In my report, I am going to be examining the role that violence plays in New Zealand sport and its impact on the New Zealand society. I will be

question why we ultimately allow for this to occur. During the 2003– 2004 National Hockey League season Todd Bertuzzi of the Vancouver Canucks

v. McSorley case, McSorley was charged with assault with a deadly weapon, his hockey stick. McSorley struck Donald Brashear in the back of the
head with his stick in the last seconds of the game (Lawless, 2016). McSorley claimed not to have intended to hit Brashear in the head, but simply
the shoulder (R. v. McSorley, 2000). This makes the intention in this case a real issue. McSorley used the defence of recklessness (R. v.
McSorley, 2000). Recklessness is "where a person knew, or ought to have known, that the conduct would likely cause serious injury to another"
(Corbett et al., 2008, Pg.45). McSorley claimed to not have intended the outcome or striking the head, but he did the action knowing the outcome
could be an injury (R. v. McSorley, 2000). Marc Crawford the head coach of the Vancouver Canucks stated "there was no chance for Donald to
expect that it was coming...it was significant force." (R.v. McSorley, 2000, Pg.8). It is very clear that Donald did not consent to the force of the
overtly violent act. There are defences that can be used when charged with criminal assault and they are: lack of intent to inflict harm, defence from
an attack, and an instinctive reaction (Corbett et al., 2008, 41). Not included in the list of defences is provocation because it cannot be used as a
credible defence to assault (Corbett et al., 2008). McSorley and his defence of recklessness were stricken down based on the fact that even a small
child would not have missed hitting another person in the shoulder instead of the head if that was their true intention (Lawless, 2016). Eventually
McSorley was found guilty of assault with a weapon and was given probation, a suspension from the NHL and never played again (Lawless,
