Webinar | Perspectives on the Proposed DOL "Fiduciary Rule"NICSA
On April 20, 2015 the DOL published its re-proposed regulation on the definition of “Fiduciary” under section 3(21) of ERISA. The proposal included not only the change to the “Fiduciary” definition, but also two new prohibited transaction exemptions (“PTE”), as well as a number of amendments to existing PTEs. Since publication the DOL has received an avalanche of comment letters on the proposal, has held four days of hearings on the proposal and has accepted additional comment letters following those hearings. The proposal, if implemented in its current form will be a true game changer for the Retirement and RIA industries. As we now wait for the DOL to sift through the mountain of comment letters and hearing transcripts this session allows us an opportunity to pause and reflect on the current proposal and to provide unique perspectives from mutual fund, broker dealer, legal and retirement record keeper stake holders on how the proposal will impact the retirement industry.

The emerging industry of Greek start-ups has gained remarkable ground, but also a lot of government recognition and kind of support during the last years: “A strong culture of innovation and entrepreneurship drives the public and private sectors to join forces through Elevate Greece and reach out into global markets, promoting Greece as a major innovation hub in Southeast Europe” (Source: https://elevategreece.gov.gr). But start-ups need, amongst others, to get supported with alternative funding methods: at the early stages of development, raising debt capital is extremely difficult for young companies, especially those with business models that aren’t fully proven, or firms that haven’t reached their break-even.
This is where Venture Capital (VC) plays a huge role by making risky investments in start-ups and young companies in return for equity ownership. The role is not limited to the capital contribution, VC also provides mentorship, industry connections, and a support network that enables the expansion of young business models. Therefore VC is not only beneficial to entrepreneurs, but it also has a positive impact on economic and business development.
This document summarizes the essentials of VC principles, activities, and methods and is based on VC guidelines published by international associations.

With the introduction of the Simplified
Supervisory Formula Approach (SSFA)
and the continued use of the gross-up approach,
institutions have the ability to choose how to calculate
the risk weighting of securitization exposures. Based
on our experience, the SSFA approach results in lower
capital charge on senior, well-capitalized tranches
compared to the gross-up approach. In order to use
the SSFA, however, institutions must have access to
the appropriate deal and loan-level data as well as
the necessary expertise to carry out the calculation.

PROCESS
Black Swan uses both quantitative
and qualitative analysis to evaluate investment
programs. Using quantitative methods we
focus on the contributing factors behind overall
returns and to assess the investment manager’s
ability to outperform benchmarks. The qualitative
component allows us to reach a subjective
decision about the ability of managers to produce
attractive returns over multiple market cycles.
Quantitative Measures:
• Benchmarking
• Performance ratio
• Expense ratio
• Absolute returns
• Tracking error
• Leading/lagging trends
• Trading effectiveness
• Conflicts of interest
Qualitative Measures:
• Cost-benefit analysis
• Adherence to covenants
• Appropriateness of asset pricing
• Adherence to fiduciary responsibilities
• Custodian/trustee accountability
