and summary in
nature.
ERs are accepted as valid and
shall automatically be included
in the canvass unless there is
convincing proof of tampering,
alteration or falsification.

CANVASSING PRINCIPLES
BOC are legally created
bodies, which canvass all
votes on ERs submitted to it
by the respective BETs.
Powers limited to adding the
vote tallies from the ERs and
declaring the winners of the
election.

PRELIMINARIES TO CANVASSING
BBOC for barangays with more
than 1 BET shall meet at 6:00 pm
on October 25, 2010.
BBOC shall canvass the ERs of
the precincts within the barangay.
Canvassing shall be held in the
voting center most accessible as
determined by EO.

CANVASSING PROCEDURE
STEP 1: The Secretary shall:
1. Receive the envelope containing
the ERs
2. Record in the Minutes of Canvass
Condition and Serial Number of
the envelope

1. Vice-chairman and secretary

completed, BBOC announces

Barangays with only 1 BET
supervising 1 barangay precinct:
BET immediately proceeds to
canvass the ERs for Barangay
elections and proclaim the
winners.
Barangays with more than 1 BET:
BETs shall deliver to the BBOC,
the copy of ERs intended for
the board.

DELAYED, LOST OR DESTROYED ERs
BBOC by messenger or other means,
obtain such missing ERs from:
BET, or
If copy has been lost or destroyed,
BBOC may use authentic copies of
ERs and direct its representative
the case and report it to the
COMELEC provided there is prior
authority from the latter.

DELAYED, LOST OR DESTROYED ERs
Even if the BBOC has not
received all ERs , it may on the
basis of available ERs:
1. Terminate the canvass
2. Proclaim the candidates
election
Provided that the missing
election returns will no longer
affect the results of the elections.

MATERIAL DEFECTS IN ERs
BBOC shall calls for BET members to
effect the correction.
Omission of the names of candidates
and/or his votes, BBOC requires BET to
complete the date in the ERs and affix
therein their initials.
Omitted votes in ERs cannot be
ascertained except by recounting the
ballots, COMELEC orders BET to open the
ballot and count the votes with notice to
candidates.

FALSIFIED OR TAMPERED ERs
When the Election Returns
Appear to be tampered
Altered
Falsified
Not authentic
Prepared by persons other than BET
Prepared by BET under duress, force, intimidation
BBOC shall
Use other copies of ERs
Use copy of the ERs inside the ballot box

FALSIFIED OR TAMPERED ERs
If Other Copies, likewise:
Appear to be tampered with
Altered
Falsified
Not authentic
Prepared by persons other than BET members
Prepared by BET under duress, force, intimidation
The BBOC shall
Bring the matter before the Commission

DISCREPANCIES IN ERs
If It affects the results of the elections:
COMELEC proceeds summarily to
determine whether the integrity of the
ballot box has been preserved
provided that a motion has been filed
by BBOC or candidate affected with
due notice to all concerned.
When COMELEC is satisfied, with the
ballot box’s integrity, it shall order
recount of the votes cast to determine
its true results.

DISCREPANCIES IN ERs
If upon opening of the ballot box, it
should appear that there are:
1. Signs of replacement
2. Tampering
3. Violation of the integrity of the
ballots
COMELEC shall not recount the ballots
but seal the ballot and order its
safekeeping.

WHAT IS MANIFEST ERROR
A copy of the election returns
was tabulated more than once;
Two or more copies of the
election returns for one precinct
were tabulated;
There was a mistake in the
copying of the figures from the
election returns to the statement
of votes;

WHAT IS MANIFEST ERROR
Election returns from non-
existent precincts were included
in the canvass;
Election returns from precinct
of one barangay were included in
the canvass for another barangay;
There was a mistake in the
addition of the votes of any
candidate

HOW TO CORRECT MANIFEST ERROR
1. Order for correction must be in
writing and promulgated;
2. Aggrieved candidate may appeal
to the COMELEC within 24 hours
from promulgation;
3. Once appealed, BBOC will not
proclaim the winning candidate,
unless the votes are not affected
by the appeal;

HOW TO CORRECT MANIFEST ERROR
4. Appeal must implead the BBOC and
candidates affected as respondents
5. Upon receipt of appeal, the Clerk of
Court issues summons with a copy of
appeal of the respondent;
6. Clerk of Court immediately sets the
appeal for hearing;
7. Appeal shall be heard and
immediately decided by the COMELEC
en banc.

QUESTIONS AFFECTING ERs
Questions affecting ERs shall be raised
during the canvass and decided immediately
by a majority vote of all BBOC members.
Decision must be writing and form part of
the Minutes and shall be final and
executory.
After all questions on ERs have been
resolved, BBOC proceeds with the
proclamation of the winners, without
prejudice to the filing of election protest by
aggrieved parties.

ELECTIONS RESULTING IN A TIE
BBOC records such fact in its Minutes.
BBOC, by resolution, and upon 5 days
notice to candidates concerned, holds
a special public meeting .
BBOC proceeds to the drawing of lots
between the candidates who have tied
and proclaims as elected the
candidates who may be favored by
luck.

Other candidates who lost in the draw for
the first place, shall automatically be the
second placer.
If more than 2 candidates tied for first place,
rolled pieces of paper duly marked by the
numbers “1”, “2”, “3”, and so on shall be made
and candidates draws any one thereof, one
after the other, and thereafter publicly open
the same.
Number of the rolled paper drawn by each
shall decide their ranking.

If the tie is for the position of
punong barangay or SK chairman or
for the 7th place for kagawad, the
one favored by luck shall be
proclaimed the winner.
BBOC issues a certificate stating
the name of the candidate who had
been favored by luck and his
proclamation is based thereon.

CERTIFICATE OF CANVASS AND
PROCLAMATION (COCP)
Prepared by BBOC in 4 copies. Duly signed
and thumbmarked by all members. Supported
by SOV.
Proclaim as elected the following
Punong barangay
7 Kagawads
SK Chairman
7 SK Kagawads
BBOC shall complete the canvass within
twenty-four (24) hrs.

DISTRIBUTION OF COCP
1. Original copy – EO
2. Second Copy – Winning candidate
for Chairman of the barangay and SK
elections
3. Third Copy – Secretary of the
sangguniang bayan or panlungsod,
as the case may be; and
4. Fourth Copy – Secretary of
sangguniang barangay.

Winning candidate for punong
barangay or SK Chairman shall reproduce
the copies of the COCP and distribute the
same to each of the winning kagawads
kagawads.

EO submits on or before
November 10, 2010, to the ERSD,
COMELEC, Manila, a certified list of
the votes obtained by each candidate
ranked from highest to lowest for the
barangay and SK elections in each
barangay.

PROCLAMATION OF RESULTS
BBOC proclaims as elected the
candidates for SK chairman and 7
kagawads who obtained the highest
number of votes.
Copy of SOV attach to each copy
of the COCP.
BBOC proceeds to canvass the
ERs for barangay elections.

SAFEKEEPING OF CANVASSED ERS
After canvass, BBOC shall:
Return ERs in their envelopes
Close and seal the same with
paper seal
Record paper seal number in
the Minutes of Canvass
Affix their signatures on the
paper seal
Deliver the ERs to the
Treasurer

DUTY OF TREASURER
City or Municipal Treasurer shall:
Place the ERs in the ballot box
in the presence of EO
Padlock the ballot box but EO
keeps the key thereto.
Lock with self-locking seal
Report the number of the self-
locking seal to EO and ERSD.
Place the ballot box in a safe
and secure room.

Voters vote freely, without threats and intimidation
Voters vote freely, according to their conscience
Votes are neither bought nor sold
Votes are counted correctly and speedily
Candidates, their watchers and leaders obey the laws
COMELEC people do their work with utmost impartiality
COMELEC Deputies (PNP, AFP, Treasurers, Teachers) perform
their work with utmost impartiality
People are vigilant in watching and reporting violators of
election laws
Violators of election laws are seriously prosecuted without
favor
