2. Andy Der was recently heard around the United
States on National Public Radio, talking to a
reporter about the controversial U.S. Supreme
Court case that looks at whether a ditch or storm
sewer system is a "navigable water" under the
Clean Water Act and thus subject to federal
permitting requirements. Der, director of
environmental sciences at Loiederman Soltesz
Associates, a Rockville, Maryland-based
engineering firm, explained why a man-made ditch
dug alongside a state road should not be regulated
by the federal government. The ditch he describes
on the radio interview drains into a former farm
field now dotted with trees and brush. While it
might resemble a stream after a rain storm, and
even reveal a fork where it has been intersected by
a deep tire track, it is not a stream, said Der, who
explains that a ditch is not navigable water. When
it created the Clean Water Act in 1987, the U.S.
Congress defined ditches as point sources. Under
the law, a permit is required to control sediments
and other pollutants that leave a ditch and flow into
navigable water. Der argues that a ditch should not
be regulated unless—and until—the contents reach
a tributary to a navigable water. The ditches at
issue in the court case, for instance, drain into a
municipal storm sewer system already permitted
under the Clean Water Act to control pollutant

culture and environment. As the world’s population
grows, land gets more scarce. The threat of
encroachment for farming or other purposes is
ever-present in many countries, indigenous people
live on the margins of society with little or no
representation in government. Climate change is
also beginning to impact indigenous habitats.

Montana's Governor's Restoration
Forum held last month. In an article
by Headwaters News entitled
Restoration is a New Economic
Narrative for the West's Wild and
Urban Landsapes discussing the
highlights of the conference, SER is
cited: " In the West, the restoration
narrative primarily concerns ecological
restoration. The Society for Ecological
Restoration defines it as “the process of
assisting the recovery of an ecosystem
that has been degraded, damaged, or
