2. Art. 69 Under The Constitution of Ukraine there are
two forms of a direct democracy:
• Elections;
• Referendum.
3. Election is a formal decision-making
process by which a population chooses an
individual or a political force to hold public
office.
4. Classification of the elections:
• Depending on the public agency:
- parliamentary;
- presidential;
- Parliament of the ARC;
- elections of the local MPs of the different level.
• According to the reason of an election:
- regular;
- special;
- off-year;
- re-run.
• Depending on the area:
- national;
- local.
5. Elective franchise in objective and subjective
aspects.
Objective elective franchise – a set of rules of law
governing the procedure for the formation of representative
bodies of state and local governments.
Subjective elective franchise – enshrined in the Article 38
of the Constitution and the rights guaranteed by the state
that citizens of Ukraine to elect and be elected to state and
local governments.
6. Principles of the subjective elective
franchise:
• Free elections;
• Majority principle;
• Equal right to vote;
• Freedom of vote;
• Corporal elective right;
• Secrecy of vote.
7. Electoral system – enforces rules to ensure valid
voting, and how votes are counted and aggregated
to yield a final result.
Types of electoral systems:
• Majority rule;
• Proportional representation;
• Mixed.
8. • A Referendum is a direct vote in which an
entire electorate is asked to vote on a particular
proposal. This may result in the adoption of a
new constitution, a constitutional amendment, or
a law.
• The issue of referendums in Ukraine is regulated
by the Constitution and the Law of Ukraine "On
national and local referendums" on July 3, 1991.
9. Classification of referendums

• Consultative
• Imperative
• According t the area:
• Nation-wide
• ARC
• Local
• Methods of realizations:
• Obligatory
• Permissive
10. According to the Art. 74 of the Constitution of Ukraine
the referendum is not allowed on the following topics :
• Taxes
• Budjet
• Amnesty;
11. • In the Ukrainian history only 2 referendums were
officially recognized:
• 1.12.1991 – support for the Independence of Ukraine.
• 16.04.2000 – support for the change in the structure of
the parliament and authorities of the Head of the State.
