Perth man Layne Armstrong faces 10 years imprisonment for manslaughter, after his appeal was
swiftly rejected at the Supreme Court of Western Australia today.
Armstrong had pleaded guilty to stabbing his neighbour Adam Summersby four times in the chest at
Australia Day celebrations in his home in Maddington last year.
Both men were intoxicated and under the influence of cannabis.
It is believed that Armstrong acted in self-defence after Mr Summersby brandished a knife during a
kitchen punch-up.
The offender called the police and the ambulance as soon as the incident had occured, and did not
throw away the blood-stained weapon.
Justice David Wallace Newnes described the events as severe criminal conduct that fitted the ball-
park of a 10 year sentence under the circumstances, but added there was little chance of Armstrong
reoffending.
Defence Lawyer Mark Andrews said the attack was carried out in a frenzy of anger with a lack of
control or coherence by Armstrong in the “heat of the moment.”
Mr Andrews added that the case was on the lower end of the scale because the appellant had pleaded
guilty to the charges made against him, and had indicated signs of remorse.
The State of Western Australia’s representative Jeffrey Scholz argued that the nature of the
circumstances put the case on “the higher end of the spectrum.”
Mr Scholz said the four blows severely penetrated the deceased and were inherently dangerous.
He added that the repetition to a vulnerable body would have caused Mr Summersby’s death within a
matter of seconds.
The offender looked gaunt and slumped silently in his chair throughout the case.
Armstrong will be eligible for parole.

(Sent to Parents in School Newsletter)
Members of Headspace Kimberley will be conducting a special assembly with students
between the ages of 14 and 17 at Broome SHS later this month. Headspace is a national youth
mental health foundation funded by the Australian Government. It is compulsory for all
students in Years 9-12 to attend, as the assembly will contain vital information regarding
support available for issues that young adolescents may face during high school years. The
members are highly trained and dedicated professionals with their own unique skills and
experiences. Further details will be provided to students in class later this week.
Speech (Excerpt)
(Introductory speech about depression)
Headspace is a national youth mental health foundation, and since we were set up by the
Australian Government in 2006 we have come a long way. I am here today to talk to you
about depression and other related mental health issues. I feel that it is essential for us to
explain to you about what we do and why we do it. It is important for our organisation that all
of you take something away from this presentation, even if it’s just a statistic or a phone
number. Please do not be alarmed if this speech is at all confronting. We want you, as high
school students to open up your minds and be aware, be mature and be kind to yourselves and
to others.
