Unfortunately for Johnny, he cannot afford the ransom. So, Johnny withdraws the ransom money from Plastic Spoon Solution Embezzlement is the theft of funds from an employer. In this case, the actual definition of embezzlement for legal purposes must involve the intentional taking of money or property by a CEO or other top official in a corporation without consent. The facts of the case are this: Johnny is the CEO of the corporation and he intentionally took money without consent in order to pay a ransom for his stolen daughter. While Johnny did perform the actions that meet the state\'s definition of embezzlement he didn\'t follow the typical pattern of embezzlement. Most embezzlement occurs in a sneaky underhanded deceptive fashion where an individual is committing the crime for personal gain, wealth, or retribution against the company. Johnny did it to save his daughter and not for personal gain or retribution on the company. While Johnny is indeed guilty of the crime of embezzlement, arguments that Johnny could present for leniency purposes are: 1. the decision to take funds from the company were made under duress 2. He was planning on telling the directors about the situation once his daughter was safely returned The police searched Johnny\'s home without a warrant and illegally seized a letter he was writing that confirmed he took the money from the company to pay the kidnappers. He could request that the judge suppress any evidence that was seized illegally, meaning that the letter was obtained without a warrant. However, it might be to his benefit to have the letter admitted as evidence in his defense instead.
