The proposed ordinance would adopt Article IX to regulate wireless network providers installing equipment in public rights-of-way. Besides explaining why, she also discusses how recent court decisions, the FCC’s new shot clock and various state laws are impacting local government control over wireless facilities siting.
Enabling Providers or Expanding Control? Standardized Reforms and the Diversi...

California municipalities are constantly faced with a changing regulatory framework related to the next generation of wireless services, known as 5G, which requires installing vast numbers of small cell equipment. These new networks present completely different local regulatory issues than the 3G and 4G networks of the past, which involved constructing large towers with a coverage range of a few miles. Supporting advanced 4G and new 5G requires telecommunications companies to build thousands of small cells at a faster pace with a far greater density of deployment. Municipalities’ policies and ordinances must keep up with this fast-changing technology.
The FCC recently adopted a new “Declaratory Ruling and Third Report and Order” that interprets provisions of the Telecommunications Act of 1996 to preempt local regulations that effectively prohibit the deployment of small cell wireless infrastructure in local communities. The FCC Ruling includes broad definitions of the types of local regulations that would be presumed to constitute an impermissible effective prohibition of wireless services, and establishes the applicable “shot clock” timelines by which local agencies must take action on small cell deployment applications.

Combined Illegal, Unregulated and Unreported (IUU) Vessel List.
The best available, up-to-date information on all fishing and related vessels that appear on the illegal, unregulated, and unreported (IUU) fishing vessel lists published by Regional Fisheries Management Organisations (RFMOs) and related organisations. The aim of the site is to improve the effectiveness of the original IUU lists as a tool for a wide variety of stakeholders to better understand and combat illegal fishing and broader fisheries crime.
To date, the following regional organisations maintain or share lists of vessels that have been found to carry out or support IUU fishing within their own or adjacent convention areas and/or species of competence:
Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR)
Commission for the Conservation of Southern Bluefin Tuna (CCSBT)
General Fisheries Commission for the Mediterranean (GFCM)
Inter-American Tropical Tuna Commission (IATTC)
International Commission for the Conservation of Atlantic Tunas (ICCAT)
Indian Ocean Tuna Commission (IOTC)
Northwest Atlantic Fisheries Organisation (NAFO)
North East Atlantic Fisheries Commission (NEAFC)
North Pacific Fisheries Commission (NPFC)
South East Atlantic Fisheries Organisation (SEAFO)
South Pacific Regional Fisheries Management Organisation (SPRFMO)
Southern Indian Ocean Fisheries Agreement (SIOFA)
Western and Central Pacific Fisheries Commission (WCPFC)
The Combined IUU Fishing Vessel List merges all these sources into one list that provides a single reference point to identify whether a vessel is currently IUU listed. Vessels that have been IUU listed in the past and subsequently delisted (for example because of a change in ownership, or because the vessel is no longer in service) are also retained on the site, so that the site contains a full historic record of IUU listed fishing vessels.
Unlike the IUU lists published on individual RFMO websites, which may update vessel details infrequently or not at all, the Combined IUU Fishing Vessel List is kept up to date with the best available information regarding changes to vessel identity, flag state, ownership, location, and operations.

- 2. SUMMARY Proposed ordinance to adopt Article IX - PUBLIC RIGHT OF WAY MANAGEMENT FOR WIRELESS NETWORK PROVIDERS, of Chapter 16 - STREETS AND SIDEWALKS
- 3. 3 BACKGROUND The State of Texas adopted Chapter 284 of the Local Government Code Governs how cities may regulate these providers within their jurisdiction. The proposed ordinance and policies were recommended by the City Attorney & the Texas Municipal League to help regulate these providers after Chapter 284 goes into effect.
- 4. 4 BACKGROUND Without these policies & regulations in place these providers would be allowed to operate in public right-of-way with limited local oversite. Ordinance will not prohibit providers from operating and installing equipment within the City, but will establish certain standards for permitting, design, construction, review, oversight, and fees.
- 5. 5 POLICY ANALYSIS Ordinance, policy, and design guidelines prescribe the permitting process, appeals, prohibition of attachment next to residential properties, and assigns fees per type of permit. These fees are established by the State and cannot be changed by the local governments.
- 6. 6 POLICY ANALYSIS Design Manual provides guidelines to the construction & placement of such devices. Specification will be reviewed by the City’s contract Engineer
- 7. 7 HIGHLIGHTS OF MAJOR REGULATION Section 16-202 “Definitions” New technology better defined Defines Micro network node, Network node, and Node support pole, in addition to other definitions.
- 8. 8 HIGHLIGHTS OF MAJOR REGULATION Sec. 16-210 APPLICABLE FEES AND RENTAL RATES TO THE CITY Network Nodes, Support Poles, and Tower Facilities: $100 each (max 30) Annual Fee $250 each May adjust annual fee equal to 1.5 the annual change in the Consumer Price Index
