 MEANING OF IP:
 Intellectual Property (IP) deals with any basic
construction of human intelligence such as
artistic, literary, technical or scientific
constructions
 MEANING IF IPR:
 Intellectual Property Rights (IPR) refers to the legal
rights granted to the inventor or manufacturer to
protect their invention or manufacture product.
These legal rights confer an exclusive right on the
inventor/manufacturer or its operator who makes
full use of it’s his invention/product for a limited
period of time. In other words, we can say that the
legal rights prohibit all others from using the
Intellectual Property for commercial purposes
without the prior consent of the IP rights holder.
 Encouraging innovation and research
 Protecting academic work
 Generating revenue
 Fostering collaboration
 Ganguli P.(1998) analyzed in their research about
innovations, appreciation of the emerging issues
related to IPR by our scientists and technocrats has
become relevant.
 Gadgil M and Utkarsh G.(1999)described the
importance of it mandatory that all IPR applicants
disclose genetic material accessed, its country of
origin and prior public knowledge, resultant
benefits including technology transfer with
providers of the genetic resources or relevant
knowledge, for promoting their conservation.
 Ghatak P.et al (2001)"It is found that as regards IPR of
R&D, India remains a non-starter in the 3G and 4G
technologies of broadband digital communications'. The
emerging trend of 4G Technology in near future is
reviewed with patent classification and patent sampler
to assist researchers update themselves and obtain
patents in this crucial area.“
 Rasiah R.(2002) showed that China among the second-
tier NIEs enjoys the best high tech and IPR infrastructure
to make the transition to NIE status. The remaining
second-tier NIEs lack the high-tech infrastructure to
sustain strony developed to enforce compliance. India,
Pakistan, Vietnam and Sri Lanka demonstrate selected
technological capabilities, but their overall infrastructure
is too weak to engender broad-based technology
development, and ensure compliance
 Ramanna A.(2003) found that farmers' rights (rights
of farmers to engage in and benefit from their
agricultural practices). India is one of the first
countries to have passed such a law, known as the
Protection of Plant Varieties and Farmers' Rights
Act, 2001.
 Singh H.(2004) "Till Medicinal Plants Board was
constituted in the year 2000, no nodal agency was
there to look into medicinal plants as an economic
"sector" and different organizations were dabbling
with different aspects of medicinal plants without
any focus and co-ordination leading to a paradox of
simultaneous existence of under-utilization and
over-exploitation.
 Murphy J.(2005) “India and Russia have moved to
resolve the long standing disagreement over intellectual
property rights (IPR), opening the door for large scale
cooperation between their respective armed forces and
defense industries. The agreement is expected to lead to
more widespread cooperation between the Indian and
Russian defense industries.”
 Gupta V.K.(2008)"The paper highlights intellectual
property rights (IPR) issues related to defence and
national security in the Indian context, for example,
management of IPR during defence R&D and
technology development, protection of IPR of strategic
nuclear and dual use technologies and applications,
negotiating patents and other IPR during acquisition of
military equipment and technologies, and counterfeiting
and piracy of legally owned intellectual property."
 Sharma A.K. et al(2010) As a result, international
legal frameworks for the management of
biological resource have had to increasingly take
into account not only the needs of biodiversity
conservation but also concerns about its potential
for economic use and its contribution to the
process of economic development. “

hurriedly implemented IPR law, as envisaged in
the 'Indian Bayh-Dole Bill 2008', can hardly be
expected to act as an instant magic formula to
energise Indian academic research for
commercial application."
 Lakshmana Prabu S.et al(2012) “In the present
article, development of Intellectual Property Law
in India, Evaluation of an International
Intellectual Property Regime, New Dimensions
and issues for resolution, Importance of IPR in
developing countries and its impact are
discussed in brief.”
 Gopakumar K.M.(2016)"By proposing a
maximalist approach towards intellectual
property rights, the new IPR policy announced
by the government is not tailored for India's
socio-economic requirements.”
 Madhavan P.K. and Sundar K.(2019) Publishers
invest in the content and intellectual property rights
assigned to them by authors. What provides value
to their investment is the protection provided by
copyright laws to the seamless acquisition and
transfer of the intellectual property asset.“
 Mitsumori Y.(2020) analyzed that foreign capital
companies started to submit patent applications to
the Indian Patent Office (IPO), which began in 2005
to examine product patent applications under the
new, revised patent law. However, both IPO and
IQVIA data show that the number of patent
applications in pharmaceuticals has been declining
in past years."

awareness among stakeholders of IP generation
and commercialization regarding the barriers
and needed changes to overcome them through
policy.”
 Fatima A. and Voutyrakos N.(2023) “this paper
focuses on how two large economies, India and
Russia, which have chosen to deal with domain
name-related concerns and disputes, in light of
the latest international developments in the field.
"
 Objective of this research is to ascertain the
knowledge among the academecians of North
India
 For the survey , we prepared a questionnaire
questions and filled them with the help of 50
students of different universities of North
India.
 The conclusion drawn from this research paper has
developed an universities based view of importance
of IPR in Academicians of North Indian
Universities by demonstrating the lack in IPR
awareness and the innovations required in teaching
techniques of universities. The response as per the
academicians depicts that out of 50 academicians 35
did not have minimal knowledge about IPR and the
universities should bring some subjects ( practical
as well as theoretical) for increasing awareness and
use of IPR and the government should support the
masses in launching their creations.

  • 2.  MEANING OF IP:  Intellectual Property (IP) deals with any basic construction of human intelligence such as artistic, literary, technical or scientific constructions
  • 3.  MEANING IF IPR:  Intellectual Property Rights (IPR) refers to the legal rights granted to the inventor or manufacturer to protect their invention or manufacture product. These legal rights confer an exclusive right on the inventor/manufacturer or its operator who makes full use of it’s his invention/product for a limited period of time. In other words, we can say that the legal rights prohibit all others from using the Intellectual Property for commercial purposes without the prior consent of the IP rights holder.

  • 5.  Ganguli P.(1998) analyzed in their research about innovations, appreciation of the emerging issues related to IPR by our scientists and technocrats has become relevant.  Gadgil M and Utkarsh G.(1999)described the importance of it mandatory that all IPR applicants disclose genetic material accessed, its country of origin and prior public knowledge, resultant benefits including technology transfer with providers of the genetic resources or relevant knowledge, for promoting their conservation.

  • 13.  Objective of this research is to ascertain the knowledge among the academecians of North India
  • 14.  For the survey , we prepared a questionnaire questions and filled them with the help of 50 students of different universities of North India.
  • 15.  The conclusion drawn from this research paper has developed an universities based view of importance of IPR in Academicians of North Indian Universities by demonstrating the lack in IPR awareness and the innovations required in teaching techniques of universities. The response as per the academicians depicts that out of 50 academicians 35 did not have minimal knowledge about IPR and the universities should bring some subjects ( practical as well as theoretical) for increasing awareness and use of IPR and the government should support the masses in launching their creations.
