Invariati i permessi ex L.104/92 in caso di trasformazione a part-
time del rapporto di lavoro
In caso di trasformazione del rapporto di lavoro da full-time a part-time verticale
il dipendente ha il diritto di conservare tutti i permessi ex Legge 104/92 (senza
riparametrazione) quando il nuovo orario di lavoro prevede una prestazione per
un numero di giornate superiore al 50% di quello ordinario (Corte di
Cassazione, sentenza n. 22925 del 29 settembre 2017).
CCNL Metalmeccanici e termini per irrogare la sanzione
disciplinare
L’art. 23 del CCNL Industria Metalmeccanica prevede un termine massimo di 6
giorni per irrogare la sanzione disciplinare al dipendente a decorrere dalla
ricezione delle sue giustificazioni. Tale termine deve essere fatto coincidere con
la spedizione della lettera contenente l’irrogazione della sanzione (Corte di
Cassazione, sentenza n. 22295 del 25 settembre 2017).
Il giudice non è vincolato dalle previsione del CCNL
Il giudice non è vincolato dalle previsioni del CCNL. Lo ha stabilito la Corte di
Cassazione con la sentenza n. 18282 del 25 luglio 2017, nella quale si afferma
che il giudice può escludere che il comportamento del lavoratore integri una
giusta causa di recesso, in considerazione delle circostanze concrete che lo
hanno determinato, anche quando questo sia stato qualificato come tale dal
CCNL.
No all’acquisizione di informazioni dall’HD del pc aziendale senza il
consenso del lavoratore
La Corte di appello di Torino, con la sentenza n. 1387 del 27 marzo 2017, ha
stabilito che è illecita l’acquisizione di informazioni personali contenute sull’hard-
disk del computer aziendale riconsegnato al datore di lavoro senza che vi sia il
consenso del lavoratore e a sua insaputa.

2. Il giudice non è vincolato alla valutazione complessiva dei fatti
ascritti al dipendente
In caso di contestazione al dipendente di diversi episodi rilevanti sul piano
disciplinare e tra loro concatenati, non occorre che il giudice valuti i fatti ascritti
nel loro complesso, ben potendo anche individuare solo in alcuni di essi il
carattere di gravità previsto dall’art. 2119 c.c. (Corte di Cassazione, sentenza n.
14564 del 12 giugno 2017).

The leaves pursuant to Law no. 104/92 are preserved in case of
vertical part-time
If the employment relationship is converted from full-time to vertical part-time the
employee has the right to preserve the possibility to use the leaves pursuant to
Law no. 104/1992 (without any duty to reduce such leaves as a consequence of
the conversion to part-time). The mentioned right is subject to the condition that
the employee works more than 50% of the days he used to work as a full-time
employee (Italian Supreme Court, judgement no. 22925 of September 29,
2017).
NCBA for the industrial sector and terms to issue the disciplinary
sanction
Pursuant to Article 23 of the National Collective Bargaining Agreement of the
employees of the industrial sector (“CCNL Industria Metalmeccanica”) the
employer has a 6-day term in order to issue the disciplinary sanction to the
employee. The mentioned term starts from the receipt by the employer of the
letter containing the justifications of the relevant employee. The disciplinary
sanction will be lawfully issued to the employee if the employer posts the letter
containing the disciplinary sanction within the 6th day from the receipt of the
employee’s justifications (Italian Supreme Court, judgement no. 22295 of
September 25, 2017).
The Judge is not bound to the provisions set forth under the NCBA
The Judge is not bound to the provisions set forth under the National Collective
Bargaining Agreement applied by the employer. This statement was upheld by
the Italian Supreme Court in its judgement no. 18282 of July 25, 2017,
according to which the Italian Supreme Court also specified that the Judge may
consider the misbehaviour of the employee as not amounting to a just cause of
termination, even if the NCBA applied by the employer provides for the contrary.
In this regard, in evaluating lawfulness of the dismissal the Judge must take into
account all the factual circumstances that led to the employee’s misbehavior.
Control on the employee’s HD without his consent
With judgement no. 1387 of March 27, 2017, the Court of Appeal of Turin held
that the employer cannot lawfully retrieve, without the employee’s consent, the
employee’s personal information stored inside the hard-disk of the company’s
laptop which has been returned by the employee to the employer.
The Judge is not bound to evaluate all the employee’s
misbehaviours
If the employer challenges to the employee several misbehaviours, one
connected to each other and which may entail a disciplinary sanction for the
employee, the Judge is not under the duty to evaluate all the employee’s
misbehaviours as a whole, since he/she may only assess that one or more of
the employee’s misconducts will amount to a just cause of termination of the
