The Surrogacy Bill of 2016 prohibits commercial surrogacy and restricts access to surrogacy services for only married Indian couples with proven infertility, barring foreigners and OCI cardholders. It mandates that couples must have been married for at least five years and outlines that surrogates cannot be compensated beyond medical expenses. Additionally, the bill establishes a national regulator to oversee surrogacy clinics and imposes further restrictions on surrogate agreements.
