Non-Agricultural khash land settlement policy, Bangladesh
1. Context:
There are two typesof khashlandunderthe managementof landministry.There isapolicyforthe
settlementof agricultural khashland.Butdue tono validpolicyfornon-agricultural khashsettlementpolicyits
distributionhasbeenpausedforlongtime.Asaresult,cityareasnon-agricultural khashare beingoccupiedby
powerful people andtheygotorare tryingto get courtsdecree bypreparingfake papers.Soitshightime to
publishaproperpolicyoutline fornon-agricultural khashlandsettlement. Onlythe khashlandsrecordedunder
the name of districtcommissionerwillbe consideredaskhashland. Anyothergovernmentlandunderthe
record of any otherinstitutionswillnotbe consideredaskhashland.The reserve foreststhathave been
declared underarticle 29 andnotifiedasForestlandlandunderarticle 4of Forestlaw,that are keptFor climate
preservationthroughforestationisnotto be settledunderthispolicywithoutthe consentof Climate &forest
ministry.Eventhiskindof caseswill notbe solvedunderthe authorityof landministry.If inthe implementation
processof the policyanylandisfoundto be in dispute overownershipandoccupancywithanygovernment
organizationordivision thenthe settlementprocesswillcontinueaccordingtothe policyonlyaftersolvingthe
dispute throughdiscussionwiththe relatedorganizationordivision.
2. Definition:
a. Non-agricultural khashland:EveryThana Headquarters andcityareaunder4 metropolitanareaof the
countrywill be consideredascityarea.Evenagricultural landsunderthisareaswill be consideredasnon-
agricultural khashland.Outside of thisareaskhashlandotherthanagricultural khashlandwill be marked
as non-agricultural khashland.
b. Thana Headquarters:Citycouncil areaunderThanaHeadquarterssconsistingof citycouncil andincase
of otherThana Headquarters markedareasbyDistrictCommissionerwithwrittenpermissionfrom
DivisionCommissionerwill be consideredasThana Headquarters area.Within180 of the declarationof
thispolicydistrictcommissionerswillmarkThana Headquarters areasinPlaceswithoutDistrictcouncil.If
citycouncil isestablishedafterthe procedure the areaundercitycouncil will thenbe consideredas
Thana Headquarters.
c. Goingmarketrate: Price fixedbyconventional pricingsystem.
3. Policyoutline for the settlementofNon-agricultural khash land:
a. Non-agricultural khashlandcanbe allottedtoanyGovernmentsecretariatorinstitutioninGovernment
need.Inthat case properprice is to be paidin goingmarketrate.
b. Neededamountof landisallowedtobe allottedtoestablish Religiousshrine,orphanage,graveyard&
cremationplace byreceiving10%moneyof the goingmarketprice of that plot.
c. Land will be allottedat10% of the marketprice to Educational institutes.
d. Long termsettlementof khashlandwill be done byallottingkhashlandupto.05acre according to
occupancyto natural calamityvictims&legallyrehabilitatedpeople bygovernmentif the landisdeemed
unnecessarybythe government.ButDhaka,Narayanganj & Chittagongmetropolitanareaswillbe
outside thisconsideration.
e. Khashlandup to .05 acre inside metropolitanareaandup to .08 acre outside metropolitanareacouldbe
allotteduponPrime Ministerspermissionatgoingmarketrate or at discountedrate withPrime Ministers
suparis to Eminenteducationist,poet,literaryora person speciallyrecognizedforhiscontributionat
national level.
f. Bangladeshi Expatriatecooperative consistingof onlyone memberfromeachfamily canbe allottedupto
1.0 acre inmetropolitanareaandupto 3.0 acre in districttown if theypaythe price in foreigncurrency
and aimto buildmultistoriedbuildingatleastupto5 stories. Formultistoriedhouse buildingevery2
members will be allottedwith.25acre of land.
g. In establishingindustryoutside of cityareaif the applicantcan collect3/4th
of the neededlandthen
khashlandup to 1/4th
of the neededlandadjacenttothe industrycouldbe allottedatgoingmarket
price.

h. Personwiththe ownershipof 1yeartermlease of aland whoare payingGovernmentOwingsforatleast
five years couldbe allottedwithupto.05 acresof khashlandat goingmarketprice.
i. Owneror successorof the owneris tobe allottedwithupto.16 acres inmetropolitanareaandupto.32
acre outside metropolitanareainsteadof givingcompensationasmoney forretakingtheirlandunder
acquisitionprocessof non-agriculturalkhashland. Ineachcase allottedland cannotbe more than the
half of acquisitionedland. Butnobodywill be allottedlessthan.04 acres incityarea and .10 acres in
village area. Moreover, asallotmentreceiveristhe formerownerof the acquisitionedlandhe isto
receive priorityinallotmentprocess.Onlyone personwill getthiskindof advantage asvictimof
acquisitionandonlywithministriespermission.
j. Land can be allotted forestablishmentof animal &dairyfirmand poultryfirmoutside metropolitan&
districttownarea.But in thiscase the projecthasto be approvedbyregardingministry.Poultryfirmwill
be allottedupto 2 acre and dairyfirmup to 5 acre as primaryshortterm for10 years.The successof
followingthe planof the projectand abidingbyof all terms& conditionsof the lease forfirst5 yearsmay
resultina longterm lease. Provisionof cancellingthe agreementwillbe includedinthe agreementin
case of the projectfailing tofollow the plan orthe projectgettingdisbandedorthe settlementtermsnot
beingfollowedproperlywithinthe first5years.If anybodyestablishesapoultryordairyfarm inhisown
property, thenhe can alsobe allottedwith adjacentnon-agricultural khashlandwithinthe above
mentionedtimeperiod.
k. Postponed
l. Foreigninvestorsorjointventureswill be allottedwithneededamountof landoutside of metropolitan
area forestablishingfactory.Inthiscase landallotmentwill be decidedinproportiontothe approved
project.Butland will be allottedinside metropolitanincase of establishinghotel/motel (withthree star
or above).
m. If there is an adjacentkhashlandto residentorfactoryandupon allottingthistoanyother person will
pose a threatto the commutingandmaycreate otherproblem, thenthatadjacentkhashlandcan be
allottedtothe concerningresidence orfactoryowner.Butin thistype of settlementcase Additional
districtcommissionerhastoinvestigate the situationandsendpropositiontothe Ministryafterdeciding
“salami”(one kindof fee) inconventional way.
n. For the constructionof multistoried(Atleast5storied) residential buildingsundercooperativesof
officialsof government/semi-governmentorautonomousorganizations,includingatleast30 people or
more members,whoare/were employedingovernment/semi-governmentorautonomous
organizationsforatleast20 yearsor more,maximum1acre inthe metropolitanareaandmaximum3
acres inthe districtor Thana city shall be allotted.
o. Cooperative societycomprisingof atleast15 freedomfighterwillbe allottedwithlandinthe same
processof cooperative of officialsstatedabove. Inbothcasespeople owninglandorhouse in
metropolitanordistricttownisnotto be allowedinthe cooperative.
p. i. Highest5 acres of landwill be allottedforcommercialflowercultivation&export.
ii.Highest15 acres to be allottedforfruitcultivation.
iii.Rubber,bamboo,cane cultivatormaygetup to 30 acres and registeredPublicLimitedCompanywill
getup to 100 acresof khashland.
iv. Land ministriesapproval isnecessaryforthe settlementprocessdiscussedinabove mentioned(i),(ii),
(iii) subparagraph.Butmore than mentionedlandcanbe allotteduponPrime Ministersapproval.
v. For the cultivationof medicinal plantindividual willgetupto 5 acres and registeredPublicLimited
Companywill getupto 10 acres of khashland.In thiscase the propositionmustcontaincertainfixed
objectivesandprobablecontributiontoMedicine sector.Withprime Ministersapproval more than
mentionedlandcanbe allotted.
q. Withoutanyof the above mentionedcasesnon-agricultural khashlandwill be allottedthrough
conventional auctioningprocessinpermanentterm.

r. KhasKhatiyan recorded areasof the Roads, ghat, hat-bazararea, rivers,streams,canals,sewerage,
ponds,dams,graveyards,cremationgrounds,parks,playgroundsanddifferentlevelsof land
administrationownedlands will notbe coveredunderthissettlement.
s. Hill tract landsettlementrule postponed.
4. Proposedsettlementactivities:
a. Any settlement other than auctioning process settlement, in metropolitan area khash land
settlement have to get approval of the Prime Minister through Land Ministry.
b. Land reformboardwill approve all propositionof settlement above .08acre indistricttown,.16 acre in
Thana Headquarters&.30 acre outside thisareas.Landsettlementforlessthanthisamountwill be
approvedindivisioncommissionerlevel. Inall the necessaryareas,the Ministryof Landwill have to
accept the priorapproval of the headof the government.
c. In all cases,the DeputyCommissionerwill sendacase recordto determine the sale of the landin
questionandsenditto the appropriate authoritiesforsettlement.
5. For the reasonsthat the settlementwill be canceled:
a. If the landisbeingusedinanyother waythan mentionedinthe agreementwithoutthe approval of
concernedauthority.
b. If the settlementholderpartlyorcompletelybreaksany termsof the contract.
c. In violationof government'slaws/orders/ ordinancesregardingland.
d. If the price is not paid in the agreed time period. Upon rejection of the settlement due to unpaid
price previously paid installments will not be repaid.
e. If necessaryinformationiskeptsecretorconditionviolation
6. If any land is allotted for long term District Commissioner will open a separate khatiyan for that land. In
that khatiyan The name of the District Commissioner representing the Government of Peoples
Republic of Bangladesh and the settlement holder will be written. Moreover, the beginning and end
date of the contract will be mentioned. Settlement holder has to pay the Land Development tax.
Settlement deed and khatiyan will consist information about Land Development tax.
7. Settlement holder will be obedient to pay this tax from the date of ownership handover.
8. The governmental decisionwill be consideredfinalinanydispute relatedtothe settlementof land.
9. Afterthe provisionof thispolicyeveryotherexistednon-agriculturalkhashlandsettlementsystemswillbe
postponedand the banon non-agricultural khashlandsettlementwill be withdrawn.Buteveryotheralready
settledlandunderpreviouspolicyframe willstillbe effective. Regardlessof whatsoeverinthispolicy,the rules
and regulationsimplementedinthe relevanttimewillbe effective atall times
10. Thispolicywill be reformedif sodeemednecessary& otherthanthe case of exception of the policyonly,the
overall jurisdictionof the headof the governmentwill be preserved.
11. Thispolicywill applytoanydistrictotherthan Rangamati,Bandarbanand Khagrachari three Hill Districts. In
orderto provide settlementof KhashlandsinRangamati, BandarbanandKhagrachari,thisdistricts special laws
and governmentdirectiveswill be implemented.

  • 1. 1 Non-Agricultural khash land settlement policy, Bangladesh 1. Context: There are two typesof khashlandunderthe managementof landministry.There isapolicyforthe settlementof agricultural khashland.Butdue tono validpolicyfornon-agricultural khashsettlementpolicyits distributionhasbeenpausedforlongtime.Asaresult,cityareasnon-agricultural khashare beingoccupiedby powerful people andtheygotorare tryingto get courtsdecree bypreparingfake papers.Soitshightime to publishaproperpolicyoutline fornon-agricultural khashlandsettlement. Onlythe khashlandsrecordedunder the name of districtcommissionerwillbe consideredaskhashland. Anyothergovernmentlandunderthe record of any otherinstitutionswillnotbe consideredaskhashland.The reserve foreststhathave been declared underarticle 29 andnotifiedasForestlandlandunderarticle 4of Forestlaw,that are keptFor climate preservationthroughforestationisnotto be settledunderthispolicywithoutthe consentof Climate &forest ministry.Eventhiskindof caseswill notbe solvedunderthe authorityof landministry.If inthe implementation processof the policyanylandisfoundto be in dispute overownershipandoccupancywithanygovernment organizationordivision thenthe settlementprocesswillcontinueaccordingtothe policyonlyaftersolvingthe dispute throughdiscussionwiththe relatedorganizationordivision. 2. Definition: a. Non-agricultural khashland:EveryThana Headquarters andcityareaunder4 metropolitanareaof the countrywill be consideredascityarea.Evenagricultural landsunderthisareaswill be consideredasnon- agricultural khashland.Outside of thisareaskhashlandotherthanagricultural khashlandwill be marked as non-agricultural khashland. b. Thana Headquarters:Citycouncil areaunderThanaHeadquarterssconsistingof citycouncil andincase of otherThana Headquarters markedareasbyDistrictCommissionerwithwrittenpermissionfrom DivisionCommissionerwill be consideredasThana Headquarters area.Within180 of the declarationof thispolicydistrictcommissionerswillmarkThana Headquarters areasinPlaceswithoutDistrictcouncil.If citycouncil isestablishedafterthe procedure the areaundercitycouncil will thenbe consideredas Thana Headquarters. c. Goingmarketrate: Price fixedbyconventional pricingsystem. 3. Policyoutline for the settlementofNon-agricultural khash land: a. Non-agricultural khashlandcanbe allottedtoanyGovernmentsecretariatorinstitutioninGovernment need.Inthat case properprice is to be paidin goingmarketrate. b. Neededamountof landisallowedtobe allottedtoestablish Religiousshrine,orphanage,graveyard& cremationplace byreceiving10%moneyof the goingmarketprice of that plot. c. Land will be allottedat10% of the marketprice to Educational institutes. d. Long termsettlementof khashlandwill be done byallottingkhashlandupto.05acre according to occupancyto natural calamityvictims&legallyrehabilitatedpeople bygovernmentif the landisdeemed unnecessarybythe government.ButDhaka,Narayanganj & Chittagongmetropolitanareaswillbe outside thisconsideration. e. Khashlandup to .05 acre inside metropolitanareaandup to .08 acre outside metropolitanareacouldbe allotteduponPrime Ministerspermissionatgoingmarketrate or at discountedrate withPrime Ministers suparis to Eminenteducationist,poet,literaryora person speciallyrecognizedforhiscontributionat national level. f. Bangladeshi Expatriatecooperative consistingof onlyone memberfromeachfamily canbe allottedupto 1.0 acre inmetropolitanareaandupto 3.0 acre in districttown if theypaythe price in foreigncurrency and aimto buildmultistoriedbuildingatleastupto5 stories. Formultistoriedhouse buildingevery2 members will be allottedwith.25acre of land. g. In establishingindustryoutside of cityareaif the applicantcan collect3/4th of the neededlandthen khashlandup to 1/4th of the neededlandadjacenttothe industrycouldbe allottedatgoingmarket price.
  • 2. 2 h. Personwiththe ownershipof 1yeartermlease of aland whoare payingGovernmentOwingsforatleast five years couldbe allottedwithupto.05 acresof khashlandat goingmarketprice. i. Owneror successorof the owneris tobe allottedwithupto.16 acres inmetropolitanareaandupto.32 acre outside metropolitanareainsteadof givingcompensationasmoney forretakingtheirlandunder acquisitionprocessof non-agriculturalkhashland. Ineachcase allottedland cannotbe more than the half of acquisitionedland. Butnobodywill be allottedlessthan.04 acres incityarea and .10 acres in village area. Moreover, asallotmentreceiveristhe formerownerof the acquisitionedlandhe isto receive priorityinallotmentprocess.Onlyone personwill getthiskindof advantage asvictimof acquisitionandonlywithministriespermission. j. Land can be allotted forestablishmentof animal &dairyfirmand poultryfirmoutside metropolitan& districttownarea.But in thiscase the projecthasto be approvedbyregardingministry.Poultryfirmwill be allottedupto 2 acre and dairyfirmup to 5 acre as primaryshortterm for10 years.The successof followingthe planof the projectand abidingbyof all terms& conditionsof the lease forfirst5 yearsmay resultina longterm lease. Provisionof cancellingthe agreementwillbe includedinthe agreementin case of the projectfailing tofollow the plan orthe projectgettingdisbandedorthe settlementtermsnot beingfollowedproperlywithinthe first5years.If anybodyestablishesapoultryordairyfarm inhisown property, thenhe can alsobe allottedwith adjacentnon-agricultural khashlandwithinthe above mentionedtimeperiod. k. Postponed l. Foreigninvestorsorjointventureswill be allottedwithneededamountof landoutside of metropolitan area forestablishingfactory.Inthiscase landallotmentwill be decidedinproportiontothe approved project.Butland will be allottedinside metropolitanincase of establishinghotel/motel (withthree star or above). m. If there is an adjacentkhashlandto residentorfactoryandupon allottingthistoanyother person will pose a threatto the commutingandmaycreate otherproblem, thenthatadjacentkhashlandcan be allottedtothe concerningresidence orfactoryowner.Butin thistype of settlementcase Additional districtcommissionerhastoinvestigate the situationandsendpropositiontothe Ministryafterdeciding “salami”(one kindof fee) inconventional way. n. For the constructionof multistoried(Atleast5storied) residential buildingsundercooperativesof officialsof government/semi-governmentorautonomousorganizations,includingatleast30 people or more members,whoare/were employedingovernment/semi-governmentorautonomous organizationsforatleast20 yearsor more,maximum1acre inthe metropolitanareaandmaximum3 acres inthe districtor Thana city shall be allotted. o. Cooperative societycomprisingof atleast15 freedomfighterwillbe allottedwithlandinthe same processof cooperative of officialsstatedabove. Inbothcasespeople owninglandorhouse in metropolitanordistricttownisnotto be allowedinthe cooperative. p. i. Highest5 acres of landwill be allottedforcommercialflowercultivation&export. ii.Highest15 acres to be allottedforfruitcultivation. iii.Rubber,bamboo,cane cultivatormaygetup to 30 acres and registeredPublicLimitedCompanywill getup to 100 acresof khashland. iv. Land ministriesapproval isnecessaryforthe settlementprocessdiscussedinabove mentioned(i),(ii), (iii) subparagraph.Butmore than mentionedlandcanbe allotteduponPrime Ministersapproval. v. For the cultivationof medicinal plantindividual willgetupto 5 acres and registeredPublicLimited Companywill getupto 10 acres of khashland.In thiscase the propositionmustcontaincertainfixed objectivesandprobablecontributiontoMedicine sector.Withprime Ministersapproval more than mentionedlandcanbe allotted. q. Withoutanyof the above mentionedcasesnon-agricultural khashlandwill be allottedthrough conventional auctioningprocessinpermanentterm.

KhasKhatiyan recorded areasof the Roads, ghat, hat-bazararea, rivers,streams,canals,sewerage, ponds,dams,graveyards,cremationgrounds,parks,playgroundsanddifferentlevelsof land administrationownedlands will notbe coveredunderthissettlement. s. Hill tract landsettlementrule postponed. 4. Proposedsettlementactivities: a. Any settlement other than auctioning process settlement, in metropolitan area khash land settlement have to get approval of the Prime Minister through Land Ministry. b. Land reformboardwill approve all propositionof settlement above .08acre indistricttown,.16 acre in Thana Headquarters&.30 acre outside thisareas.Landsettlementforlessthanthisamountwill be approvedindivisioncommissionerlevel. Inall the necessaryareas,the Ministryof Landwill have to accept the priorapproval of the headof the government. c. In all cases,the DeputyCommissionerwill sendacase recordto determine the sale of the landin questionandsenditto the appropriate authoritiesforsettlement. 5. For the reasonsthat the settlementwill be canceled: a. If the landisbeingusedinanyother waythan mentionedinthe agreementwithoutthe approval of concernedauthority. b. If the settlementholderpartlyorcompletelybreaksany termsof the contract. c. In violationof government'slaws/orders/ ordinancesregardingland. d. If the price is not paid in the agreed time period. Upon rejection of the settlement due to unpaid price previously paid installments will not be repaid. e. If necessaryinformationiskeptsecretorconditionviolation 6. If any land is allotted for long term District Commissioner will open a separate khatiyan for that land. In that khatiyan The name of the District Commissioner representing the Government of Peoples Republic of Bangladesh and the settlement holder will be written. Moreover, the beginning and end date of the contract will be mentioned. Settlement holder has to pay the Land Development tax. Settlement deed and khatiyan will consist information about Land Development tax. 7. Settlement holder will be obedient to pay this tax from the date of ownership handover. 8. The governmental decisionwill be consideredfinalinanydispute relatedtothe settlementof land. 9. Afterthe provisionof thispolicyeveryotherexistednon-agriculturalkhashlandsettlementsystemswillbe postponedand the banon non-agricultural khashlandsettlementwill be withdrawn.Buteveryotheralready settledlandunderpreviouspolicyframe willstillbe effective. Regardlessof whatsoeverinthispolicy,the rules and regulationsimplementedinthe relevanttimewillbe effective atall times 10. Thispolicywill be reformedif sodeemednecessary& otherthanthe case of exception of the policyonly,the overall jurisdictionof the headof the governmentwill be preserved. 11. Thispolicywill applytoanydistrictotherthan Rangamati,Bandarbanand Khagrachari three Hill Districts. In orderto provide settlementof KhashlandsinRangamati, BandarbanandKhagrachari,thisdistricts special laws and governmentdirectiveswill be implemented.
