The Chief of Police is requesting that the City Council discuss and possibly approve a Memorandum of Understanding (MOU) between the Alamo Heights Police Department and the San Antonio Police Department. The MOU would clarify the roles and responsibilities of each agency regarding emergency responses and investigations at schools within SAPD's jurisdiction but that have Alamo Heights police officers serving as School Resource Officers. If approved, the MOU would be in effect for five years unless terminated with 60 days notice by either party.

SUMMARY
The new presence of Alamo Heights Police Department School Resource Officers (SRO)
on school campuses falling under the jurisdiction of the San Antonio Police Department
creates reasonable cause for a Memorandum of Understanding (MOU) clarifying the
roles and responsibilities of each law enforcement agency during emergency and non-
emergency incidents and investigations.
BACKGROUND INFORMATION
The proposed MOU is an agreement SAPD has prepared for all school districts having
their own police department within the jurisdictional boundaries of SAPD. The MOU is
prepared to guide agencies providing law enforcement to schools within SAPD’s
jurisdiction with the common goals of serving the community effectively and efficiently
through mutual understanding.
The MOU outlines procedures and responsibilities of each agency for guidance and
clarification for overlapping jurisdictions working to a common cause. The MOU also
provides an understanding of the following topics:
• Acknowledges in most cases the SROs will be the first officer initiating any need
for a law enforcement response and SAPD will provide any needed support;
• Depending on the nature and/or severity of the criminal incident SAPD shall
assume the role of investigating agency and the SRO will assist to the limits
necessary;
• All criminal law violations committed by a faculty member or other AHISD
employee shall be investigated by SAPD;
• Provides each entity is responsible for the acts, deeds and negligence of its own
agents or employees and each entity shall be responsible for any liability or
damages by its personnel;

2. • An acknowledgement by both parties that they are governmental entities and that
neither party indemnifies the other party;
• The MOU will become effective once fully executed and remains in effect for
five years unless terminated by either party providing sixty days notices to the
other party.
The MOU applies to Alamo Heights Jr. High School, Howard Elementary and
Woodridge Elementary.
FISCAL IMPACT
The MOU does not create any financial obligation or fiscal impact.
POLICY
Pursuant to the Interlocal Cooperation Contracts, Chapter 791, Texas Government Code,
the City of Alamo Heights and the City of San Antonio, both a Texas home-rule
municipality, may jointly exercise the power to provide governmental services for public
health, safety and general welfare.
COORDINATION
City Manager and City Attorney have reviewed the MOU.
The AHISD Executive Staff, Attorney and the AHISD Board have reviewed the MOU.
