Assignment Title Understanding Law of Contract and Tort
Purpose of this assignment
The purpose of this assignment is to make students understand and apply elements of a contract and
principles of liability and negligence. Another important aim is to develop the common skills that
learners require in practical life, which will be observed closely during the report.
Introduction
Write an integrated report that completes all the task in the body, with one Executive Summary, one
Introduction, one Conclusion and one Reference List. Within each task, there are some sub-parts. You
should answer these sub-parts in an integrated way in paragraphs. Use business situations/
scenarios/examples as your context. Cite your academic sources including books, law journals, and
law bulletins. You can also cite online sources, which are credible. Use Harvard system of referencing.
Task 1 (LO 1 & 3: AC 1.1, 1.2, 1.3, 3.1, 3.2, 3.3)
Students are required to start their report by explaining the significance of the essential elements
required for the formation of a valid contract with examples. Cite academic sources as well. (1.1)
Next, discuss the impact of different types of contract. Use academic sources and real business world
examples for supporting your discussion. (1.2)
For the next section of the report, students are required to analyze terms in different kinds of contracts
(Content of the agreement, Express term, implied term and relative importance of contractual terms
such as Condition, Warranty, Innominate Terms) with reference to their meaning and effect. Use
examples to support your analysis. (1.3)
In this section of your report, students are required to contrast liability in tort with contractual liability.
For this you need to differentiate the liability in torts and contract. Use academic sources for
supporting your points. (3.1)
Next, explain the nature of liability in negligence. Cite your academic sources. You are also encouraged
to report examples for amplifying your explanation. (3.2)
Now, using examples and supporting text from your academic sources, you are required to explain
how a business can be vicariously liable (3.3)
