At the end of the lesson, students should be able to:
a. Identify the different legal concerns on first aid and basic life support;
b. relate some examples that connect to the legal concern; and
c. explain the importance of legal concerns before doing first aid.

A. MOTIVATION
Before we will proceed with our lesson for
today, I’d like you please behave yourself
and fasten your seatbelts and just talk if it is
necessary. Is that clear class?
Before we continue, let’s have an activity
called the “Cross Word Puzzle”. I know that
everybody is familiar with this game.
Right?
All you have to do is just to look for the
words from the image that I will show to
you. I will give you a minute to look in the
image and as I call on your name be sure

B.PRESENTATION
With regards to our activity a while ago, the
words that you’ve just encountered are part
of our lesson for today which is the legal
concerns of first aid and basic life support.
C.LESSON PROPER
In our previous lessons we have defined
that first aid is the immediate or initial
process of assessing and addressing the
need of someone who is experiencing
medical emergencies. In continuation to
that we shall now proceed to the legal
concerns on first aid and basic life
support.
Outdoor educators are sometimes afraid
that in the stress and strain of a real

emergency they may make mistakes, fail
to save, or even cause harm to others.
Particularly in relation to strangers, they
have a further concern that mistakes may
lead to legal problems or that they will be
sued if they do the wrong thing. It is
reassuring to learn that outdoor educators
while administering first aid are not
expected to be perfect; nor is it expected
that every incident will turn out perfectly.
However, what is required, is that the
outdoor educator act reasonably and
prudent and, of course, always in good
faith when administering first aid. When
administering first aid outdoor educators
must keep the best interests of the
casualty in mind.
As a first aider soon we must keep in
mind the different legal concerns before
administering a patient. The first thing
you should put in mind is Negligence.
1. Negligence means carelessness, or the
failure to behave in the manner
expected by the community when
dealing with others. Therefore, in a
negligence claim, the plaintiff must
prove the following;
- Duty of care
- Standard of care
- Abandonment
Have you ever witness an accidents wherein
you were involve in that accident and then
you ask for help but no one helped you?
What do you think the reason why some do
not help others during accidents?

2. Duty of care arises when, at law,
there is sufficient relationship
between one person and another.
Note: Once a person begins to
provide first aid, a duty of care is
established and the first aider is
required to act in accordance with
training and experience.
Can you give more examples that is related
with this duty of care?
3. Standard of care has been described
as the standard of a reasonable
person. This standard means a person
is obliged to take such care as a
reasonable persons, having due regard
to the consequences of his/her
actions.
The following could be used to
establish an appropriate standard of
care;
- The amount of training the person
has
- Rules od standards set by
authorizing groups (e.g. the
employer)
- The evidence of experts
Who are these person with enough abilities
to care someone who is in need of
emergency crisis?
4. Foreseeability & Proximity
 Foreseeability involves the action or
lack of action by a person or a
person which results in a risk of
injury.
 Proximity involves establishing that
the plaintiff’s injury is directly

Employers and their employees
Outdoor adventures and their clients.
Examples are doctors, nurses, 911 and
more.

linked to the area of the defendant’s
responsibility.
Therefore;
- Use reasonable care in assessing the
priorities of the situation based on
their level of training.
- Take steps to call for further medical
assistance.
- Keep the casualty stabilized until
medical assistance arrives
- Follow established treatment and
management protocols.
- Not misrepresent themselves or take
unnecessary risks.
5. Consent
 A first aider must seek permission
from the victim prior to providing
first aid
 If the victim is unresponsive or
unable to communicate, the law
assumes that consent would been
given by the victim.
 If the victim is child, the consent of
a parent or legal guardian should be
sought where possible.
6. Recording
 First aider should keep a written
record of any incidents where they
provide first aid.
 Such records can be used as a legal
documents in courts and therefore
should be written clearly, accurately
and concisely.
REMEMBER:
 Appropriate confidentiality must be
maintained to protect the privacy of
a victim.

So, those are the 6 legal concerns that I’ve
found in the internet. If there any questions
or any addition please don’t hesitate to give
your ideas.
However, there is that we called the Good
Samaritan Law. This law doesn’t oblige you
to act as a good Samaritan and you have no
duty to rescue or provide first aid but first
aiders have a moral duty to aid fellow
human beings in a time of crisis. As long as
you are in good faith to provide emergency
aiding to those who are in crisis, you are
safe under the law.

Before we end our topic today, I just
want to remind everybody that we have
to follow this concerns or protocols for us
to be safe and do not violate the law.
