Occupational Safety And Health Act
The Occupational Safety and Health Act passed in 1970. This act signals an important moment in
occupational safety and health. Prior to 1970, the occupational safety and health were unsatisfactory.
In fact, many accidents occurred in the workplace because of chemicals, dusts, and dangerous
machines. There were many hazards in the workplace that contributed to terrible injuries and
fatalities. Furthermore, in 1970 an estimated 14,000 workers were killed on the job. After the
Occupational Safety and Health Act passed, the number of injuries have declined. Previously,
businesses were not concerned about hazards in the workplace The Occupational Safety and Health
Act is an important topic to address because it led the way for occupational safety and health. I
choose to research this law in a greater depth because I found it interesting how this law changed
how businesses prepare to prevent occupational health and safety hazards. There were minimal
efforts to ensure workplace health and safety. When people were injured or died, they were easily
replaced. In fact, it was cheaper to replace a worker than to actual implement safety measures.
Furthermore, the tort law did not help the survivors of dead workers or injured employees. Over the
years, there were minimal improvements. Eventually labor unions formed and public anger about
poor workplace safety grew which led to a reduction in employee worker accidents for some time.
After World War II, people were concerned about winning

THE OCCUPATIONAL SAFETY AND HEALTH ACT: INSPECTIONS AND VIOLATIONS
INTRODUCTION:
The Occupational Safety and Health Act is introduced in 1970, it is also known as OSH Act, it is
administered by the Occupational Safety and Health Administration (OSHA).The OSH Act covers
all employers and their employees in the 50 states, the District of Columbia, Puerto Rico, and other
U.S. territories. Coverage is provided either directly by the central Occupational Safety and Health
Administration or by an OSHA–approved state job safety and health plan. The Act grants employees
several important rights, including the right to file a complaint with OSHA about safety and health
conditions in their workplaces and, to the scope permitted by law, have their ... Show more content

authorizes OSHA to treat certain violations, which have no direct or direct relationship to safety and
health, requiring no penalty or abatement. OSHA does not issue certification for violations. Other

Task 1: OHS Laws and Institutional Frameworks The Occupational Health and Safety (OHS) Act
sets out the laws about health and safety requirements affecting workplaces, work activities and the
use of plant and substances. Besides that, the OHS Act is an essential framework in the workplace to
cultivate good safety habits in all individuals so as to stimulate a strong safety culture in the
workplace. The Act establishes a framework for people by preventing or minimising their exposure
to risk. One of the key features of the OHS Act is that it establishes a workplace health and safety
board that encourages industry participation and cooperation. Another feature is that the OHS Act
imposes workplace health and safety obligations on people who ... Show more content on

Health hazards can de further classified into chemical, physical and ergonomic hazards. Chemical
hazards in the construction may develop from dust, fumes, fibers and liquids. They can be emitted
by welding, spraying paint and using solvents. There also are hazards found in materials such as
asbestos, lead, silica, cadmium and carbon monoxide. At the construction site, workers might be
exposed to chemicals by breathing them in, ingestion and absorption through the eyes or skin.
Chemicals at the construction work sites can cause headaches, eye irritation, dizziness, faintness,
sleepiness and thus affect judgment and coordination. Physical hazards in a construction zone
include noise, vibration, extreme temperatures and radiation. Extended noise levels above 85
decibels can cause future hearing loss. Vibration harm typically occurs when workers use hand tools
for extended periods. To prevent this, workers should take breaks and use earplugs to protect the
body and ears from vibration and noise. In the site, extreme temperature changes can cause heat
rash, fainting, heat cramps, heat exhaustion, heat stroke, frost nip, immersion injury, frostbite and
hypothermia.. Ergonomic hazards cause disabling injuries to the joints and muscles. Ergonomic
hazards occur most frequently in construction and contribute to the most injuries on job sites. These
hazards occur because of heavy, frequent and awkward lifting or grips.

Case Study: Federal Occupational Safety And Health...
Under the Presidency of Richard Nixon, the Federal Occupational Safety and Health Act of 1970
(OSH Act) was approved to avoid employees from being seriously injured or killed while at work.
With the new law passed, The United States Department of Labor created the Occupational Safety
and Health Administration (OSHA), which on a Federal level establishes, implements, and enforces
safety and health standards in the workplace. OSHA is also responsible for providing education,
training, and support to employers and workers.
OSHA oversees most private sector companies and employees in all 50 states, the District of
Columbia, and the other United States jurisdictions either directly through federal OSHA or through
an OSHA–approved State Plan. State ... Show more content on Helpwriting.net ...
By comparison, ADOSH under the Arizona State Plan is somewhat limited compared to the Federal
OSHAAgency regarding the authority to investigate or enforce regulations of federal government
workers including military bases, private sector maritime, workers on Indian Lands (Bureau of
Indian Affairs) and areas exclusive to federal jurisdiction such as copper mines. A fantastic example
of jurisdiction of ADOSH vs. OSHA was documented after a fatal accident at the Gila River Indian
Community in Chandler, Arizona in August 2012. The OSHA report stated "OSHA continues to see
tragic cases where workers die because the necessary steps were not followed to ensure quick
couplers are properly connected prior to starting excavation work," said T. Zachary Barnett, director
of OSHA's Phoenix Area Office. "Employee safety must be the top priority. It is the employer's
responsibility to assess the hazards and fix them." The report went on to say that, "To ask questions,
obtain compliance assistance, file a complaint, or report workplace hospitalizations, fatalities or
situations posing imminent danger to workers, the public should call OSHA's toll–free hotline at
800–321–OSHA (6742). While the Arizona Division of Occupational Safety and Health has
authority over most workplace safety and health programs in Arizona, federal OSHA has jurisdiction
over contractors working on Indian reservations." (Amaden &

The United States Occupational Safety and Health Administration (OSHA) is an agency of the
United States Department of Labor. It was created by Congress of the United States under the
Occupational Safety and Health Act, signed by President Richard M. Nixon, on December 29, 1970.
Its mission is to prevent work–related injuries, illnesses, and occupational fatality by issuing and
enforcing rules called standards for workplace safety and health. The agency is headed by a Deputy
Assistant Secretary of Labor. OSHA federal regulations cover most private sector workplaces. The

Respiratory protection and safety belts and lines are also protection that could prove beneficial on
the construction site. For instance, safety belts would be needed if a high rise building was being
constructed. Respiratory protection is needed when underground construction is being performed to
protect from harmful gasses that may be emitted. Hazards are very common on a construction site.
This makes barricades and accident prevention signs very important. Accident prevention signs shall
be visible at all times when work is being performed, and shall be removed or covered promptly
when the hazards no longer exist. They should also be color coded to represent certain types of
hazards. Barricades are used mainly for construction where traffic may come into play. They protect
workers that may be working in an area where vehicles could possible be a danger. There is a large
section of the OSHA standards that deals with tools that are commonly used on a construction site.
This section is very important because it governs what tools can be used on a site and how they can
be used. If the tools require a guard, they should only be used when the guard is attached to the tool.
The same is required for any welding equipment is being used. Concrete masonry construction has a
set of OSHA requirements all to themselves. No construction loads shall be placed on a concrete
structure or portion of a concrete structure

A Brief Note On Occupational Health And Safety
Occupational health and safety is concerned with protecting the safety, health and welfare of people
engaged in work or employment. The enjoyment of these standards at the highest levels is a basic
human right that should be accessible by each and every worker. Regardless of the nature of their
work, workers should be able to carry out their responsibilities in a safe and secure working
environment, free from hazards As per regulations we are to provide Providing and maintaining safe

How Louisiana Should Improve Funding For Occupational...
In approximately five years since the Deep–Water Horizon incident in the Gulf, expectations for
essential changes in safety, access, and preventative measures designed to capture a potential spill
related illnesses should have taken place. Louisiana should expand funding for Occupational Safety
& Health (OSHA) in efforts to prevent future rig explosions. Expand care to assist all Louisianans
with getting care, or create changes in preventative care and treatment measures to combat those
unhealthy trends that have arisen since the spill. However, given specific numbers and comparisons
with other states, Louisiana appears to not be making much if any progress to gain ground in
national rankings. By comparison, Illinois has increased its overall health ranking over 9 other states
ranking as the 26th healthiest state. The difference between Louisiana and Illinois however, is the
effort both states would need to create in order to get to that top ranking.
Louisiana and Illinois have 8 core measures that affect their state's overall health ranking, including:
High School Graduation, Infant Mortality, Cancer Deaths, Children in Poverty, Violent Crimes, and
Cardiovascular Deaths. In all of these measures, Illinois ranks better. Looking closer at three
specific ones, Occupational Fatalities, Obesity, and Lack of Health Insurance can be traced back to
issues that could relate to the Gulf Spill. Occupational Fatalities and increases in OSHA could help

SUMMARY A furnace used for heat–treating of small iron and steel components exploded in the
one of the research facility of a company. Hydrogen gas was used as a catalyst during the process in
order to produce a steel and iron with a bright surface finish. During the incident, there was a new
employee working in the room, of his first time undergoing the heat treatment process without a
supervision of the experts. The main cause of the incident was due to insufficient amount of purging
before lighting the furnace, allowing the hydrogen gas to mix with oxygen gas. Also, after further
investigation carried out, there were also various factors that led to the incident. The compliance of
the research facility to the Occupational Health and Safety legislation makes up the main body of
the report. The recommendation to the company to improve the operation also stated in this report.

Occupational Safety And Health Administration Essay
INTRODUCTION
Accidents are unfortunately inevitable in an industry as dangerous as the construction industry. It is
not unknown that all–around construction is the occupational field that produces the most accidents
and fatalities per year, which can definitely be intimidating for anyone desiring a career in this
environment. Furthermore, the sad truth is that accidents will never cease to occur regardless of all
of the strict rules and safety procedures implemented by supervisors and safety organizations such
as Occupational Safety and Health Administration (OSHA), for there are situations where there are
unwilling workers who choose not to cooperate with set safety rules. Construction individuals are
solely responsible for their own health and safety; as a result, workers put themselves at risk by not
following safety–implanted rules, which undoubtedly adds to the ever–growing list of
injuries/fatalities per year in construction.
However, even though accidents and fatalities will never stop in this industry, the reduction of
incidents is definitely a mutual aim for everyone involved in this profession. For example, OSHA
requires companies to commands their respective workers to utilize Personal Protective Equipment,
also referred to as PPE. PPE aims to lower the physical risk of workers when dealing directly with
the likes of toxic substances, tools, and machinery in addition to be around unstable objects and
structures. There are countless forms of gadgets, tools, and

OHSAS 18001: Occupational safety and health management OHSAS 18001 is a standard from the
national group of standards that defines the requirements that are of relation to the system of safety
management and occupational health. The standard exists to ensure that all kinds of organizations
demonstrate a safe and healthy performance. In 2007 specifications for the OHSAS 18001 were
updated, this updates included a new specification closely related to the structures of ISO 14001 and
ISO 9001. These helped the organization adapt the standard alongside the already existing standards
and management systems, after the update the component of health in health and safety received
more emphasis. The standard enables response to urgent demand by customers for a recognizable
occupational safety and health system of management standard against the existing management
system. The OHSAS 18001 standard is compatible to the ISOs related to the environment and those

industries. The expansion has created numerous jobs for Canadians and is gradually bringing us out

There are many direct and indirect hazards that need to be taken into consideration. If the hazard
includes a chemical or air pollutant, then the company must indicate the potential harm to its
employees and residents surrounding the area. For example, there was a study done to assess the
effect of occupational exposure to formaldehyde on the risk of lung cancer in two Canadian
population–based case–control studies. "Formaldehyde (CH2O) is an organic compound widely
used throughout the world, particularly in the production of resins used in the wood (pressed wood
products), paper (paper product coatings), and textile (permanent press fabrics) industries. It is also
found in varnishes, glues, and plastics". Assessments were conducted using various studies, data
collection and variable definitions. It was concluded that individuals were often exposed at low
concentration levels, which ties into dose–response assessment. Ultimately the results did not
support an increased risk of lung cancer among workers exposed to formaldehyde. However, it
won't always be the case where the results will be positive. If changes were to occur in a company
dealing with chemicals, that may result in different conclusions about the safety hazard. That is why
there should be tests conducted more frequently to avoid any personal harm occurring

crucial element in workplace policy development. Duty of care is not generally defined in

Occupational health and safety and its role in the workplace Occupational Health and safety can also

Successful occupational health and safety practice requires the collaboration and participation of
both employers and workers in health and safety programs such as the Four–Point Workplace
Program and Voluntary Protection Programs (VPP), as well as involving the consideration of issues
relating to the direct and indirect costs of injuries to an organization. The OSH Act of 1970 was
established to provide guidelines and regulate laws to protect employers and employees in the

Each company would determine hazardous conditions unique to their situation after a job analysis
has been completed and reviewed. A reality employer's face every day in the workplace is
challenges about how to eliminate accidents as they are extremely costly to an organization.
Workplace accidents are costly to an organization because the funds that pay for the injuries come
directly from a company's profit margin, which in the long–run could prevent company bonuses, pay
raises, and extreme cases layoffs or termination of employment. When looking at how much
accidents affect a company financially, one needs to analyze the direct and indirect costs of when
workers stay whole and healthy versus the negative side of not maintaining a safe and healthy
workforce. Companies benefit from a healthy workforce because they end up directly spending less
on workers' compensation insurance costs, reduced medical expenditures, lower costs for job
accommodations for injured workers, and smaller expenditures for return–to–work programs. Safe
and healthy employees pay huge indirect dividends to companies as well by increasing productivity,
producing higher quality products, a boost in morale, reduced absenteeism, and better
employee/management relations. When employees are safe and healthy at the workplace, not only
do the company and employee benefit, their families do as well. Peace

The first organization that I had interviewed was a large manufacturing company (Company 1). The
company is proud of the strong commitment that they have to promoting health and safety in the
workplace, and the prevention of injury and illness. In the company the Human Resources and
management are responsible for establishing and maintaining health and safety programs, and
supervisors are responsible for ensuring that the employees are complying with the safe work
procedures that have been put in place. Multiple times a year the company revises and updates the
Occupational Health and Safety program. Records are also kept on each employee when they not
only receive training, but when they violate a safety procedure. In these cases the necessary
disciplinary action is taken. The other large company (Company 2) that I interviewed proved to be
very similar in their commitment to providing a safe and healthy workplace for their employees,
even though they are in a different sector – in this case retail. Though vastly different in the types of
services provided, they shared a common promise on ensuring due diligence. As it is a relatively
large retail outlet, they have a Health and Safety Committee including one manager, and 5 workers.

level by the Occupational Safety and Health Administration, a division of the US Department of
Labor. The application of the OSH Act in the current employment climate will be discussed as it
applies to a variety of industries; considerations that are most applicable to the specific type of

These requirements fall under the "Housekeeping" section of OSHA's general requirements. Other
significant considerations include air quality, lighting considerations, and noise exposure.
Conscientious employers address air quality concerns by ensuring that routine maintenance for
heating, ventilation, and air conditioning units occurs at regularly scheduled intervals, and that
filters or pads are replaced according to manufacturer's specifications. Inadequate or inappropriate
lighting has been recently associated with migraine and vision disorders in some individuals
(Berkley, 2006). Employers must ensure that the lighting used in work environments meets OSHA
standards of brightness, spectrum, and stability (non–flickering). Excessive noise in an office
environment can be generated by a number of factors including copy machines, computer servers,
printers, and mail processing machines. Business leaders must ensure that the noise produced by this
equipment is within acceptable limitations or that employees are provided with protective
equipment.

variety of regulations under OSHA than office–type work environments. The most primary issues to

A Brief Note On Occupational Safety And Health
Occupational Safety and Health refers to the concerns of safety and health of people occupied in
employment or work services. Over the years the safety precautions have changed quite a bit and
now we are more precautious to people's safety while they work, even though we could always
improve more.
"Worker deaths in America are down–on average–, from about 38 worker deaths a day in 1970 to 12
a day in 2012, injuries and illnesses are down from 10.9 incidents per 100 workers in 1972 to 3.4 per
100 in 2011"(Commonly Used Statistics).
With that being said it is clearly shown how we have improved a lot from the 1970's to 2012. In this
paper I will address three individuals work experiences, ranging from ages 19 to 80. All of our work
experiences are fairly different from each other. The first individual, Felicita, who is 80 years of age,
has worked in multiple factories during her lifetime. The first factory she worked in was in 1952
when she was only 19 years of age and first came to America. She worked in a factory making belts
and was paid about seventy–five cents an hour. Another factory she worked in shortly after the
previous one, she was making purses for about one–dollar an hour. Upon talking to my
grandmother, Felicita, she stated that the hazards she faced in these factories were machine hazards,
factory fires, hazards from dust, and pollution. The machine hazards included cutting tools with no

Occupational Safety And Health Agency
Employee Safety Introduction The system of the Occupational Safety and Health Agency occurred
to protect the interests of the workers in various organizations. The federal legislation proposes that
each employer should be capable of providing a safe and healthy work environment for employees
to reduce or avoid the occurrence of accidents. If not, the employees require some form of insurance
covers for compensation when directly exposed to the hazards. General hazards in the organization
include chemicals, poisonous gasses, sharp tools, and factors that make people vulnerable to falls
just to mention but a few (Burt, 2015). Other conditions set by the federal law include the possibility
that the aggrieved employee will have the opportunity to talk about the unsafe workplace without
fear that the managers will retaliate harshly to his or her sentiments. Several factors entail employee
safety including the possibility of training the workers about the possibly dangerous workplace and
ensuring that the OSHA officers have access to the same environment for inspection. Companies
that follow such details carefully often refrain from allegations of providing the employees with the
worst work environments as the submission further unveils. Training Workplaces are sometimes
very complicated to the employees that the greatest nightmare becomes moving around the people

Occupational Health and Safety Regulation Compliance
Occupational Health and Safety Regulation Compliance
Introduction
Occupational Health and Safety (OHS) regulations are a norm for every organization to follow and
thus are provided for to every employee when he/she is hired to familiarize them with the company's
policies, regulations and procedures. The compliance with these norms is one essential part of
ensuring whether these regulations are being adhered to or not and this is where the role of
inspectors is introduced. The inspectors are professionals responsible to ensure the compliance of
health and safety regulations in a company and conduct periodic inspections to either avoid a serious
accident or injury or to handle the workplace situation in case accident/injury has already taken
place.
The article talks about the issue based on the Self–determination theory categorizing inspectors into
two categories; autonomy–supportive inspectors and coercive inspectors derived from these similar
work environments and debates statistically on which type of inspection is more effective. An
autonomy–supportive environment supports an environment conducive to learning for employees
and is thus subject to more positive outcomes. On the other hand, a coercive work environment is
more of an autocrative leadership style where the boss enforces the regulation compliance with
power and authority.

The Alberta Occupational Health And Safety Essay
SCOPE
The Alberta Occupational Health and Safety (OH&S) Code and Alpine Construction Policies both
indicate that the employer is responsible for the identification, assessment, elimination or control of
hazards in the workplace. Hazard Identification, Assessment and Control is critical to the success
and effectiveness of any OH&S program. This program specifies requirements for the elimination of
OH&S hazards and for the control of risk associated with the remaining hazards that cannot be
eliminated.
Alpine Construction has adopted a step by step process to guide responsible persons to an effective
hazard identification, assessment and controls system. These steps include:
 Hazard Identification: identifying the actual and potential hazards
 Hazard Assessment: determining the risks and the risk rating associated with the identified hazard
based on probability, severity and frequency of occurrence
 Hazard Elimination: eliminating the hazard
 Hazard Control: if the hazard cannot be eliminated, controls for the hazard and the risks
associated with the hazard will be implemented
 Providing information, education, training and supervision on the hazards, risks and controls to
employees, contractors, and stakeholders
 Periodic review of the hazard assessment and control process.

work–related deaths and 650,000 work–related injuries each year, resulting in an annual economic
loss of more than $27 billion. Malaysia in 1989 reported 112,095 industrial accidents to 125,304 the
year after. In 1991 there was an increase of 15% in this short period to 128,871. In China where
government regulations are ignored, the death rate from accidents in the coalmining industry is 500–
1000 times more; according to the International Labour Organisation data, it is reported that almost
400,000 Chinese workers died of occupational illnesses in 2002. An organization which successfully
reduces its rates and severity of occupational accidents, diseases and work–related stress levels and

more productivity due to fewer lost workdays ii) increased efficiency from a more committed work

Workplace Occupational Health And Safety
Introduction Since late 19th century, workplace occupational health and safety has drawn more and
more attention in Canada with relative legislations becoming stronger and more comprehensive.
Effective OH&S programs could help business save considerable cost on worker's injury or illness.
OH&S becomes even more significant in some open–to–public workplaces, such as schools, which
not only relating to staffs' health and safety, but also thousands of students'. George Brown College

GBC. According to statistics from "Fast Fact 2014–2015" (2013) published by GBC, there are more
than 25,000 full–time enrolled students; 3,200 part–time students and around 1,300 fulltime and
nearly 1,900 part–time employees in GBC in the period of 2013–2014 fiscal year. The college
makes noticeable efforts to ensure both public and staff's health and safety and try to reduce the
injury and illness. Jurisdiction & Legislation In Canada, every province and terrorist territories has
its own OH&S Act. Although there some exceptional business are covered under the federal
jurisdiction, for example airport , banks, canals and etc., Canadian center for Health and Safety

The Occupational Health And Safety Standards
As safety practitioners, we need to understand that procedures can be the nemesis of any
occupational health and safety (OHS) management system. Getting it wrong can be the difference
between success and failure in safety compliance.
Sometimes procedures are created too rigid and bureaucratic, and other times they're non–specific
and ineffectual. The point is no one wants to be under the burden of unnecessary or unusable
procedures. What is needed is the right balance of simple instructions that are easy to read and
comprehend.
Developing your Safety Procedures
Procedures should communicate to employees what they need to know to do their job safely. Here
are 5 simple steps to follow:
1. Justification – Ensure there is a genuine reason for ... Show more content on Helpwriting.net ...
Always consider the following options:
Flowchart – This shows a process as a simple diagram. By using a series of symbols and arrows to
indicate flow and action you can outline a process and make it easy to follow.
Tip: Don't complicate your chart with too many symbols or too much text. It should flow naturally
from start to finish and be structured in a logical way.
Photographs or Diagrams – Are commonly used especially where there is difficulty in
communicating due to illiteracy or use of multiple languages. The main goal of visualisation is to
make it possible to absorb large amounts of data quickly.
Tip: The saying "A picture is worth a thousand words" refers to the notion that a complex idea can
be conveyed with just a single still image. However just make sure you check that your image or
diagram is saying the right words to employees.
Step 4: Writing Style.
Remember when you write you need to consider the end–user, the person who has to read and
understand your procedure. To ensure success adopt the following simple rules of writing;
Use plain everyday English words or local language. The use of uncommon, long or complex words
or sentences should be avoided where possible.
Keep to short paragraphs and avoid using too many words. Just be specific enough to communicate
clearly.
Write at the appropriate reading level.
Try to keep the procedure itself to a reasonable size

The Occupational Safety and Health Act
"The Occupational Safety and Health Act of 1970 heralded a new era in the history of public efforts
to protect workers from harm on the job. This Act established for the first time a nationwide, federal
program to protect almost the entire work force from job–related death, injury and illness,"
(MacLaury). Occupational health and safety awareness pre–dates OSHA by decades, though, and it
is important to place the administration within its historical context. The Industrial Revolution in the
late nineteenth century proceeded like a locomotive, without any barrier or restriction. However,
working conditions became increasingly dangerous. Social and political activism spawned the labor
movements that led to early occupational safety regulations. As United States Department of Labor
Occupational Safety and Health Administration states, the nation's first occupational safety
regulations were passed in Massachusetts in 1877. Several states followed suit, paving the way for
the United States Department of Labor to take federal action. Special investigator for the
Department of Labor, Alice Hamilton, conducted some of the first forma surveys of factories and
other industrial workplaces. These formative surveyed provided the methodological foundations
upon which modern occupational safety research and practice are built. In 1934, Secretary of Labor
Frances Perkins created the Bureau of Labor Standards, to provide a list of regulations and codify
them in law. The Bureau of Labor

Occupational Health And Safety Management System
Introduction
Despite undeniable efforts investing in safety and health within the workplace, occupational
accidents continue to account for injuries and deaths every year (Cadieux et al, 2006). In Quebec
alone in the year of 2004, 176 deaths and 128,104 occupational injuries were registered by the
National OHS board (Cadieux et al, 2006). In order to improve these rates worldwide, Occupational
Health and Safety Management systems are developed and implemented in the workplace.
An Occupational Health and Safety Management System (OHSMS) is a planned, documented and
verifiable method of managing workplace hazards and their associated risks (Pillay, 2016). An
OHSMS provides a structure that allows an organisation to identify and control health and safety
risks within the organisation. The implementation of such structures promotes a safe and healthy
working environment which, in turn, will reduce the potential for accidents in the workplace whilst
aiding legislative compliance and improving the overall performance of the organisation.
Comparing and contrasting OHSMSs through the analysis of available literature allows one to
determine the most appropriate management system for their organisation.
The objective of this analysis is to;
Summarise the literature on Occupational Health and Safety Management Systems OHSAS 18001
and AZ/NZS 4801.

Occupational Safety and Health Administration (OSHA)
About OSHA
In 1970, the Occupational Safety and Health Act was created. It was passed to prevent workers from
being seriously injured or harmed on the job. This, in turn, created the Occupational Safety and
Health Administration (OSHA). This administration sets and enforces standards that ensure workers
are protected at their job site. They also provide information, training, and assistance to employers
to continue to create these safe environments. In the end, they believe that no person's life should be
a risk at the work place (U.S. Department of Labor, 2015, OSHAAt–A–Glance).

The Occupational Safety and Health Act of 1970: A Brief Overview

  • 1. Occupational Safety And Health Act The Occupational Safety and Health Act passed in 1970. This act signals an important moment in occupational safety and health. Prior to 1970, the occupational safety and health were unsatisfactory. In fact, many accidents occurred in the workplace because of chemicals, dusts, and dangerous machines. There were many hazards in the workplace that contributed to terrible injuries and fatalities. Furthermore, in 1970 an estimated 14,000 workers were killed on the job. After the Occupational Safety and Health Act passed, the number of injuries have declined. Previously, businesses were not concerned about hazards in the workplace The Occupational Safety and Health Act is an important topic to address because it led the way for occupational safety and health. I choose to research this law in a greater depth because I found it interesting how this law changed how businesses prepare to prevent occupational health and safety hazards. There were minimal efforts to ensure workplace health and safety. When people were injured or died, they were easily replaced. In fact, it was cheaper to replace a worker than to actual implement safety measures. Furthermore, the tort law did not help the survivors of dead workers or injured employees. Over the years, there were minimal improvements. Eventually labor unions formed and public anger about poor workplace safety grew which led to a reduction in employee worker accidents for some time. After World War II, people were concerned about winning ... Get more on HelpWriting.net ...

Health hazards can de further classified into chemical, physical and ergonomic hazards. Chemical hazards in the construction may develop from dust, fumes, fibers and liquids. They can be emitted by welding, spraying paint and using solvents. There also are hazards found in materials such as asbestos, lead, silica, cadmium and carbon monoxide. At the construction site, workers might be exposed to chemicals by breathing them in, ingestion and absorption through the eyes or skin. Chemicals at the construction work sites can cause headaches, eye irritation, dizziness, faintness, sleepiness and thus affect judgment and coordination. Physical hazards in a construction zone include noise, vibration, extreme temperatures and radiation. Extended noise levels above 85 decibels can cause future hearing loss. Vibration harm typically occurs when workers use hand tools for extended periods. To prevent this, workers should take breaks and use earplugs to protect the body and ears from vibration and noise. • 13. Case Study: Federal Occupational Safety And Health... Under the Presidency of Richard Nixon, the Federal Occupational Safety and Health Act of 1970 (OSH Act) was approved to avoid employees from being seriously injured or killed while at work. With the new law passed, The United States Department of Labor created the Occupational Safety and Health Administration (OSHA), which on a Federal level establishes, implements, and enforces safety and health standards in the workplace. OSHA is also responsible for providing education, training, and support to employers and workers. By comparison, ADOSH under the Arizona State Plan is somewhat limited compared to the Federal OSHAAgency regarding the authority to investigate or enforce regulations of federal government workers including military bases, private sector maritime, workers on Indian Lands (Bureau of Indian Affairs) and areas exclusive to federal jurisdiction such as copper mines. A fantastic example of jurisdiction of ADOSH vs. OSHA was documented after a fatal accident at the Gila River Indian Community in Chandler, Arizona in August 2012. The OSHA report stated "OSHA continues to see tragic cases where workers die because the necessary steps were not followed to ensure quick couplers are properly connected prior to starting excavation work," said T. Zachary Barnett, director of OSHA's Phoenix Area Office. "Employee safety must be the top priority. It is the employer's responsibility to assess the hazards and fix them." The report went on to say that, "To ask questions, obtain compliance assistance, file a complaint, or report workplace hospitalizations, fatalities or situations posing imminent danger to workers, the public should call OSHA's toll–free hotline at 800–321–OSHA (6742). While the Arizona Division of Occupational Safety and Health has authority over most workplace safety and health programs in Arizona, federal OSHA has jurisdiction over contractors working on Indian reservations." They should also be color coded to represent certain types of hazards. Barricades are used mainly for construction where traffic may come into play. They protect workers that may be working in an area where vehicles could possible be a danger. There is a large section of the OSHA standards that deals with tools that are commonly used on a construction site. If the tools require a guard, they should only be used when the guard is attached to the tool. The same is required for any welding equipment is being used. In approximately five years since the Deep–Water Horizon incident in the Gulf, expectations for essential changes in safety, access, and preventative measures designed to capture a potential spill related illnesses should have taken place. Louisiana should expand funding for Occupational Safety & Health (OSHA) in efforts to prevent future rig explosions. Expand care to assist all Louisianans with getting care, or create changes in preventative care and treatment measures to combat those unhealthy trends that have arisen since the spill. However, given specific numbers and comparisons with other states, Louisiana appears to not be making much if any progress to gain ground in national rankings. By comparison, Illinois has increased its overall health ranking over 9 other states ranking as the 26th healthiest state. The difference between Louisiana and Illinois however, is the effort both states would need to create in order to get to that top ranking. Louisiana and Illinois have 8 core measures that affect their state's overall health ranking, including: High School Graduation, Infant Mortality, Cancer Deaths, Children in Poverty, Violent Crimes, and Cardiovascular Deaths. In all of these measures, Illinois ranks better. Looking closer at three specific ones, Occupational Fatalities, Obesity, and Lack of Health Insurance can be traced back to issues that could relate to the Gulf Spill. • 49. Occupational Safety And Health Administration Essay INTRODUCTION Accidents are unfortunately inevitable in an industry as dangerous as the construction industry. It is not unknown that all–around construction is the occupational field that produces the most accidents and fatalities per year, which can definitely be intimidating for anyone desiring a career in this environment. Furthermore, the sad truth is that accidents will never cease to occur regardless of all of the strict rules and safety procedures implemented by supervisors and safety organizations such as Occupational Safety and Health Administration (OSHA), for there are situations where there are unwilling workers who choose not to cooperate with set safety rules. Construction individuals are solely responsible for their own health and safety; as a result, workers put themselves at risk by not following safety–implanted rules, which undoubtedly adds to the ever–growing list of injuries/fatalities per year in construction. However, even though accidents and fatalities will never stop in this industry, the reduction of incidents is definitely a mutual aim for everyone involved in this profession. For example, OSHA requires companies to commands their respective workers to utilize Personal Protective Equipment, also referred to as PPE. PPE aims to lower the physical risk of workers when dealing directly with the likes of toxic substances, tools, and machinery in addition to be around unstable objects and structures. If the hazard includes a chemical or air pollutant, then the company must indicate the potential harm to its employees and residents surrounding the area. For example, there was a study done to assess the effect of occupational exposure to formaldehyde on the risk of lung cancer in two Canadian population–based case–control studies. "Formaldehyde (CH2O) is an organic compound widely used throughout the world, particularly in the production of resins used in the wood (pressed wood products), paper (paper product coatings), and textile (permanent press fabrics) industries. It is also found in varnishes, glues, and plastics". Assessments were conducted using various studies, data collection and variable definitions. It was concluded that individuals were often exposed at low concentration levels, which ties into dose–response assessment. Ultimately the results did not support an increased risk of lung cancer among workers exposed to formaldehyde. However, it won't always be the case where the results will be positive. If changes were to occur in a company dealing with chemicals, that may result in different conclusions about the safety hazard. When looking at how much accidents affect a company financially, one needs to analyze the direct and indirect costs of when workers stay whole and healthy versus the negative side of not maintaining a safe and healthy workforce. Companies benefit from a healthy workforce because they end up directly spending less on workers' compensation insurance costs, reduced medical expenditures, lower costs for job accommodations for injured workers, and smaller expenditures for return–to–work programs. Safe and healthy employees pay huge indirect dividends to companies as well by increasing productivity, producing higher quality products, a boost in morale, reduced absenteeism, and better employee/management relations. Over the years the safety precautions have changed quite a bit and now we are more precautious to people's safety while they work, even though we could always improve more. "Worker deaths in America are down–on average–, from about 38 worker deaths a day in 1970 to 12 a day in 2012, injuries and illnesses are down from 10.9 incidents per 100 workers in 1972 to 3.4 per 100 in 2011"(Commonly Used Statistics). With that being said it is clearly shown how we have improved a lot from the 1970's to 2012. In this paper I will address three individuals work experiences, ranging from ages 19 to 80. All of our work experiences are fairly different from each other. The first individual, Felicita, who is 80 years of age, has worked in multiple factories during her lifetime. The first factory she worked in was in 1952 when she was only 19 years of age and first came to America. She worked in a factory making belts and was paid about seventy–five cents an hour. Another factory she worked in shortly after the previous one, she was making purses for about one–dollar an hour. Upon talking to my grandmother, Felicita, she stated that the hazards she faced in these factories were machine hazards, factory fires, hazards from dust, and pollution. The machine hazards included cutting tools with no guards, lifting heavy items on the machine with no support, loud noises ... Get more on HelpWriting.net ...

The Occupational Safety And Health Administration Essay administrative law judge of the Occupational Safety and Health Review Commission would have to affirm the citation issued by Occupational Safety and Health Administration (OSHA). The Commission's judge would then rule the employer is in violation if the four required elements of the citation under the General Duty Clause exist. The Occupational Safety and Health Administration (OSHA) took an aggressive enforcement approach with workplace violence which leads to the issuing of eight General Duty Clause citations within the two–year period of 1993 through 1995 for workplace violence. Even though they don't list workplace violence among the twenty National Emphasis programs they routinely target various industries with unusually high injury or illness rates for inspections. According to Cornell HR Review, other forms of case law have been enacted in different states do to an up–rise of workplace violence. The state California became the first state to pass a workplace violence law when it enacted the Workplace Violence Safety Act (WVSA) Cal. Civ. Proc. Code § 527.8 (2012). The law allows an employer to obtain a temporary restraining order an injunction against any individual who has engaged in unlawful violence or has made a credible threat of violence in the workplace. • 109. Occupational Safety And Health Agency Employee Safety Introduction The system of the Occupational Safety and Health Agency occurred to protect the interests of the workers in various organizations. The federal legislation proposes that each employer should be capable of providing a safe and healthy work environment for employees to reduce or avoid the occurrence of accidents. If not, the employees require some form of insurance covers for compensation when directly exposed to the hazards. General hazards in the organization include chemicals, poisonous gasses, sharp tools, and factors that make people vulnerable to falls just to mention but a few (Burt, 2015). Other conditions set by the federal law include the possibility that the aggrieved employee will have the opportunity to talk about the unsafe workplace without fear that the managers will retaliate harshly to his or her sentiments. Several factors entail employee safety including the possibility of training the workers about the possibly dangerous workplace and ensuring that the OSHA officers have access to the same environment for inspection. Companies that follow such details carefully often refrain from allegations of providing the employees with the worst work environments as the submission further unveils. Training Workplaces are sometimes very complicated to the employees that the greatest nightmare becomes moving around the people and the machinery. Occupational Health and Safety Regulation Compliance Occupational Health and Safety Regulation Compliance Introduction Occupational Health and Safety (OHS) regulations are a norm for every organization to follow and thus are provided for to every employee when he/she is hired to familiarize them with the company's policies, regulations and procedures. The compliance with these norms is one essential part of ensuring whether these regulations are being adhered to or not and this is where the role of inspectors is introduced. The inspectors are professionals responsible to ensure the compliance of health and safety regulations in a company and conduct periodic inspections to either avoid a serious accident or injury or to handle the workplace situation in case accident/injury has already taken place. The article talks about the issue based on the Self–determination theory categorizing inspectors into two categories; autonomy–supportive inspectors and coercive inspectors derived from these similar work environments and debates statistically on which type of inspection is more effective. An autonomy–supportive environment supports an environment conducive to learning for employees and is thus subject to more positive outcomes. On the other hand, a coercive work environment is more of an autocrative leadership style where the boss enforces the regulation compliance with power and authority. Analysis The article reflects with research the idea presented by Self–determination theory which states that the best way to deal with ... Get more on HelpWriting.net ...

The Alberta Occupational Health And Safety Essay SCOPE The Alberta Occupational Health and Safety (OH&S) Code and Alpine Construction Policies both indicate that the employer is responsible for the identification, assessment, elimination or control of hazards in the workplace. Hazard Identification, Assessment and Control is critical to the success and effectiveness of any OH&S program. This program specifies requirements for the elimination of OH&S hazards and for the control of risk associated with the remaining hazards that cannot be eliminated. Alpine Construction has adopted a step by step process to guide responsible persons to an effective hazard identification, assessment and controls system. These steps include:  Hazard Identification: identifying the actual and potential hazards  Hazard Assessment: determining the risks and the risk rating associated with the identified hazard based on probability, severity and frequency of occurrence  Hazard Elimination: eliminating the hazard  Hazard Control: if the hazard cannot be eliminated, controls for the hazard and the risks associated with the hazard will be implemented  Providing information, education, training and supervision on the hazards, risks and controls to employees, contractors, and stakeholders  Periodic review of the hazard assessment and control process. Malaysia in 1989 reported 112,095 industrial accidents to 125,304 the year after. In 1991 there was an increase of 15% in this short period to 128,871. In China where government regulations are ignored, the death rate from accidents in the coalmining industry is 500– 1000 times more; according to the International Labour Organisation data, it is reported that almost 400,000 Chinese workers died of occupational illnesses in 2002. An organization which successfully reduces its rates and severity of occupational accidents, diseases and work–related stress levels and improve the quality of work life becomes more effective, and sees beneficial results, such as : i) more productivity due to fewer lost workdays ii) increased efficiency from a more committed work force iii) reduced medical and insurance costs iv) lower workers' compensation rates and direct payments because fewer claims are filed v) greater flexibility and adaptability in the work force as a result of increased participation and an increased sense of ownership, and vi) better selection ratios because of the enhanced image of the organization (Matthes 1992) Thus, companies are able to increase ... • 133. The Occupational Health And Safety Standards As safety practitioners, we need to understand that procedures can be the nemesis of any occupational health and safety (OHS) management system. Getting it wrong can be the difference between success and failure in safety compliance. Sometimes procedures are created too rigid and bureaucratic, and other times they're non–specific and ineffectual. The point is no one wants to be under the burden of unnecessary or unusable procedures. What is needed is the right balance of simple instructions that are easy to read and comprehend. • 141. The Occupational Safety and Health Act "The Occupational Safety and Health Act of 1970 heralded a new era in the history of public efforts to protect workers from harm on the job. This Act established for the first time a nationwide, federal program to protect almost the entire work force from job–related death, injury and illness," (MacLaury). Occupational health and safety awareness pre–dates OSHA by decades, though, and it is important to place the administration within its historical context. The Industrial Revolution in the late nineteenth century proceeded like a locomotive, without any barrier or restriction. However, working conditions became increasingly dangerous. Social and political activism spawned the labor movements that led to early occupational safety regulations. As United States Department of Labor Occupational Safety and Health Administration states, the nation's first occupational safety regulations were passed in Massachusetts in 1877. Several states followed suit, paving the way for the United States Department of Labor to take federal action. Special investigator for the Department of Labor, Alice Hamilton, conducted some of the first forma surveys of factories and other industrial workplaces. These formative surveyed provided the methodological foundations upon which modern occupational safety research and practice are built. In 1934, Secretary of Labor Frances Perkins created the Bureau of Labor Standards, to provide a list of regulations and codify them in law. The Bureau of Labor ... Get more on HelpWriting.net ...

  • 145. Occupational Health And Safety Management System Introduction Despite undeniable efforts investing in safety and health within the workplace, occupational accidents continue to account for injuries and deaths every year (Cadieux et al, 2006). In Quebec alone in the year of 2004, 176 deaths and 128,104 occupational injuries were registered by the National OHS board (Cadieux et al, 2006). In order to improve these rates worldwide, Occupational Health and Safety Management systems are developed and implemented in the workplace. An Occupational Health and Safety Management System (OHSMS) is a planned, documented and verifiable method of managing workplace hazards and their associated risks (Pillay, 2016). An OHSMS provides a structure that allows an organisation to identify and control health and safety risks within the organisation. The implementation of such structures promotes a safe and healthy working environment which, in turn, will reduce the potential for accidents in the workplace whilst aiding legislative compliance and improving the overall performance of the organisation. Comparing and contrasting OHSMSs through the analysis of available literature allows one to determine the most appropriate management system for their organisation. The objective of this analysis is to; Summarise the literature on Occupational Health and Safety Management Systems OHSAS 18001 and AZ/NZS 4801.
