Why do SEA?
• Integrate environmental issues into decision making and promote sustainability
– concerns early in the process (conception stage)
• Opportunity to integrate other legislation (Habs Directive) and participation of
stakeholders (Aarhus Convention);
• Minimise negative impacts on the environment and promote positive ones; and
• But………not an end in itself, it is to ensure the Plan is as robust as possible in the
context of the wider environment.

Statutory plans and programmes prepared and/or adopted by national, regional or
local authorities and required by legislative, regulatory or administrative provisions.
All plans and programmes which are prepared for:
• agriculture, forestry, fisheries, energy, industry, transport, waste management, water
management, telecommunications and tourism,
• and which set the framework for future development consent of projects listed in
Annexes I and II to the Environmental Impact Assessment Directive, or
• which are not directly connected with or necessary to the management of a European
site but, either individually or in combination with other plans, are likely to have a
significant effect on any such site.

Alternatives are at the heart of SEA. Legal requirement under
the SEA Directive
Art. 5.1: reasonable alternatives taking into account the
objectives and the geographical scope of the plan or
programme, are identified, described and evaluated’
Art. 9.1: a statement is prepared summarising ‘… the reasons
for choosing the plan or programme as adopted, in the light
of the reasonable alternatives dealt with.’
Annex 1h: the Environmental Report includes ‘an outline of
the reasons for selecting the alternatives dealt with.

• How environmental considerations have been integrated into the plan or
programme, or modification to a plan or programme
• How the environmental report, submissions and observations made to the
competent authorities and the public have been taken into account
• The reasons for choosing the plan or programme, or modification to a plan or
programme, in the light of the other reasonable alternatives dealt with, and
• The measures decided upon to monitor the significant environmental effects of

Appropriate Assessment is a key protection mechanism
Article 6(3) Habitats Directive
Any plan or project not directly connected with or necessary to the management of
the site but likely to have a significant effect thereon, either individually or in
combination with other plans or projects, shall be subject to appropriate
assessment of its implications for the site in view of the site's conservation
objectives. In the light of the conclusions of the assessment of the implications for
the site and subject to the provisions of paragraph 4 , the competent national
authorities shall agree to the plan or project only after having ascertained that it
will not adversely affect the integrity of the site concerned and , if appropriate,
after having obtained the opinion of the general public.

FORESTRY
Forest Service – AA PROCESS REQUIRED:
• applications for consent for afforestation, road construction under the
European Communities (Forest Consent and Assessment) Regulations 2010
• grant approval (any Forest Service grant scheme}
• licenses in relation to aerial fertilisation, various forestry activities
(thinning and felling) under the Forestry Act 1946
Where AA is required in relation to a proposed thinning, felling, replanting or forest
road construction, such development will also require planning permission from the
relevant LA [Section 17(1)(b) of the Environment (Miscellaneous Provisions) Act
2011]
NOTE: AA Screening is done by FS as part of application evaluation

All plans and programmes which are prepared for: • agriculture, forestry, fisheries, energy, industry, transport, waste management, water management, telecommunications and tourism, • and which set the framework for future development consent of projects listed in Annexes I and II to the Environmental Impact Assessment Directive, or • which are not directly connected with or necessary to the management of a European site but, either individually or in combination with other plans, are likely to have a significant effect on any such site.

Appropriate Assessment is a key protection mechanism Article 6(3) Habitats Directive Any plan or project not directly connected with or necessary to the management of the site but likely to have a significant effect thereon, either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implications for the site in view of the site's conservation objectives.
