Sex Discrimination In College Sports
Foundation
Over the past few years, intercollegiate athletic programs have grown at a rate that has raised concerns in many higher education institutions. One of
the concerns is funding equity for male and female athletic programs. Since its establishment in 1972, Title IX has prohibited sex discrimination in
educational programs that receive federal funds (Carpenter, 2000). In this paper, I analyze the establishment of Title IX and how it has impacted
intercollegiate athletics.
With the establishment of Title IX, higher education and athletic programs have provided anti–discrimination based on sex. The law states, "no person

The outcome help establish the need for institutions to provide equitable opportunity for both sexes in college athletics. Current research on Title IX
has demonstrated positive and negative implications with the policy.
First, we will look at the positive impact. The positive effects of Title IX have seen a higher number representation of women athletes in higher
education. Currently, women make up 57% of the college student population, and 43% of females are now playing intercollegiate sports (US News,
2012). With the increase of female students, Title IX has provided access to females in higher education and intercollegiate athletics.
While female student participation in college athletics is increasing, it does not come close to men's participation or finances. Female participation has
increased by 3,550 while men's participation increased by 6,431 almost double of their female counterparts (American Association of University
Women, 2013). In addition, the NCAAGender Equity Report shows that in the 2009–2010 school year, the total revenue for men was $5,519,600,
while women's was significantly lower at $2,622,900 (NCAA, 2010). Although Title IX has provided opportunity for both sexes in college athletics,
male participation is still dominating. However, recent trends are indicating that athletic programs have taken action to promote female

Title IX And Sex Discrimination
Title IX was first introduced in Congress by its head author and sponsor, Senator Birch Bayh. On June 23, 1972, President Richard Nixon signed into
law Title IX of the Education Amendment of 1972 in response to the 1964 Civil Rights Act, requiring equal opportunity for males and females in
educational programs – including athletic programs. According to the United States Justice Department, Title IX is a comprehensive federal law which
prohibits discrimination on the basis of sex in any type of federally funded education program or activity. The main purpose of Title IX is to avoid
using federal money to support sex discrimination within education programs and to provide United States citizens with effective protection.

Dianne Rawlinson And Sex Discrimination
Dianne Rawlinson applied to be a prison guard with the Alabama Department of Corrections. The Department had a minimum height and weight
requirement of 120 pounds and 5 feet 2 inches. She did not meet the minimum weight requirement, so the Department refused to hire her. Rawlinson
sued on behalf of herself and all similarly situated women under Title VII, alleging sex discrimination. While this suit was pending, the Alabama Board
of Corrections adopted a rule banning women from working in contact positions that require close physical proximity to inmates. Rawlinson amended
her complaint to challenge the new rule as well. The U.S. District Court for the Middle District of Alabama ruled in favor of Rawlinson (Oyez, n.d.).

How can a governmental business operate normally when it is in violation of the Constitution? Every action of government is constrained by
constitutional limitations. Normal operation of all government functions takes place within them. A prison system operating in obvious violation of the
Eighth Amendment is an exception that should be remedied as quickly as possible. In the meantime, the existence of such violations should not be
legitimatized by calling them normal. Nor should the Court accept them as justifying conduct that would otherwise violate a statute intended to remedy
age–old discrimination. Where is the evidence in the record to show that women guards would create any danger to security in Alabama prisons
significantly greater than that which already exists? The Court first sees women guards as a threat to security because there are few visible deterrents
to inmate assaults on women custodians. The rationale is a treacherous myth that women as guards will generate sexual assaults and it should not be
justifiable. Is the Court saying that women should be punished because their very presence might provoke sexual assaults? It is not fair for women to
pay the price in lost job opportunities for the

Persuasive Speech On Sex Discrimination
Discrimination has been around for centuries and even though there have been many improvements in the way society deals with discrimination, we
still have a very long way to go. Gay and lesbian youth are two to three times more likely to commit suicide than other youths and 30% of all
completed adolescence suicides are related to sexual identity. Parents, teachers, students – everyone needs to be more open about homosexuality and
there should also be an understanding that being gay or lesbian is perfectly fine – as long as their happy, you should be too.
Well, let's face it, no one is born homophobic. When straight men and women show public affection no one cares or stares. But when homosexuals
do, someone is sure to make a hostile comment. I admit it; everyone is prejudice in some way or another, yes. We all judge to a point, it's useless
to deny it. But, simple things such as two men or women holding hands or a brief hug can set some people off or "gross them out." Everyone has
seen a heterosexual couple holding hands, and most of the time we don't even notice it because it's such a common thing. Images of heterosexual
P.D.A. have been implanted into our minds since many of us were old enough to watch television. If we all agree that a minor display of affection
such as hand holding among a straight couple is perfectly acceptable to society, why shouldn't it be the same for same–sex couples? We all need to
show affection. It's our outward statement of love – a right most

Wal–Mart has maintained that they did not discriminate against Betty and the other women that filed claim against, but I believe that Wal–Mart knew
exactly what was going on and just chose to ignore Betty when she was making her complaints. They began to take her seriously when she filed the
suit. Some of the moral complaints the women were suing Wal–Mart for was for statistical disparities such female workers were less likely to be paid
the proper wages as the men; they were denied promotion in a timely fashion different to those of the men (Boatright, 2009, pg.199). There was a lot
of bias involved with all of this; it even has a hint of gender stereotyping. I believe the moral complaints were justified because Betty made complaints
to managers and higher up and because she did this they began to treat her differently and demoted her for not opening a cash register with a penny but
for talking. When it came to promotions opportunities they were not made known, and those that she wanted they kept telling her they were filled and
hired male counter parts that were not fit for the position. What made Wal–Mart managers determine what part of the store you worked was based on
your gender and that was wrong, not because they were women meant they could not do what was needed. The women by far were more experienced
than the men and the stayed longer on the job also. It was shown based on the records of the trial and brought

Essay about Sex Discrimination
Introduction
Discrimination involves action toward individuals on the basis of their group membership; Baron and Byrne (1994) defined discrimination as prejudice
in action. Discrimination can take a very overt form (e.g., refusal to hire women into certain jobs), but in many instances, gender discrimination
involves the degree to which the workplace is open to versus resistant to the participation of women. Although many discussions of gender
discrimination have focused on the ways managers and supervisors treat men and women, gender discrimination could involve managers, co–workers,
subordinates, clients, or customers. In general, gender discrimination include behaviours occurring in the workplace that limit the target person's ability

Additionally, some specific features of the workplace appear to contribute to prejudice and discrimination against both men and women.
This research will try to identify and assess gender issues and discrimination in the workplace by looking at various types of sex discrimination,
features of the workplace that contribute to gender discrimination, employers retaliation against workers who claim sex discrimination, and
conclusively, legal ways of proving sex discrimination and their remedies.
Types of Sex Discrimination
The Sex Discrimination Act 1975 (as amended) identifies three types of discrimination. These are: (1) direct discrimination; (2) indirect
discrimination; and (3) victimisation (Chandler et al., 2003). The 1975 Act, with certain exceptions, applies equally to men and women. It not only
forbids discrimination on grounds of sex or gender reassignment but discrimination also against married persons in the employment field. The 1975
Act is, of course, primarily directed towards the protection of women (SDA 1975, ss 1,2,3 & 4).
Features of the Workplace that Contribute to Gender Discrimination
Gender discrimination occurs in a number of settings. Men and women are perceived differently, are assigned different roles and are assumed to have
different characteristics in most settings, for example household chores like

Title IX People are constantly making mistakes and avoiding certain responsibilities. Mainly minor responsibilities can be avoided and unanswered, but
major ones need to be questioned and brought to attention in order for them to be dealt with. Sex discrimination is one of those mistakes that people are
constantly making. It isn't happening as much as it used to in the past, but it is still occurring in our education system, employment, housing, and even
in something as small as credit. There are large episodes in past time that we are able to track down and see examples of sex discrimination
towards females, especially in education. From as early as birth, women are being discriminated against just because they are supposedly inferior
to men. This was all put to a stop when Title IX was formed. Title IX's main objective is "to protect people from discrimination based on sex in
education programs or activities that receive Federal financial assistance. The motto that we follow is "No person in the United States shall, on the
basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity
receiving Federal financial assistance". Title IX was passed as a law by Richard Nixon in 1972, and was created within the Education Amendments by
Congress. It also consisted of two benefactors, Birch Bayh from the Senate, and Edith Green from the House

Sex Discrimination In Health And Social Care
What is sex discrimination?
Sex discrimination is when a person is treated less favourably than a person of the opposite sex would be treated in the same or similar circumstances.
For example, it would be 'direct sex discrimination' if male and female employees are doing exactly the same work, but male employees are being paid
more.
It is also sex discrimination when there is a rule or policy that is the same for everyone but has an unfair effect on people of a particular sex. This is
called 'indirect discrimination'.
For example, it may be indirect sex discrimination if a policy says that managers must work full–time, as this might disadvantage women because they
are more likely to work part–time because of caring responsibilities.

employees claimed that Wal–Mart was discriminating through the use of salary and promotion which in result was violating Title VII and the Civil
Rights Acts of 1964. Was this case too big for the Supreme Court to handle? In 2011, the Dukes v. Wal

Essay On Prejudice And Discrimination On Same Sex Marriage
Legal but still not acceptable: Prejudice and discrimination on same sex marriage.
Prejudice which means prejudgement where it displays attitude towards a social group (Hogg & Vaughan, 2011). This is a huge social issue within
society has faced as it leads to many consequences that can end in violence. Homosexuality is an example of sexual minors facing prejudice from other
social groups. There have been a number of prejudice and discrimination towards the gay community since the 1980's where sexual behaviour between
the same genders was not considered normal (Hogg & Vaughan, 2011). The influence of Christianity encouraged the prosecution of homosexuals which
become labelled as a mental illness and considered an act that should be punishable. However, through protesting and fight for equality and gay rights
gay marriage became legal in many parts of the world. Taking into consideration the legalisation of gay marriage, there is a continuation of
discrimination against the gay community.
Despite the legalisation of the gay marriage law being approved by the Supreme Court on June 26th. A gay couple is still facing discrimination after
being refused a marriage licence from a 49 year old US Christian county clerk. Her strong religious principles has provoked her from allowing a
homosexual couple to get married that she rather be in jail then approve of the marriage licence.

Despite Legislation for Equal Opportunities, sexism is still in evidence in the workplace.
Sexism is a particular concern for society when considering it's effect in the workplace. Sexism has always been a particular problem in the labour
market especially with the formation of capitalism. In the last half of the
20th century this has been especially highlighted due to the increase of woman entering the labour market. This aroused the need for a legislation for
equal opportunity for both sex's to be passed in 1975. It stated that discrimination of a persons sex whether male or female was unlawful in employment,
union membership, education, provision of goods, services, advertisements and pay.

These men / woman dominated areas are clearly seen, simply by looking in classrooms at secondary or university education. 91% of sociology classes
are female dominated and about 90% of computer science / physics, classes are male dominated (Pascall 1995: 4).
The Sex Discrimination Act is in power to help woman in a number of ways and lets them into previously closed doors. However due to the fact that
most legal institutions are male dominated it is not quite as clear cut as it may seem on the outside. The law is often interpreted restrictivly meaning a
woman may have to fight an unequal battle with her employer and even if they come out victorious little compensation is received and she may be
victimized at work in the aftermath.
A major need for the discrimination act is to try to help break down the presence of what is known as theglass ceiling'. This is where men get
promoted and go further up the managerial hierarchy while woman get to a certain position and can not climb any further. Although they can see the
men climbing further up the company they cannot break the glass ceiling themselves (Gregg 1991: 8).
A study called Indsco' in a large industrial conglomerate lead by Rosabeth

Title IX: Discrimination On The Basis Of Sex
Title IX was established in 1972 as a law that "prohibits discrimination on the basis of sex"(Title IX of the Education Amendments of 1972). It can
also be states as a law that, "requires gender equity for boys and girls in every educational program that receives federal funding"(History). The ten
specific areas of educational programs that the law covers are Access to Higher Education, Career Education, Education for Pregnant and Parenting
Students, Employment, Learning Environment, Math and Science, Sexual Harassment, Standardized Testing and Technology, and lastly Athletics. The
purpose of the law is to give equal opportunities to both males and females in each of these areas. However, the main focus of this law tends to be

Looking at the statistics from before Title IX to present day, this law has definitely instilled change. It has opened up a much broader range of
opportunities for women in sport that they may have never experienced without this law. These opportunities include more sports available in schools
for women to participate in, more scholarships for women to play in college, and more funding for women's teams in schools. In addition to this, a
woman's sports team cannot be cut or diminished in size because they are considered the underrepresented class. So, in these areas, Title IX has
been widely successful, however it still has a long way to go. Men still have the upper hand in athletics in that they have more opportunities, more
scholarships, and more budget dollars. This shows that Title IX has not fully reached its intended purpose and is still working to decrease
discrimination for women in sports. However, I believe that not all the factors are taken into account for this. There may be less opportunities for
women in sports because there is less interest by them to participate. The majority of women in a school may not even want to participate in a sport
and therefore are not being discriminated against in this area. On the other hand, however, it appears that Title IX has caused men to be discriminated
against. The law states that its purpose is to prohibit the discrimination on the basis of sex and enforce gender equity, but it has allowed men to be
discriminated against in that their sports, funding, and scholarships can be cut in order to accommodate the needs of women's athletics. Of course it
makes sense to do this because men are highly represented, especially compared to women, but that does not mean they should suffer losses because
of this. I am not saying I know of a better solution, but I

Sex, Religion, And Discrimination
1.Chapter Summary
Historically, there has been race, sex, religion, and many other sources of discrimination worldwide. America has come a long way in bringing justice
to those who have been discriminated, and to prevent it from happening by implementing relevant policies. However, it is apparent that traces of these
historical discriminations have followed us onto the new era of the 21st century.
In the past few months alone, there were a few laws executed to stop inequity allowing for:
Same sex marriage, and
Gay/lesbian service in the military (this law is still limited to open transgender citizens) (1).
Gender pay gap, is also another evidence of gender disparity. A full–time women employee earns 78 cents of every dollar a male earns, this ratio differs
from one state to another and it varies from 91cents in DC to 66 cents in Louisiana(2) shows the un–uniformity among the state laws. Many people hide
their gender identity in the workplace, to get recognized for their talents, because they are afraid that the gender bias may restrict their growth. In the
screenshot below from Equal Employment Opportunity data analysis, it is clear that the presence of women in the workforce globally is still 40%
less than men and the White race still has the majority of the jobs in the US (15).
In this chapter, you will learn about different types of discrimination in the work place and how to implement effective policies to eliminate such
situations.

Race, Sex, And Religious Discrimination
America is filled with thousands upon thousands of affirmative action groups all with their own specific motivation to make a difference. Although
laws have been put in place to end this, there are still many instances in which countless people are affected by modern day discrimination. Race, sex,
and religious discrimination are arguable the three most prevalent forms of these issues still ongoing today. My assigned roundtable's topic was on sex
discrimination specifically. We were asked to focus the recent hiring practices of the Hooters restaurant chain. What was unique to this case was that
men were the gender side claiming inequality in hiring practices. To accurately explain this issue we will look at the men's rights groups' claims, the
company's claims, and women's rights group's claims. I will look at my position I was assigned, the women's law coalition, and draw conclusions when
assessing their positions in regard to the Bona fide occupational qualifications.
In 1964 the civil rights act was passed that changed America. Title VII of the Civil Rights Act of 1964 provides strong protections against sex
discrimination in employment. Specifically, Title VII makes it illegal for an employer:

Sex Discrimination in the American Workplace Still Stands
Charles Darwin, a famous English naturalist and geologist, is responsible for a well–known theory as "survival of the fittest." This simply means that
the continuing existence of organisms that are "best adapted" to their environment, with the extinction of others, are the ones who ultimately survive.
One can apply almost the same kind of concept to the American work place: a place where both men and women can gain the same education and
work the same job, yet somehow the men always seem to prevail, leaving the women lagging behind. As Americans, we should all be very aware of
the fact that women were not always considered to be "equal" with men. For countless decades, they were regarded as "less capable" and less
significant in our society, and although there has been dramatic increase of gender equality since the Suffrage Movement back in the late 1800's and
early 1900's, there still seems to be a sense of discrimination against women when it comes to the corporate world. Although women's overall
presence in the work force has seen a boost in numbers in America, men today still get paid more than their female counterparts. To begin with,
differences in the pay of workers between both genders seems to be an ongoing issue ever since the time women joined men in the work place. For
that reason, "America made a commitment to equal pay for equal work regardless of the worker's sex" when they passed the Equal Pay Act in 1963
(Remus & Kelley 149). Despite the fact this act

Same Sex Discrimination In America
Discrimination is the practice of unfairly treating a person or group of people differently from other people or groups of people. This idea is old as
mankind itself. Since the beginning of time, people of a certain group have discriminated against people of the other races, beliefs, sexual preferences,
etc. Some examples of equal rights movements which have occurred in America include the women's suffrage movement, the abolishment of slavery as
well as all African American civil rights movements, and most recently, the same sex marriage movement.
The discrimination behind same sex relationships has been around for thousands of years. In America, the issue of equal rights for LGBTQ

from this is a "mortal sin". (Pickett). The first formal law against homosexuality was an imperial decree in 390 AD and was posted in the Hall of
Minerva; a gathering place for actors and writers. (Pickett). The punishment for such acts was death by burning. This was believed to be passed
because the homosexual men of the imperial court were the most defiant of the Catholic doctrine. The idea was that a man who lacked any interest in
procreating wasn't actually a man but instead something of lesser importance. The Catholic Church would continue to use this heresy as means to
control.

The Effects Of Sex Discrimination On The Workforce Essay
Title: Sex Discrimination in the workforce
Research Topic
Sex discrimination is defined when a person is treated unfairly or with less favourable attitude/ characteristics than a person of the opposite sex. The
factors that has influenced me to select this specific topic is due to the actuality that sex discrimination against women in the workforce is never taken
into consideration by the community. Women in Australia have been fighting for the right to equal pay since the early century. Australia as a
community has contributed to the factors of unequal pay between men and women.
Research Question
Initially, my research paper outlines the effect of sex discrimination and what can be done to prevention this issue? Due to the outcome of this
research question, the question was too broad, as it does not specifically identify my topic. I have constructed a new research question stating "Why
does females get discriminated more than men's and how are we able to prevent the equal pay between males and females." Potential consequences
are the decreases numbers of employees in the workforce due to the society's aspect for particular job and suitability. This causes victims suffering sex
discrimination to feel a strong resentment and loss of self worth, as the society does not support them. The outcome of having a barrier between
genders causes conflicts such as violence leading to depression and anxiety. Various ways to prevent this issue is by raising the community's awareness

Sex, Racism, And Discrimination In Advertising
The industry of advertising was intended to be a means of having a product reach its targeted audience. It is supposed to entice consumers into buying
a product. Advertising has become a hugely productive force. The advertising industry brings in revenue of $250 billion dollars per year in the United
States alone. Advertising is unavoidable and consuming. The average American women, man, or child is exposed to over 3,000 ads a day and will
spend about two years of his or her life watching television commercials. The ads are featured at bus stops, school vending machines, and even on
food items. People tend to feel that they are unaffected by advertising and are simply able to "tune them out." People are unable to avoid
advertising's influence because even if one does their best to ignore advertising, it is impossible. Advertising's impact is quick and subconscious.
We are affected every day and in every aspect of our lives by the power of advertising and remain completely unaware (Killing Us Softy 4). Over the
last century there has been a shift in what the purpose of advertising is and what is doing to its viewers. While advertising still sells a product to a
particular group of people, more and more the way advertising agencies go about this has lead to sexism, racism, and discrimination. What is
discrimination? The Merriam–Webster Dictionary ... Show more content on Helpwriting.net ...

Effects Of Sex Discrimination In Fairy Tales
Subtle sex discrimination, which is one of the forms of sex discrimination, is hidden and not easy to noticed in our daily life since most people have
internalized it as natural and as something matters little. (Benokraitis, 1997) Startlingly, it is found that subtle sex discrimination appears in fairy tale
either. The story of prince and princess deliver the hidden message of subtle sex discrimination unintentionally. It is worth writing because the fairy
tales could bring huge impacts on girls' growth stage and children may internalize the subtle sexist behaviour as "normal" or acceptable. I have
divided my essay into three parts. First, I would like to summarize the sociology reading written by Benokraitis, "How subtle sex discrimination
work". Second, I will take "Snow White" as ... Show more content on Helpwriting.net ...
Fairy tales play a significant role in shaping children's self–image. Girls will dream of becoming a princess after reading fairy tales. All the images of
princess are congruent with male's aesthetic standard. The princess in fairy tale is beautiful, slim, and innocent with gorgeous dress and high–heels. You
will never see a girl wearing jeans and sports shoes could be recognized as a "Princess". It reflects one of the subtle sex discrimination: subjective
objectification, which is a form of subtle sex discrimination that treats women as an object from the perspective of men. (Benokraitis, 1997) "As
culture has granted men the right and privilege of looking at women, women have been expected to accept the role of stimulators of men's visual
interest, with their bodies' becoming objects that can be lined up, compared and rated." (Benokraitis, 1997) The Snow White delivers the message
that girls should wear dress and have good appearance so that you will be jealous by others, like Snow White is jealous by the wicked queen.
Nonetheless, why princess should wear dress and high–heels? Why slim is the synonym of

Sexism, Prejudice, And Discrimination On The Basis Of Sex
Sexism is the prejudice, stereotyping, or discrimination on the basis of sex. Sexism is regarded mostly towards women. Sexism affects everyone but
not effecting everyone evenly. For women, they suffer from sexism socially, educational, political, religious, social, etc. The idea of sexism is that the
men have more power than the women. Women get judged differently than men do. Women get judged in the workplace which limits them to certain
jobs. The stereotypes that women are under are unbelievable. Some stereotypes like women are bad drivers, women are bad at leadership, and that all
women are good at cooking. I believe that sexism causes a break in our society that divides the two sexes apart from each other. Throughout St. John's
Prep, sexism is present with the female teachers. The workplace for women differs greatly from men. The Catholic Social teaching theme of community
stands out most dominantly in the topic of sexism. Sexism effects women everyday in their life. They encounter obstacles that men don't ever have to
worry about. Throughout the idea of sexism, one must remember that the Catholic Social theme of community goes a long way in understanding that
we are all equal in one body. Within all the media, magazines, movies, music, and television, I have noticed that there is a huge difference betweenmale
and females. Males appear to be much smarter with more educational background while the females are viewed to be unintelligent. The men seem to be

Sex Discrimination In Health And Social Care
Sex discrimination is relatively self–explanatory, in that it refers to discrimination that is based on the fact that an individual is either a male or
female. For example, Cathy work in the social service department which is mainly female and she discovered that she receive half the pay of
employees who work in the planning department which is mainly male, even though both employees work for the same length of time. Sex
discrimination is the most highly developed aspect of the EU social policy and has long been considered a core right (Steiner, J. Woods, L 2012).

Poland has also restricted the sale of Gioco computer games arguing that they encourage bad behavior which can be bad for the user's health. In
considering this, public health is an obvious ground. However, there must be evidence of a real risk and measure must be proportionate to that
risk. The ECJ repeatedly held that the health and life of humans rank among the asset and interest protected by Article 36 TFEU (Steiner, J.

What Is Direct Sex-Based Discrimination?
According to the US Equal Employment Opportunity Commission, sex based discrimination may be (direct) straightforward or (indirect) passive.
Direct sex based discrimination requires treating someone, a candidate or employee, adversely because of that individual's sex. Indirect sex

Racism, Discrimination, And Sex Education Essay
Educate Your Children about Homosexuality Growing up in middle school and high school there is education on racism, discrimination, and sex
education. Truth is homosexuality is one of the issues that lack education with children. Usually when teenagers become high school students, they
see it and are already aware because there are same sex couples in high school. Seven years ago in high school, a couple kept a secret about their
relationship because they did not know how others would react, and they still wanted respect by their fellow classmates. It is a lot different now. More
teenagers are comfortable with their sexuality in high school because it is reality. People are more comfortable expressing themselves and letting
everyone see that this what they are into. What happens when the younger generation lacks knowledge about homosexuality and then exposed to it?
How would they react in public? Kids not knowing any better can say some rude things. There should be education on homosexuality just as much
for racism and discrimination, so kids can learn to respect those who prefer to be homosexual. At work, there is a woman named Izz, who is married
to another woman and are in a very happy relationship. They have five kids total from previous relationships and they age from seven to fifth teen.
Their kids are well aware of what homosexuality is because they grew up around it. That has not changed their perspective on who they want to date.

A moment appearance happens when a man is oppressed on the same event however in two diverse ways. (4)For instance, a gay lady may

Lopez (1995) handled the issue of carrying a gun in a school zone and whether Congress had the ability to regulate that. The court, in a 5–4 decision,
said no, that the act of carrying a gun does not substantially effect commerce. Congress overstepped its bounds. Justice Breyer dissented claiming a
three prong approach of which the court should consider "significant effect", the act as a whole, and whether Congress had a "rational basis." Morrison

WAL–MART SEX DISCRIMINATION LAWSUIT Largest Case in US History Revives a Longstanding Debate

Abstract
The sex discrimination case against Wal–Mart, in which the U.S. Supreme Court handed an important victory to the retail chain on June 20, 2011,
revives a longstanding debate: are disparities in the workplace due primarily to gender bias or to deep–rooted gender differences? The answer is
anything but simple. Women make up nearly two–thirds of hourly workers at Wal–Mart but only one–third of management. The complaint argued that
such disparities can be explained ... Show more content on Helpwriting.net ...
A majority of the research in this area has focused on dissimilarity in terms of gender, race, and age, and the results in this area have been inconsistent.
(Joshi, 2011). These findings tend to discount any attempts by Wal–mart to conclude there were other factors at play in the overall statistics involved in
the lawsuit.
Wal–mart Management Practices Left–wing journalist Liza Featherstone, whose 2004 book about the case, "Selling Women Short: The Landmark
Battle for Women's Rights at Wal
–Mart," is strongly sympathetic to the plaintiffs. In an interview, Featherstone was asked about other suits against
Wal–Mart, including one by the widow of a male manager who had died of a heart attack. Featherstone explained, "Her husband was incredibly
overworked, as many Wal–Mart managers are ... assistant mangers are forced to work 70–80 hours a week. In some sense, they are more exploited
than hourly workers, because they are salaried, so they don't get overtime." (Ibarra, 1993). In another interview, Featherstone noted that Wal–Mart
expects managers to be available to work at any time and that the chief plaintiff in the women's case, Betty Dukes, felt her career had suffered because
she refused to work Sundays. All this lends credibility to Wal–Mart's assertion that far fewer women than men have been interested in management
jobs. Does this mean that the

Employment Discrimination Against Individuals Based On...
Introduction This new generation brings new challenges that in the past were taboo. In the sixties and seventies, a hippie was widely accepted, but
now being transgender is not favorable. The hiring process has many different attributes that employers have to deal with. Some aspects include
physical appearance, lifestyle, and language. For several decades, the law has forbidden discrimination against individuals based on age, race, national
origin, or sex, and these factors should not be in job specifications or recruitment advertisements (Shaw, 2014, 284). Employment discrimination against
physical appearance, lifestyle, and language is not only wrong but also unethical.
I.Physical Appearance Psychologists have long known that people form impressions of others purely based on their appearance (Duarte, Siegel, &
Young, 2012, p.2455). Today's society puts great importance on people's physical appearance (Yang, & Stoeber, 2012, p.69). Not everyone can be
have a size 2 Victoria Secret model body or look like Duane Johnson (The Rock). Veterans have a harder time getting jobs now because of their
physical characteristics after the Iraqi war. Perfect looks are highly valued because they symbolize success, happiness, and being loved and admired
by others; consequently, many people strive to look perfect, and many others are concerned about their physical appearance worrying that they may not
look perfect (Yang, & Stoeber, 2012, p.69). The Civil Rights

Victimising someone as they have made or intend to make a complaint or allegation in relation to a complaint of discrimination with regards to sexual

Sex Discrimination In College Sports

  • 1. Sex Discrimination In College Sports Foundation Over the past few years, intercollegiate athletic programs have grown at a rate that has raised concerns in many higher education institutions. One of the concerns is funding equity for male and female athletic programs. Since its establishment in 1972, Title IX has prohibited sex discrimination in educational programs that receive federal funds (Carpenter, 2000). In this paper, I analyze the establishment of Title IX and how it has impacted intercollegiate athletics. With the establishment of Title IX, higher education and athletic programs have provided anti–discrimination based on sex. The law states, "no person in the United States shall, on the basis of sex, be excluded form participation in, be denied the benefits of, or be ... Show more content on Helpwriting.net ... The outcome help establish the need for institutions to provide equitable opportunity for both sexes in college athletics. Current research on Title IX has demonstrated positive and negative implications with the policy. First, we will look at the positive impact. The positive effects of Title IX have seen a higher number representation of women athletes in higher education. Currently, women make up 57% of the college student population, and 43% of females are now playing intercollegiate sports (US News, 2012). With the increase of female students, Title IX has provided access to females in higher education and intercollegiate athletics. While female student participation in college athletics is increasing, it does not come close to men's participation or finances. Female participation has increased by 3,550 while men's participation increased by 6,431 almost double of their female counterparts (American Association of University Women, 2013). In addition, the NCAAGender Equity Report shows that in the 2009–2010 school year, the total revenue for men was $5,519,600, while women's was significantly lower at $2,622,900 (NCAA, 2010). Although Title IX has provided opportunity for both sexes in college athletics, male participation is still dominating. However, recent trends are indicating that athletic programs have taken action to promote female ... Get more on HelpWriting.net ...
  • 2. Title IX And Sex Discrimination Title IX was first introduced in Congress by its head author and sponsor, Senator Birch Bayh. On June 23, 1972, President Richard Nixon signed into law Title IX of the Education Amendment of 1972 in response to the 1964 Civil Rights Act, requiring equal opportunity for males and females in educational programs – including athletic programs. According to the United States Justice Department, Title IX is a comprehensive federal law which prohibits discrimination on the basis of sex in any type of federally funded education program or activity. The main purpose of Title IX is to avoid using federal money to support sex discrimination within education programs and to provide United States citizens with effective protection. • 3. Dianne Rawlinson And Sex Discrimination Dianne Rawlinson applied to be a prison guard with the Alabama Department of Corrections. The Department had a minimum height and weight requirement of 120 pounds and 5 feet 2 inches. She did not meet the minimum weight requirement, so the Department refused to hire her. Rawlinson sued on behalf of herself and all similarly situated women under Title VII, alleging sex discrimination. While this suit was pending, the Alabama Board of Corrections adopted a rule banning women from working in contact positions that require close physical proximity to inmates. Rawlinson amended her complaint to challenge the new rule as well. The U.S. District Court for the Middle District of Alabama ruled in favor of Rawlinson (Oyez, n.d.). The district court found ... Show more content on Helpwriting.net ... How can a governmental business operate normally when it is in violation of the Constitution? Every action of government is constrained by constitutional limitations. Normal operation of all government functions takes place within them. A prison system operating in obvious violation of the Eighth Amendment is an exception that should be remedied as quickly as possible. In the meantime, the existence of such violations should not be legitimatized by calling them normal. Nor should the Court accept them as justifying conduct that would otherwise violate a statute intended to remedy age–old discrimination. Where is the evidence in the record to show that women guards would create any danger to security in Alabama prisons significantly greater than that which already exists? The Court first sees women guards as a threat to security because there are few visible deterrents to inmate assaults on women custodians. The rationale is a treacherous myth that women as guards will generate sexual assaults and it should not be justifiable. Is the Court saying that women should be punished because their very presence might provoke sexual assaults? It is not fair for women to pay the price in lost job opportunities for the ... • 4. Persuasive Speech On Sex Discrimination Discrimination has been around for centuries and even though there have been many improvements in the way society deals with discrimination, we still have a very long way to go. Gay and lesbian youth are two to three times more likely to commit suicide than other youths and 30% of all completed adolescence suicides are related to sexual identity. Parents, teachers, students – everyone needs to be more open about homosexuality and there should also be an understanding that being gay or lesbian is perfectly fine – as long as their happy, you should be too. Well, let's face it, no one is born homophobic. When straight men and women show public affection no one cares or stares. But when homosexuals do, someone is sure to make a hostile comment. I admit it; everyone is prejudice in some way or another, yes. We all judge to a point, it's useless to deny it. But, simple things such as two men or women holding hands or a brief hug can set some people off or "gross them out." Everyone has seen a heterosexual couple holding hands, and most of the time we don't even notice it because it's such a common thing. Images of heterosexual P.D.A. have been implanted into our minds since many of us were old enough to watch television. If we all agree that a minor display of affection such as hand holding among a straight couple is perfectly acceptable to society, why shouldn't it be the same for same–sex couples? We all need to show affection. It's our outward statement of love – a right most ... Get more on HelpWriting.net ...

Sex Discrimination at Walmart Essay Sex Discrimination at Wal–Mart OMM640 Business Ethics and Social Responsibility Dr.: David Britton May 14, 2012 Betty Dukes along with five other women filled a law suit against Wal–Mart Inc. in 2001 for discrimination against women, denying them their raises and also their promotions. Betty Dukes and the other women hope that they can stand for hundreds of thousands of other women who might have been similarly affected by this type of behavior when they were there also. Years later the ladies got the go ahead to represent 1.6 other women in the case seeking back wages and maybe even punitive damages from Wal–Mart. Wal–Mart has maintained that they did not discriminate against Betty and the other women that filed claim against, but I believe that Wal–Mart knew exactly what was going on and just chose to ignore Betty when she was making her complaints. They began to take her seriously when she filed the suit. Some of the moral complaints the women were suing Wal–Mart for was for statistical disparities such female workers were less likely to be paid the proper wages as the men; they were denied promotion in a timely fashion different to those of the men (Boatright, 2009, pg.199). There was a lot of bias involved with all of this; it even has a hint of gender stereotyping. I believe the moral complaints were justified because Betty made complaints to managers and higher up and because she did this they began to treat her differently and demoted her for not opening a cash register with a penny but for talking. When it came to promotions opportunities they were not made known, and those that she wanted they kept telling her they were filled and hired male counter parts that were not fit for the position. What made Wal–Mart managers determine what part of the store you worked was based on your gender and that was wrong, not because they were women meant they could not do what was needed. The women by far were more experienced than the men and the stayed longer on the job also. It was shown based on the records of the trial and brought ... Get more on HelpWriting.net ...
  • 6. Essay about Sex Discrimination Introduction Discrimination involves action toward individuals on the basis of their group membership; Baron and Byrne (1994) defined discrimination as prejudice in action. Discrimination can take a very overt form (e.g., refusal to hire women into certain jobs), but in many instances, gender discrimination involves the degree to which the workplace is open to versus resistant to the participation of women. Although many discussions of gender discrimination have focused on the ways managers and supervisors treat men and women, gender discrimination could involve managers, co–workers, subordinates, clients, or customers. Additionally, some specific features of the workplace appear to contribute to prejudice and discrimination against both men and women. This research will try to identify and assess gender issues and discrimination in the workplace by looking at various types of sex discrimination, features of the workplace that contribute to gender discrimination, employers retaliation against workers who claim sex discrimination, and conclusively, legal ways of proving sex discrimination and their remedies. Types of Sex Discrimination The Sex Discrimination Act 1975 (as amended) identifies three types of discrimination. These are: (1) direct discrimination; (2) indirect discrimination; and (3) victimisation (Chandler et al., 2003). The 1975 Act, with certain exceptions, applies equally to men and women. It not only forbids discrimination on grounds of sex or gender reassignment but discrimination also against married persons in the employment field. The 1975 Act is, of course, primarily directed towards the protection of women (SDA 1975, ss 1,2,3 & 4). Features of the Workplace that Contribute to Gender Discrimination Gender discrimination occurs in a number of settings. Men and women are perceived differently, are assigned different roles and are assumed to have different characteristics in most settings, for example household chores like ... • 7. Sex Discrimination And Discrimination Kyle Eagleston Professor Brogan PE–100 12/10/2017 Title IX People are constantly making mistakes and avoiding certain responsibilities. Mainly minor responsibilities can be avoided and unanswered, but major ones need to be questioned and brought to attention in order for them to be dealt with. Sex discrimination is one of those mistakes that people are constantly making. It isn't happening as much as it used to in the past, but it is still occurring in our education system, employment, housing, and even in something as small as credit. There are large episodes in past time that we are able to track down and see examples of sex discrimination towards females, especially in education. From as early as birth, women are being discriminated against just because they are supposedly inferior to men. This was all put to a stop when Title IX was formed. Title IX's main objective is "to protect people from discrimination based on sex in education programs or activities that receive Federal financial assistance. The motto that we follow is "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance". • 8. Sex Discrimination In Health And Social Care What is sex discrimination? Sex discrimination is when a person is treated less favourably than a person of the opposite sex would be treated in the same or similar circumstances. For example, it would be 'direct sex discrimination' if male and female employees are doing exactly the same work, but male employees are being paid more. It is also sex discrimination when there is a rule or policy that is the same for everyone but has an unfair effect on people of a particular sex. This is called 'indirect discrimination'. For example, it may be indirect sex discrimination if a policy says that managers must work full–time, as this might disadvantage women because they are more likely to work part–time because of caring responsibilities. I agree that transgender employee should be considered by the courts to be a protected class under Title VII's prohibition of sex discrimination in the workplace. Title VII of the Civil Rights Act of 1964 makes it illegal to discriminate against someone on the basis of race, color, religion, national origin, or sex. All of these employees claimed that Wal–Mart was discriminating through the use of salary and promotion which in result was violating Title VII and the Civil Rights Acts of 1964. • 12. Essay On Prejudice And Discrimination On Same Sex Marriage Legal but still not acceptable: Prejudice and discrimination on same sex marriage. Prejudice which means prejudgement where it displays attitude towards a social group (Hogg & Vaughan, 2011). This is a huge social issue within society has faced as it leads to many consequences that can end in violence. Homosexuality is an example of sexual minors facing prejudice from other social groups. There have been a number of prejudice and discrimination towards the gay community since the 1980's where sexual behaviour between the same genders was not considered normal (Hogg & Vaughan, 2011). The influence of Christianity encouraged the prosecution of homosexuals which become labelled as a mental illness and considered an act that should be punishable. However, through protesting and fight for equality and gay rights gay marriage became legal in many parts of the world. Taking into consideration the legalisation of gay marriage, there is a continuation of discrimination against the gay community. Despite the legalisation of the gay marriage law being approved by the Supreme Court on June 26th. A gay couple is still facing discrimination after being refused a marriage licence from a 49 year old US Christian county clerk. Sexism is a particular concern for society when considering it's effect in the workplace. Sexism has always been a particular problem in the labour market especially with the formation of capitalism. In the last half of the 20th century this has been especially highlighted due to the increase of woman entering the labour market. This aroused the need for a legislation for equal opportunity for both sex's to be passed in 1975. It stated that discrimination of a persons sex whether male or female was unlawful in employment, union membership, education, provision of goods, services, advertisements and pay. In this essay the ... Show more content on Helpwriting.net ... These men / woman dominated areas are clearly seen, simply by looking in classrooms at secondary or university education. 91% of sociology classes are female dominated and about 90% of computer science / physics, classes are male dominated (Pascall 1995: 4). The Sex Discrimination Act is in power to help woman in a number of ways and lets them into previously closed doors. However due to the fact that most legal institutions are male dominated it is not quite as clear cut as it may seem on the outside. The law is often interpreted restrictivly meaning a woman may have to fight an unequal battle with her employer and even if they come out victorious little compensation is received and she may be victimized at work in the aftermath. A major need for the discrimination act is to try to help break down the presence of what is known as theglass ceiling'. This is where men get promoted and go further up the managerial hierarchy while woman get to a certain position and can not climb any further. Although they can see the men climbing further up the company they cannot break the glass ceiling themselves (Gregg 1991: 8). A study called Indsco' in a large industrial conglomerate lead by Rosabeth Moss Kanter (A management professor at Harvard) in 1977, recognized that people who work in large organizations have a tendency to hire and promote those who resemble themselves (Mildrew 1992: 17).

It can also be states as a law that, "requires gender equity for boys and girls in every educational program that receives federal funding"(History). The ten specific areas of educational programs that the law covers are Access to Higher Education, Career Education, Education for Pregnant and Parenting Students, Employment, Learning Environment, Math and Science, Sexual Harassment, Standardized Testing and Technology, and lastly Athletics. Show more content on Helpwriting.net ... Looking at the statistics from before Title IX to present day, this law has definitely instilled change. It has opened up a much broader range of opportunities for women in sport that they may have never experienced without this law. These opportunities include more sports available in schools for women to participate in, more scholarships for women to play in college, and more funding for women's teams in schools. In addition to this, a woman's sports team cannot be cut or diminished in size because they are considered the underrepresented class. So, in these areas, Title IX has been widely successful, however it still has a long way to go. Men still have the upper hand in athletics in that they have more opportunities, more scholarships, and more budget dollars. This shows that Title IX has not fully reached its intended purpose and is still working to decrease discrimination for women in sports. However, I believe that not all the factors are taken into account for this. There may be less opportunities for women in sports because there is less interest by them to participate. The majority of women in a school may not even want to participate in a sport and therefore are not being discriminated against in this area. On the other hand, however, it appears that Title IX has caused men to be discriminated against. The law states that its purpose is to prohibit the discrimination on the basis of sex and enforce gender equity, but it has allowed men to be discriminated against in that their sports, funding, and scholarships can be cut in order to accommodate the needs of women's athletics. Of course it makes sense to do this because men are highly represented, especially compared to women, but that does not mean they should suffer losses because of this. • 17. Sex, Religion, And Discrimination 1.Chapter Summary Historically, there has been race, sex, religion, and many other sources of discrimination worldwide. America has come a long way in bringing justice to those who have been discriminated, and to prevent it from happening by implementing relevant policies. However, it is apparent that traces of these historical discriminations have followed us onto the new era of the 21st century. In the past few months alone, there were a few laws executed to stop inequity allowing for: Same sex marriage, and Gay/lesbian service in the military (this law is still limited to open transgender citizens) (1). Gender pay gap, is also another evidence of gender disparity. A full–time women employee earns 78 cents of every dollar a male earns, this ratio differs from one state to another and it varies from 91cents in DC to 66 cents in Louisiana(2) shows the un–uniformity among the state laws. Many people hide their gender identity in the workplace, to get recognized for their talents, because they are afraid that the gender bias may restrict their growth. In the screenshot below from Equal Employment Opportunity data analysis, it is clear that the presence of women in the workforce globally is still 40% less than men and the White race still has the majority of the jobs in the US (15). • 19. Race, Sex, And Religious Discrimination America is filled with thousands upon thousands of affirmative action groups all with their own specific motivation to make a difference. Although laws have been put in place to end this, there are still many instances in which countless people are affected by modern day discrimination. Race, sex, and religious discrimination are arguable the three most prevalent forms of these issues still ongoing today. My assigned roundtable's topic was on sex discrimination specifically. We were asked to focus the recent hiring practices of the Hooters restaurant chain. What was unique to this case was that men were the gender side claiming inequality in hiring practices. To accurately explain this issue we will look at the men's rights groups' claims, the company's claims, and women's rights group's claims. I will look at my position I was assigned, the women's law coalition, and draw conclusions when assessing their positions in regard to the Bona fide occupational qualifications. In 1964 the civil rights act was passed that changed America. Title VII of the Civil Rights Act of 1964 provides strong protections against sex discrimination in employment. • 20. Sex Discrimination in the American Workplace Still Stands Charles Darwin, a famous English naturalist and geologist, is responsible for a well–known theory as "survival of the fittest." This simply means that the continuing existence of organisms that are "best adapted" to their environment, with the extinction of others, are the ones who ultimately survive. One can apply almost the same kind of concept to the American work place: a place where both men and women can gain the same education and work the same job, yet somehow the men always seem to prevail, leaving the women lagging behind. As Americans, we should all be very aware of the fact that women were not always considered to be "equal" with men. For countless decades, they were regarded as "less capable" and less significant in our society, and although there has been dramatic increase of gender equality since the Suffrage Movement back in the late 1800's and early 1900's, there still seems to be a sense of discrimination against women when it comes to the corporate world. Although women's overall presence in the work force has seen a boost in numbers in America, men today still get paid more than their female counterparts. To begin with, differences in the pay of workers between both genders seems to be an ongoing issue ever since the time women joined men in the work place. For that reason, "America made a commitment to equal pay for equal work regardless of the worker's sex" when they passed the Equal Pay Act in 1963 (Remus & Kelley 149). Despite the fact this act ... • 23. The Effects Of Sex Discrimination On The Workforce Essay Title: Sex Discrimination in the workforce Research Topic Sex discrimination is defined when a person is treated unfairly or with less favourable attitude/ characteristics than a person of the opposite sex. The factors that has influenced me to select this specific topic is due to the actuality that sex discrimination against women in the workforce is never taken into consideration by the community. Women in Australia have been fighting for the right to equal pay since the early century. Australia as a community has contributed to the factors of unequal pay between men and women. Research Question Initially, my research paper outlines the effect of sex discrimination and what can be done to prevention this issue? Due to the outcome of this research question, the question was too broad, as it does not specifically identify my topic. I have constructed a new research question stating "Why does females get discriminated more than men's and how are we able to prevent the equal pay between males and females." Potential consequences are the decreases numbers of employees in the workforce due to the society's aspect for particular job and suitability. This causes victims suffering sex discrimination to feel a strong resentment and loss of self worth, as the society does not support them. The outcome of having a barrier between genders causes conflicts such as violence leading to depression and anxiety. Various ways to prevent this issue is by raising the community's awareness but ... It is supposed to entice consumers into buying a product. Advertising has become a hugely productive force. The advertising industry brings in revenue of $250 billion dollars per year in the United States alone. Advertising is unavoidable and consuming. The average American women, man, or child is exposed to over 3,000 ads a day and will spend about two years of his or her life watching television commercials. The ads are featured at bus stops, school vending machines, and even on food items. People tend to feel that they are unaffected by advertising and are simply able to "tune them out." People are unable to avoid advertising's influence because even if one does their best to ignore advertising, it is impossible. Advertising's impact is quick and subconscious. We are affected every day and in every aspect of our lives by the power of advertising and remain completely unaware (Killing Us Softy 4). Over the last century there has been a shift in what the purpose of advertising is and what is doing to its viewers. Sexism affects everyone but not effecting everyone evenly. For women, they suffer from sexism socially, educational, political, religious, social, etc. The idea of sexism is that the men have more power than the women. Women get judged differently than men do. Women get judged in the workplace which limits them to certain jobs. The stereotypes that women are under are unbelievable. Some stereotypes like women are bad drivers, women are bad at leadership, and that all women are good at cooking. I believe that sexism causes a break in our society that divides the two sexes apart from each other. Throughout St. John's Prep, sexism is present with the female teachers. The workplace for women differs greatly from men. The Catholic Social teaching theme of community stands out most dominantly in the topic of sexism. Sexism effects women everyday in their life. They encounter obstacles that men don't ever have to worry about. Throughout the idea of sexism, one must remember that the Catholic Social theme of community goes a long way in understanding that we are all equal in one body. In the sixties and seventies, a hippie was widely accepted, but now being transgender is not favorable. The hiring process has many different attributes that employers have to deal with. Some aspects include physical appearance, lifestyle, and language. For several decades, the law has forbidden discrimination against individuals based on age, race, national origin, or sex, and these factors should not be in job specifications or recruitment advertisements (Shaw, 2014, 284). Employment discrimination against physical appearance, lifestyle, and language is not only wrong but also unethical.
