SlideShare a Scribd company logo
 The judiciary is an independent organ of the
government. It is not under the power of the
legislature or the executive
 It does not favour the party in power and makes
decisions according to justice.
 It makes judgments only from the evidences
presented to them and also based on the
Constitution of India.
 It acts like a guardian in protecting the
fundamental rights of the people, as enshrined
in the Constitution
 The Chief Justice of India is appointed by the President
and has the highest judicial position in India.
 All the other judges of the Supreme Court and High Court
are also appointed by the president with advice from the
Prime Minister and consultation of Chief Justice of India.
 Senior, experienced judges of the Supreme Court select
new judges for Supreme Court and High Court.
 The senior most judge is usually appointed by the Chief
Justice of India.
 Once any judge is appointed to the Supreme Court or High
Court, it is nearly impossible to remove him or her from the
position.
 The president of India is not answerable to any court of the
judiciary.
 A judge can only be removed from power only by an
impeachment motion* passed separately by two-thirds members
of the two houses of the Parliament.]
 This has never happened till to this day in India.
