Death Penalty In The 18th Century
When the first colonists came to the United States, they brought the British penal system with them. Laws concerning the death penalty varied from
colony to colony. In the Tenth Century A.D., hanging became the main method of execution in Britain. Death sentences were carried out by
crucifixion, drowning, beating to death, burning alive, and impalement. The first death penalty laws go back as far as the eighteenth century in Babylon.
As for the United States, the first documented execution was in the Jamestown colony of Virginia in 1608. Captain George Kendall was hanged for the
capital offense of treason. In 1632 Jane Champion became the first women to be executed.
The abolitionist movement had many European theorists such as Montesquieu, Voltaire and Bentham. The first attempted changes of the death penalty
in the U.S. happened when Thomas Jefferson introduced a bill to revise Virginia's death penalty laws. The bill suggested thatcapital punishment was to
be used only for the crimes of murder and treason. In the early 1800's, states started to reduce the crimes punishable by capital punishment and started
building jails and penitentiaries. Pennsylvania became the first state to move executions away from the public and ... Show more content on

Since the reinstatement of the death penalty in the United States in 1976, 138 innocent men and women have been released from death row, including
some who came within minutes of execution. Missouri, Texas and Virginia have opened investigations to determine if those states executed innocent
men. Sometimes people make mistakes and may realize this after it's too late. One of the most frequent causes of reversals in death penalty cases is
ineffective assistance of counsel. With inadequate defense as one of the main reasons requiring reversal, a study at Columbia University found that
68% of all death penalty cases were reversed on

Debate on the Death Penalty in America
On September 9, 1993 a seventeen year old boy, Christopher Simmons, and a few of his friends met up to discuss and devise a plan to commit a
robbery and possibly even a murder, just for the sake of fun. Simmons' plan was not complicated: find someone to burglarize, tie up the victim and
either leave the victim tied to a tree or push them off a bridge. Simmons and his accomplice climbed through a window and proceeded into the
bedroom of the victim, Mrs. Cook. The two teenagers tied the woman up and loaded her into the back of her own minivan. They drove to the state
park at the edge of town, where they had planned to dispose of the body and that is exactly what they did. The boys were caught later on that month
and put on trial for cold... Show more content on Helpwriting.net ...
The police were not protected from being a homicide victim even though capital punishment was on their side and supposedly protecting them. (Bailey,
Peterson) According to statistics gathered from the Federal Bureau of Investigation, the areas of the country that had a lower enforcement of capital
punishment were actually a place where the police officers were safer than in the regions where the capital punishment was heavily enforced. (Death
Penalty in Focus) For instance, the number of murders of an officer of the law in the southern states between the years of 1989 and 1998 was an
alarming two hundred and ninety–two total deaths. Averaging the number of murders over the ten year period, 29.2 police officers were killed each
year, and this was in a region where the death penalty was heavily enforced. (Death Penalty in Focus, Table 1.1) On the other side of the pole, the
states in the northeast region had as little as eighty murders in the same time span, with an average of eight murders per year. These statistics definitely
contradict that the death penalty acts as deterrence for an act of murder. If deterrence is what is supposed to validate capital punishment, but criminals
are not intimidated by it, then maybe it does not protect lives after all and it could be unconstitutional.

The death penalty will prevent future murders from striking again. The country to actually influence America into the death penalty was Britain.

Controversial Argument Essay: The Death Penalty Debate
The death penalty is one of the most controversial arguments in this era as it determines the ultimatum of life or death. While it remains legal in a
majority of states in America, it is debatable based around the aspects of morality, practical grounds, and cost efficiency. At the same time many believe
that it is an effective way of eliminating crime in society as it has been this way since people began hanging colonist for witchcraft. Former governor of
New York, Mario Cuomo, who has studied thedeath penalty more than half his life, argues the negative effect the death penalty tolls on our morality
as it "lowers us all" as human beings and only reflects the meaning of our life as hatred. American political writer and panelist on a CNN political ...

As being involved in the law and a part of it every day, his perspective on the capital punishment system is simple and logical according to himself. He
believes society functions as a whole and those who act out upon society should have no part and as sacred as life is, it should not be wasted on
those who misuse it. Stewart's stance provides that he is logically inclined to believe eliminating people who have committed crimes in the past such
as murder, are in fact actually eliminating criminal activity itself in society. He brings up another point about emotions to families affected and how
capital punishment can serve as closure which he believes to be important. Stewart says, "I believe that there are some defendants who have earned the
ultimate punishment to our society," he accredits that the death penalty is the solvent as a proper delivery tool to extreme crimes. Stewart claims if
criminals remain alive they will then choose to continue crime and harm the world and serve a serious risk to society. Stewart reinstates this by saying,
"society has not only the right, but the duty to act in self–defense to protect the innocent." Restoration is the general mindset of Stewart as he credits
the system to serve justice to the people and let the criminals be punished for what they have

The Death Penalty In The United States
The death penalty is an issue that has the United States divided. The death penalty is a controversial problem in law that has become a popular debate
among politicians due to its economical and ethical issues. While there are many who encourage it, there is also a huge amount of those who are
against it, including myself. I believe the death penalty should be illegal throughout the country. There are many reasons why I presume this. The
debates against the death penalty are mainly moral in their character that it is wrong to kill and when the state kills it sends out the wrong message to
the rest of the country. The death penalty should not be legal in the United States because putting the criminal inprison would keep people safe and cost

Acording to nccadp.org it states "according to the N.C. Department of Justice, the state murder rate has declined in the years since executions stopped.
Given this fact, there is no credible argument that the death penalty deters crime". Nccadp.org also states that "In fact, most people on death row
committed their crimes in the heat of passion, while under the influence of drugs or alcohol, or while suffering from mental illness". In ones
opinion this quotation means there is a bigger more wider picture and that is eliminating drugs from the picture instead of using drugs against
someone. One isnt in the right fraim of mind if they are under the influence by any drug they are not "themselves" The use of alcohol and drugs can
negatively affect all aspects of a person's life, impact their family, friends and community, and place an enormous burden on American society.

The death penalty may seem perfectly fine and isn't something you think about often, but first read the arguments for and against, you may just
change your mind. Three disadvantages of the death penalty are as follows: it costs taxpayers several times more than to keep a prisoner for life, it
violates the "cruel and unusual" punishments in the bill of rights, and sometimes innocent people are put to death. To hold a death row inmate costs
$90,000 more per year than to keep a prisoner for life. 130 people have been released from death row because they were innocent. A quote from Tim

Death Penalty In America's Use Of Punishment
The death penalty is the lawful execution of a person for a crime. The first death penalty law goes back to the eighteenth century and has been used in
many cultures. It was also used in Greece as the punishment for all crimes, Rome also adopted the death penalty. The methods of execution in these
times were crucifixion, drowning, impalement, and even burning alive. In Britain, hanging was the most prominent method of execution. Over 200
different crimes were punishable by death. However, in the eighteenth century 100 of the crimes were eliminated from the death penalty. Britain was the
primary influence on America's use of the death penalty. The death penalty has been used in America for several different crimes, such as murder and

They reference a part of the Bible where God did not respond to murder with death, and in fact took action to prevent his death: "When Cain killed
Abel, God did not end Cain's life. Instead, he sent Cain into exile, not only sparing his life, but protecting it by putting a mark on Cain, lest anyone
should kill him on sight." (Gn 4:15). This raises a valid point to whether or not God supports the death penalty. They also reference Pope John Paul
II's call for the repeal of the death penalty: "The new evangelization calls for followers of Christ who are unconditionally pro–life: who will proclaim,
celebrate and serve the Gospel of life in every situation. A sign of hope is the increasing recognition that the dignity of human life must never be taken
away, even in the case of someone who has done great evil. . . . I renew the appeal I made . . . for a consensus to end the death penalty, which is both
cruel and unnecessary." While he wanted to abolish the death penalty, he did not change the teachings of the Catholic church. In response to the Bible
mandating the death penalty in the old testament, they say that the coming of Christ marked the abolition of the death

One of the rising issues in the United States today is the death penalty. Some people believe that it is morally wrong, some say it helps families with

perspectives, it can be used to practice writing about controversial issues, and it can help the students look at several factors to decide on an issue.
The issue of whether or not the death penalty should be used has many different perspectives and opinions. For those who oppose the death penalty,...

The Debate On The Death Penalty
Death Penalty
The debate on if the death penalty is ethical is something that is a long–standing debate depending on what side of the issue you are on. Both sides of
this issue have their points yet there are always things about the issue that kept it in the forefront. The right to life is taken for granted without
thinking twice, however, due to the laws of this country the freedom we take for granted can be taken away with the mistakes we made. Looking at
both sides of the issue gives insight on why this remains a relevant and will continue being debated not only civilly, but also in many appeals in our
court system today.

Walter Berns expressed himself by saying," If human life is to be held in awe, as it should be, the law forbidding the taking of it must be held in
awe, and the only way the law can be made awe inspiring is to entitle it to inflict the penalty of death"(Berns,1980). The value of a human life varies
depending on which side of the issue one's beliefs lay.
Understanding more on why the thought of taking a life instead of a life sentence in a prison is complex yet simple at the same time due to the nature of
the crimes that were committed with the mentality of the punishment fits the crime. The majority of the executions of people come from the countries
Vietnam, China, Iran, and the United States which is the only westernized country.
The cost difference between putting someone to death versus a life sentence can be major due to the legal appeals that are granted to death row
cases. The cost of putting someone to death varies depending on state and what cost they pay for security, police time, and investigation. If the death
penalty was replaced with life without, the possibility of parole protects the public as well as saves the cost of many appeals. Putting to death
innocent people happen all the time yet if they were sentenced to jail for the rest of their life than many of those would have been saved.

The Death Penalty Debate Essay
The Death Penalty Debate
The issue of the death penalty is widely disputed. So disputed that maybe I shouldn't have picked this topic. But nevertheless, the death penalty is an
issue that needs to be addressed. Should the death penalty be abolished from our criminal justice system? Well, that depends on whom you ask. If you
ask me... no. I personally don't see anything wrong with the death penalty because there are a lot of criminals that are just too dangerous to society and
death is the only punishment they deserve.
I know that it is in the eighth amendment that prohibits cruel and unusual punishment, and I can't think of a greater punishment for a crime than death,
but I believe that exceptions should be made.

The most recent state to enact a death penalty law was New York in 1995. As of January 1998, 38 states and the federal government havecapital
punishment laws in effect. Alaska, Hawaii, Iowa, Maine, Massachusetts, Michigan, Minnesota, North Dakota, Rhode Island, Vermont, West Virginia,
and Wisconsin do not have a death penalty. (http://www.uaa.alaska.edu/just/death/)
Death penalty advocates argue that the execution of convicted murderers deter others from committing murder for fear that they will also be executed,
and also that murderers will be incapacitated: once dead, they will have no opportunity to commit additional murders. Death penalty opponents dispute
the deterrent effect of capital punishment, arguing that few murderers rationally weigh the possibility that they might face the death penalty before
committing a murder. Finally, death penalty opponents do not dispute that execution incapacitates executed murders, but argue that life imprisonment
without possibility of parole is equally incapacitating. (Jacob Sullum, Los Angeles)

Essay on Summary: the Changing Nature of Death Penalty...
In this paper, the authors examine how the death penalty argument has changed in the last 25 years in the United States. They examine six specific
issues: deterrence, incapacitation, caprice and bias, cost innocence and retribution; and how public opinion has change regarding these issues. They
argue that social science research is changing the way Americans view the death penalty and suggest that Americans are moving toward an eventual
abolition of the death penalty. The authors describe the history of the death penalty statues in the United States and how "In a monumental 1972
decision by the US Supreme Court, all but a few death penalty statutes in the United States were declared unconstitutional" (Radelet & Borg, 2000,
... Show more content on Helpwriting.net ...
The authors argue that recent research has modified the way the general population used to think and how now, if given the option, many would
support the alternative punishment of life without parole over the death penalty. While supporters of the death penalty thought that the death penalty
could be applied without racial and class disparities, research conducted through the years have indicated that race and class disparities have shown
not in isolated cases, but in many cases. The authors argue that "Public opinion on the death penalty show that while most Americans recognize the
problem of race and class bias, they do not view such discrimination as a reason to oppose the death penalty" (Radelet & Borg, 2000, page 5).
Fiscal cost is another way in which death penalty argument has changed. In the past it was thought that it was cheaper to execute an inmate than to
support him for the rest of his life. Research has established that death penalty system costs several times more than the punishment of life in prison
without parole. "They also include the costs both the trial and for the lengthy appeals that are necessary before an execution can be authorized"
(Radelet & Borg, 2000, page 5). "Death penalty retentionists now admit that as long as we use the death penalty, innocent defendants will
occasionally be executed" (Radelet & Borg, 2000, page 6). This is

The Death Penalty Debate Essay
The death penalty seems to be a very debatable subject. There are arguments and support for both sides of the debate, but which side is right? That is a
tough question to ask. After reading the article in the textbook, two other articles, and looking at statistics, I seem to feel that the death penalty may not
be the right answer.
The article in the textbook The Death Penalty in the United States and Worldwide was fairly informative. One of the points it brought up was the cost
of life without parole vs the death penalty, and those costs were stated as life without parole costing 1.1 million dollars vs the death penalty costing 3
million dollars (Schaefer, Richard T, 2009 pg 176). This is a significant difference in price. The text... Show more content on Helpwriting.net ...
I found a chart on the website http://www.deathpenaltyinfo.org/murder–rates–nationally–and–state. The chart on the site shows that murder rates were
actually higher in states with the death penalty than in states that did not have the death penalty (Death Penalty Information Center, 2010). If the
death penalty is a deterrent, wouldn't these rates be reversed? In an article published in the New York Times entitled ABSENCE OF EXECUTIONS:
A special report.; States With No Death Penalty Share Lower Homicide Rates, states that states who do have the death penalty actually have higher
murder rates than the national average and in the past twenty years the rates have been found to be 48 to 101 percent higher than the states who do
not have the death penalty (Bonner, Raymond and Fessenden, Ford, 2000). The article also states that as of 1998 Hawaii had the fifth lowest homicide
rate in the nation and Hawaii is one of the states in which no death penalty is enforced (Bonner, Raymond and Fessenden, Ford, 2000). This illustrates
to me that the death penalty in fact does not act as a deterrent for one to not commit violent crime. If it were a deterrent it would show that states with
the death penalty had lower homicide rates than those states without the death penalty. There is also a statement in the article from John O'Hair, a
Detroit District Attorney, that basically stated that

Dehumanizing Death Penalty
The death penalty is proven to not deter criminals from committing a crime punishable by death. There are many arguments on whether the death
penalty should be legal, but the debate boils down to personal morals. The death penalty is immoral. Criminals will act on their drive, with no thoughts
about future consequences. The death penalty not only hurts the criminal, but it affects the criminal's family. The family already had to experience what
it felt like to see a loved one take an innocent person's life. This causes emotional unnecessary emotional distress for the family and those close to the
person on death row. Murdering the criminal will only put the family through even more unnecessary trauma. Furthermore, humans are not pets. The
human race should not be able to put others down in the sense of death. It is dehumanizing for the person sentenced to death and the executioner. There
should not be a job in the United States where, in the job description, it states that you will kill someone. ... Show more content on Helpwriting.net ...
If so many people murder, why aren't there more people on death row? Who chooses who gets the death penalty and who does not? To my knowledge,
there is not a manual detailing the exceptions of murder to avoid the death penalty. A jury should have to obtain irrefutable evidence of a murder but
that usually does not happen. Innocent people can be wrongly convicted and executed. Mental illnesses should be taken into consideration when
assigning convicted murderers to death row. A mentally ill person that has committed acrime that has put them in jail should be in a mental psych ward

The Debate On Death Penalty
The debate on death penalty In her book Last Words From Death Row: The Walls Unit, Norma Herrera writes about the tribulations she and her family
went through while trying to free her brother, Leonel, from the death row. Despite showing glaring and overwhelming evidence claiming his innocence,
Leonel was sentenced to death for a crime that he did not commit. His last words to the world were, "I am innocent, innocent, innocent. I am an
innocent man, and something very wrong is taking place tonight." (Herrera) Those who support the death row, however, would score Herrera for her
attempt to bring light to this sensitive issue, and call her words an excessively emphatic exultation to bring attention away from the crime itself. They
would argue that a person who took another 's life should not be allowed to keep his own. The death penalty is an issue more complicated than any
debate that the country has ever seen. Despite the long debates and the rehashed concepts that are presented to the media almost every day, there is but
one truth that defines the issue: there is no way to look at the death penalty in black and white. Where on one hand, it ventures into immoral territory
due to the obvious murder involved. On the other hand, though, the act is justified by calling it justice or retribution. Words like revenge, good, cruel
and inhumane pop–up, but they do little to cast any importance on the debate: we cannot look at the death penalty with the expectations to reach a final

Why Is Capital Punishment Wrong

Capital Punishment: A Necessary Penalty The topic of capital punishment being right or wrong is an argument of sorts that many people debate upon
on a daily basis. This argument is literally an argument over life or death for a particular group of individuals. That stated reason is why this topic is
argued upon so intently on both sides. The idea of, "capital punishment is wrong", is the statement I'd like to focus on, and argue against that idea.
Capital punishment, often referred to as the death penalty, is now legal in thirty–five U.S. states, with an average rate of 1 execution for every 325
murder convictions. Even compared to other countries that practice capital punishment, the ... Show more content on Helpwriting.net ...
The issue we as a society face with this argument is mainly the morals and financial factors. For example if someone is sentenced to life in prison for
murdering another human being, that may not be enough of a moral closure for the victims family. It's hard to argue either way without being in those
shoes, but the death penalty reassures this victims family that this murderer has no chance of getting out of prison. Whether it be parole, or an escape,
a person still have the opportunity of getting out of prison, and statistically most convicts will be arrested again for the same or similar reasons as their

Persuasive Essay Pro Death Penalty
"There are murder victims' family members who go through this process thinking they'll feel peace once the revenge of the death penalty is carried
out. What I've learned from meeting with these people is that you don't feel better in revenge. You feel better in forgiveness" (Steinberg, 2015). Today,
there are 31 states that are for the death penalty, leaving 19 that are against it. There are many reasons to be for and against the death penalty, but in my
opinion, I think that there is a better way to take care of criminals rather than killing them.
One side of this debate is being for the death penalty. According to Van Den Haag (1983), people fear death more than life in prison. Having the death
penalty will be a consequence that people don't want to face so it will help decrease future murder. Also, Swift (2014) states that they deserve being put
to death. They knew before they did the crime that the consequence for murder is being put to death. He also argues that having them put to death will
help stop further crime and overcrowding of prisons. ... Show more content on Helpwriting.net ...
The purpose for the death penalty is to help with future crimes, but it seems to have no deterrent effect. Death Penalty Cost (2015) states that in
California, it currently costs $137 million for the death penalty every year. It would be reduced down to $11.5 million if they took care of this situation
without having to go through all the trials leading up to the execution. Many times it ends up that they find out that the criminal is innocent, so they
wasted a lot of taxpayer's money going through all the trials, and then they usually have life sentence expenses that taxpayers also have to pay

The Death Penalty Debate Essay
The Death Penalty Debate
To kill or not to kill. That is the question. Some people think it is wrong; however, a close look into the matter will show it is the right thing to do.
The Bible states "thou shall not kill" but it also states "an eye for eye". The death penalty is the worst and most deserved punishment for those who
choose to take a life. There is no excuse for a life to be taken; therefore, the murderer should be punished to the full extent. Imagine a loved one of
yours is brutally murdered; how would you feel? How much pain would your family have to go through? How would you be able to sleep at night

In American society, the threat ofcapital punishment stands as the ultimate sentence for a criminal. The moral complications of the taking of another
life, whether it is by murder or as legally accepted punishment, remains an unresolved conflict between Americans. Despite the fact that capital
punishment, otherwise known as the "death penalty", is legal in only a handful of countries in the world, the majority of Americans regard it as
acceptable retribution. In the 1981 Gallup Poll, two–thirds of Americans voted general approval of capital punishment. By 1994, the same poll
concluded that a tremendous 80% of Americans approved of capital punishment (Moore, 1994:5). It is no wonder that many of our countries leaders
approve of the death penalty. The former Speaker of the House of Representatives, Newt Gingrich, believes that mass executions of "27 or 30 or 35
people at a time" would be effective in the reduction of the importation of illegal drugs in to America (Taylor, 1995). In 1972, capital punishment was
eradicated in the United States when the Supreme Court declared that under then existing laws "imposition

Raising The Death Penalty
In America, the death penalty is a highly debated topic. In the debate "should the death penalty be abolished," Diann Rust–Tierney and Joshua Marquis
argue this issue. Although the death penalty system is prone to error and discrimination, space the death penalty should not be abolished because win
the executions started to raise the murder rate began to drop in America and that scientists have proven that the death penalty is a definite deterrent to
murder. There have been many errors and discriminatory problems when it comes to the death penalty. In the article, it states "Finally, there's the fact
that the system is prone to human error and discrimination" (Rust–Tierney 22). After new evidence is found, there are many more trials, and a lot of
the people have been freed. Many people believe that if you kill someone, you should not get the same punishment as what you did. Finally, if the

The Sixth Commandment And The Death Penalty Debate
"Religious leaders and organizations have been powerful lobbies on both sides of the death penalty debate. Those against the death penalty say it is
their moral obligation to bring the issue of capital punishment to the forefront of the religious community's agenda. They also argue that it is becoming
increasingly difficult for the U.S. to maintain its position as the global leader on human rights when it not only still executes people, but juveniles as
well. On the other side of the debate, some religious leaders firmly believe the Sixth Commandment is a prohibition against murder and not a
prohibition against the death penalty." 5

The Debate On The Death Penalty
The debate on the death penalty has been the ongoing question for generations. There are plenty of different sides to take on this issue. You have the
side where some people think that putting prisoners to death is inhumane and that no matter what they did putting a human to death is wrong. While
others may think that if the crime is extreme enough that the prisoner who committed this crime should pay for it with their own life. Throughout
history there have been several instances where prisoners have been put to death in horrible, gruesome ways that would make some turn their heads
toward some of these types of execution methods. The reason being because the method tortures the prisoner in the attempt to end the prisoners' life.
Although, some are not as gruesome as others, some kill the prisoner peacefully while not giving the prisoner little to no pain at all during the
process. Thus, appealing to people who I agree with the death penalty but does not think that the prisoner should suffer through the procedure of
getting put to death since they are already going to die. The point I'm making here is that there is a bazillion perspectives on the death penalty being
in effect. Is it too humane? Are there any efficient pain free ways to end someone's life? Should the method of killing the prisoner match the severity
of the crime? These types of questions are what make this issue such a controversial topic. What side am I on? You are going to have to read my

Death Penalty In Australia
Introduction:
The debate for re–establishment of the death penalty in Australia has been ongoing since the 1973abolishment of capital punishment in Australia.
While capital punishment was first abolished in Queensland on the 3rd of July 1922, the last state in Australia was New South Wales to formally
abolish the death penalty for all crimes in 1985. Ronald Ryan was the last man executed at Pentridge Prison in Australia. On the 3rd of February
1967, Ryan was hanged after being convicted of the shooting death of a prison officer during a prison escape from Pentridge Prison, Coburg and
Victoria in 1965. The death penalty is not an effective punishment for all cases and there has not been any solid evidence stating that it is a more

A serious crime like murder generally centres on the idea of justice and what the punishment is for. Most who agree to bring back capital punishment
believe that the only way to punish someone for taking another person's life is to take their life by sentencing the death penalty. Another very
common argument to bring back the death penalty is deterrence. Australia will become a safer country if the death penalty was brought back as it
would simply deter people from committing a serious crime like murder or rape. If a murderer is imprisoned without the possibility of parole, they
may bring danger to staff or other prisoners. There are many more arguments for the death penalty, which include, overpopulation of prisons and even

The Debate Of Banning The Death Penalty
Public Executions The United States has been going through the debate of banning the death penalty for decades; however, it continues to remain at a
standstill as crime rates continue to stay the same throughout the country. The people for continuing the death penalty happens to see their group split
in to two groups. One for the private executions and the other for public. Public executions can do many things like deter crimes from happening,
giving the victims closure, and finding the right kind of execution method that is inexpensive and once used throughout history. The ability to deter
crimes with the method of public execution is one we should not waste. It leaves everyone with the knowledge that there is nothing to keep them from
being the next one on the chopping block so to speak, especially if they have committed such a crime to deserve the sentence. It takes removes this
mindset that the public has come to grasp that everything does not have a consequence for the actions they take. The scare factor works brilliantly in
this regard, holding the public to a line they know not to cross. With the line drawn, the number of convicts in the prison system would decrease. This
will also free up taxpayers money for other things like education, medical, security, and paying off the national debt. Secondly, this would bring closer
to the families, as well as, friends and acquaintances of the victim. This type of execution would give everyone the benefit of seeing

The Debate Over The Death Penalty
The use of Capital Punishment has always been an issue for which the states must determine the proper use and implementation. Like the other
thirty–two states that practice the death penalty, Idaho has its own unique statutes regarding the death penalty, but also like all other states, the statute
is constantly under scrutiny through the appeals process death row inmates take part in. Through looking at their current statutes, one can understand
this complicated and high profile punishment. It seems that with each person who is executed, a new part of the law is highlighted which may be
unfair. The appeals process is lengthy, and because of this, it tends to be an incredibly costly sentence to carry out. With an age in which the media...

The only crimes, which are eligible for Capital Punishment, are murder in the first degree, kidnapping in the first degree, and perjury, which results in
the death of an innocent person. This statute was changed in 1973 as a result of the Furman decision to make the death penalty mandatory for a
conviction of murder in the first degree to make jury sentencing unnecessary (Office of Performance Evaluations, 2014).
According to Idaho Statute 19–2515, Sentencing in Capital Cases outlines the mens rea, which is necessary to seek the death penalty. It states the jury
or judge must find that one of the listed aggravating circumstances must be found present for a person to be sentenced to the death penalty: A previous
conviction for murder; knowingly committing two murders at the same time; knowingly placing many people at great risk of death; a murder
committed for money; an especially "heinous, atrocious or cruel" murder; a murder which exhibits a disregard for human life, murder in conjunction
with attempted/executed arson, rape, robbery, burglary, or kidnapping; murder committed during the commission of acrime against nature (i.e. sexual
abuse of a child under sixteen); actions which would indicate a continued threat to society; a murder in which the victim was a law enforcement officer

Why The Death Penalty Is Wrong?
The death penalty, while simple in concept, is sadly complex in execution. There are laws on when the death penalty may be used and how the death
happens. There is a supposed racial and social bias on a process that is still debated whether or not it is still constitutional. The victim's family
themselves are debate for and against it. It is those debates may take years to decide whether or not to kill the suspect.
The weird thing is that we have used the death penalty for centuries. In Biblical times, the death penalty was used for crimes that we don't use the death
penalty for (Bushman). There are laws nowadays that determines when one could receive the death penalty. The majority includes murder, or murder

As of 2016, 43% of executed defendants are black, and 33% were white ("Race and Death). Currently, 42.34% currently on death row are white, and

white victims (Bushman). There are thirty–one death row cases involving a white person killing a black person, but there are 297 death row cases the
other way around (Race and Death). The reason for that is because judges and juries are six times less likely to impose the death penalty when the
victim is black (Tucker). It doesn't just targets a race, but the poor as well. Justice Ruth Bader Grinsburg has said, "People who are represented well
in trial don't get the death penalty" (Bushman).OJ Simpson's lawyer was paid over five million dollars to defend him, and has said, "There are no

In view of these safeguards, proponents of capital punishment believe that state executions are justified sentences for those convicted of willful
first–degree murder. They do not think sentencing murderers to prison is a harsh enough sentence, especially if there is the possibility of parole for the
perpetrator. A final argument posed by proponents of thedeath penalty is that execution is an effective deterrence. They are convinced that potential
murderers will likely think twice before they commit murder. Despite the rhetoric of politicians for the increased use of the death penalty, a number of
prominent individuals and organizations have emerged to express their opposition to capital punishment. Along with families of death row prisoners,
the International Court of The Hague, the United Nations, Amnesty International, the Texas Conference of Churches, Pope John Paul II, Nobel Peace

struggle against the death penalty. They invariably argue that capital punishment is wrong and inhumane. Religious folk generally evoke the nature of

(NAKELL, 1978) The death penalty is much more expensive than life imprisonment without parole. Capital trails are longer and more expensive at
every step than other murder trials. Capital cases tend to last several years and can consist of pretrial motions, expert witness investigations, jury
selection, and the necessity for two trials; one on guilt and the other on sentencing. Once an individual is sentenced to death, the case automatically gets
appealed to the state, then to the Court of Appeals and finally to the Supreme Court. Guilty pleas in capital punishment cases are almost unheard of,
plus many of these trials result in life sentences anyway, so the state in which the trial is held ends up paying for the costs of the capital case. The
extreme costs of capital punishment are actually making America less safe because financial and legal resources are being diverted from effective
crime fighting. When a prosecutor decides to pursue a capital case they go to extensive and costly means, this may include the use of forensics,
psychology, technology, and witnesses. The states (tax payers) also suffer; security precautions imposed by the death sentence must be paid. In the end
the offender may die in prison, so there is no reliable data that the death penalty

It is definitely true that money should not be an issue when it comes to fighting crime and saving people's lives. However, it is also true that it is
necessary to logically and rationally choose the best way to spend the available money for crime–fighting. In the case of the death penalty, so much
extra money is spent in legal procedures and appeals that could be spent toward other more deterrent and efficient ways to fighting crime, such as
increased police forces, more funding for the war on guns, and other crime–fighting initiatives. In the economic sense, the death penalty is clearly not
the smartest and most efficient way to fight crime. One of the most important issues in the debate is the deterrent effect of the death penalty. Deterrent
effect, meaning that by having the death penalty as an available form of punishment it will deter future murders from committing their crimes. So
supposedly, by instilling this fear of death a murderer will be forced to think twice before they kill. This is not the case, as many studies have shown
that the death penalty does not have a deterrent effect. For instance, the homicide rates in states that do have the death penalty and those that don't are
generally the same. Furthermore, when states have established the death penalty they have not seen their homicide rates fall (Barkan p. 498). A global

The Global Debate on Death Penalty
The death penalty is one of the most hotly debated legal issues in the democratic world today. This is particularly the case in the United States, where
some states have implemented capital punishment as a response to major crimes and others have abolished the practice. Among legislators, policy
makers, and the general public, there appears no likelihood of resolving the debate. The wide array of moral, religious, humanitarian, and
criminological views simply appears too divergent to ever meet. At the basis of the debate is the issue of whether capital punishment is a suitable
response to severe criminal activity such as murder, or if there are better and more effective ways to respond to these. While there are compelling
arguments both in favor of and against capital punishment, one may draw the conclusion that the death penalty serves little purpose beyond revenge,
which ultimately does little to compensate the affected parties. Generally, a search for arguments relating to capital punishment tends to result in a
majority of articles against this type of response to crimes involving murder. Some writings in favor of this type of justice, however, can be
surprisingly compelling. One of these is the article by Jacoby (2003), where he argues for the death penalty without overtly religious or emotional
appeals to the reader. Jacoby makes two main points in support of his view. First, the death penalty results in justice for the victims. According to the
author, murder is

arguments for both sides of the debate over the morality of the death penalty are vast, the bottom line is that the death penalty does not disregard
human life, but rather it reveres it, as Hatch said. Morality is defined as, "The quality of being in accord with standards of right or good conduct,"

U.S. and Canada are comparable since then, counting the four–year death penalty suspension in the U.S. in the 1970s. (Liptak, 2007)
Does the death penalty really help deter crime? The theory of deterrence is based on the idea that the threat of punishment must be severe enough to
counter the benefits or pleasures that the criminal would receive from the crime. In addition, the punishment must be administered swiftly so that
potential criminals will see a clear cause and– effect relationship between the crime and the punishment. The death penalty would be considered a
specific deterrence. As a result of their punishment, the criminal can not commit further crimes. There is no doubt that capital punishment serves as a
specific deterrent: The executed criminal will never kill again. However, experts and others have long debated whether capital punishment is a more
effective general deterrent than life in prison.
Some opponents of the death penalty argue that instead of deterring crime, capital punishment actually increases murder rates because the state, through
executions, devalues human life. Another argument for the

Abolishing The Death Penalty : A Values Debate Essay
Abolishing the Death Penalty: A Values Debate Is society better off without its most heinous criminals? Does the justice system have the right to
determine who lives or who dies? For centuries, human civilizations have pondered similar questions regarding the philosophical ideologies
surrounding capital punishment. The discordance within the United States creates deep divides between proponents and opponents of the death
penalty; nonetheless, these schisms are inconsequential due to the continued use of capital punishment for the entirety of American history. With the rise
of critical statistical analysis, however, evidence opposing the death penalty paints a clear picture: the policy creates more harm than good. Despite
claims that the death penalty makes society safer, the United States should abolish capital punishment because state–sanctioned executions are
associated with inefficiency and inequality.
The Popularity of Security Conflicting values dominate the debate surrounding capital punishment; and, the arguments made by supporters are easily
encapsulated by the value of security. Integral to the defense of the death penalty is the contention that individuals and society should be safe, free of
insecurity or worry. In order to provide for the security of Americans, proponents assert that the death penalty serves as a deterrent for crime while also
eliminating the potential threat of dangerous criminals. These perspectives are highly popular; according to a Gallup

Debates over Death Penalty in the United States The issue of death penalty today is a popular topic for numerous public and scholarly discussions. The
death penalty has a long and distinguished history in the United States, as it has been around in some form–either official or otherwise–since the
beginning of American society. America originally adopted the British justice system, with hundreds of crimes being punishable by death. Slowly but
surely, states began to eliminate the number of things that could lead to the death penalty. Likewise, new methods were introduced, with the electric
chair coming about around the turn of the 1900s. The modern death penalty system came after the Supreme Court ruled the death penalty
unconstitutional in Furman v. Georgia. Today, the death penalty is only available for murder, only available for people over 18, and not available for
people who are mentally retarded. While the differences in punishment between death penalty states and non–death penalty states is severe, the
difference in outcomes is not as severe. While one would expect death penalty states to have lower murder rates because of the fear of the death
penalty, the opposite ends up being true. In death penalty states, the murder rate has been significantly higher in every year since 1990. States without
the death penalty also feature lower general crime rates. States with no death penalty also tend to spend less money on

Death Penalty In The 18Th Century

  • 1. Death Penalty In The 18th Century When the first colonists came to the United States, they brought the British penal system with them. Laws concerning the death penalty varied from colony to colony. In the Tenth Century A.D., hanging became the main method of execution in Britain. Death sentences were carried out by crucifixion, drowning, beating to death, burning alive, and impalement. The first death penalty laws go back as far as the eighteenth century in Babylon. As for the United States, the first documented execution was in the Jamestown colony of Virginia in 1608. Captain George Kendall was hanged for the capital offense of treason. In 1632 Jane Champion became the first women to be executed. The abolitionist movement had many European theorists such as Montesquieu, Voltaire and Bentham. The first attempted changes of the death penalty in the U.S. happened when Thomas Jefferson introduced a bill to revise Virginia's death penalty laws. The bill suggested thatcapital punishment was to be used only for the crimes of murder and treason. In the early 1800's, states started to reduce the crimes punishable by capital punishment and started building jails and penitentiaries. Pennsylvania became the first state to move executions away from the public and ... Show more content on Helpwriting.net ... Since the reinstatement of the death penalty in the United States in 1976, 138 innocent men and women have been released from death row, including some who came within minutes of execution. Missouri, Texas and Virginia have opened investigations to determine if those states executed innocent men. Sometimes people make mistakes and may realize this after it's too late. One of the most frequent causes of reversals in death penalty cases is ineffective assistance of counsel. With inadequate defense as one of the main reasons requiring reversal, a study at Columbia University found that 68% of all death penalty cases were reversed on ... Get more on HelpWriting.net ...
  • 2. Debate on the Death Penalty in America On September 9, 1993 a seventeen year old boy, Christopher Simmons, and a few of his friends met up to discuss and devise a plan to commit a robbery and possibly even a murder, just for the sake of fun. Simmons' plan was not complicated: find someone to burglarize, tie up the victim and either leave the victim tied to a tree or push them off a bridge. Simmons and his accomplice climbed through a window and proceeded into the bedroom of the victim, Mrs. Cook. The two teenagers tied the woman up and loaded her into the back of her own minivan. They drove to the state park at the edge of town, where they had planned to dispose of the body and that is exactly what they did. The boys were caught later on that month and put on trial for cold... Show more content on Helpwriting.net ... The police were not protected from being a homicide victim even though capital punishment was on their side and supposedly protecting them. (Bailey, Peterson) According to statistics gathered from the Federal Bureau of Investigation, the areas of the country that had a lower enforcement of capital punishment were actually a place where the police officers were safer than in the regions where the capital punishment was heavily enforced. (Death Penalty in Focus) For instance, the number of murders of an officer of the law in the southern states between the years of 1989 and 1998 was an alarming two hundred and ninety–two total deaths. Averaging the number of murders over the ten year period, 29.2 police officers were killed each year, and this was in a region where the death penalty was heavily enforced. (Death Penalty in Focus, Table 1.1) On the other side of the pole, the states in the northeast region had as little as eighty murders in the same time span, with an average of eight murders per year. These statistics definitely contradict that the death penalty acts as deterrence for an act of murder. If deterrence is what is supposed to validate capital punishment, but criminals are not intimidated by it, then maybe it does not protect lives after all and it could be unconstitutional. President George W. Bush made the following statement in support of capital punishment "I think ... Get more on HelpWriting.net ...
  • 3. Pros And Cons Of Pro Death Penalty T'Asia Bell Ms. Smith Period: 4 11/29/14 Pro for death penalty: Good evening everyone my name is T'Asia Bell and my debate position is pro death penalty. I am pro for capital punishment depending upon the crime type up to a certain degree for an example murder, rape, homicides and ECT base on the case what the criminal has done. Everybody life is valuable in some kind of way and we are made for different purposes on this earth, and violence is not acceptable, and will never be. Capital punishment or death penalty is the executing or killing of a person for a conviction of a crime. Show more content on Helpwriting.net ... The death penalty will prevent future murders from striking again. The country to actually influence America into the death penalty was Britain. The death penalty was brought by the Europeans The Death Penalty helps deter crimes and saves lives said federal, state, and local officials. How would you feel if you or someone else lose a person that you loved or had a very close relationship with them? The question is would you want to fight for justice and until it is served, because no innocent victim deserves to die no matter the circumstance or let the murder off easy like it's okay. People are capable of making their own decisions and no what's right from wrong, criminals are no different from normal people and should think before they act because those individuals know exactly what they are doing. Basically the point I'm trying to get across is that the death penalty The death penalty may be costly but, but it's worth it and that is debatable, because, it cost more to keep an inmate alive that the actually death penalty. Every human life is precious and important and having the death penalty is moral it teaches criminals a lesson or learning experience of how strict laws can be on citizens who have the intent to hurt others. • 4. Controversial Argument Essay: The Death Penalty Debate The death penalty is one of the most controversial arguments in this era as it determines the ultimatum of life or death. While it remains legal in a majority of states in America, it is debatable based around the aspects of morality, practical grounds, and cost efficiency. At the same time many believe that it is an effective way of eliminating crime in society as it has been this way since people began hanging colonist for witchcraft. Former governor of New York, Mario Cuomo, who has studied thedeath penalty more than half his life, argues the negative effect the death penalty tolls on our morality as it "lowers us all" as human beings and only reflects the meaning of our life as hatred. American political writer and panelist on a CNN political ... Show more content on Helpwriting.net ... As being involved in the law and a part of it every day, his perspective on the capital punishment system is simple and logical according to himself. He believes society functions as a whole and those who act out upon society should have no part and as sacred as life is, it should not be wasted on those who misuse it. Stewart's stance provides that he is logically inclined to believe eliminating people who have committed crimes in the past such as murder, are in fact actually eliminating criminal activity itself in society. He brings up another point about emotions to families affected and how capital punishment can serve as closure which he believes to be important. Stewart says, "I believe that there are some defendants who have earned the ultimate punishment to our society," he accredits that the death penalty is the solvent as a proper delivery tool to extreme crimes. Stewart claims if criminals remain alive they will then choose to continue crime and harm the world and serve a serious risk to society. Stewart reinstates this by saying, "society has not only the right, but the duty to act in self–defense to protect the innocent." Restoration is the general mindset of Stewart as he credits the system to serve justice to the people and let the criminals be punished for what they have ... Get more on HelpWriting.net ...
  • 5. The Death Penalty In The United States The death penalty is an issue that has the United States divided. The death penalty is a controversial problem in law that has become a popular debate among politicians due to its economical and ethical issues. While there are many who encourage it, there is also a huge amount of those who are against it, including myself. I believe the death penalty should be illegal throughout the country. There are many reasons why I presume this. The debates against the death penalty are mainly moral in their character that it is wrong to kill and when the state kills it sends out the wrong message to the rest of the country. The death penalty should not be legal in the United States because putting the criminal inprison would keep people safe and cost ... Show more content on Helpwriting.net ... Acording to nccadp.org it states "according to the N.C. Department of Justice, the state murder rate has declined in the years since executions stopped. Given this fact, there is no credible argument that the death penalty deters crime". Nccadp.org also states that "In fact, most people on death row committed their crimes in the heat of passion, while under the influence of drugs or alcohol, or while suffering from mental illness". In ones opinion this quotation means there is a bigger more wider picture and that is eliminating drugs from the picture instead of using drugs against someone. One isnt in the right fraim of mind if they are under the influence by any drug they are not "themselves" The use of alcohol and drugs can negatively affect all aspects of a person's life, impact their family, friends and community, and place an enormous burden on American society. according to ncadd.org "Nearly 50% of jail and prison inmates are clinically addicted". and "Approximately 60% of individuals arrested for most types of crimes test positive for illegal drugs at ... • 6. Capital Punishment Was Abolished By Harold Wilson Capital Punishment was abolished "under Harold Wilson's Labour government in 1969" (Manton.K, 2011, P.16) in the United Kingdom, but there have been continuing debates concerning the reinstatement of the death penalty in the UK.(BBC NEWS, 2011) reports that the Conservative party MP calls for submission on capital punishment in the UK. The Brigg and Goole MP "is one of a number of Tory backbenchers calling for a commons debate of the return of capital punishment."(BBC NEWS, 5th August 2011) Currently, Paul Staines, who writes the Guido Fawkes ' calls for the death to be brought back for child and police officer murderers," he carried out a public opinion poll, which recommends that around half the population want capital punishment to be reinstated for murders ' this rises to 60% when it comes to child or police officer kills', furthermore his e–petition on the government website needs '100,000 people to support' it so that there could possibly be a preliminary debate on the issue (BBC NEWS, 4th August 2011). As Mr. Staines statistics poll shows, in 2011 that there is a high percent of the public that requests capital punishment to be reinstated in the UK for serious crimes such as; murder, child murder and police officer kills. This study aims to examine the public's opinion of reintroducing capital punishments. • 7. Pro Death Penalty Research Paper The death penalty may seem perfectly fine and isn't something you think about often, but first read the arguments for and against, you may just change your mind. Three disadvantages of the death penalty are as follows: it costs taxpayers several times more than to keep a prisoner for life, it violates the "cruel and unusual" punishments in the bill of rights, and sometimes innocent people are put to death. To hold a death row inmate costs $90,000 more per year than to keep a prisoner for life. 130 people have been released from death row because they were innocent. The first death penalty law goes back to the eighteenth century and has been used in many cultures. It was also used in Greece as the punishment for all crimes, Rome also adopted the death penalty. The methods of execution in these times were crucifixion, drowning, impalement, and even burning alive. In Britain, hanging was the most prominent method of execution. Over 200 different crimes were punishable by death. However, in the eighteenth century 100 of the crimes were eliminated from the death penalty. Britain was the primary influence on America's use of the death penalty. The death penalty has been used in America for several different crimes, such as murder and treason. ... They reference a part of the Bible where God did not respond to murder with death, and in fact took action to prevent his death: "When Cain killed Abel, God did not end Cain's life. Instead, he sent Cain into exile, not only sparing his life, but protecting it by putting a mark on Cain, lest anyone should kill him on sight." (Gn 4:15). This raises a valid point to whether or not God supports the death penalty. They also reference Pope John Paul II's call for the repeal of the death penalty: "The new evangelization calls for followers of Christ who are unconditionally pro–life: who will proclaim, celebrate and serve the Gospel of life in every situation. A sign of hope is the increasing recognition that the dignity of human life must never be taken away, even in the case of someone who has done great evil. . . . I renew the appeal I made . . . for a consensus to end the death penalty, which is both cruel and unnecessary." • 9. Issues In Eng/131 One of the rising issues in the United States today is the death penalty. Some people believe that it is morally wrong, some say it helps families with closure, and others don't want to spend taxpayer's money on criminals sentenced for life. No matter what side a person is on, the death penalty is an issue that is arising in politics and needs to be dealt with. The death penalty should be taught in ENG 131 because it is an issue with many different perspectives, it can be used to practice writing about controversial issues, and it can help the students look at several factors to decide on an issue. This article is a scholarly article because it cites off of the information and anyone can easily look up where the author got her information. The article is also 15 pages long and goes into depth about every topic that is covered. The final hint that shows that the writing is a scholarly article is that a professor of cultural and social geography at Queen's University wrote it. In this article, the author talks about Troy Davis, a man who was sentenced to death after he was found guilty of murdering a police officer. However, it was revealed that much of the evidence and the witnesses were corrupted, but it was too late and Troy Davis was killed. Kobayashi talks about how the United States is one of the few countries in the world to still have the death penalty. Kobayashi then goes into detail about how a majority of the people sentenced to death by the Federal court were African American, just like Troy Davis. Kobayashi also says that there is no correlation between states with high murder rates and number of people sentenced to death. More specifically this means I do not condemn the death penalty entire but I believe the Bible he gives governments the authority to decide when to use the death penalty. I understand these are not everyone's use is the only approach the conversation I believe I can take. Furthermore the simple belief that governments have authority over the use of the death penalty is appropriate does not mean the matter is settled. CHAPTER ONE: INTRODUCTION 1.1 Introduction Capital Punishment was abolished "under Harold Wilson's Labour government in 1969" (Manton.K, 2011, P.16) in the United Kingdom, but there have been continuing debates concerning the reinstatement of the death penalty in the UK.(BBC NEWS, 2011) reports that the conservative party MP calls for submission on capital punishment in the UK. (Gannon.A.T, Wood.J, 2013, P.33) state that the motivation behind why public opinion is important because in ... Both sides of this issue have their points yet there are always things about the issue that kept it in the forefront. The right to life is taken for granted without thinking twice, however, due to the laws of this country the freedom we take for granted can be taken away with the mistakes we made. The value of a human life varies depending on which side of the issue one's beliefs lay. Understanding more on why the thought of taking a life instead of a life sentence in a prison is complex yet simple at the same time due to the nature of the crimes that were committed with the mentality of the punishment fits the crime. The majority of the executions of people come from the countries Vietnam, China, Iran, and the United States which is the only westernized country. The cost difference between putting someone to death versus a life sentence can be major due to the legal appeals that are granted to death row cases. The cost of putting someone to death varies depending on state and what cost they pay for security, police time, and investigation. But nevertheless, the death penalty is an issue that needs to be addressed. Should the death penalty be abolished from our criminal justice system? Well, that depends on whom you ask. If you ask me... no. I personally don't see anything wrong with the death penalty because there are a lot of criminals that are just too dangerous to society and death is the only punishment they deserve. I know that it is in the eighth amendment that prohibits cruel and unusual punishment, and I can't think of a greater punishment for a crime than death, but I believe that exceptions should be made. Death penalty opponents dispute the deterrent effect of capital punishment, arguing that few murderers rationally weigh the possibility that they might face the death penalty before committing a murder. Finally, death penalty opponents do not dispute that execution incapacitates executed murders, but argue that life imprisonment without possibility of parole is equally incapacitating. They examine six specific issues: deterrence, incapacitation, caprice and bias, cost innocence and retribution; and how public opinion has change regarding these issues. They argue that social science research is changing the way Americans view the death penalty and suggest that Americans are moving toward an eventual abolition of the death penalty. The authors describe the history of the death penalty statues in the United States and how "In a monumental 1972 decision by the US Supreme Court, all but a few death penalty statutes in the United States were declared unconstitutional" (Radelet & Borg, 2000, ... The authors argue that recent research has modified the way the general population used to think and how now, if given the option, many would support the alternative punishment of life without parole over the death penalty. While supporters of the death penalty thought that the death penalty could be applied without racial and class disparities, research conducted through the years have indicated that race and class disparities have shown not in isolated cases, but in many cases. The authors argue that "Public opinion on the death penalty show that while most Americans recognize the problem of race and class bias, they do not view such discrimination as a reason to oppose the death penalty" (Radelet & Borg, 2000, page 5). Fiscal cost is another way in which death penalty argument has changed. In the past it was thought that it was cheaper to execute an inmate than to support him for the rest of his life. Research has established that death penalty system costs several times more than the punishment of life in prison without parole. "They also include the costs both the trial and for the lengthy appeals that are necessary before an execution can be authorized" (Radelet & Borg, 2000, page 5). That is a tough question to ask. After reading the article in the textbook, two other articles, and looking at statistics, I seem to feel that the death penalty may not be the right answer. The article in the textbook The Death Penalty in the United States and Worldwide was fairly informative. One of the points it brought up was the cost of life without parole vs the death penalty, and those costs were stated as life without parole costing 1.1 million dollars vs the death penalty costing 3 million dollars (Schaefer, Richard T, 2009 pg 176). The chart on the site shows that murder rates were actually higher in states with the death penalty than in states that did not have the death penalty (Death Penalty Information Center, 2010). If the death penalty is a deterrent, wouldn't these rates be reversed? In an article published in the New York Times entitled ABSENCE OF EXECUTIONS: A special report.; States With No Death Penalty Share Lower Homicide Rates, states that states who do have the death penalty actually have higher murder rates than the national average and in the past twenty years the rates have been found to be 48 to 101 percent higher than the states who do not have the death penalty (Bonner, Raymond and Fessenden, Ford, 2000). The article also states that as of 1998 Hawaii had the fifth lowest homicide rate in the nation and Hawaii is one of the states in which no death penalty is enforced (Bonner, Raymond and Fessenden, Ford, 2000). This illustrates to me that the death penalty in fact does not act as a deterrent for one to not commit violent crime. If it were a deterrent it would show that states with the death penalty had lower homicide rates than those states without the death penalty. There are many arguments on whether the death penalty should be legal, but the debate boils down to personal morals. The death penalty is immoral. Criminals will act on their drive, with no thoughts about future consequences. The death penalty not only hurts the criminal, but it affects the criminal's family. The family already had to experience what it felt like to see a loved one take an innocent person's life. This causes emotional unnecessary emotional distress for the family and those close to the person on death row. Murdering the criminal will only put the family through even more unnecessary trauma. Furthermore, humans are not pets. The human race should not be able to put others down in the sense of death. It is dehumanizing for the person sentenced to death and the executioner. The Debate On Death Penalty The debate on death penalty In her book Last Words From Death Row: The Walls Unit, Norma Herrera writes about the tribulations she and her family went through while trying to free her brother, Leonel, from the death row. Despite showing glaring and overwhelming evidence claiming his innocence, Leonel was sentenced to death for a crime that he did not commit. His last words to the world were, "I am innocent, innocent, innocent. I am an innocent man, and something very wrong is taking place tonight." (Herrera) Those who support the death row, however, would score Herrera for her attempt to bring light to this sensitive issue, and call her words an excessively emphatic exultation to bring attention away from the crime itself. They would argue that a person who took another 's life should not be allowed to keep his own. The death penalty is an issue more complicated than any debate that the country has ever seen. Despite the long debates and the rehashed concepts that are presented to the media almost every day, there is but one truth that defines the issue: there is no way to look at the death penalty in black and white. Where on one hand, it ventures into immoral territory due to the obvious murder involved. On the other hand, though, the act is justified by calling it justice or retribution. Today, there are 31 states that are for the death penalty, leaving 19 that are against it. There are many reasons to be for and against the death penalty, but in my opinion, I think that there is a better way to take care of criminals rather than killing them. One side of this debate is being for the death penalty. According to Van Den Haag (1983), people fear death more than life in prison. Having the death penalty will be a consequence that people don't want to face so it will help decrease future murder. Also, Swift (2014) states that they deserve being put to death. • 24. The Debate On The Death Penalty The debate on the death penalty has been the ongoing question for generations. There are plenty of different sides to take on this issue. You have the side where some people think that putting prisoners to death is inhumane and that no matter what they did putting a human to death is wrong. While others may think that if the crime is extreme enough that the prisoner who committed this crime should pay for it with their own life. Throughout history there have been several instances where prisoners have been put to death in horrible, gruesome ways that would make some turn their heads toward some of these types of execution methods. The reason being because the method tortures the prisoner in the attempt to end the prisoners' life. Although, some are not as gruesome as others, some kill the prisoner peacefully while not giving the prisoner little to no pain at all during the process. Thus, appealing to people who I agree with the death penalty but does not think that the prisoner should suffer through the procedure of getting put to death since they are already going to die. The point I'm making here is that there is a bazillion perspectives on the death penalty being in effect. Is it too humane? Are there any efficient pain free ways to end someone's life? The Debate Of Banning The Death Penalty Public Executions The United States has been going through the debate of banning the death penalty for decades; however, it continues to remain at a standstill as crime rates continue to stay the same throughout the country. The people for continuing the death penalty happens to see their group split in to two groups. One for the private executions and the other for public. Public executions can do many things like deter crimes from happening, giving the victims closure, and finding the right kind of execution method that is inexpensive and once used throughout history. The ability to deter crimes with the method of public execution is one we should not waste. They do not think sentencing murderers to prison is a harsh enough sentence, especially if there is the possibility of parole for the perpetrator. A final argument posed by proponents of thedeath penalty is that execution is an effective deterrence. They are convinced that potential murderers will likely think twice before they commit murder. Despite the rhetoric of politicians for the increased use of the death penalty, a number of prominent individuals and organizations have emerged to express their opposition to capital punishment. Along with families of death row prisoners, the International Court of The Hague, the United Nations, Amnesty International, the Texas Conference of Churches, Pope John Paul II, Nobel Peace recipient, Bishop Tutu, numerous judges and former prosecutors, former Attorney General, Ramsey Clark, actors, and writers are waging a determined struggle against the death penalty. They invariably argue that capital punishment is wrong and inhumane. Religious folk generally evoke the nature of an "ideal spiritual community" (Cauthen, 1). Within this perspective, a moral and ethical community does not insist on a life for a life. While a community must act to protect law– abiding citizens, an ethical response would be to ... • 31. Essay on Death Penalty Debate Why is the death penalty still allowed throughout much of the U.S.? The process of prosecuting and convicting an individual is astronomical, and there is great debate as to whether the death penalty actually works as a deterrent. Retribution and biasness have contributed too many that have received this sentence, considering all this, life imprisonment is best for all, realistically, and most effective. The advantages of life imprisonment far more outweigh the death sentence. Death Penalty America has always had a history of using the death penalty, but no subject has received greater debate. There are many reasons why the death penalty should not be used in America, first there is not data that shows that the death penalty acts as ... Show more content on Helpwriting.net ... (NAKELL, 1978) The death penalty is much more expensive than life imprisonment without parole. Capital trails are longer and more expensive at every step than other murder trials. Capital cases tend to last several years and can consist of pretrial motions, expert witness investigations, jury selection, and the necessity for two trials; one on guilt and the other on sentencing. Once an individual is sentenced to death, the case automatically gets appealed to the state, then to the Court of Appeals and finally to the Supreme Court. Guilty pleas in capital punishment cases are almost unheard of, plus many of these trials result in life sentences anyway, so the state in which the trial is held ends up paying for the costs of the capital case. The extreme costs of capital punishment are actually making America less safe because financial and legal resources are being diverted from effective crime fighting. When a prosecutor decides to pursue a capital case they go to extensive and costly means, this may include the use of forensics, psychology, technology, and witnesses. The states (tax payers) also suffer; security precautions imposed by the death sentence must be paid. In the end the offender may die in prison, so there is no reliable data that the death penalty ... Get more on HelpWriting.net ...
  • 32. Death Penalty Debate Essay The controversial debate over the death penalty has been going on for a very long time and still has no conclusive solution. In the United States that is, most of the rest of the civilized world has done away with the death penalty a long time ago. Many people have different views on this issue. Although, there is a consensus that heinous murders need to be severely punished, there is no consensus on the choice of that punished. The debate over the proper punishment lies between the death penalty and life in prison. Some of the issues that encompass the debate are the morality of the death penalty, the cost of the death penalty as opposed the cost of life in prison, the deterrent effect of the death penalty, family consideration of what... Show more content on Helpwriting.net ... It is definitely true that money should not be an issue when it comes to fighting crime and saving people's lives. However, it is also true that it is necessary to logically and rationally choose the best way to spend the available money for crime–fighting. In the case of the death penalty, so much extra money is spent in legal procedures and appeals that could be spent toward other more deterrent and efficient ways to fighting crime, such as increased police forces, more funding for the war on guns, and other crime–fighting initiatives. In the economic sense, the death penalty is clearly not the smartest and most efficient way to fight crime. One of the most important issues in the debate is the deterrent effect of the death penalty. Deterrent effect, meaning that by having the death penalty as an available form of punishment it will deter future murders from committing their crimes. So supposedly, by instilling this fear of death a murderer will be forced to think twice before they kill. This is not the case, as many studies have shown that the death penalty does not have a deterrent effect. For instance, the homicide rates in states that do have the death penalty and those that don't are generally the same. Furthermore, when states have established the death penalty they have not seen their homicide rates fall (Barkan p. 498). A global statistic that disproves the deterrent effect of the death penalty is that the United States, which in ... Get more on HelpWriting.net ...

My first article talks about what exactly the Death Penalty is. The official definition of Capital Punishment is "Imposition of a penalty of death by the state." The background of the death penalty has been around since ancient times, but in the year 2004, most countries have exiled the idea of the death penalty. As of now, 36 states have reinstated the idea of capital punishment and the death penalty. Most capital sentences in the United States have been cause from murder cases. • 34. The Global Debate on Death Penalty The death penalty is one of the most hotly debated legal issues in the democratic world today. This is particularly the case in the United States, where some states have implemented capital punishment as a response to major crimes and others have abolished the practice. Among legislators, policy makers, and the general public, there appears no likelihood of resolving the debate. The wide array of moral, religious, humanitarian, and criminological views simply appears too divergent to ever meet. At the basis of the debate is the issue of whether capital punishment is a suitable response to severe criminal activity such as murder, or if there are better and more effective ways to respond to these. While there are compelling arguments both in favor of and against capital punishment, one may draw the conclusion that the death penalty serves little purpose beyond revenge, which ultimately does little to compensate the affected parties. Generally, a search for arguments relating to capital punishment tends to result in a majority of articles against this type of response to crimes involving murder. Some writings in favor of this type of justice, however, can be surprisingly compelling. One of these is the article by Jacoby (2003), where he argues for the death penalty without overtly religious or emotional appeals to the reader. Jacoby makes two main points in support of his view. First, the death penalty results in justice for the victims. According to the author, murder is ... Get more on HelpWriting.net ...
  • 35. The Debate Over the Morality of the Death Penalty Essay Senator for Utah Orrin Hatch once said, "Capital punishment is our society's recognition of the sanctity of human life," (Brainy Quote). While the arguments for both sides of the debate over the morality of the death penalty are vast, the bottom line is that the death penalty does not disregard human life, but rather it reveres it, as Hatch said. Morality is defined as, "The quality of being in accord with standards of right or good conduct," (The Free Dictionary). One who seeks to protect a person who has committed a heinous crime such as murder is arguably not in accords with what is right and wrong. Many people arguing whether or not the death penalty should exist. Who's to say whether the death penalty is a form of justice and therefore a valid and appropriate punishment or whether it is a "cruel and unusual" form of punishment. "The Arizona Supreme Court threw out the death sentences for a Tucson man who bludgeoned his girlfriend and her two children to death in 1984 after lying in wait for each of them, ruling that the murders weren't especially heinous even though they were "atrocious" and "senseless"." It is unlikely that any research predicated primarily on current U.S. statistics can discover a trustworthy connection between homicide and execution rates. (Liptak, 2007) Con The most compelling comparison made by Profesor Wolfers is Canada has not used capital punishment since 1962. However, the homicide rates in the U.S. and Canada are comparable since then, counting the four–year death penalty suspension in the U.S. in the 1970s. (Liptak, 2007) Does the death penalty really help deter crime? The theory of deterrence is based on the idea that the threat of punishment must be severe enough to counter the benefits or pleasures that the criminal would receive from the crime. In addition, the punishment must be administered swiftly so that potential criminals will see a clear cause and– effect relationship between the crime and the punishment. The death penalty would be considered a specific deterrence. As a result of their punishment, the criminal can not commit further crimes. There is no doubt that capital punishment serves as a specific deterrent: The executed criminal will never kill again. However, experts and others have long debated whether capital punishment is a more effective general deterrent than life in prison. Some opponents of the death penalty argue that instead of deterring crime, capital punishment actually increases murder rates because the state, through executions, devalues human life. Another argument for the

  • 39. Abolishing The Death Penalty : A Values Debate Essay Abolishing the Death Penalty: A Values Debate Is society better off without its most heinous criminals? Does the justice system have the right to determine who lives or who dies? For centuries, human civilizations have pondered similar questions regarding the philosophical ideologies surrounding capital punishment. The discordance within the United States creates deep divides between proponents and opponents of the death penalty; nonetheless, these schisms are inconsequential due to the continued use of capital punishment for the entirety of American history. With the rise of critical statistical analysis, however, evidence opposing the death penalty paints a clear picture: the policy creates more harm than good. Despite claims that the death penalty makes society safer, the United States should abolish capital punishment because state–sanctioned executions are associated with inefficiency and inequality. The Popularity of Security Conflicting values dominate the debate surrounding capital punishment; and, the arguments made by supporters are easily encapsulated by the value of security. Integral to the defense of the death penalty is the contention that individuals and society should be safe, free of insecurity or worry. In order to provide for the security of Americans, proponents assert that the death penalty serves as a deterrent for crime while also eliminating the potential threat of dangerous criminals. • 40. The Debate Over Death Penalty Parker Coss Professor Reiner Writing 39C 7/20/16 Debates over Death Penalty in the United States The issue of death penalty today is a popular topic for numerous public and scholarly discussions. The death penalty has a long and distinguished history in the United States, as it has been around in some form–either official or otherwise–since the beginning of American society. America originally adopted the British justice system, with hundreds of crimes being punishable by death. Slowly but surely, states began to eliminate the number of things that could lead to the death penalty. Likewise, new methods were introduced, with the electric chair coming about around the turn of the 1900s. The modern death penalty system came after the Supreme Court ruled the death penalty unconstitutional in Furman v. Georgia. Today, the death penalty is only available for murder, only available for people over 18, and not available for people who are mentally retarded. While the differences in punishment between death penalty states and non–death penalty states is severe, the difference in outcomes is not as severe. While one would expect death penalty states to have lower murder rates because of the fear of the death penalty, the opposite ends up being true. In death penalty states, the murder rate has been significantly higher in every year since 1990. States without the death penalty also feature lower general crime rates.
