It has been said that all that is needed for "safe work" is good workplace "communication", good work
"planning" and a "competent" workforce. All world class safety management systems include these elements.
For the last decade the focus has been on occupational health and safety management system development
which has resulted in improved workplace communication and better work planning. What remains is the need
for the development and assurance of employee competency. Competency requires formal integration of
education and training. The word 'competent' and term 'competency assessment' are being used more
frequently, and sometimes loosely, within the context of Occupational Health and Safety Management Systems
(OHSMS). Little is being done to formally develop competency profiles, implement competency develop
processes or assess worker competency. Why not? Is it fear, complacency or ignorance? Or some combination
thereof? In this session a framework for developing a competency assessment profile will be outlined. Further
an outline of a competency development plan will be provided and tools (online and others) for assessing
worker competency will be demonstrated. The Corporate and psychological resistance to putting energy into
developing competency will be discussed. Participants will gain an understanding of what competency means

Although disability management and the duty to accommodate disabilities have been with us for decades they
still present some of the most challenging issues facing employers today. The complexity of the subject is
impacted by developments in the law. Further complicating variables include the characteristics of different
disabilities, the impact of multiple disabilities and the unique nature of the workplaces that are impacted by
them. We will review case law developments concerning the accommodation of disabilities throughout the

Mental health is the number one cause of disability in Canada, accounting for nearly 30% of disability claims. It
is believed that 10-25% of mental health claims are preventable. In January 2013 the CSA released the new
Psychological Health & Safety Standard. The Standard--the first of its kind worldwide--was developed to
prevent psychological harm from conditions in the workplace and to promote psychological health in the
workplace. At present adherence is voluntary, but nobody wants to be caught off guard if the voluntary
Standard becomes the Mandatory Standard. The Standard identifies thirteen workplace factors employers
should target and outlines a management practice framework for reducing psychological risk. Since the release
of the Standard, AGS Rehab has been collecting data from various Ontario employers and life insurance
companies to understand the impact of the Standard on employers and the implications for mental health
claims. For the first time, AGS will present the results of our research--information that will help you establish

claims is constantly evolving. Furthermore, the always challenging process of accommodating a disabled worker
becomes even more challenging when the disability has a psychological component. This session will be
presented by an experienced lawyer who is a Certified Specialist in Workplace Safety and Insurance Law. You
will be brought up to date on the current law regarding entitlement for traumatic mental stress,

the audit process from the Consensus Based Disability Management Audit™ (CBDMA™) that was developed by
NIDMAR, highlight the components of the audit, outline the benefits of using an audit. A representative from
