• Copy means:
A single sample of a particular book, record, or other publication or issue.
• Right means:
A moral or legal right to have or do something.
4. Definition of Copyright Act
Eric Miller:
“Copyright refers to the laws that regulate the use of the work of creator, such as an
artist or author. This includes copying, distributing, altering and displaying creative,
literary and other types of work. Unless otherwise stated in a contract, the author or
creator of a work retrains the copyright.”

9. Background of Copyright Act in Pakistan
• In Pakistan the first law on copyright was the Copyright Act, 1914.
• Modeled after the U.K. Copyright Act, 1911
• The Copyright Ordinance, 1962 replaced the earlier Copyright Act of 1914
10. Copyright Ordinance 1962
• According to the Copyright Ordinance 1962, copyright is a set of exclusive rights
granted to the owner for a limited time to protect the particular form, way or
manner in which an idea or information is expressed.
• Copyright is the moral and economic right of authors/writers, publishers,
performers and producers. The Copyright Rules 1962 was framed for the proper
working of the ordinance
11. Objects of Copyright Ordinance 1962
According to Copyright Ordinance 1962 subsists in
• literary works (including computer programmed and excluding speeches)
• dramatic works
• musical works (any combination of melody and harmony or either of them,
produced or reproduced graphically)
• records (any disc, tape, wire, perforated roll or other device in which sounds are
embodied)
• artistic works (painting, sculpture, drawing, engraving or a photograph, an
architectural work of art and any other work of artistic craftsmanship)
• cinematographic works etc.
12. Owner of Copyright Ordinance 1962
• The first owner of copyright in general is the author (exceptions: works for hire,
Government works).
• The owner of copyright may assign the copyright or grant any interest in the
copyright by license. Licenses may also be granted by the Copyright Board to
republish a work withheld from the public.
• Registration of copyright with the Copyright Office is not obligatory, but if
registration has taken place the Register of Copyrights gives prima facie evidence
of the particulars entered therein.
13. Term of Copyright Ordinance 1962
• Copyright in a literary, dramatic, musical or artistic work published within the
lifetime of the author subsists until 50 years from the beginning of the calendar
year next following the year in which the author dies.
• Copyright in a cinematographic work, a record or a photograph subsists until 50
years from the beginning of the calendar year next following the publication of the
work.
• If a work is not published within 50 years after the death of the author or, the
author being unknown, within 50 years after its creation, it falls into the public
domain.

Copyright means the exclusive right to copy
• to reproduce the work
• to publish the work
• to perform or broadcast the work
• to make any translation or adaption of the work
When an author assigns the rights in the intellectual property, he does not assign his
moral rights

• After independence in 1947, Pakistan adopted the British Copyright Act, 1911
• The British Copyright Act, 1911 was replaced by the Copyright Ordinance, 1962

17. Conclusion
There are several requirements for a work to obtain copyright, such as recorded in a
material form; however the one relevant to this paper is the requirement that the work
must be original. It should be noted that this only applies to literary, dramatic, musical
and artistic works.
