2. Why???
Before this Act, child sexual offences was prosecuted under:
IPC 375 – RAPE
IPC 354 – Outraging the modesty of women
IPC 377 – Unnatural sexual offence
IPC 511 – Attempt
3. To protect children below 18 years of age from any kind of sexual
abuses.
Before the enactment of this Act, there was no other Act which
protect children specially from any kind of sexual offences.
India has signed the UN Convention on the Rights of Child in
1992. The Convention require sexual exploitation and sexual
abuse to be addressed as heinous crimes.
To provide strict punishments to create a deterrence effects
against the sexual offences against the children.
4. The Protection of Children from Sexual offences
Enacted in the year 14th November, 2012
In 2019, the act has been amended
The amendment contains provision for enhancement for
punishment for various offences, provide dignified
childhood for a child.
