Gli effetti della pandemia provocata dalla diffusione del virus Covid-19 hanno investito tutti i settori delle attività sociali del Paese, compresa l’attività giudiziaria. In Italia, come nel mondo, la tortura è stata usata da parte delle forze dell'ordine. Va punita (con una legge ben più effettiva che quella vergognosa approvata in Italia nell'estate 2017) o invece dobbiamo "fight fire with fire", per citare Donald Trump? Ed è vero che "torture works", come dice sempre il POTUS?

Attacks on lawyers, fatal and otherwise, occur across the world in all types of countries. They are increasing in frequency. More than 1000 lawyers and legal workers have been killed or disappeared in the past several decades.
Many of these lawyers were courageous human rights defenders who accepted the risks involved. But that risk should not include impunity for the perpetrators. Unfortunately, many governments appear reluctant to investigate and bring to justice the suspected assassins. In many cases, it seems that reluctance to pursue the guilty stems from the involvement of the military, police or private interests aligned with the government.
The exercise of the legal profession is protected under national and international legislation, because it is a premise of the right of defense in the rule of law. Moreover, lawyers involved in human rights cases are protected under the Declaration on Human Rights Defenders, adopted by Resolution 53/144 of UN General Assembly in 1999.

Questo lavoro di ricerca, svolto (qualche tempo fa) a margine del Master in Educazione alla Pace e diritti umani (Università Roma Tre) e di un viaggio studio sul campo, si colloca nell’orizzonte temporale, sociale e giuridico della transizione da regimi dittatoriali alla democrazia, applicandosi nel particolare alle gravi violazioni dei diritti umani da parte dello Stato. Un tema per me di tragica attualità, su cui in questi quasi dieci anni ancora troppo poco siamo andati avanti. Un lavoro da riprendere assolutamente.

The project lawyers for rights, co-funded by the Justice Programme of the European Union, aims at improving the understanding of the European Charter of Fundamental Rights via specific training activities addressed to lawyers. In the face of emerging challenges such as migrations and terrorism, lawyers play a key role in the protection of fundamental rights and need to have a better knowledge on the Charter and its application at national level.

Due mesi con condizionale per 'apologia del terrorismo'
Otto-Preminger-Institut v. Austria, (13470/87) del 20 settembre 1994, avente ad oggetto una opera artistica giudicata “blasfema” (Herabwürdigung religiöser Lehren) dal Landesgericht di Innsbruck dopo una denuncia delle autorità cattoliche, la Corte europea ha stabilito al par. 49 quanto segue:
As the Court has consistently held, freedom of expression constitutes one of the essential foundations of a democratic society, one of the basic conditions for its progress and for the development of everyone. Subject to paragraph 2 of Article 10 (art. 10-2), it is applicable not only to "information" or "ideas" that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that shock, offend or disturb the State or any sector of the population. La libertà di espressione del pensiero implica dunque che vi sia spazio per esprimere e divulgare idee nuove e anticonformiste, e che non siano represse le opinioni che pure urtano o inquietano (cfr., ancora, Corte europea dei diritti dell’uomo, 8 luglio 1986, Lingens c. Austria, A-103; 23 settembre 1994 Jersild c. Danimarca, A-298).
