The Importance of Patient Confidentiality
Types of ROI
1. EMERGENCY CONTACT/ PRESENCE
IN TREATMENT / TRANSFER
● For Emergency Contact
● For Relatives, Friends, Support system
● For Employer, Human Resources
○ If it’s for a company or business it’s not
necessary to specify contact name
unless patient insists.
2. CONTINUITY OF CARE
For aftercare planning
● Signed prior to
○ Sending insurance information (COB)
○ Contacting any facility for which you need to
share patient information
3. MEDICAL
Medical appointments / when requesting medical information
from another facility / when sharing medical information with
another facility
When do we complete one?
● PRIOR to making ANY contact with a third
party in which you will release information
pertaining to the patient
● For example: a family member, a friend, a
sponsor, a treatment facility, a parole
officer, a judge, a lawyer, a doctor, etc.
Note:
Always confirm that there is a correctly filled out
ROI in place prior to making a call for the patient
or with the patient
○ Verify in chart
○ Verify in KIPU
● If you can’t confirm, have the patient fill
one out
How do we complete a ROI?
● Explain it to the patient
● Fill in all information fields required for the patient
● Patient signs and dates
● Witness signs and dates
FAQS
What do I do if patient revokes a consent?
● Have patient revoke the consent on the
original consent form
● Communicate immediately via email to the
treatment team
● Document on shift report and in progress
notes.
● The revocation may indicate a need for a
change in the discharge plan
What if patient revokes verbally and AMA’s
before signing the revocation form?
● Verbal revoke of consent is valid
● Staff takes the original form and writes
“Patient revoked on __(date)” in specified
field, and signs / or on form, checks of
“Revoked” and writes “patient unable /
refused to sign”
● Document and communicate this to the
treatment team.
FAQ’S
What if the consent I need is in the chart, but not
properly completed?
● Properly fill out a new ROI with the patient
What if the patient has the phone number but
not the address to the contact he wishes to add
on the ROI?
● Patient must have NAME, PHONE
NUMBER, FULL ADDRESS and ,
RELATIONSHIP of person to be added on
ROI form. If not available he must get it
from another contact
What if the patients admit to treatment with a
friend or relative?
● Both parties need to sign a ROI for each
other
What if a distraught family member calls
requesting to know if loved one is a patient?
● If there is NO ROI, do not confirm or deny
presence in treatment
FAQS - Gray areas….
● Does anything trump a ROI or a Patient Consent Form?
○ A court order
● Is a there a limit to the number of Consents a patient has?
○ NO
● Can a patient revoke and add repeatedly the same contact?
○ YES...but if this happens, communicate this with the Treatment Team
● How long is the ROI valid?
○ For 120 days after the date it was signed

Release of Information (ROI) Training

  • 1. Releases of Information The Importance of Patient Confidentiality
  • 2. Types of ROI 1. EMERGENCY CONTACT/ PRESENCE IN TREATMENT / TRANSFER ● For Emergency Contact ● For Relatives, Friends, Support system ● For Employer, Human Resources ○ If it’s for a company or business it’s not necessary to specify contact name unless patient insists. 2. CONTINUITY OF CARE For aftercare planning ● Signed prior to ○ Sending insurance information (COB) ○ Contacting any facility for which you need to share patient information 3. MEDICAL Medical appointments / when requesting medical information from another facility / when sharing medical information with another facility
  • 3. When do we complete one? ● PRIOR to making ANY contact with a third party in which you will release information pertaining to the patient ● For example: a family member, a friend, a sponsor, a treatment facility, a parole officer, a judge, a lawyer, a doctor, etc. Note: Always confirm that there is a correctly filled out ROI in place prior to making a call for the patient or with the patient ○ Verify in chart ○ Verify in KIPU ● If you can’t confirm, have the patient fill one out
  • 4. How do we complete a ROI? ● Explain it to the patient ● Fill in all information fields required for the patient ● Patient signs and dates ● Witness signs and dates
  • 5. FAQS What do I do if patient revokes a consent? ● Have patient revoke the consent on the original consent form ● Communicate immediately via email to the treatment team ● Document on shift report and in progress notes. ● The revocation may indicate a need for a change in the discharge plan What if patient revokes verbally and AMA’s before signing the revocation form? ● Verbal revoke of consent is valid ● Staff takes the original form and writes “Patient revoked on __(date)” in specified field, and signs / or on form, checks of “Revoked” and writes “patient unable / refused to sign” ● Document and communicate this to the treatment team.
  • 6. FAQ’S What if the consent I need is in the chart, but not properly completed? ● Properly fill out a new ROI with the patient What if the patient has the phone number but not the address to the contact he wishes to add on the ROI? ● Patient must have NAME, PHONE NUMBER, FULL ADDRESS and , RELATIONSHIP of person to be added on ROI form. If not available he must get it from another contact What if the patients admit to treatment with a friend or relative? ● Both parties need to sign a ROI for each other What if a distraught family member calls requesting to know if loved one is a patient? ● If there is NO ROI, do not confirm or deny presence in treatment
  • 7. FAQS - Gray areas…. ● Does anything trump a ROI or a Patient Consent Form? ○ A court order ● Is a there a limit to the number of Consents a patient has? ○ NO ● Can a patient revoke and add repeatedly the same contact? ○ YES...but if this happens, communicate this with the Treatment Team ● How long is the ROI valid? ○ For 120 days after the date it was signed If you have any questions pertaining to Releases of Information, do not hesitate to ask your Supervisor.
