The UK’s gambling laws are set to change, enabling the government to tax gaming firms located overseas. It has recently been announced that all gambling operators offering bets to customers in the UK will be required to hold a UK license irrespective of where they are based. The changes are designed to stop offshore operators having an unfair advantage over UK-based competitors – which have to deal with a 15% gross profits tax, on top of corporation tax and VAT – as well as to provide increased protection for British customers gambling online.
So, what do these changes mean for offshore operators and affiliates? When are these changes due to be implemented? And how can the UK prepare for the changing legislation?

Presentation about the European Market Infrastructure Regulation (EMIR) focusing on objectives, obligations, affected entities and instruments, reality check on pension funds, reality check on clearers and reality check on real economy (20 pages).
The current regulatory situation in the Member States is such that operators may be required, when offering the same type of online gambling service (e.g. sports betting) in different Member States, to apply for a licence in each of these Member States. Certain Member States recognise licences issued in other Member States that are notified to them (white listing) and allow such licensed providers to offer their on-line gambling services into their territories without an additional licence. Others may take account of such licences when issuing their own licences to such operators but impose double licensing regimes whereby each operator, irrespective of whether he is operating in another Member State, must be licensed within their territory before he can offer such services.

In his presentation Ignacio Gonzalez-Paramo, VP Global Compliance PAYVISION, will try to provide the audience with an insight on why EU regulation is strategically key for those willing to establish in the EU or to strengthen their market positioning there.
On top of that, he will also walk the attendees through the key actors in the European policy making process, as well as the most important pieces of legislation to be borne in mind by potential or existing EU CNP players. Ignacio will also underscore the regulatory issues that might imply hurdles for running a CNP business.
And, to end with, he will provide some pieces of advice on how to successfully address those issues.

After working in marketing and ecommerce for a number of private companies, in June 2007 he moved to AAMS (now ADM), where he accomplished the reform of the regulation and the introduction of poker, casino and slots games. He is a member of the European Commission’s Expert Group on Gambling Services.

This bill amends the Betting and Gaming Act.It is the second phase in the modernisation process of the games of chance policy, which aims to prevent gambling addiction, protect the consumer and discourage illegality and crime.
Remote games of chance are games of chance in which the player takes part with electronic means of communication and without physical contact with (the personnel of the) the organiser of the games of chance or a third party which provides a room and resources for the participation in the games of chance.
Because of the lack of direct contact between the player and the games of chance provider, these games involve different and bigger risks of fraud and gambling addiction than the traditional physical (“land based”) games of chance.
Proper and strict regulation of remote games of chance involves among other things that additional measures are set to prevent gambling addiction, including a central register for the exclusion of games of chance3, as well as additional supervision and enforcement powers for the Games of Chance Authority and amendment of the games of chance legislation.
The European Union is the second-largest economy across the globe. It is right behind famous Asian countries like South Korea and Japan in terms of Cryptocurrency investment. The gaming and amusement industry can contribute by making industry data available to public authorities and in many cases the industry also directly funds research into problem behaviour; however, as governments derive substantial tax revenues from the industry, and this trend is increasing, EUROMAT and its members see a clear case for a greater proportion of this revenue to directly fund the development of a body of credible evidence.

6. EUROMAT welcomed the launch of the debate
The EU institutions are taking the right approach:
◦ Respect the principle of subsidiarity
◦ No harmonised EU-wide set of rules for the entire gambling
arena.
◦ Due to significant moral, religious and cultural differences
between Member States gambling is better regulated at
national level
7. The cross-border nature of remote gambling justifies an “EU
approach”
A European (or international) framework of minimum
standards would ensure proper and effective regulation of
online gambling
National regulators need to work together
The EU institutions have a fundamental role to play in ensuring
that Member States have the tools and incentives required to
regulate and enforce at national level operating licenses across
the spectrum of gambling services
8. EUROMAT supports the Commission’s efforts to mantain a
strong and consistent EU framework to protect consumers and
businesses against the risks of money laundering (AML) and
terrorist financing (CTF)
But, machines available in gaming arcades entail only low
stakes and low payouts and thereby represent only very
minimum or no AML/CTF risks
We need to avoid the imposition of an excessive burden on
lower risk activities
9. In order to foster future growth, we need to ensure a
level-playing field across the European gambling
arena:
◦ A fair and adequate taxation regime
◦ Same regulatory requirements for all operators
◦ Requirements must properly enforced
National rules need to be structured in such a way as
to allow us to innovate and keep pace with demand
10. Only if we work together will we be able to find the
best way to turn the threats and challenges that our
industry is facting into real opportunities both for
our industry, as well as for society.
