Non-registrable marks include marks that deceive the public or cause confusion, marks that are contrary to law, and marks that contain scandalous or obscene matter. Descriptive marks, generic names, surnames, and marks that are devoid of distinctive character are also not registrable. Certain shapes, sounds, colors, or other characteristics that are functional or give value to goods cannot be registered as trademarks. Chemical names, portraits or signatures identifying individuals also cannot be registered without consent. Religious, political or illegal imagery may be considered scandalous.
