Violations of Securities Laws Karel Svoboda, a credit officer for Rogue Bank, evaluated and approved his employer’s extensions of credit to clients. The case was then sent back to the trial court judge to determine whether the inaccurate instructions regarding the one charge tainted the convictions on the other charges. In 2013, the case was finally resolved as he was resentenced to 14 years in a federal prison as part of a court ordered reduction and a separate plea agreement with the prosecution. Unfortunately, this story is just one of many recent large and complex white-collar crime scandals. Allen Stanford. Sentence: 110 years
Allen Stanford, 63, was a Texan financier accused of running a $7 billion Ponzi scheme. In December 2008 Stanford International Bank had $88 million in cash, but it fudged its numbers to say it had $1 billion in assets. In the same month it finally owed investors $7 billion when they tried to pull out their money, and the bank had no money to cover the costs.
In 2012, a jury found Stanford guilty of conspiracy, along with 12 other criminal charges including obstruction. He was found innocent of one wire fraud charge. Stanford was sentenced to 110 years in federal prison.
Bernard Madoff, Businessman. Sentence: 150 years
Madoff, 72, directed one of the largest Ponzi schemes in U.S. history. Madoff, in his role as CEO of Bernard L. Madoff Investment Securities LLC, stole from his clients in a $65 billion Ponzi scheme. Despite a continuing decline in the economy, Madoff continued to assure his clients that his numbers (investment returns) would continue rising. As the economy continued to decline, Madoff’s increases became suspicious and clients began to contact him to get their money back. When the requests for returned funds reached $7 billion, Madoff met with his sons and told them that his business was fraudulent. The sons turned Madoff in to the authorities.
In 2009, Madoff pleaded guilty to, among other things, securities fraud, wire fraud, money laundering, making false filings with the SEC, and making false statements. He was sentenced to the maximum 150 years in prison for his offenses. His projected release date is November 14, 2159. Since Madoff’s plea, David Friehling from his accounting department has pled guilty to securities fraud, investment advisor fraud, and making false filings with the SEC. Additionally, Frank DiPascali has pled guilty to securities fraud, investment advisor fraud, mail fraud, wire fraud, income tax evasion, international money laundering, falsifying books and records, and more.
Joseph Naccio. Sentence: 6 years
Joseph Naccio, 60, was the chief financial officer and chairman of the board for Qwest Communications International. Qwest is a telecommunications provider in the western United States. When the economy began to decline, Naccio continued to assure Wall Street that the company would continue making large returns even though he knew that such returns would not occur. Based on inside information, Nacchio sold $52 million of Qwest stock just before the prices fell.
In 2007, Naccio was convicted on 19 counts of insider trading and sentenced to 6 years in federal prison. Ponzi schemes are based on two fundamentals: trust and greed. The trust comes from building a relationship with the potential victims. Usually, in Ponzi schemes, the person perpetrating the fraud has gained trust through (a) direct, observable actions by others, (b) professional or other affiliations, or (c) through references by others. The greed comes from the investors who see an opportunity to obtain higher than usual gains, and because the trust is there, they do not perform their normal due diligence. Both trust and greed were prevalent in the Madoff scheme as described below.

One example is the “flash mob”—defined most generally as a group of people voluntarily assembled at a particular place and time for a particular purpose, coordinated through shared access to social media. This is not altogether a new invention—the telephone and, before that, the telegraph or even a good strong voice have been tools for assembling flash mobs in the past. But what has been recently discovered is how easy it is using modern social media, and how effective such mobs can be.
As we said, whether or not you consider this to be a good development or a bad development depends a lot on how you evaluate the purpose of the mob. Public assemblies to install democracy in an authoritarian state sound pretty good; assembling gang members to break windows and burn cars would not strike most of us as all that great. Inpatient suicides in health care organizations although rare are a traumatic sentinel events. Health care facilities are required to operate under transparently disclosing all events to the public. Hospitals in the United States report sentinel events to
The Joint Commission on the Accreditation of Healthcare Organizations
(JCAHO). JCAHO complied this information and prepared a root cause analysis to determine if the current procedure that the organization has in place could have prevented the incident. A 1998 JCAHO sentinel event alert report stated that inpatient suicide most frequently occurred in psychiatric hospitals followed by general hospitals and residential care facilities (
Tishler & Staatas, 2008).
Health care organizations are responsible for decreasing the likelihood of sentinel events, which includes a suicide crisis. Factors such as patient care, staff training, organizational policies, and the hospital environment all relate to the suicide rule-making process. Suicides are difficult to predict and prevent therefore organizations must create rules and form policies to prevent the risk of suicide.
The impetus for this transparent movement was sparked largely in the 1990s when two prominent reports summarizing the number and type of errors committed by hospitals were published (
Tishler & Staatas, 2008). The reports summarized suicide events that required immediate investigation. A rulemaking process and protocol was established to assess for risk and safety of patients. The protocol for suicide risk assessment relates to health care organizations as a safety precaution to decrease the number of inpatient suicides. Madoff Securities Case
Ponzi schemes are based on two fundamentals: trust and greed. The trust comes from building a relationship with the potential victims. Usually, in Ponzi schemes, the person perpetrating the fraud has gained trust through (a) direct, observable actions by others, (b) professional or other affiliations, or (c) through references by others. The greed comes from the investors who see an opportunity to obtain higher than usual gains, and because the trust is there, they do not perform their normal due diligence. Both trust and greed were prevalent in the Madoff scheme as described below.
In March 2009, Madoff pleaded guilty to 11 federal crimes and admitted to turning his wealth management business into a massive Ponzi scheme that defrauded thousands of investors of billions of dollars. Madoff said he began the

One example is the “flash mob”—defined most generally as a group of people voluntarily assembled at a particular place and time for a particular purpose, coordinated through shared access to social media. This is not altogether a new invention—the telephone and, before that, the telegraph or even a good strong voice have been tools for assembling flash mobs in the past. But what has been recently discovered is how easy it is using modern social media, and how effective such mobs can be.
As we said, whether or not you consider this to be a good development or a bad development depends a lot on how you evaluate the purpose of the mob. Public assemblies to install democracy in an authoritarian state sound pretty good; assembling gang members to break windows and burn cars would not strike most of us as all that great. Inpatient suicides in health care organizations although rare are a traumatic sentinel events. Health care facilities are required to operate under transparently disclosing all events to the public. Hospitals in the United States report sentinel events to
The Joint Commission on the Accreditation of Healthcare Organizations
(JCAHO). JCAHO complied this information and prepared a root cause analysis to determine if the current procedure that the organization has in place could have prevented the incident. A 1998 JCAHO sentinel event alert report stated that inpatient suicide most frequently occurred in psychiatric hospitals followed by general hospitals and residential care facilities (
Tishler & Staatas, 2008).
Health care organizations are responsible for decreasing the likelihood of sentinel events, which includes a suicide crisis. Factors such as patient care, staff training, organizational policies, and the hospital environment all relate to the suicide rule-making process. Suicides are difficult to predict and prevent therefore organizations must create rules and form policies to prevent the risk of suicide.
The impetus for this transparent movement was sparked largely in the 1990s when two prominent reports summarizing the number and type of errors committed by hospitals were published (
Tishler & Staatas, 2008). The reports summarized suicide events that required immediate investigation. A rulemaking process and protocol was established to assess for risk and safety of patients. The protocol for suicide risk assessment relates to health care organizations as a safety precaution to decrease the number of inpatient suicides. A wound is a break in the integrity of the skin or tissues, which may be associated with disruption of the structure and function.
Healing is the body’s response to injury in an attempt to restore normal structure and functions.
Healing can occur in two ways: Regeneration and Repair
There are 4 phases of wound healing: hemostasis, inflammation, proliferation, and remodeling. This document also describes the mechanism of wound healing. Factors that affect healing include infection, uncontrolled diabetes, poor nutrition, age, anemia, the presence of foreign bodies, etc.
Complications of wound healing like infection, hyperpigmentation of scar, contractures, and keloid formation.

- 1. Violations of Securities Laws Karel Svoboda, a credit officer for Rogue Bank, evaluated and approved his employer’s extensions of credit to clients. These responsibilities gave Svoboda access to nonpublic information about the clients’ earnings, performance, acquisitions, and business plans from confidential memos, email, and other sources. Svoboda devised a scheme with Alena Robles, an independent accountant, to use this information to trade securities. Pursuant to their scheme, Robles traded in the securities of more than twenty different companies and profited by more than $2 million. Svoboda also executed trades for his own profit of more than $800,000, despite their agreement that Robles would do all the trading. Aware that their scheme violated Rogue Bank’s policy, they attempted to conduct their trades to avoid suspicion. When the bank questioned Svoboda about his actions, he lied, refused to cooperate, and was fired. Using this information, address the following: Explain what crimes Svoboda and Robles each committed. Analyze the civil liability for Svoboda and Robles including who could file suit and on what grounds. Explain any defenses that Svoboda and Robles could raise and the likely success of the defense.
