1. Hello there! Here I go with a drafting exercise. Facts have been partially distorted, based
on a true episode recently reported by the press. Please follow instructions. Then, how
much do you know about contract law theory? If possible, answer the following question:
WHAT SPECIFIC KIND OF CONTRACT BREACH has the chef incurred in??? Feel free
to post your answers.
Your law firm has been hired by DONALD TRUMP in his private capacity. Your client has
contracted a celebrity chef for the opening of restaurant in a massive building that the
Trump Group is renovating in Washington. This renovation coincides with your client's
immigration comments, which he made in public. After hearing those comments, the
celebrity communicated his intention to cancel the provision of his services, by alleging
that such derogatory comments were insulting and morally aggressive.
Both the TRUMP group and your law firm claim that the celebrity shouldn't be surprised
as your client publicly shared views on immigration have remained consistent for many
years, and Mr. Trump’s willingness to frankly share his opinions is widely known. More
specifically, the Chef, who was born and raised in Mexico, expressed his unwillingness to
perform his part of the contract as Mr Trump said that "Mexican society sends some of its
worst elements to the U.S. in the form of criminal immigrants". Mr. Andres, who had also
been pressed by hispanic groups, even told the The Washington Post it was “impossible”
now to work with the businessman-candidate. The opening is in two weeks' time.
The senior partner of the firm has entrusted you with the drafting of the DEMAND
LETTER to Mr Andres, so that he is compelled to perform his part of the contract. Your
letter should be as effective as possible, so your drafting skills are really important for this
