Violent intentions: Distribution of Property in the Family HomeKate Galloway
In claims by intimate partners for a beneficial interest in the family home, the common law is clear that the courts’ role is to ascertain intimate partners’ own distribution of property according to the general law. It is a distribution declared, and not a redistribution of property that is at stake. Therefore in ascertaining the distribution of beneficial interests in intimate partner trust cases, central to courts’ inquiry is the parties’ intention as to beneficial ownership. Distribution is thus ascertained as an expression of the parties’ will in the guise of intention. These pillars of intimate partner trusts reflect the liberal underpinnings of property law. What goes unremarked in the case law however, is the power dynamic within intimate relations that informs the way in which the parties hold property at law, and the way in which their intentions are expressed. Courts are particularly deft at avoiding considering the role intimate partner violence might play in an ostensible distribution property. This paper presents an aspect of my PhD research, drawing on case law to identify the high incidence of violence and coercion that is nonetheless largely ignored in the intimate partner trust cases across four common law jurisdictions. It goes on to suggest that if intention is truly at the heart of ascertaining the distribution of the parties’ beneficial interests, the courts must move beyond the assumptions of the general law to accommodate the intimate context and with it, the likelihood of violence. In turn, the means of ascribing intention as to property distribution must account for the effect of violence and coercion upon an act of will.
The paper was presented at Victoria University, Wellington in May 2017.

200 ml Gutes Land Frischmilch
1/2 Würfel Hefe
150 g Zucker
350 g Korn Mühle Mehl
4 Vom Land Eier
40 g Gutes Land Butter
1 TL Carat gemahlener Zimt
300 g Gutes Land Schmand
1 TL gemahlener Sternanis
500 g Zwetschgen
So geht’s:
1. Milch in einem Topf erwärmen. Hefe hineinbröckeln und mit 20 g Zucker verrühren.
2. Mehl und 40 g Zucker in einer Rührschüssel mit der Hefemilch, einem Ei, der Butter und dem Zimt mit einem Handrührgerät verrühren. Zugedeckt ca. 40 Min. gehen lassen.
3. Drei Eier mit 40 g Zucker, Schmand und Sternanis verrühren.
4. Zwetschgen waschen, halbieren und entsteinen.
5. Hefeteig nochmals gründlich kneten. Teig auf einem gefetteten, tiefen Backblech ausrollen. Saure-Sahne-Guss daraufgeben. Zwetschgen darauf verteilen und mit 40 g Zucker bestreuen. Im vorgeheizten Backofen bei 200 Grad (Gasstufe 3, Umluft 180 Grad) auf der mittleren Schiene 25–30 Min. backen. Aus dem Ofen nehmen, auf ein Kuchengitter setzen und abkühlen lassen.

A Strategic Approach: GenAI in EducationPeter Windle

The four art disciplines for Visual and Performing Arts in California are Dance, Music, Theatre, and Visual Arts. Media arts should be added as a fifth discipline soon.
According to state standards, the arts should be instructed by highly qualified teachers in a comprehensive and sequential manner during the regular school day. It is stated in the standards, so let's make it a reality!
Many schools do have music programs taught by music teachers starting in fourth grade, but most districts cannot afford art specialists or guest teaching artists for other grades or art forms. That is why instruction in the arts is typically the responsibility of the GENERAL CLASSROOM TEACHER.
The California Alliance for the Arts has come out with “10 Important Things to Know about Arts Education in California.” One of those important things is that extensive research has demonstrated that arts education engages students in learning, contributes to higher test scores and reduces truancy and dropout rates.

Arts education is highly valued by most Americans
A 2005 Harris Poll revealed that 93 Percent of Americans believe that the arts are vital to providing a well-rounded education. Additionally, 54 percent rated the importance of arts education a “ten” on a scale of one to ten.
So maybe the question should be why NOT study the arts? Gives you something to think about…
