The value of the Irish public sector procurement market in 2013 was €12 Billion. It is the single biggest market opportunity for Small and Medium Enterprises (SMEs). TenderScout is a market intelligence company that helps SMEs win public sector tenders.
This report is based not just on interviews with SMEs and analysis of government policy, but critically a foren- sic assessment of the publically available procurement data.
The highlights of our analysis are presented in this re- port, which we hope will provide a forum for discussion and inform both buyer and suppliers as to the realities of what’s happening within public sector procurement.
By exposing some of the trends within public sector procurement, we hope to demystify the process for the many SMEs who at present do not see this as a viable option for their business. In doing so we aim to increase participation amongst SMEs and positively impact the health and vibrancy of the SME sector.

research methodology used in this study is qualitative. The instrument of study was based on
non standard interview with the officers that are experts on the topic at the district assemblies
where 11 districts assemblies were covered out of 22. The study revealed the following causes;
procurement practitioners find it difficult to understand the Procurement Act 663, practitioners
lack capacity both academically and professionally in the management and operationalisation
of the procurement process, the Procurement Act 663 is excessively legalistic and technical,
the Act 663 is at anomalous with market trends or practices. The study also found out that there
are lapses in monitoring for compliance of the Procurement Act 663, no examples of known
procurement practitioners punished for non compliance, lack of commitment on the part of
officialdom, organisational culture at the district level a major cause of maverick buying and
most of the procurement activities are unplanned. On the impact, the study established that MB
defeats the superseding objectives of the Public Procurement Act 663 of 2003, it is also
insidious to the aptitude to negotiate favourable terms for price of goods, services and works
due to the crumbling of spend, MB had the ability to deny the assemblies the knack to collect
data on the assemblies’ sequence of purchasing or spending thereby causing the assemblies to
lose visibility over its outlay, it also increases purchasing cost where it affects equally the
actual purchasing price and process cost, it was also disclosed that fraud and corruption can
ensue from MB. The study recommends that PPA and the ministry of education should link up
to train procurement practitioners as stipulated in Procurement Act 663 section 3(k) to improve
the awareness and knowledge of procurement processes at the district assemblies and the
nation in general. Monitoring compliance trends should also be a key part of the Public
Procurement Authority-PPA. As a matter of fact the institution responsible for sanction should
be incorporated into the enforcement unit for swift punishment to act as deterrence to others.
PPA and the districts should link up on how eProcurement systems can be implemented to
ensure compliance since the most commonly declare solution for maverick buying is the
implementation of electronic procurement.

With public sector contracts representing 12% of the Irish economy, public procurement impacts on more than185,000 businesses and is, a cornerstone of sustainable economic re- covery. After five years in decline, spending will rise in 2015 by €0.5 billion to an estimated €9 billion.
This report is based on the findings of a TenderScout Survey, which gives voice to those most impacted by public procurement changes – Irish businesses. Our national survey was conducted in November 2014 in conjunction with Amarach Research.
We have also provided an examination of the Legal Services sector. The changes we see in this industry serve as an early warning to other sectors as it is at the forefront of public procure- ment reform and serves as an indicator of public procurement’s evolution.
More importantly, this report provides recommendations based on our engagement with over 1,000 suppliers across the country to boost confidence in the system. Without confidence that the system is working for both the government and business, suppliers will not participate. Government will ultimately receive less value for money and suppliers will not develop the ca- pability to compete in other markets.

Is the Forex Market Dangerous?
A concern was raised in an article in the Financial Times; Fast forex moves raise liquidity worries.
In recent months a series of dramatic and unforeseen intraday fluctuations -even in popular and widely traded currencies -has led forex investors, bank traders and analysts to question the mechanics of the market.
The broader concern is that declining liquidity will fuel more sudden forex moves and destabilize the market. According to Standard Bank’s G10 currency strategist Steven Barrow, “volatility and spikes borne out of aggressive reactions to perhaps not very startling moves can drive currencies away from fundamentals”.
Is the Forex market dangerous? Traditional thinking is that when one trades two major currencies there is so much trading volume and liquidity that there are no unexpected jumps in prices and no risk of getting trapped in a trade with no way out. If the Forex market is becoming illiquid it may become dangerous.

Key Trends
SMEs spend over €185 Million writing tender submissions
Spending is down, but activity is up!
Over 40,000III tender submissions were compiled in 2013 at a total cost to SMEs of over
€185 Million. The cost of evaluating submissions for the public sector was €37 MillionIV.
Around 7,500 opportunities were published by the Irish Government in 2013. This is comparable with the previous two years and indicates that the volume of transactions has not
changed, although the value of individual transactions has declined by 25% since 2008.

most companies and so they are excluded from the procurement process.
This still amounts to €12 billion of public money spend on procuring goods and services
and makes the State the single largest buyer in the country.
Only 10% of SMEs are participating in public sector

In 2013, barely 10% of companies participated in any of the 7,500 opportunities to sell
through the public procurment process. Despite the best efforts of government to encourage participation, through policy with Circular 10/10I and through education with the ‘goto-tender’II programme amongst others.
Government initiatives aim to educate and encourage
In November, Minister of State for Public Works, Brian Hayes noted in the Dail1
that “70% of SMEs are not even registered
on the eTenders website”. As part of the
government’s procurement reform businesses are being asked to “register on the
website and then they will know about every contract ranging in price from €3,000
to €3 million”.

As the public sector seeks better value from its suppliers, it is often the larger suppliers
from the abroad who can leverage their greater buying power that compete best on price.
It may also be conjectured that although the professionalism of Irish companies when it
comes to tendering has improved in recent years, suppliers used to tendering in the more

The TenderScout SME Attitude Survey
Why we conducted the survey
In July 2013, TenderScout commissioned an independent survey of 397 SMEs who had
previously won tenders. The purpose of the survey was to gain an appreciation as to how
suppliers perceived public sector procurement in 2013 and how this impacted on their
levels of engagement.
