De procedure:
Bij dagvaarding van 13 februari 2009 is tegen [gedaagde] een vordering ingesteld als in de
2. dagvaarding nader omschreven. [gedaagde] zijn in de procedure verschenen en hebben verweer
gevoerd. Vervolgens is schriftelijk verder geprocedeerd. Daarbij is de vordering van
Stadsverwarming Purmerend buiten bezwaar van [gedaagde] vermeerderd (aangepast aan het
tijdsverloop).
De inhoud van die stukken kan als hier ingelast en herhaald worden beschouwd.
Vonnis werd bepaald op heden.
Vaststaande feiten:
In deze procedure zijn de volgende feiten als niet, dan wel onvoldoende betwist, komen vast te
staan.
1. Tussen Stadsverwarming Purmerend, althans haar rechtsvoorgangster, en [gedaagde] bestaat
een overeenkomst tot het leveren van warmte c.a.
2. Klanten van Stadsverwarming Purmerend kunnen de verschuldigde voorschotbedragen óf zelf
betalen, na facturatie (met gebruikmaking van een acceptgirokaart, dan wel via internet) óf een
machtiging tot automatische afschrijving afgeven, in welk geval niet wordt gefactureerd.
[gedaagde] betalen via internet.
3. Tot en met januari 2005 bracht (de rechtsvoorgangster van) Stadsverwarming Purmerend haar
klanten geen kosten in rekening voor het betalen met een acceptgirokaart of via internet. Met
ingang van 24 februari 2005 bracht zij daarvoor maandelijks echter een bedrag groot € 1,50 in
rekening onder de vermelding ‘acceptgiro’. Met ingang van 16 juni 2006 is die vermelding
gewijzigd in ‘administratiekosten per toegezonden factuur’. Thans is dit tarief gestegen tot € 2,--
per factuur.
4. [gedaagde] hebben geweigerd deze in rekening gebrachte kosten van betaling te voldoen en
hebben daarover herhaaldelijk bij Stadsverwarming Purmerend geklaagd. Van de kant van
Stadsverwarming Purmerend is niet serieus op die klachten gereageerd. Volstaan is met het
toesturen van de door Stadsverwarming Purmerend gehanteerde Algemene Voorwaarden
Kleinverbruikers van 1 juli 2004. Wel werden aanmaningskosten in rekening gebracht.
5. In artikel 15 van de hiervoor bedoelde algemene voorwaarden, dat over de betaling gaat, wordt
vermeld dat alle verschuldigde bedragen door middel van een nota in rekening worden gebracht.
Geen nota wordt verstuurd voor voorschotbedragen, waarvoor een machtiging tot automatische
afschrijving is verstrekt. Van enige verplichting om een dergelijke machtiging af te geven is geen
sprake. Evenmin wordt iets vermeld over bijkomende ‘kosten’ indien zonder machtiging wordt
betaald.
6. In artikel 14 van de hiervoor bedoelde algemene voorwaarden, dat over de tarieven gaat, is
voor zover thans van belang bepaald dat voor het tot stand brengen, in stand houden of wijzigen
van een aansluiting en voor de levering door de gebruiker bedragen verschuldigd zijn volgens de
tarieven- en vergoedingsregeling van het bedrijf. Het bedrijf bepaalt welk tarief van toepassing is.
Blijkens de overgelegde tarievenlijst per 1 januari 2009 wordt voor het factureren via een
acceptgirokaart thans € 2,-- in rekening gebracht. Dat was voorheen € 1,50.
3. De vordering:
Stadsverwarming Purmerend vordert na vermeerdering van eis de ontbinding van de overeenkomst
tot levering van warmte c.a. betreffende het verbruikadres aan de [adres], met hoofdelijke
veroordeling van [gedaagde] tot betaling van een bedrag van € 508,67 vermeerderd met
buitengerechtelijke kosten en rente, met veroordeling van [gedaagde] in de proceskosten.
Daarnaast vordert zij veroordeling van [gedaagde] tot betaling van de maandelijkse
voorschotbedragen
ad € 101,54 na april 2009 én voor het geval [gedaagde] de gevorderde hoofdsom en rente niet
voldoen, veroordeling van [gedaagde] om haar monteur toe te laten, teneinde hun van verdere
warmteleveranties af te sluiten.
Op grond van de toepasselijke bepalingen zijn er (thans) kosten verbonden aan het versturen van
acceptgirokaarten, voor zover er geen automatische incassomogelijkheid is. [gedaagde] betalen
niet via automatische incasso, zodat zij die bijkomende kosten verschuldigd zijn.
Het verweer:
[gedaagde] betwisten dat zij de kosten voor acceptgirokaarten dienen te betalen. Al sedert 24
februari 2005 hebben zij Stadsverwarming Purmerend ervan op de hoogte gesteld deze niet te
zullen betalen, maar die heeft slechts algemene voorwaarden toegezonden waarin geen spoor van
acceptgirokosten valt te ontdekken. [gedaagde] hebben bewust niet gereageerd op
betalingsherinneringen. In reactie op de conclusie van repliek/tevens vermeerdering van eis
hebben [gedaagde] aangevoerd dat de algemene voorwaarden waarover zij beschikken gedateerd
zijn en dat Stadsverwarming daar geen rechten aan kan ontlenen. De verbruikskosten hebben zij
inmiddels via girotel aan Stadsverwarming betaald en zij claimen inmiddels een bedrag van €
250,13 wegens gederfde kosten.
De beoordeling van het geschil:
Het geschil spitst zich toe of [gedaagde] verplicht waren en zijn de door Stadsverwarming in
rekening gebrachte kosten van betaling te voldoen.
De kantonrechter overweegt daartoe als volgt.
Volgens het bepaalde in artikel 6:114 lid 1 van het Burgerlijk Wetboek zijn [gedaagde] bevoegd om
het aan Stadsverwarming Purmerend verschuldigde via internet over te maken. Die bevoegdheid is
contractueel niet uitgesloten of beperkt. Gesteld noch gebleken is dat daaraan kosten, zoals
4. bedoeld in artikel 6.47 van het Burgerlijk Wetboek, zijn verbonden. Zo bezien bestaat er geen
enkele grond om van [gedaagde] bijkomende kosten van betaling te vorderen. Dat
Stadsverwarming Purmerend voor het administreren van inkomende betalingen kosten moet
maken ligt voor de hand. Dergelijke kosten behoren echter tot de algemene bedrijfskosten die zij
via haar tarieven terug moet zien te verdienen.
Dat is alleen anders indien partijen daarover rechtsgeldig iets anders zouden hebben afgesproken.
Daarvan is echter niets gebleken.
De door Stadsverwarming Purmerend gehanteerde algemene voorwaarden zwijgen daarover. Dat
artikel 14 zou voorzien in de mogelijkheid dergelijke kosten in rekening te brengen kan de
kantonrechter daarin niet lezen. Op zijn minst is deze bepaling op dat punt onvoldoende duidelijk
en begrijpelijk geformuleerd, zodat zij op dit punt niet tegen [gedaagde] mag worden gebruikt
(artikel 6.238 lid 2 van het Burgerlijk Wetboek).
Maar ook al zouden deze voorwaarden wel een grondslag bieden voor het in rekening brengen van
dergelijke kosten, dan nog zou de kantonrechter deze als onredelijk bezwarend buiten toepassing
laten. Het is immers onredelijk bezwarend te achten om consumenten op straffe van een
kostenopslag feitelijk te dwingen tot het afgeven van een machtiging tot automatische
afschrijving.
Samenvattend moet worden geoordeeld dat Stadsverwarming Purmerend geen recht heeft op de
door haar in rekening gebrachte kosten van betaling. In het verlengde daarvan heeft zij evenmin
recht op (mogelijk) in rekening gebrachte kosten van aanmaning, voor zover die voortvloeien uit
de weigering van [gedaagde] om bedoelde kosten van betaling te voldoen.
Stadsverwarming Purmerend zal in de gelegenheid worden gesteld om haar vordering te
herberekenen en te actualiseren (dus alleen het actuele saldo werkelijke voorschot- en/of
eindafrekeningen), met gelijktijdige herberekening van vertragingsrente.
Op voorhand kan verder al worden aangekondigd dat de gevorderde ontbinding van de
leveringsovereenkomst, gelet op het principiële karakter van deze procedure, niet voor de hand
ligt, voor zover niet alsnog blijkt dat [gedaagde] zijn gestopt met het betalen van hetgeen zij wel
verschuldigd zijn. Buitengerechtelijke incassokosten zullen evenmin worden toegewezen, al was
het maar omdat Stadsverwarming Purmerend onbetwist niet serieus heeft gereageerd op de
terechte klachten van [gedaagde]. Stadsverwarming Purmerend kan haar vordering wat dat betreft
verminderen.
Waar [gedaagde] bij conclusie van dupliek betaling vorderen van ten behoeve van deze zaak
gemaakte kosten, wordt reeds thans opgemerkt dat een tegenvordering uiterlijk bij de conclusie
van antwoord (eerste verweer) had moeten worden ingesteld. Overigens worden proceskosten
zelfstandig door de kantonrechter begroot en toegewezen.
5. De beslissing:
Stadsverwarming Purmerend wordt in de gelegenheid gesteld haar vordering met inachtneming
van het voorgaande bij akte te herberekenen en desgewenst te verminderen.
Dat moet gebeuren ter terechtzitting van 20 augustus 2009 om 10.00 uur (civiele rolzitting).
[gedaagde] hoeven daarvoor niet te komen. Zij krijgen nader bericht wanneer zij schriftelijk op de
akte van Stadsverwarming Purmerend mogen reageren.
Iedere verdere beslissing wordt aangehouden.

terechtzitting van bovengenoemde datum.
