7. IDEA: Luật Giáo dục cho người Khuyết tật
IDEA: Luật Giáo dục cho người Khuyết tật là một luật
của Liên bang về giáo dục học sinh khuyết tật, yêu cầu
các trường học phải cung cấp cho phụ huynh học
sinh khuyết tật một bản thông báo giải thích đầy đủ các
biện pháp bảo vệ theo thủ tục hiện có theo như các quy
định của IDEA và Bộ Giáo dục Hoa Kỳ.
Giáo dục đặc biệt là cách giảng dạy được sọan đặc biệt,
miễn phí cho phụ huynh nhằm đáp ứng nhu cầu riêng của
trẻ khuyết tật.

12. Quyền về chấp thuận
1. Chấp thuận hoặc từ chối việc thẩm định để xác định xem con quý
vị có hội đủ điều kiện hưởng các dịch vụ giáo dục đặc biệt hay

2. Chấp thuận hoặc từ chối việc tái thẩm định cho con quý vị
3. Chấp thuận hoặc từ chối việc sắp xếp ban đầu cho con quý vị
trong chương trình giáo dục đặc biệt.

13. Quyền về hồ sơ ghi chép:
1. Xem lại các hồ sơ học tập của con mình,
2. Yêu cầu thay đổi các hồ sơ nếu quý vị cho rằng các hồ sơ này
không đúng hay sai lạc,
3. Đưa ra sự chấp thuận của mình trước khi các hồ sơ được tiết lộ
cho các cá nhân hoặc cơ quan khác.
14. Quyền về thẩm định giáo dục độc lập (IEE)
Phụ huynh có quyền yêu cầu thẩm định độc lập mà
không phải trả khoản phí nào nếu quý vị không đồng
ý với kết quả thẩm định của nhà trường.

16. Các quyền được hoàn trả:
Trong một số trường hợp nhất định, phụ huynh có quyền nhận
hoàn trả cho các chi phí như phí luật sư hoặc phí của trường
tư.

17. Quyền được chuyển tiếp:
(Transition) Các quyền của phụ huynh sẽ được

Chương trình giáo dục đặc biệt là các chương trình, hổ
trợ và các dịch vụ được thiết kế đặc biệt nhằm đáp ứng
nhu cầu riêng của mỗi trẻ.
Chương trình giáo dục đặc biệt giúp cho trẻ khuyết tật có
thể tham gia chương trình giáo dục chung cũng như

Chương trình cung cấp các hoạt động có ý nghĩa mang
tính giáo dục nhằm giúp học sinh có được những tiến bộ

22. Tiến trình IEP
1. Giới thiệu: phụ huynh hoặc các nhà chuyên môn có thể viết thư cho nhà
trường yêu cầu thẩm định.
2. Thẩm định: sau khi phụ huynh ký đơn chấp thuận cho nhà trường làm thẩm
định, trường sẽ tiến hành làm các thẩm định
• Lưu ý là tất cả các thẩm định phải được thực hiện trong vòng 30 ngày kể
từ khi phụ huynh ký đơn chấp thuận cho nhà trường làm thẩm định
• Phụ huynh yêu cầu nhà trường gửi bảng copy của tất cả các thẩm định
nhà trường làm 2 ngày trước khi nhóm họp IEP.
3. Họp IEP
* phải được thực hiện trong vòng 45 ngày kể từ ngày phụ huynh ký đơn chấp
thụân cho nhà trường làm thẩm định
4. Thiết kế bảng kế họach học tập cá nhân
* phụ huynh phải nhận được IEP trong vòng 55 ngày kể từ huynh ký đơn chấp
thụân cho nhà trường làm thẩm định và phụ huynh phải ký và gửi lại IEP cho
nhà trường trong vòng 30 ngày sau khi nhận được IEP.
5. Quyết định:
Ký bảng IEP và gửi lại cho nhà trường, hoặc chỉ ký chập thuận một phần nào
đó trong bảng IEP
23. Quá trình thẩm định giáo dục đặc biệt
Mốc thời gian cho các thẩm định
Giới thiệu: Phụ huynh hoặc các nhà chuyên môn phát hiện trẻ cần
giáo dục đặc biệt và các dịch vụ liên quan.
Chấp thuận: trong vòng 5 ngày, sau khi nhận được giới thiệu, học
khu phải thông báo cho phụ huynh và yêu cầu ký chấp thuận cho
nhà trường làm thẩm định.
Thẩm định: Trong vòng 30 ngày kể từ ngày phụ huynh ký giấy chấp
thuận cho nhà trường thẩm định, các chuyên gia có trình độ và bằng
cấp chuyên môn sẽ thực hiện các thâm định liên quan.
Trong vòng 10 ngày kể từ khi có kết quả thẩm định, học khu phải
họp đôi ngũ thiết kế kế họach học tập cá nhân.
24. Giới thiệu và thẩm định:
*Nhà trường không thể không làm thẩm định ban đầu
Thẩm định phải được thực hiện liên tục đến khi nào phát hiện
trẻ không còn hội đủ điều kiện được hưởng giáo dục đặc biệt
nữa
* Phụ huynh có thể yêu cầu nhà trường thẩm định cho con mình
một lần một năm về các mảng khuyếm khuyết hoặc nghi có
khuyếm khuyến.
Ngôn ngữ thẩm định phải được cung cấp bằng tiếng mẹ đẻ
hoặc bằng phương pháp giao tiếp khác mà có thể đưa ra được
kết quả chính xác nhất trừ phi một số trường hợp đặc biệt [IDEA
CFR 300.304]
25. Thẩm định bắt buộc
Thẩm định chuyên môn về tất cả các mảng nghi ngờ bị khuyếm khuyết
(Ví dụ: Các đánh giá về hành vi chức năng, về kỹ thuật hổ trợ, về ngôn
ngữ, vể nghề nghiệp)
Đánh giá về giáo dục:
Bao gồm các thông tin liên quan đến quá trình học tập, tiến bộ trong
chương trình học phổ thông
Thẩm định về tâm lý (không bắt buộc )
26. Quá trình thẩm định:
Phụ huynh có thể nêu lên nhưng ưu tư, lo
lắng về con mình cũng như bất cứ các
thông tin gì về con mình
Lý do về việc giới thiệu và mong cho kết
quả khả quan
Nội dung của thẩm định
Phụ huynh có thể:
• Đồng ý một phần họặc tòan bộ bảng thẩm
định
• Yêu cầu làm thêm các thẩm định
• Yêu cầu nhà trường chấp nhận các đề
xuất của các thẩm định bên ngòai
Phụ huynh có thể yêu cầu buổi họp với các thẩm định viên trước khi quá
trình thẩm định chính thức được thực hiện…[603 CMR 28.04 (1)(c)]
27. Thẩm định và tái thẩm định
Số liệu của các thẩm định chính là quá trình quyết định trẻ có hội
đủ điều kiện cho chương trình giáo dục đặc biệt
Thẩm định bao gồm:
•Các thẩm định về học thuật, về phát triển
và về chức năng của trẻ
•Các nhà thẩm định phải lấy thông tin từ phụ huynh
•Các thẩm định phải phù hợp với từng bang,
từng khu phố, từng lớp học
•Thẩm định còn bao gồm sự quan sát của giáo viên và các nhà cung cấp
dịch vụ liên quan

31. Hướng dẫn giảng dạy chuyên biệt:

33. Tiếp tục đánh giá về hội đủ điều kiện: Tái
thẩm định
Cứ 3 năm một lần thì học khu phải
làm đánh giá lại toàn bộ trừ phi phụ
huynh và nhà trường cảm thấy không
cần thiết.

hiện sớm hơn, nhưng không thể làm
một lần một năm được

34. Giải quyết bất đồng
Nếu phụ huynh không đồng ý với đội ngũ IEP vê
chương trình, sự sắp xếp lớp, dịch vụ. Phụ huynh
có thể yêu cầu làm thẩm định độc lập cho bất cứ
mảng nào phụ huynh quan tâm
• Phụ huynh có thể yêu cầu làm IEE trong vòng
16 tháng sau khi nhà trường làm thẩm định.
• Phụ huynh chỉ được yêu cầu IEE cho mỗi mảng
khuyết tật một lần một năm
Đánh giá thẩm định độc lập (IEE)
35. Nếu phụ huynh yêu cầu IEE:
• Phụ huynh có quyền chọn người làm thẩm định. (Học khu phải chịu
chi phí cho các thẩm định này theo mức gia Bang quy định.)
o Học khu phải chi trả cao hơn tùy theo trường hợp đặc biệt của
từng trẻ
o Tùy theo thu nhập của phụ huynh mà bang có chương trình chia
sẻ chi phí tình nguyện. Trong trường hợp này phụ huynh yêu cầu
phải cung cấp các thông tin về tài chính của mình
Trong vòng 5 ngày, học khu phải
Đồng ý chi trả IEE hoặc ra hầu tòa để giải quyết mâu thuẩn rằng các
đánh giá do nhà trường làm là phù hợp

36. Đội ngũ IEP sẽ nhóm họp để bàn về kết quả thẩm định độc lập trong vòng
10 ngày sau khi nhận được kết quả.
Đội ngũ họp bàn nhằm xem xét kết quả thẩm định và thảo luận nhằm đưa
các đề xuất vào IEP
Đây là cơ hội tốt nhất để phụ huynh và nhà trường có thể giải quyết mâu
thuẩn với nhau.
Nếu buổi họp không đi đến kết luận gì, bước tiếp theo là khiếu nại lên Ban
Kháng Cáo Giáo Dục Đặc Biệt (BSEA).
*Phụ huynh có thể tự trả tiền túi họăc yêu cầu bảo hiểm chi trả cho bất kì
đánh giá độc lập vào bất cứ lúc nào.

This workshop will help you better understand how to work with your school to obtain the support and services your child needs to make progress.
We will first learn about Special Education Law.
We will then describe your rights and responsibilities under Special Education Law and give you suggestions on how to be a more effective advocate.

IDEA 04 is organized around these six principles.
The overall framework of IDEA remains the same with IDEA 2004.
Parent/Student Participation Parents participate as partners with the school in developing, reviewing, and revising their student’s IEP. Students should be included at age 14. Decision-making authority transfers to the student at age 18, unless there is a court-appointed guardian. (Page 10 refers to the Parent’s Guide to Special Education)
Appropriate Evaluation. Schools must use a multidisciplinary team of properly credentialed evaluators to evaluate all areas of suspected disability and must ensure that evaluation tests are nondiscriminatory. (Page 11)
Individualized Education Program (IEP) A team of people that includes the parent will write an IEP for the eligible student describing the specially designed instruction and related services the student will receive to meet his/her unique needs. (Page 19)
FAPE Public schools must provide eligible students with disabilities, ages 3 through 21, with a free appropriate education at no cost to the parents. (Page 27) Please describe the implications of “appropriate” education to the participants.
Least Restrictive Environment Students with disabilities must be educated with non-disabled children of the same age in the regular education classroom with the needed supports and services unless it is clearly not possible for them to succeed there. Students can not be placed in separate or more restrictive environments only because they require modification of the curriculum. Also, placement should not be based on the student’s disability classification. (Page 28)
Procedural Safeguards These are the procedures that protect the rights of parents and children entitled to special education services, e.g., the right to written notice, independent evaluations, due process. (Page 29)

To be eligible a child needs to fit into one of these disability categories.
For example, a child with PDD or Aspergers would be classified under autism. Children with sensory integration dysfunction (DSI) are classified under neurological impairment. Children with bipolar or oppositional defiant disorder or obsessive compulsive disorder are classified under emotional impairment. Children with ADD/HD and Tourettes Syndrome are classified under other health impairment.

Another example is a Functional Behavioral Assessment (FBA) which is an assessment of student behaviors that helps determine when or why a behavior is happening so positive behavioral interventions can be used to develop more appropriate school behaviors.
Many children would benefit from an assistive technology evaluation to determine what assistive technology or special equipment would help a child in school.
For transition-age students, you may also want to consider a Vocational Assessment which can either be done formally with standardized assessments or functionally, that is, on the job.
For all assessments, it is important that the appropriate test and the entire test not just subtests be given and that the test is for the age range of your child.
Optional Assessments:
Health Assessment: an assessment to identify any medical problems that may affect the student’s learning.
Psychological Assessment: an assessment to consider student’s learning abilities and style in relationship to social/emotional skills.
Home Assessment: an assessment of family history that may affect the child’s learning.

One factor to consider is whether the child passed MCAS. Keep in mind though that this may be because the child is in an underperforming school. In which case, the child may be eligible for supplemental services or a school change.

Methodology or Delivery of Instruction - the way in which the student is taught is changed. Ex: Instruct the child through a multi-sensory reading program

Interpreting services includes transcription services, such as communication access real-time translation (CART), C-Print, and Type Well for children who are deaf or hard of hearing, and special interpreting services for children who are deaf-blind
IDEA 2004 excluded any surgically implanted medical devices including cochlear implants and the optimization of that device’s functioning, maintenance of that device, or the replacement of that device.
This does not limit the right of a child with a surgically implanted device to receive related services.
This does not limit the responsibility of a school to properly monitor and maintain medical devices that are needed to maintain the health and safety of the child, including breathing, nutrition, or operation of other bodily functions, while the child is transported to and from school and is at school
This does not prevent the routine checking of an external component of a surgically-implanted device to make sure it is functioning properly
For children who are visually impaired or blind, orientation and mobility is imperative. This includes learning to navigate and move around in all environments, successfully and safely. Orientation and mobility is different from travel training instruction but can also be included in the IEP.
School nurse services has been expanded and re-named school health services and school nurse services
This clarifies that “school nurse services” are provided by a qualified school nurse and “school health services” may be provided by a qualified school nurse or other qualified person.
A student must need special education to be eligible.
When making an eligibility determination, Teams must remember that the final question to ask is: Does the student require special education in order to make
ED 1 progress? Special education is defined as specially designed instruction to meet the unique needs of the student or related services that are necessary to access the general curriculum. Specially designed instruction means that there is a need to adapt the content, methodology, delivery of instruction and/or performance criteria in order for a student to make effective progress.
Related services, are developmental corrective and other supportive services. Within Massachusetts, related services necessary to access the general curriculum are considered special education and may be provided alone or in combination with specially designed instruction.
If the student only requires accommodations, then that student is not eligible for special education. Accommodations are adaptations to presentation or setting that can typically and easily occur in general education (such as preferential seating, wearing eyeglasses, giving extra time on tests).
The student is eligible. If the student has one or more of the disabilities defined at 603 CMR 28.02(7) and if, as a result of the disability(ies), the student is unable to progress effectively in the general education program without the provision of specially designed instruction, or is unable to access the general curriculum without the provision of one or more related services, the Team shall determine that the student is eligible

Writing a strong IEP with needed services requires a re-evaluation to take place every three years.

The foundation of a good educational program is an evaluation that truly reflects the strengths and needs of the individual student.
At times a parent may find that they disagree with the school district's evaluation.
If the parent disagrees with the school district's evaluation results they have the right to have their child evaluated by a qualified professional(s) not employed by the school system. Both federal and state law allows parents to seek an Independent Educational Evaluation (IEE).
Parents know their children's needs best but the school needs concrete evidence to show that the child requires the services parents ask for.
An evaluation is the only way to prove the parent perspective.
The IEE is an avenue to provide the school with concrete evidence.
The school has the first right to evaluate. You can get a private IEE any time but the school will require their own evaluation as well.
Best practice is to request the school to evaluate your child first and then get an IEE.

If families are not financially eligible, or decline to participate in cost-sharing, or request evaluation in area not assessed by the school, the federal law supersedes the state law.
Under the Federal law, there is then no sliding scale and no time limit.
If more than 16 months have gone by, then the parents can request a reevaluation by the school and then request an independent evaluation.
If the school fails to initiate a hearing within 5 days, the school loses the right to initiate a hearing at all. In this case, the school must pay for the IEE.
Purpose of Slide: To explain what happens after the IEE is completed.

Once you receive the report, provide it to the team 10 days prior to the team meeting.

The special education evaluation process requires the school district to assess the student in all areas related to the suspected disability as well as conducting a comprehensive educational assessment. Parents have an opportunity to request publicly funded independent educational evaluations (IEEs) of their child if they disagree with the results of an evaluation by the school district. If the parent requests an IEE at public expense, the school district must either pay for the IEE or, within five days, request a determination from the Bureau of Special Education Appeals (BSEA) that the district's evaluation was comprehensive and appropriate. The federal standard for IEEs is not time limited.
Under Massachusetts law, school districts are required to provide publicly funded IEEs on a sliding fee scale for students whose families meet certain income criteria. This sliding fee scale provision applies to requests for an IEE made within 16 months of a contested evaluation. The application of the sliding fee scale is detailed in Administrative Advisory SPED 2001-3, available at http://www.doe.mass.edu/sped/advisories/01_3.html.
Within 10 school days from the time the school district receives the report of the IEE, the Team shall reconvene and consider the IEE and whether a new or amended Individualized Education Program (IEP) is appropriate.
If a parent requests an IEE more than 16 months after the school district evaluated the student, the best practice would be for the district to seek consent from the parent to conduct its own updated assessments and evaluation of the student first, within the timelines required by the special education regulations.
If a parent requests an IEE in an area not assessed by the school district, the best practice would be for the school district to review its evaluation and determine whether the requested assessments) would provide needed additional or new information about the student's disability and if so, offer to conduct the additional assessments) itself with the parent's consent.
Parents may obtain an IEE at their own expense at any time.
Purpose of the slide: To list and explain the appeals options if differences can not be resolved.

NEW Facilitated IEP Team Meeting: IEP team meeting facilitation is a voluntary process that can be used when the parties to an IEP meeting agree that the presence of a neutral third party would assist them in communicating and in the successfully drafting an IEP for a student.
Mediation is an informal process with a mediator, a third-party neutral, to work out resolution of conflicts between the parents and the school district. A mediation agreement, if reached, will be written and attached to the IEP to amend the IEP. Mediation can be requested at any time.
Once an agreement has been reached and signed it is a binding legal document.
If offers are not accepted during mediation, they are non-binding once the meeting is over and cannot be used at a hearing.
It is signed by both parent and the school district representative
Is enforceable in court
Mediation and Resolution Meeting can result in a Written Settlement Agreement
An advisory opinion allows a hearing officer to review a case and offer an opinion on the merits of the case and offer a nonbinding ruling without going through a formal hearing.
Usually advisory opinions are mirrored by hearing decisions after a case proceeds to hearing.
This is a good way to test the merits of your case without incurring all the costs of a hearing.
If these two options fail, then a formal hearing may be necessary.
If you request a hearing, a packet of information will be sent to you within 5 days of when you or the school forwards the rejected IEP to the BSEA.
Resolution meeting is required, and used before going to a hearing. Mediation can be used in place of the resolution meeting if both parties agree in writing. Substituting mediation may prevent a re-hashing of previous disputes because there is a neutral party present to help facilitate. Many times there are better outcomes for kids and families through this process.
Most cases that use this process do not reach a full hearing.
Resolution Only: Can be voided within 3 business days by either party [IDEA 2004: CFR: 300.510]
Pre-hearing conference calls can also result in settlement agreements prior to hearings. Before going to Hearing if both parties agree they can participate in a Pre-Hearing conference call to see if they can negotiate an agreement. If an agreement seems possible the parties may opt for a Settlement Agreement. The agreement is facilitated by a BSEA personnel. If there continues to be no agreement then the parties may continue on to Hearing.
SpedEx: is a dispute resolution 3 yr pilot project that will be available after a hearing request has been filed.
It is designed to assure that a child receives FAPE in the LRE
Is voluntary and will build trust between parents and LEA
Is expedient
Involves a jointly agreed-upon independent SpedEx consultant chosen from a list maintained by the BSEA and paid for by the BSEA, who can assist parties to determine the program the child ensuring FAPE in the LRE
The parties are not bound by the consultants report and recommendation
If the parties do agree, the hearing request is withdrawn and the SpedEx consultant observes the child in the program to assure that FAPE is being provided in the LRE.
If the parties do not agree the parties can pursue their due process rights or Hearing
Background Information:
Facilitated IEP’s: process has experienced a great deal of growth on the national level and new programs are being implemented in many states. Though most IEP team meetings flow smoothly and do not need the assistance of a facilitatior, sometimes conflicts arise, impasse occurs, issues are new and complex, or other problems develop and outside assistance is useful to remain focused on the development of a sound IEP for the student. The Program Quality Assurance Department (PQA) has a liaison for each town who will accept and investigate written complaints within 60 days.
When you call, the liaison will send you a complaint form in the mail.
From the time you receive the complaint form, you have 30 calendar days to submit it.
If the written complaint is not submitted within 30 calendar days it will not be considered.
IDEA regulations now require that parents filing complaints must forward a copy of the complaint to the school district serving the child at the same time they file a complaint with the Department of Education.

ED REFORM
The 1980s saw the beginning of a national movement to reform education by setting learning standards for all students.
The goal of the standards is to ensure a quality education for all students.
Our own Massachusetts Education reform Act of 1993 and the national No Child Left Behind Act passed in 2002 establish in law many of the approaches to education reform developed during the 1980s.
The Education Reform Act is based on the belief that every child deserves to have a meaningful education driven by high expectations.
The Act required a standard curricula for all children in MA. This curricula is called the MA Curriculum Frameworks.
They are called “Curriculum Frameworks” because they give the basic structure or framework that the specific curricula will be based on. It is like a skeleton for education.
Curriculum Frameworks define what every student should know and be able to do at each grade level.
Local districts and schools develop specific curricula based on the MA curriculum framework standards.
This curricula is then used by all teachers to develop lesson plans.
NCLB requires that all students are tested on the curriculum framework standards—in MA this test is called The Massachusetts Comprehensive Assessment System (MCAS).
MCAS provides accountability on the individual, school, district and even state level.
In order to be held accountable for the knowledge tested on the MCAS, every child must have had the chance to learn the same information.
Access to the general curriculum is achieved when children on IEPs have the same chance to learn the curriculum frameworks with accommodations, modifications and other supports necessary to enhance progress.
*Note: Federal and State laws each have corresponding regulations. State laws and regulations can have more protections.
IDEA 2004 is the federal law that applies to all eligible children with disabilities across the nation.
NCLB another federal law that applies to all children
Massachusetts Special Education Law has additional protections for students in Massachusetts.
Background information:
IDEA was originally enacted in 1975 as the Education for All Handicapped Children Act.
It is reauthorized periodically. The name was changed to IDEA during the 1990 amendment.
It was then amended again in 1997.
IDEA 2004 was signed into law by President Bush on December 3, 2004 after a three-year process.
