When a person is arrested for a crime they have the right to put on a defense. The criminal defendant can claim the committed the crime in self defense or they could simply say they are innocent. Another type of defense is the insanity defense. In the insanity defense the criminal defendant claims they are not responsible for the crime due to their mental state. In order to be successful at pleading the insanity defense the defendant must prove they were not in their right mind at the time of the crime. If a defendant is found to be legally insane they will either be sent to a mental health facility or to prison where they will receive mental health treatment.
There have been many famous cases where the criminal defendant claimed they were insane. John Hinckley attempted to assassinate President Reagan but despite the heinous crime he was found not guilty for reasons of insanity. This outraged the American public leading to all types of reforms to the insanity defense. The McNaughton Rule was the original test applied to measuring insanity (Collins, 2006). This test simply asks whether the defendant new the difference between right and wrong at the time of the crime. After Hinckley the McNaughton rule was discarded in many states and the burden of proof went from the prosecutor to the defendant.
In some rare case a jury will find a person temporarily insane. In the Lorena Bobbitt case the defendant was found temporarily insane after she mutilated her husband’s genitalia. Lorena Bobbitt is infamous for cutting off her husband’s penis after he raped her. Bobbitt then discarded the penis but it was later retrieved by police. Lorena claimed she was under extreme stress at the time she got the knife and mutilated her sleeping husband. Procedural Justice and the Adolescent Offender_2
This study examined how perceptions of procedural justice during legal proceedings affect the emotional and behavioral adjustment of 373 incarcerated male juvenile offenders. The researchers found that perceptions of unjust treatment were associated with greater levels of anger, less positive views of the justice system and facility, and more frequent and varied offending behavior over time. Perceptions of injustice were greater for minority youth and did not depend on prior offense history or victimization while incarcerated. offenders, Augustus gathered background information about the offender’s life and
criminal history. If he determined that the person was worthy, Augustus provided bail
money out of his own pocket. If he succeeded in winning the person’s release, he helped
them find employment and housing. Later he appeared at the sentencing hearing and
provided the judge with a detailed report of the person’s performance. Augustus would
then recommend that the judge suspend the sentence and release the person to his
custody.
Considered the father of modern probation, Augustus’s leadership led the Massachusetts
legislature to establish the nation’s first probation law in 1878. By authorizing the Mayor
of Boston to appoint a member of the police department to serve as a paid probation
officer, this statute formalized the practice of extending probation to "such persons as
may be reasonably be expected to be reformed without punishment." The law was
expanded in 1891 with the creation of an independent state-wide probation system. By
the time that the National Probation Act was passed in 1925 creating a Federal probation
service, the majority of states had probation statutes.

Procedural Justice and the Adolescent Offender_2
This study examined how perceptions of procedural justice during legal proceedings affect the emotional and behavioral adjustment of 373 incarcerated male juvenile offenders. The researchers found that perceptions of unjust treatment were associated with greater levels of anger, less positive views of the justice system and facility, and more frequent and varied offending behavior over time. Perceptions of injustice were greater for minority youth and did not depend on prior offense history or victimization while incarcerated. The effects of perceived unfairness lasted throughout incarceration, suggesting rehabilitation efforts may be most effective when starting at initial contacts with the justice system.

individualized sentencing. With the advent of more punitive sentencing policies in recent
years, the PSI has become more offense focused and less individualized. Despite current
trends, the PSI will likely remain a critical component of the American criminal justice

Origins of the PSI
The origins of the modern presentence investigation began in the 1840s with the
crusading efforts of Boston shoemaker John Augustus (1841-1859). It was Augustus’
belief that the "object of the law is to reform criminals and to prevent crime, and not to
punish maliciously or from a spirit of revenge." In his efforts to redeem selected
offenders, Augustus gathered background information about the offender’s life and
criminal history. If he determined that the person was worthy, Augustus provided bail
money out of his own pocket. If he succeeded in winning the person’s release, he helped
them find employment and housing. Later he appeared at the sentencing hearing and
provided the judge with a detailed report of the person’s performance. Augustus would
then recommend that the judge suspend the sentence and release the person to his
custody.
Considered the father of modern probation, Augustus’s leadership led the Massachusetts
legislature to establish the nation’s first probation law in 1878. By authorizing the Mayor
of Boston to appoint a member of the police department to serve as a paid probation
officer, this statute formalized the practice of extending probation to "such persons as
may be reasonably be expected to be reformed without punishment." The law was
expanded in 1891 with the creation of an independent state-wide probation system. By
the time that the National Probation Act was passed in 1925 creating a Federal probation
service, the majority of states had probation statutes.
The evolution of the presentence investigation was given further impetus by the
reformatory movement of the 1870s. Because reformatory movement proponents
advocated an individualized approach towards the redemption of the criminal,
indeterminate sentencing became a popular sentencing reform throughout the later half of

Did they effectively use the media to deliver key messages?
Did they share good and bad news?
Did they exhibit consistent and believable communication?
Did they involve employees and customers in the communication effort?
Were their actions aligned with mission and values?

Ineffective victim or suspect interviews or interrogations can cost an investigator a case, and understanding the difference between an interview and an interrogation is critical in selecting an appropriate approach for a specific situation. Interviews and interrogations are dynamic, evolving situations, and developing interviewing and interrogation skills takes time and practice. Interrogation involves an accusatory, persuasive approach. Effective interviewers have the ability to quickly establish rapport with their subjects and gain complete, concise, and accurate information about crimes, additional witnesses, and suspects. Building rapport early helps take down barriers to open and clear communication, which is critical in conducting interviews and interrogations.
