Under United States law, a refugee is
someone who (USCIS):
• Is living outside the US
• Is of special humanitarian concern
to the US
• Shows that they were persecuted or
fear persecution due to race,
religion, nationality, political opinion,

• Is currently not settled in any other
country
• Can be moved to the United States
Immigrant:
The Immigration and Naturalization
Act , an Immigrant is someone who:
• Any alien who has entered the US,
except those under a non-
immigrant visa category.
• So, it includes anyone who has a
willingness to permanently settle in
the US, and is not in the US on
temporary/non-immigrant visa
(visitors visa, student visa, work
visa)
• Thus, an illegal immigrant is also
