SUMMARY
 The proposed amendments will update the
current zoning regulations concerning
definitions, land uses, lot area, lot width,
lot coverage, setbacks, articulation,
building heights, parking requirements,
and landscaping, as well as codify key
elements of the City’s Comprehensive
Plan.

BACKGROUND
 On February 21, 2017, city staff presented
proposed amendments to the City’s zoning
codes and P&Z recommendations.
 City Council had several concerns that
required further research.

ITEMS OF CONCERN #1
 Relocation of overhead utilities
underground or to the rear of the
property.
 Locating utilities in rear may have
negative effects on adjacent residential
properties.

ITEMS OF CONCERN #1
 P&Z recommended adding the following
language “shall be approved and may be
modified by Council, after ARB
recommendations, as part of the Final
Design Review process”.
 This language, if adopted, would allow
Council to consider the utility locations
for a project on a case-by-case basis.

 Also need to add language “for properties
with frontage along Broadway”.

ITEMS OF CONCERN #2
 Interior remodel or small addition would
trigger the relocation of utilities, new
sidewalks, planting strips, and other
public realm improvements.
 Current code/regulations would only
require these items if the property was
expanding and would not be triggered by
interior renovations.

 Banning the parking of trailers, service
vehicles, buses, food trailers, or similar
vehicles.
 The concern was the effect this
regulation would have on existing
businesses.

ITEMS OF CONCERN #3
 After further discussion, research, and
Council direction, it was determined that
only trailers and food trailers/trucks were
of concern at this time.
 Staff recommends only prohibiting the
parking of trailers & food trucks in the
front of the property adjacent to
Broadway.

ITEMS OF CONCERN #3
 Need to add language “that this
regulation will go into effect 1 year from
the date of adoption, for existing
properties currently storing these
vehicles”, in order to allow business
owners to find alternative places to
store these vehicles.

 P&Z recommended allowing these
vehicles to be located in the front of the
property, if no rear parking was
available.

 Compact Car Parking spaces.
 P&Z recommended looking at ratios &
feasibility of allowing a certain ratio of
smaller parking spaces to be
constructed.

ITEMS OF CONCERN #4
 Staff researched and found no definitive
evidence that this is a benefit to the
community, while it is a benefit to
developers.
 Staff recommends not allowing compact
spaces in order to ensure that all required
off-street parking may be utilized by all
citizens, regardless of vehicle size.

 Outdoor dining areas & additional
parking.
 Current proposal is to require 1 space
per every 100 gross sq. ft. of restaurant
and an additional space per every 300
sq. ft. of outdoor seating areas.

 After further research, no standard
parking ratio is available for outdoor
seating areas.
 Staff recommendations
 Keep as originally proposed.
 1,000 sq. ft. of outdoor seating area
would only require 4 additional
spaces.

  • 1. Case #386 Zoning Code Proposed Amendments Presented By: Jason Lutz Community Development Services Director City Council Meeting Agenda Item #7 April 24, 2017
  • 2. SUMMARY  The proposed amendments will update the current zoning regulations concerning definitions, land uses, lot area, lot width, lot coverage, setbacks, articulation, building heights, parking requirements, and landscaping, as well as codify key elements of the City’s Comprehensive Plan.
  • 3. 3 BACKGROUND  On February 21, 2017, city staff presented proposed amendments to the City’s zoning codes and P&Z recommendations.  City Council had several concerns that required further research.
  • 4. 4 ITEMS OF CONCERN #1  Relocation of overhead utilities underground or to the rear of the property.  Locating utilities in rear may have negative effects on adjacent residential properties.
  • 5. 5 ITEMS OF CONCERN #1  P&Z recommended adding the following language “shall be approved and may be modified by Council, after ARB recommendations, as part of the Final Design Review process”.  This language, if adopted, would allow Council to consider the utility locations for a project on a case-by-case basis.
  • 6. 6 ITEMS OF CONCERN #1  Also need to add language “for properties with frontage along Broadway”.
  • 7. 7 ITEMS OF CONCERN #2  Interior remodel or small addition would trigger the relocation of utilities, new sidewalks, planting strips, and other public realm improvements.  Current code/regulations would only require these items if the property was expanding and would not be triggered by interior renovations.
  • 8. 8 ITEMS OF CONCERN #3  Banning the parking of trailers, service vehicles, buses, food trailers, or similar vehicles.  The concern was the effect this regulation would have on existing businesses.
  • 9. 9 ITEMS OF CONCERN #3  After further discussion, research, and Council direction, it was determined that only trailers and food trailers/trucks were of concern at this time.  Staff recommends only prohibiting the parking of trailers & food trucks in the front of the property adjacent to Broadway.
  • 10. 10 ITEMS OF CONCERN #3  Need to add language “that this regulation will go into effect 1 year from the date of adoption, for existing properties currently storing these vehicles”, in order to allow business owners to find alternative places to store these vehicles.
  • 11. 11 ITEMS OF CONCERN #3  P&Z recommended allowing these vehicles to be located in the front of the property, if no rear parking was available.
  • 12. 12 ITEMS OF CONCERN #4  Compact Car Parking spaces.  P&Z recommended looking at ratios & feasibility of allowing a certain ratio of smaller parking spaces to be constructed.
  • 13. 13 ITEMS OF CONCERN #4  Staff researched and found no definitive evidence that this is a benefit to the community, while it is a benefit to developers.  Staff recommends not allowing compact spaces in order to ensure that all required off-street parking may be utilized by all citizens, regardless of vehicle size.
  • 14. 14 ITEMS OF CONCERN #5  Outdoor dining areas & additional parking.  Current proposal is to require 1 space per every 100 gross sq. ft. of restaurant and an additional space per every 300 sq. ft. of outdoor seating areas.
  • 15. 15 ITEMS OF CONCERN #5  After further research, no standard parking ratio is available for outdoor seating areas.  Staff recommendations  Keep as originally proposed.  1,000 sq. ft. of outdoor seating area would only require 4 additional spaces.
