Recently, McKinsey republished an article from 1976 entitled ‘ Sex bias – still in business ’ with the following 2014 introduction:
Despite much talk of equal opportunity for women, discrimination persists in business. This 1976 McKinsey Quarterly article, part of a series celebrating our 50th anniversary, shows how companies should correct disparities that are illegal, immoral, and bad for business.
Curious as to how a 38 year old article could offer fresh and relevant insights into a subject close to my heart, I sat down with keen anticipation to read it. My enthusiasm was quickly dispelled by tedium and increasing frustration. The article was too predictable. It gave a prescription of organisational measures to create greater opportunities for women, but the only reason it gave for doing so was ‘unfairness’ and the need to conform with legislation. I struggled to understand why McKinsey were bothering to republish it in 2014 – it certainly did not provide thought leadership..
Whilst the right of women to equal opportunities is undeniable there are even more positive and compelling reasons to advance their role in business. Ask yourself whether ‘the fairer sex’ or ‘the testosterone-fuelled sex’ are likely to fare better on the following, research-validated characteristics of Top 1% companies:
• Decisions, which can occasionally be bold and radical, are made on the basis of quiet, calm insight and understanding, not bravado.
• There is an holistic culture with a long-term, nurturing perspective and a recognition of the constant need to improve and to learn, personally and collectively.
• Staff regard the company as if it was their family and describe it with affection as an open, honest and supportive environment in which standards are high, but everyone’s contribution is valued.
As marketers, we are tasked with continuously driving and adapting to change. A role like ours requires an appetite for constant learning—from the leading thinkers in our field, as well as from our peers.
In an attempt to learn from each other as a community, and to gain insights and perspectives across industries, I thought it would be instructive to invite top CMOs to share their best reads, and why these books have made it to the top of their reading lists.

Women in business should especially use emotional
intelligence to lead. They use the same skills as any good
leader: visionary, strategic, innovative, good communicator,
trustworthy, problem-solver, accountable, empathetic,
transparent, humble, and resilient. There are two traits that
women leaders need to have in order to be effective:
humility and inclusiveness.
When you are humble, you are able to acknowledge and
recognize your mistakes. When you don't center yourself in
your leadership role, it creates trust. By being inclusive, a
leader is creating a culture of belonging - where people feel
safe to be authentic and have their voice heard. Numerous
studies have shown that when people feel like they are
valued, not only are they more engaged in their work, but
the company experiences increased productivity and
profitability.

encourages everyone to bring their best. An impactful

Co-Founder at Cucumber Clothing. According to Eileen,
these important traits should be possessed by every leader,
but equally important are those of empathy, emotional
intelligence, integrity, vision and humility. The combination
of all these traits together allows for a rounded leadership,
one that allows for the strength of dissention, resilience in
the face of discord and ultimately success of the team as a
whole.
In an interview conducted between Eileen and Insights
Success, he sheds light on her entrepreneurial journey and
how she headed Cucumber Clothing to reach where it is
today.
Below are the highlights of the interview:
How do you diversify your organization’s offerings to
entice the target audience?
At Cucumber, we are proud for what we stand for, this
includes our strong commitment to sustainability and our
support for women at all stages of their lives. We believe
this can be seen in our dedication to customer service that
encompasses personal follow ups to all enquiries, as well as
ensuring that the products we offer are the ones our
customers want. We do this through constant attention to
where our sales lie, as well as reaching out to our wonderful
customer base by email, social media and focus groups.
What roadblocks or challenges were faced by you in a
corporate business? And how did you overcome them?
Every business faces multiple stumbling blocks, from the
small irritations of an email being bounced back to more
serious ones that affect customers or cash flow. We have
had our fair share of challenging moments. One of the most
serious was our first foray into outsourcing fulfillment. At
great cost we moved all our stock to a distant warehouse
and entrusted a fulfillment company to send out our orders.
With strict instructions as to how to pack, how to label to
try and ensure a seamless continuation of our five star
customer service we were dismayed and then horrified to
find that customers were receiving the wrong items, double
orders and some orders marked ‘shoes’ (we do not make
shoes.) We quickly moved back in house, lesson learned.
According to you, what essential traits should a business
leader possess to thrive in any given competitive
market?
The world of business shares some characteristics with the
world of academe. With a goal to achieve (read thesis) one
of the key supports is the undertaking of deep and serious
research. These investigations must cover competitors, data
analytics, new material and manufacturing technology, the
latest social media and online technology to name but a few
areas. A keen interest in facts and figures is an absolute
essential for a successful business leader. Working in
vacuum is not realistic, however brilliant an idea may be, it
has to reside in the real world.
Where are you focusing your energy now, and where do
you hope to make an impact next?
The background to business of the last twelve months has
been one of chaos and bewilderment, to put it mildly. No
sector has been untouched and fashion and retail have been
on a what feels like a high speed roller coaster ride. With
this in mind we have spent much of the past year focusing
on the consolidation and reorganization of our business to
ensure that as the world begins to open up, we will be
ideally placed to benefit. Right now we are focusing our
energies in creating new supply lines, accelerating the

What is your idea of impactful
leadership? What style of leadership do
you personally prefer and have
implemented within your team at
Cucumber Clothing?
Following on from leadership traits above,
for me personally, impactful leadership is a
troika led by inspiration, vision and
emotional intelligence. A leader must have
the original vision. This is what every cog
in the business ultimately is working
towards achieving. A successful leader
must also be able to inspire passion for this
vision, both within themselves and their
team. Finally, a business is a community.
How we treat and interact with those within
that community will always play a major
role in how that community functions. To
be able to lead, to be able to have an impact
as a leader, draws on deep wells of
emotional intelligence. A leader must be
able to gauge and understand each
employee’s strengths and weaknesses. They
must be able to utilise the former and
improve the latter. What is emotional
intelligence other than a type of kindness?
An acknowledgement that we are all
different and all have a role to play. A true
leader is understands this instinctively.
What have you envisioned for your
organization’s future, with regards to
your role at Cucumber Clothing and for
your personal ambitions as well?
At Cucumber we are keen to be recognized
as a brand leader in sustainable, luxury
leisurewear that empowers women. Quite a
mouthful, but we have been ploughing all
our energies into making this happen and
feel we have come a long way since our
launch only three years ago. On a personal
note, I am very keen to become more
involved in leveling the playing field for
those of a diverse background entering the
start-up world. I am a featured member of i:Entrepreneur, a campaign
celebrating, championing and shining a light on small businesses
founded by entrepreneurs of diverse backgrounds; a founding member
of the Allbright Diversity and Inclusion Committee, as well as a
shortlisted candidate for the 2020 Asian Women of Achievement
Awards. Finally, after a year of global turbulence, what I really wish
for is a future of peace where we can spend time with those we love
and hug them once again.

Playing Responsible Roles Judiciously
The survival of mankind depends on three things: clean
water, food, and a livable environment. These
fundamental needs of every living entity must be
sustainably met for all time to come. Food and water
contaminated with bacteria and fungi have the potential to
destroy human health and end life on Earth. Taking this threat
straight on, Aequor was founded. Aequor is a biotech
company that developed new chemicals that kill a broad
spectrum of bacteria and fungi - including the antimicrobial-
resistant (AMR) "Superbugs" for which there is no other cure.
Aequor's lead chemical was also validated as the only non-
toxic remedy to remove the bacteria and fungi's protective
"biofilm" shield and inhibit biofilm formation. Biofilm is the
root cause of contamination, corrosion, infection, and disease
on land and the marine fouling (barnacles, mussels, algae) on
surfacesincontactwithfresh andsaltwater.
The leading light ofAequor is Marilyn Bruno, the CEO of the
company. After three decades in male-dominated careers
before joining Aequor, she has been an inspiration to many
women to enter into any career of their choice. ButAequor has
been a real challenge. Marilyn finds appalling that statistically
only2.7% of women-ledbusinesses getinvestmentfunding.
HighlyEducated and DiverseExperiences
Marilyn Bruno has had several totally disparate careers:
international academic administration, finance, trade, law
and diplomacy. First, Marilyn was a Spanish Literature
major at Mount Holyoke College in Massachusetts during
the revolutionary '60s, and headed to Madrid to do her
Masters' degree with the NYU in Spain academic program.
After earning her M.A., NYU hired her as an administrator
of the program. She worked for NYU for the next 10 years,
growing the program to 300 students and 80 faculty
members, earning her PhD and teaching as Adjunct
Professor of Medieval to 17th Century literature. She left
Spain in the early '80s with her infant daughter and became
a stock and commodity broker on Wall Street, VP at a bank,
and ultimately started a computerized trading system in
collaboration with the General Electric Information
Services Company -- the only company with commercial
satellite access at the time.
Award Winning Entrepreneur
Marilyn’s proprietary trading system, called Tradetech, was
pre-Internet, pre-eBay, pre-Amazon and pre-Wikipedia but
it had email, research and auction features that supported
over 70 complex international trade transactions, as she
pioneered the use of barter and countertrade to finance U.S.
exports to cash-strapped countries in Latin America and
Europe. When Marilyn travelled with her Compaq
computer (the first portable, 20 lb., machine), Customs
officials would ask her why she was traveling with her
sewing machine.
Ten years later, she received many awards, including
Woman Entrepreneur of the Year, featured in Business
Week, appointed to the U.S. President's Blue Ribbon Task
Force on National Security, etc.
After an unfriendly takeover of Tradetech by GE, Marilyn
went to New York Law School, graduated in 2.5 years,
passed the Bar exams of NY, NJ, FL and was waived into
the DC Bar. Marilyn is licensed to argue before the

16. Supreme Court. She was a Clerk at the Court of
International Trade when she was accepted into the U.S.
Foreign Service. She served 16 years in the Diplomatic
Corps as an Economic Officer both at the State Department
in Washington, D.C. and at U.S. Embassies overseas,
handling the food security, pandemic threat, and
environmental portfolios among others. Marilyn resigned
her Foreign Service post to work full time as CEO of
Aequor - a company founded by her daughter, Cynthia
Burzell, now a Ph.D. Marine and Medical Microbiologist
and the scientist who made the breakthrough discovery of
novel chemicals in the ocean that kill the Superbugs.
Contributing to the UN Health Goals
Cynthia discovered a new genus and several new species of
marine microbes (she named one after Marilyn) and
extracted the remarkable new chemicals. Aequor has now
patented over 70 non-toxic, “green,” eco-friendly, and
sustainable chemicals — dispersants, cleaning, antibiofilm,
antifouling, antimicrobial agents — and several proprietary
“green” products containing them. Cynthia offers microbial
and biofilm testing services to third parties to determine
whether the antimicrobials in their products, devices,
coatings, etc. are able to kill the AMR Superbugs.
Aequor is the only company dedicated to the United
Nations (UN) "One Health" goals to control pandemic
threats from their 3 sources of transmission: animals,
humans and the environment (water, food, air, surfaces,
etc.). Aequor's green chemicals can replace the toxic
biocides that accumulate and persist in the environment,
triggering further antimicrobial resistance and spawning
stronger Superbugs.
And Aequor is helping to save the Space program. The
bacteria and fungi hitchhiking up to the International Space
Station were contaminating the water reuse/recycling
system used for life support. In the micro and zero-gravity
environments and exposed to radiation, the bacteria and
fungi form thicker biofilm and quickly become resistant to
silver and other antimicrobials. After a 3-year pilot project
with NASA, one single treatment of Aequor's chemicals
removed the biofilm from the water system in minutes and
remained active for 15 months without replenishment.
NASA became Aequor’s first customer.
Creating Sustainable Sources of Food
Aequor's treatments were tested in algae cultivation
systems and yeast fermentation systems converting plant
residues into new products. Aequor's treatments boosted
the productivity of algae and plant biomass by up to 40%
in half the time. This boosts the profitability of new
sources of biobased, sustainable sources of food -- like the
meatless burger, yoghurt and ice cream. These treatments
also boost the profitability of biofuels to replace fossil
fuels and cut CO2 emissions.
Allowing Specialists to Specialize
Marilyn considers that it is important for business leaders
to have vision. She advises to look 10 years into the
future, identify needs and come back to the present to
prepare for them. Marilyn lets the specialists specialize.
Cynthia liaises with a Scientific Advisory Board and
Marilyn liaises with a Business Advisory Board. This
virtual, capital-efficient model is well-suited for a
company like Aequor, where its proprietary chemicals can
be used in multiple verticals. Aequor seeks licensees to
run with the spinoffs: water treatments, surface cleaners,
algae/yeast boosters, new drug candidates. Of course,
Aequor is always looking for investors. In the upcoming
years, Marilyn sees Aequor as a $ billion company,
Cynthia receiving a Nobel Prize, and she writing her
book.

until being in a leadership position at Towerwall.
Before founding Towerwall in 1993, I ran the US
operation of CDG Technologies, growing the IT
consulting and VAR business exponentially before
selling it to a public company. I stayed with the new
company but grew disenchanted by the direction, so I
decided to buy back the company and make it mine!
That was my proudest moment in business. For nearly 30
years I’ve worked closely with many SMBs, mid-market,
and enterprise companies providing highly specialized
cybersecurity technology and services.
What roadblocks or challenges were faced by you in a
corporate business? And how did you overcome
them?
Security is a journey, not a destination. Keeping up with
the growing list of regulatory mandates and upcoming
data privacy laws can be challenging. A great example is
a client who came to us to help them answer a seemingly
simple GRC security questionnaire from one of their
customers. In doing so we discovered they needed an
entire information security infrastructure to protect not
only their own intellectual property but their customers
as well. The big challenge was getting a plan in place in
a very short time span to ensure they could continue
doing business.
What is your idea of impactful leadership? What
style of leadership do you personally prefer and have
implemented within your team at Towerwall?
I am a firm believer in servant leadership. Our team is
incredibly talented and committed to not only our
profession but to our clients and our community. By
serving and empowering them “we” are able to
effectively and efficiently solve our client’s information
security challenges. In the end, our clients receive
superior service and result knowing our team is highly
collaborative.
How do you diversify your organization’s offerings to
entice the target audience?
Information security is all we do. We are highly focused
and specialized in protecting our client’s critical assets.
We take great pride in being our client’s trusted security
partner by working along-side in addressing the daily
challenges they face in securing key data as well as
keeping them abreast of the evolving legal and
regulatory requirements. We build security user
awareness programs that take their employees from
“weakest link” to “strongest asset”, a winning
combination.
What are the vital traits that every woman business
leader should possess?
I would say every leader no matter their gender, should
place integrity, honesty, and client needs ahead of any
profit motive. I always say “You only have one
reputation so honor it”. So for us, it's easy, we demand
excellence and hold each other accountable which I
attribute greatly to our success. I learned a long time ago
a great leader surrounds themselves with “GREATER”
people. I am very blessed to have an exceptional team.

20. According to you, what essential traits should a
business leader possess to thrive in any given
competitive market?
Focus, determination, and compassion. We all face
challenges in our personal and business life (especially
in the world of COVID), but the ability to persevere is
the difference between success and failure. Particularly
in business, it’s being highly focused on solving your
customer’s needs. As I mentioned before, Information
Security is what we do so our entire team is focused on
just that. They are highly experienced and versed, in the
key challenges CIO, CISO, ISO, and DPO’s face. To cite
by example, Towerwall often competes and wins against
the “big guys” because our team has a “run through the
wall” attitude when we are maturing our customer’s
security programs.
What have you envisioned for your organization’s
future, with regards to your role at Towerwall and for
your personal ambitions as well?
The bad guys are getting “badder” and we are helping
our customers build repeatable processes to protect
themselves. In addition to our corporate headquarters in
Massachusetts, we operate throughout North America
and Caribbean countries. Our service set continues to
evolve and adapt to changing market conditions and the
regulatory framework. We are growing organically as
well as through partnerships to better help our customers.
Again, our “run through the wall” attitude will take us a
long way.

Emmeline Pankhurst
“You must make women count as much as men; you must
have an equal standard of morals; and the only way to
enforce that is through giving women political power so
that you can get that equal moral standard registered in the
laws of the country. It is the only way.”
Born on July 14, 1858 Emmeline Pankhurst worked for
woman suffrage. She was the leader of the suffragette
movement whose 40-year campaign achieved complete
success and led to the vote being granted to women who
fulfilled the criteria of being over the age of 30, owned
property or were married to a man who owned property.
Before her death British women obtained full equality in
the voting franchise. Emmeline’s daughter Christabel
Harriette Pankhurst also was well-known for her
participation in woman suffrage movement.

nonviolence. She served as president of the Women’s
International League for Peace and Freedom until 1929 and
then as honorary president for the rest of her life.

health and her journey throughout. Below are the highlights

Take our readers through your professional journey
until being in a leadership position at SynxBody.
I’m Rachael Ferguson, an international award-winning
podiatrist and entrepreneur, author and keynote speaker. I
created SynxBody with my co-founder in 2011 after we
identified a gap in the market for a slim insole that fitted
into more shoes. We used our podiatry experience to design,
develop and bring to market an insole, including a system
for health professionals to modify them.
We trademarked and patented our insole design globally
and in 2015, appeared on the hit TV show Shark Tank and
landed a deal with shark Andrew Banks who still remains
an investor to this day.
In the early years there was a great deal of time away from
our families and time spent overseas, with my energy
always split between leading two businesses, my podiatry
practice and SynxBody, being a mother of two young
children and a wife. Trying to make everything balance was
proving impossible.
In 2017, my co-founder exited the business, at which time I
made the difficult decision to walk away from my podiatrist
practice and lead SynxBody as CEO. On reflection, it was
a risky decision, but I researched and strategized on what
was needed to take SynxBody to the next level.
My world changed when I engaged a business coach,
started journaling, meditating, reading, exercising and
eating better. Having the discipline to show up at 5am every
day and repeat the same routine was the key to unlocking
my full potential.
Then in 2018, SynxBody finally started to grow and
become wildly successful with opportunities for
international growth on the horizon.

Amongst Equals in Western Australia and Ausmumpreneur

How do you diversify your organization’s offerings to
entice the target audience?
In 2018, after a huge overhaul in packaging, I added
another three brands and ten new products to the SynxBody
range, all whilst securing ranging of our patented insole,
Synxsole in Australia’s biggest retailer, Chemist
Warehouse. This was a turning point in the company with
more products added to the range over the next three years.
We are also in the final stages of formulating new pain
relief products, a cream and oral capsules under our new
brand Synxeaze®. Our goal is to create, formulate and
bring to market Australian made organic range of pain relief
products.
Where are you focusing your energy now, and where do
you hope to make an impact next?
I am currently focusing my energies on our new Synxeaze®
pain relief range of topical and oral products which will hit
the shelves in Australia by June 2021. I am also continuing
to expand my other product ranges by bringing new
products to the market by the end of 2021 and expanding
our product range in the USA.
What is your idea of impactful leadership? What style of
leadership do you personally prefer and have
implemented within your team at SynxBody?
Impactful leadership is not being afraid to challenge the
status quo and standing up for what is right. I also believe
that exceptional leaders pay close attention to detail, stay
true to their values and never lose sight of the needs of their
team members or customers.
I like to model these beliefs by demonstrating care,
compassion and understanding to my team whilst still being
strong and considered in my business decisions. I consider
my style of leadership to be a mix between democratic and
affiliative leadership types, encouraging my team to
contribute to our decisions regularly.

29. Synxbody’s biggest challenge, which in turn became
integral to the business growth was recognizing the
product’s packaging was too dark, as well as identifying
there was a need for a variety of products for a broader
customer base. So, the packaging was redesigned whilst
developing a plan for 3 new brands with 10 new products,
that I considered would solve the most common foot
complaints.
SynxBody grew from a struggling venture to being stocked
in major pharmacies by rebranding and repackaging the
product range to stand out on the shelves and pivoting our
marketing plan. Through consistent effort and hard work,
we are well on our way to expanding our international
channels.
Not only did I invest in the business, but more importantly,
I invested in myself.
What have you envisioned for your organization’s
future, with regards to your role at SynxBody and for
your personal ambitions as well?
SynxBody is on a mission to educate the public on the
importance of foot health and to change the way people
think about preventative care. We aim to achieve this
through creating products to help keep people on their feet
and pain free because your health really starts from the
ground up.
I strive for SynxBody to be a household name around the
globe by 2025.
Personally, I am dedicated to inspiring women in business
to dream bigger, reach further and break down barriers to
reach their full potential.

ARebecca Baumgartner is of the opinion that if
2020 has taught us anything, it is that nothing will
go according to plan. One will have to pivot on a moment’s
notice. If you are slow or resistant to change or setback, you
will be unable to stay relevant in any type of market
disruption. Inculcating the same approach and traits,
Rebecca has set a noteworthy instance of an impactful
leadership. Currently, she is the Sr. Diversity and Inclusion
Manager at Ogletree Deakins.
From Working at a Casino to Being an Inclusion
Manager
I took a fairly serpentine path to where I am today. My first
professional role was in restaurant management at a casino.
I soaked up every morsel of knowledge and experience that
I could. Unfortunately, I didn’t necessarily have the
guidance or support to really help me understand how to
implement this information, how to actually be a leader in
my own right instead of mimicking leadership traits of
others. There were some painful times, and I became
dedicated to seek out knowledge and development for
myself. The more I learned, the more I realized that I didn’t
actually like the operations side of my job. I became
extremely disengaged and didn’t feel like I was where I was
supposed to be. The only enjoyment I had, came from
leading and developing people. I took advantage of an
opportunity to assist the company’s corporate training
department and become a training facilitator for the local
property. I felt like a whole new world opened up for me
and I finally was able to be my best self at work. Shortly
after, I was hired into a training and leadership development
role at another casino company.
Because of the nature of a casino’s operations, the work
force is extremely diverse. From its EVS/custodial crew to
table dealers to marketing professionals, there is a vast
array of difference in terms of ethnicity, race,
socioeconomic status, education level, etc. I noticed that
there was not a strong effort to take these differences into
consideration in my department. I have always been
focused on equitable treatment, meeting individuals where
they are and giving them what they need to succeed as
opposed to a “one-size-fits-all” approach. This was my first
real “a-ha” moment regarding how historically
underrepresented individuals were getting left behind.
After moving into a Human Resources Manager role, I
began working at a law firm that was at the beginning of its
D&I journey. I became the staff leader of the attorney
inclusion and diversity committee and was able to work

directly on issues like access to development and
advancement for non-majority individuals in a formal
capacity. Similar to how becoming a facilitator earlier in my
career felt like a new world, this was truly transformational.
When Ogletree Deakins posted a position for a diversity
and inclusion leader, it felt like the stars were aligned for
me.
Making a Difference
Most of my focus right now is on Ogletree’s equal justice
task force that the firm created in response to the murder of
George Floyd, Ahmaud Arbery, and Breonna Taylor and the
subsequent civil unrest that followed. The belief that we
have a responsibility as legal professionals to advance
justice led the formation of ODACT (Ogletree Deakins Act,
Change, and Transform). The group focuses on four main
areas where we feel we can make a difference: Voter
Education, Internal Policy Reform, Criminal Justice Reform
and Pro Bono, and Local Office support and education.
Even though it was only formed in July 2020, the group has
already made huge steps. We organized a firm-wide
volunteer effort where dozens of Ogletree lawyers and
paralegals volunteered for shifts staffing the Lawyers’
Committee for Civil Rights Under Law’s non-partisan
National Voter Hotline and served as Poll Watchers. We
have already created and implemented new firm policies
around billable hour credit for DEI work, unlimited time off
for voting, creating a firm holiday for Juneteenth, and
hosting open forums for attorneys and staff to have a safe
space to discuss the issues that are impacting their
emotional and mental well-being. We partnered with the
Equal Justice Initiative and Bryan Stephenson to raise
almost $100,000 for EJI through an internal fundraising
campaign. We are also leveraging the firm’s collective labor
and employment expertise to work with clients to provide
employer qualified immunity and training on matters
regarding employment for those with arrest and conviction
records.
This is a top priority for me and the firm. We have the
ability to impact not only our Ogletree family, but our
clients and communities as well.
Being Flexible is the Key
For me, impactful leadership is the ability to be flexible
with your style and approach. Every single person is unique
in how they learn, respond, grow, etc. You can’t be effective
and impactful to every one of these individuals with the
same leadership style. Some people thrive under a more
democratic style, others need a more structured
transactional approach. A strong leader is able to dip into
each of these buckets to meet their team where they are
while also staying true to themselves.
There are two traits that I feel all leaders need to have in
order to be effective: humility and inclusiveness. When you
are humble, you are able to acknowledge and recognize
your mistakes. When you don't center yourself in your
leadership role, it creates trust. By being inclusive, a leader
is creating a culture of belonging - where people feel safe to
be authentic and have their voice heard. Numerous studies
have shown that when people feel like they are valued, not
only are they more engaged in their work, but the company
experiences increased productivity and profitability.
A Roadmap Ahead
Ogletree has always been a leading force in DEI in the legal
industry. I think our newly created equal justice task force,
ODACT, will continue to provide opportunities for further
growth, development, and innovation. Generally, law firms
tend to focus most of their efforts on lawyers, as they are
revenue generating, and fail to be truly inclusive of
professional staff. One of my goals moving forward is to
disrupt this habit at Ogletree and have more cohesion and
support around staff diversity efforts. I envision a structure
that is not only inclusive of all employees at Ogletree,
where they are interconnected and collaborative, but
provides holistic support from ethnicity, gender, gender
identity, socioeconomic status, geography, religion, mental
health and emotional wellness, and more.
I am always looking to grow and develop. Ogletree has
been extremely supportive of any professional development
or skills training that I have expressed interest in. Not only
have I been able to achieve my Certified Diversity
Executive credentials, I am working towards a coaching
certification this year. One of my biggest goals, however, is
to increase my involvement here locally in Kansas City.
There are so many great organizations fighting for and
working towards racial equity and justice in our
communities, and I feel that I can help make an impact
close to home.

1. The Impact of Covid-19 on Divorces
I am often asked about the impact of Covid-19 on
the rate of divorce and couples’ attitude to
divorce. The truth is that, as yet, we do not know
the full impact. I have seen statistics pointing to
an upwards trend but also a lowering of the
divorce rate. The decision to separate or divorce is
one which takes months, and often years, so
whilst the pandemic may have acted as an
accelerator for some couples, it is hugely unlikely
to have been the cause of a relationship coming to
an end.
What I have seen in practice is a change in
couples’ attitudes to divorce and separation. I have
been a family law barrister for 16 years, and
certainly in the last 5 years I have seen a
noticeable shift in the way separating couples
approach divorce. Most do not want conflict for
conflict’s sake. They recognise that some
relationships have a shelf-life, and that does not
mean that they are a failure, it just means that the
marriage has run its course. Increasingly, couples
are viewing divorce as a shared obstacle to
navigate together. And they are quite right to take
that view. Ultimately, the only way to achieve a
fair outcome on divorce is to reach an agreement
which you can both live with and recognise as
fair.

36. When I co-founded The Divorce Surgery in 2018, we were
the first and only regulated service in England and Wales
enabling separating couples to share one impartial lawyer,
who advises them both, together, as to what a Court would
view as fair with regards to the division of their finances or
arrangements for their children. We were described as a
‘disruption’ of the family law market. But what we do is in
fact the default in many other European jurisdictions. And
the success of our One Couple One Lawyer model comes
from the fact that the vast majority of separating couples do
not start their separation wanting an acrimonious, lengthy
and costly legal battle. They just want an outcome which
works for their family and is fair on everyone.
If anything, the pandemic has given us all a wake-up call as
to what matters in life. I believe we are going to need to
work hard to retain those perspectives as lockdown lifts.
But some changes are irreversible. My hope is that one of
the lasting impacts of Covid-19 is for us all to reflect on
why, as a society, we stigmatise divorce. 42% of marriages
end in divorce. That is not a failure. It is most likely
inevitable given the fact that people change as they grow
older, and can grow apart. But if couples approach
separation in the same way that they approached marriage
in the first place, with respect, dignity and a shared sense of
responsibility to do it right, but ditch the shame and the
guilt, we can enable a much kinder, more positive
experience.
2. Effective Parenting through Pandemic and Beyond
Co-parenting is a life-long endeavour. Whether a marriage
lasts or doesn’t is an issue for the adults, but really must be
kept in that adult domain. When children are dragged into
the adult dispute, we are depriving them of the opportunity
to be children. No parent starts a separation wanting
conflict. But it can be very difficult to see each other’s
perspectives and work together when emotions are running
high. Which is why professional support is so crucial, and
the earlier the better.
It may surprise you to hear that I don’t think a parent’s first
port of call should be a lawyer. In most situations, parents
first need therapeutic rather than legal support, unless of
course a family member is in a situation where their safety
is at risk. Decisions surrounding the right arrangements for
children on divorce involve a multitude of disciplines. Yes,
parents will want to understand the legal landscape, and
should receive specialist advice on this, but they also,
crucially, need to learn how to be effective co-parents living
apart. To redefine their adult relationship into one which
supports both the adults and children in the many years of
co-parenting ahead. This is why, at The Divorce Surgery,
we have pioneered our Living Apart Parenting Together
service, which enables separating parents to share both a
co-parenting expert and a lawyer who can, together, help
them navigate the separation well and reach a child-centred
agreement about the arrangements for their children.
3. The Road ahead for Courts, Judiciary and Family
Law
We are at an important crossroads in Family Justice. There
is agreement across the board by Family Judges and
lawyers alike that the Family Courts should be the absolute
law resort for families. Research has consistently shown the
damaging impact on children and adults alike which results
from being in conflict, and adversarial legal proceedings
can cause emotional harm to those involved in them. A
report from the Nuffield Family Justice Observatory in 2019
found that of all separating couples in England and Wales,
38% end up in court over the arrangements for their
children on separation. It is estimated that at least 25% of
those do not need to be there at all. Given the damaging
impact court proceedings have on children, this is being
viewed as a public health crisis.
So what can be done? Many stakeholders are now joining
force: senior Family Judges, the Ministry of Justice, the
Department of Work and Pensions, solicitors, barristers,
mediators, therapists and co-parenting professionals to call
for a radical change in the way couples approach divorce
and separation. We need a solutions-based approach, rather
than problem-driven one. We need to de-stigmatise divorce.
To create a family justice system which serves families by
enabling them to work together, not against each other. I am
very proud that The Divorce Surgery has been part of that
change, but fundamentally every industry is the product of
the consumers it services. The more separating couples
demand a joint, constructive approach to divorce, the more
quickly the profession will change to meet that need.

andrine Desbarbieux-Lloyd is a senior executive
Swith over 25 years of international experience,
leading organizations in the implementation of
strategic change and digital transformation. She is the
European Vice President of Digital at Samsung, where
she oversees digital sales and marketing, a multi-billion-
pound business across 33 countries in Europe. In this role,
she is driving Samsung’s digital transformation including
major innovation such as machine learning applications.
Previously, Sandrine was the Director of Marketing and
Digital at Avis Budget Group with the responsibility for all
digital platforms and marketing programs across Europe,
Middle East and Africa. She has also held several senior e-
commerce, digital and marketing roles for internationally
recognized consumer brands including BT, LACOSTE,
AXA, BAA, E.ON and BUPA.
Notable in her career is the national launch of broadband
and Wi-Fi for the first time in the UK. This extremely
challenging role involved defining the wireless strategy for
BT Group following the de-merger of 02, building a
mobility business, launching BT Openzone the UK’s first
Public WLAN service, and the re-launch of BT Mobile a
new SP/MVNO business.
In an interview with Insights Success, Sandrine talks about
her undulating entrepreneurial journey and the hurdles she
overcame.
Below are the highlights of the interview:
How do you diversify your organization’s offerings to
entice the target audience?
I believe the key to customer satisfaction is customer
research and meeting customer needs. At Samsung, we go
one step further. We innovate in our products and services
not just by understanding what customers want, but also
what customers do not know they want. Customer needs
and behaviours change all the time; every generation, every
segment, every customer is different, so it's a core skill in
the organisation. We put our customers first.
Where are you focusing your energy now, and where do
you hope to make an impact next?
I believe that the new era of tech (Artificial
Intelligence/Machine Learning/Deep

Learning/Automation/Cloud Computing/Big Data) – the 4
industrial revolution – will drive profound change and these
changes have already started in many ways. At least 50% of
human tasks today could be automated, leaving people to
focus on more valuable activities. For example, we spend a
lot of our time focusing on intelligent automation of
analytics to be able to focus the teams on insight and
trading.
What is your idea of impactful leadership? What style of
leadership do you personally prefer and have
implemented within your team at Samsung Electronics?
In order to drive transformation as a woman business leader
at Samsung, I focus on:
Identifying key stakeholders, clients and suppliers
Actively listening to them by asking open questions
Trying to understand the different agendas and motivations
by putting myself in the shoes of their stakeholders, clients
and suppliers
Defining a win-win strategy with my colleagues
Surrounding myself with teams and people who are better

What roadblocks or challenges were faced by you in a
corporate business? And how did you overcome them?
Earlier in my career, I worked in the Telecoms industry
when companies were strategically moving into ICT
(Information and Communications Technology). It was a
big and exciting challenge for me. At the age of 25, I was
building e-Commerce solutions, running multi-million
campaigns across traditional and digital channels, launching
Broadband and Wi-Fi for the first time in the UK. Whilst on
that journey, I met a few clients who were resistant to
change. I remember the Marketing Director of a global
hotel chain stating that she didn't believe Wi-Fi would take
off! Looking back, I now realise that one of the biggest
challenges in corporate businesses is to understand others,
why they think what they think, putting yourself in their
shoes, and defining how best to take them with you on that
journey.
What are the vital traits that every woman business
leader should possess?
I believe women in business should especially use
emotional intelligence to lead. On top on this, they should
use the same skills as any good leader: visionary, strategic,
innovative, good communicator, trustworthy, problem-
solver, accountable, empathetic, transparent, humble and
resilient.
The best teams are made of differences, so made of men
and women.
What have you envisioned for your organization’s
future, with regards to your role at Samsung Electronics
and for your personal ambitions as well?
My role is Digital transformation. Constant change is part
of the job and as It is part of the job. As a team, we are used
to this. We take calculated risks, we try things out, we
succeed, we fail, we learn, we roll-out, etc. Artificial
intelligence and blockchain technologies will drive even
greater change.
AI is not new, it is already happening everywhere.
Algorithms pre-recommend the content we see and watch
and the products we buy across all areas of our lives today.
blockchain brings with it a decentralised model to data.
Effectively, businesses will only be able to store and use
very limited parts of customer data at specific times. No
longer owning customer data will change most businesses.
We need to get ready for that.
These technologies will change my job, everyone’s jobs,
and also our business models.

Improving Diversity and
Inclusion in Legal Profession
The call for more diversity and inclusion is
becoming louder and more critical in the legal
industry. Tahisha Pearson Fugate wanted to be
part of the solution to long-standing challenge of
diversity, equity and inclusion in the legal industry. Her
passion for leveraging diverse talent to provide
innovation solutions for clients’ most complex business
challenges, as well as the skills she has built during her
16-year legal business development career led her to
Orrick Herrington & Sutcliffe LLP, where she serves
as the Sr. Manager DEI Client Development. She
could not be more excited than she is at present about the
work she will be able to do in identifying opportunities
to help those underrepresented in the legal industry grow
their careers and building a pipeline of legal
professionals who represent the real world.
In an interview with Insights Success, Tahisha shares
about her inspiring business journey. She is the wife of
Rashawn Fugate and mother to Jamari Cunningham (18)
and Sophia Fugate (6). She serves on the Advisory Board
of The Conscious Inclusion Company and former Vice
President for the Prince George’s County Chapter of
Mocha Moms, Inc and Program Director for Legal
Marketing Association – Mid-Atlantic.

How do you diversify your organization’s offerings to
entice the target audience?
Among law firms, Orrick is a pioneer in advancing
diversity and inclusion in the legal profession, including
being one of the founding firms in an unprecedented
collaboration to improve diversity and inclusion in the
legal profession – the Move the Needle (MTN) Fund.
MTN is a five-year, $5 million effort that aims to
improve diversity and inclusion in the legal profession.
This initiative brings together peer law firms, corporate
legal departments, and community leaders to develop
goals and work together to improve diversity, equity, and
inclusion in the legal industry. Orrick is committed to
having at least 55% diverse teams – including women,
lawyers of color, and LGBTQ+ lawyers – serving an
initial set of 40 clients in meaningful roles by 2025, as
representative of some of the goals of MTN. In my new
role, I will support this initiative as well as others that
align with the firm’s commitment to increasing DEI
within the firm and the legal industry.
What are the vital traits that every woman business
leader should possess?
Every woman business leader needs to tap into their
resilience, confidence, innate leadership, and ability to
build relationships. Don’t be afraid of creating your own
path and defining success for yourself. Women are the
backbone of this country so naturally, we are badass in
business. Own that energy.
Where are you focusing your energy now, and where
do you hope to make an impact next?
I am focusing my energy on creating more equity and
inclusion in the legal industry for diverse lawyers and
professionals. Building a pipeline of lawyers and
business professionals that are representative of a full
scope of backgrounds and experiences is very important
to the future of business.

44. What is your idea of impactful leadership? What
style of leadership do you personally prefer and hope
to implement within your team at Orrick?
Impactful leadership empowers others and encourages
everyone to bring their best selves and ideas to the
profession. An impactful leader values building
relationships and understands how to authentically grow
them. I prefer to empower and offer grace – to myself
and others. I consider it a privilege to play a role in
helping others grow their careers and with great privilege
comes great responsibility. My responsibility is to
identify opportunities for my team members to grow,
learn, and become confident in their contributions, and
support them along the way.
What roadblocks or challenges were faced by you in a
corporate business? And how did you overcome
them?
As a Black woman in the legal industry, especially not
being a lawyer, I’ve faced many challenges. For many
years, I’ve been the only person that looked like me in
several rooms. The legal profession has historically been
hierarchical – lawyers at the top, staff at the bottom.
Business professionals in law firms often feel
marginalized. Add to that being Black and being a
woman, at times it’s been a tough environment to
navigate when you don’t see people that look like you at
the top or who have any experience working with
someone who understands your background. I didn’t
attend an Ivy League college or business school – my
educational path was non-traditional, and I often found
that there are very few people in my professional circles
who share my experiences. By the time I graduated from
undergrad I was already a mother. When I decided to go
back to school to pursue my MBA, my son was 7/8 years
old and I had a full-time, very demanding, role at a large
law firm. As a mom years ago, law firms didn’t offer a
lot of support and resources for working parents –
especially staff. Leadership did not have experience or
training to manage professional parents – many still
don’t, and it showed in the way I was treated at times –
often with me feeling pressured to choose between being
a mom and being a professional. Leadership often made
it hard for those roles to co-exist. To overcome these
challenges, I learned to advocate for myself and my
career and I do the same for my community. I continued
to show up, take full advantage of opportunities
presented but also create opportunities for myself, and
develop the mind set of “doing it scared.” And most
importantly, I learned to ask for and accept help and I’ve
been blessed with a personal and professional village
that supports me.
I’m encouraged by the positive changes I’m seeing in the
legal industry with regard to DEI but real change takes
consistent and thoughtful effort and time. So, I’m
committed to rolling up my sleeves and doing my part.
According to you, what essential traits should a
business leader possess to thrive in any given
competitive market?
A business leader should possess the ability to be open to
change, consciousness, empathy, and authentic
relationships. There are many studies that confirm
diverse teams are most innovative. A business leader
should know how to authentically leverage diverse
talent, backgrounds, and skill sets to drive business
growth and empower her team to be successful.
What have you envisioned for your organization’s
future, with regards to your role at Orrick and for
your personal ambitions as well?
I envision leaving the legal profession better than I
entered it – more colorful (figuratively and literally). I
look forward to identifying and creating growth
opportunities for attorneys and legal professionals of
color and a legacy for my children that encourages them
to be limitless and makes them proud to be Black. I feel
hopeful that there is an opportunity to create great
change in the profession and we have a duty to take full
advantage of this time. Future generations are counting
on the work that we do now to create opportunities for
them, where they will find others that look like them in
the rooms that they enter and empower them to grow as
far as they dream. Leadership in the legal profession
across business functions – lawyers and legal
professionals – will be representative of the world in
which we live and work.
