Many disability management accommodations involve co-workers taking on tasks or portions of the injured
employee’s position that are outside the returning workers’ abilities. Although a practical solution to the issue
at hand, co-workers can be significantly burdened with a heavier and more difficult workload. Ergonomics and

workplace and you will start to notice some people using walking as their means of exercise, some even using
Walking Poles; check out your local park and you will see employees participating on Tag Frisbee Team; head
past the new house being built and you might see a team of employees building a house for Habitat for
Humanity. The term fitness often conjures up the idea of putting on one's Lu Lu Lemons and heading to the gym
for Step Class or to ""pump iron"". It turns out based on research emerging from Exercise Physiology and
Kinesiology researchers that this is an unrealistic notion of fitness and one that needs to be thought about on
the part of Wellness teams in the workplace. Jane Sleeth, a former Teaching Tennis Professional and fitness
enthusiast advises many clients as part of their ergonomic programs on what fitness should really be; how to
measure success; and how to get more employees involved with regular fitness regimes. Jane will outline the

accommodation of older workers has become a significant issue for organizations. As well, employees who are

It has been said that all that is needed for "safe work" is good workplace "communication", good work
"planning" and a "competent" workforce. All world class safety management systems include these elements.
For the last decade the focus has been on occupational health and safety management system development
which has resulted in improved workplace communication and better work planning. What remains is the need
for the development and assurance of employee competency. Competency requires formal integration of
education and training. The word 'competent' and term 'competency assessment' are being used more
frequently, and sometimes loosely, within the context of Occupational Health and Safety Management Systems
(OHSMS). Little is being done to formally develop competency profiles, implement competency develop
processes or assess worker competency. Why not? Is it fear, complacency or ignorance? Or some combination
thereof? In this session a framework for developing a competency assessment profile will be outlined. Further
an outline of a competency development plan will be provided and tools (online and others) for assessing
worker competency will be demonstrated. The Corporate and psychological resistance to putting energy into
developing competency will be discussed. Participants will gain an understanding of what competency means
and how to set up a program for competency assessment and competency development in your workplace.

Although disability management and the duty to accommodate disabilities have been with us for decades they
still present some of the most challenging issues facing employers today. The complexity of the subject is
impacted by developments in the law. Further complicating variables include the characteristics of different
disabilities, the impact of multiple disabilities and the unique nature of the workplaces that are impacted by
them. We will review case law developments concerning the accommodation of disabilities throughout the
employment relationship, from hiring to firing, with specific consideration to issues raised by some of the most
common and challenging disabilities facing employers today including scent allergies, chronic pain, depression,
anxiety, stress, Bi-Polar Disorder, obesity, addictions (alcohol, drugs and gambling), Post Traumatic Stress

Mental health is the number one cause of disability in Canada, accounting for nearly 30% of disability claims. It
is believed that 10-25% of mental health claims are preventable. In January 2013 the CSA released the new
Psychological Health & Safety Standard. The Standard--the first of its kind worldwide--was developed to
prevent psychological harm from conditions in the workplace and to promote psychological health in the
workplace. At present adherence is voluntary, but nobody wants to be caught off guard if the voluntary
Standard becomes the Mandatory Standard. The Standard identifies thirteen workplace factors employers
should target and outlines a management practice framework for reducing psychological risk. Since the release
of the Standard, AGS Rehab has been collecting data from various Ontario employers and life insurance
companies to understand the impact of the Standard on employers and the implications for mental health
claims. For the first time, AGS will present the results of our research--information that will help you establish
and implement best practice. An implementation tool kit will also be reviewed.

The law relating to the allowance of traumatic mental stress WSIB claims and psychotraumatic disability WSIB
claims is constantly evolving. Furthermore, the always challenging process of accommodating a disabled worker
becomes even more challenging when the disability has a psychological component. This session will be
presented by an experienced lawyer who is a Certified Specialist in Workplace Safety and Insurance Law. You
will be brought up to date on the current law regarding entitlement for traumatic mental stress,
psychotraumatic disability and chronic pain disability claims. In addition, the session will address an employer's
co-operation obligations under the WSIA as well as accommodation obligations under the Human Rights Code.
You will be provided with practical advice and strategies on how to deal with return to work issues involving
these types of claims. The session will also cover the complexities involved in the interaction between WSIB

partnered with National Institute of Disability Management and Research (NIDMAR) and the WSIB to conduct
DM audits in nursing homes. During this knowledge-to-practice session, the speaker will provide an overview of
the audit process from the Consensus Based Disability Management Audit™ (CBDMA™) that was developed by
NIDMAR, highlight the components of the audit, outline the benefits of using an audit. A representative from
Georgian college, an organization where the audit was piloted, will share their experience implementing this
program. Key recommendations for improving Disability Management programs and Return to Work practices
will be presented. This session will conclude with an overview of the results of these audits in Ontario and

collides with the privacy interests of the employee to whom that information pertains, employers may find

legal landscape surrounding employee privacy as it pertains to the management and adjudication of workers'
compensation claims in Ontario, and to provide helpful strategies to obtain and share relevant information in a

The average worker is now approximately 45 years old and may not retire until well into his/her 60's. The drastic change in working demographics does not change the biological fact that as we age our physical wellbeing starts to become compromised. This session will look at research- based, practical solutions to improve work conditions and management systems to assist in ensuring that the aging workforce in your facility is working healthy and without injury for years to come. By employing various management strategies and ergonomic design principles this session will provide a detailed outline of working processes that will aid in lowering the likelihood of injuries by ensuring corporations are ready and adaptable to combat our aging workforce efficiently and cost effectively. What are the common types of injuries and conditions associated with poor workstation designs and repetitive office tasks? How can an employer/employee be proactive in identifying possible yellow and red flags before injury and absenteeism begin? This discussion will offer a comprehensive look at how ergonomics and proper workstation set up can benefit your company. The discussion will specifically look at the types of common office related musculoskeletal injuries, the natural history of said injuries and the standard conservative measures of management for those injuries. What Fitness Should REALLY Look Like in Your Workplace -- Take a look around the walking paths near your workplace and you will start to notice some people using walking as their means of exercise, some even using Walking Poles; check out your local park and you will see employees participating on Tag Frisbee Team; head past the new house being built and you might see a team of employees building a house for Habitat for Humanity. The term fitness often conjures up the idea of putting on one's Lu Lu Lemons and heading to the gym for Step Class or to ""pump iron"". It turns out based on research emerging from Exercise Physiology and Kinesiology researchers that this is an unrealistic notion of fitness and one that needs to be thought about on the part of Wellness teams in the workplace. As well, employees who are receiving LTD and/or WSIB benefits generally have their entitlements end at age 65. However, the employment obligations continue after benefits end. This presentation will discuss the legal implications of both of these issues and will also review proactive strategies that organizations can adopt to reduce or eliminate the risk associated with these issues in both unionized and non-union workforces. All world class safety management systems include these elements. For the last decade the focus has been on occupational health and safety management system development which has resulted in improved workplace communication and better work planning. What remains is the need for the development and assurance of employee competency. Competency requires formal integration of education and training. The word 'competent' and term 'competency assessment' are being used more frequently, and sometimes loosely, within the context of Occupational Health and Safety Management Systems (OHSMS). Little is being done to formally develop competency profiles, implement competency develop processes or assess worker competency. Why not? Is it fear, complacency or ignorance? Or some combination thereof? In this session a framework for developing a competency assessment profile will be outlined. Further an outline of a competency development plan will be provided and tools (online and others) for assessing worker competency will be demonstrated. The Corporate and psychological resistance to putting energy into developing competency will be discussed. Participants will gain an understanding of what competency means and how to set up a program for competency assessment and competency development in your workplace. We will review case law developments concerning the accommodation of disabilities throughout the employment relationship, from hiring to firing, with specific consideration to issues raised by some of the most common and challenging disabilities facing employers today including scent allergies, chronic pain, depression, anxiety, stress, Bi-Polar Disorder, obesity, addictions (alcohol, drugs and gambling), Post Traumatic Stress Disorder, multiple disabilities. This interactive seminar assumes that participants have a solid grounding in the disability insurance, human rights, WSIB and OHS laws, although a refresher of the basic principles will be provided.
