He later arrived at Hospital DEF a bit tipsy and was seen staggering toward the delivery room. Ms. Marshall. a nurse attending to Mrs. Garza who was then about to deliver, suggested that the on-call obstetrician be called to perform the delivery. Dr. Miller got irritated at the nurse, insisted that he was quite capable of delivering Mrs. Garza's baby, and the on-call obstetrician was never called. During surgery. Dr. Miller accidentally nicked the patient's right thigh with a scalpel on account of drunkerness. Liability for the injury therefore extends to the following party/parties: Dr. Maler and the on-call obstetrician. Hospital DEF alone. the nurse and Dr. Miller.
