Here’s a quick overview of the topics I’ll cover
Before I go into the details, I’ll give you a quick overview of what ALPE is and it’s components.
ALPE stands for “Archivio Licenze dei Periodici Elettronici” (Archive of Electronic Serial Licenses).
Its goal is for supporting librarians to collectevely manage and share the information regarding the use of E-Resources for Interlibrary Loan and Document Delivery
Its components are:
Public archive of DD-ILL clauses in e-licenses
Management software to insert, display, associate e-licenses
Search engine to find the effective license for each item
New NILDE software module integrated into the lending process
Who is working in ALPE?
The ALPE project stands on the experience and it is the evolution of a former database, called “Help-Licenses”, which has been available since 2005 for NILDE librarians. It contained information only from the “big” publishers e-licenses negotiated by consortia.
The ALPE project started with the release of a “Request for comments” document and after that, a first project meeting was organised in June 2012. Then, the ALPE Working group was formed; presently it is composed by 33 colleagues belonging to several academic and research institutions and to three national consortia. Their role are various and their expertises cover all the areas needed for this project: there are negotiators, e-resource librarians, ILL librarians and software developers .
NILDE is the ILL management software used in academic and research libraries in Italy, and now in Spain and Greece too. NILDE supports transmission of files and digital hard-copy. The effect of such a procedure is to transform publisher’s original pdf-text files into pdf-images, which will be made available to the borrowing library.
Thanks to the negotiation carried out by the Italian national consortia, several publishers have agreed so far to include the NILDE system in their license as as a “secure electronic delivery” system.
Now I will like to share with you in a few slides the problem that the ALPE project will address.
The shift from paper to e-subscriptions has brought about a change in the legal framework libraries provide services to accomplish their mission. Exceptions and limitations for libraries provided by copyright law have become “license to use” under contract law. ILL, especially in the digital landscape, has always been considered by publishers as a “concurrent” activity to their incomes. So, the ILL of e-resources has to be negotiated in contracts, and libraries should not give away rights (for their users) which are guaranteed by law.
How this impacted on the borrowing and lending activity? With the general uncertainty related to e-licenses, the activity of checking the permitted use within the lending work-flow is more inhibiting than the license content itself.
To check if the library has the “license to share”, that is, if lending is permitted, ILL librarians have to know which is the “proper” license for that item.
Sometimes they will have lists of titles provided by the institution, or managed by an ERM systems.
However, to maintain and keep updated such information requires a bigg effort.
How could ILL management software automate the license checking?
Unfortunately, ILL sw usually know about bibliographic information (such as title, ISSN, publication year) associated to the item to lend, while they lack of many information which usually it would require to access to a knowledge base. Licenses are identified by different information: the publisher/content provider, the platform (that is, the web portal where content is accessed), the contract duration , the licensee (the subscribers)
This slides shows a practical example:
For a given title it may exist several licenses which define the permitted use, depending on “from where” the contents are accessed.
A library may subscribe to access the title contents to a certain web site (the e-content platform).
There may be several platforms: the publisher’s one, the content providers (one or many), the archive’s platform.
A library may subscribe to current contents or to the archives (in this case it can be a yearly-subscription or a one-time acquisition of the back-files)
Besides, license may be negotiated one or, on the opposite side, standard license.
Standard licenses automatically enter into force at the time of subscription. Usually, they are made public on the publisher’s or content distributor or aggregator web site.
The Interlibrary Loan activity must be explicitly permitted by the license agreement and is usually specified in a specific clause.
It is necessary to determine whether the publisher or the content aggregator with which the library has subscribed to the content owns the rights on the digital resources distributed or otherwise and, therefore, is able to grant to the library this right of use.
Indeed, the international marketing and distribution panorama of the electronic resources on the part of multiple stakeholders (university publishers, commercial publishers, aggregators, agents) on the one hand makes it easy for libraries to acquire digital content from multiple distribution channels, on the other hand it further complicates the task of acknowledging who owns the rights relating to the ILL.

ALPE has developed a schema to describe ILL clause. It has several purposes:
To standardize description of the clause;
To be easily exchanged across systems (such as ILL systems, ERMS, …);
To minimize the risk of subjective interpretation on the part of the librarians.
